REPORT TO LEGISLATIVE REVIEW COMMITTEE
OBJECTIVES OF BY-LAW
A by-law to limit the number of cats kept on premises and for the management and control of
cats in the Council area.
REASON FOR INTRODUCTION
This by-law has been prepared as part of the overall review of the Council's by-laws required
by section 251 of the Local Government Act 1999. The by-law has been redrawn to address
the Council's current needs and circumstances. The by-law is based on the Local
Government Association template Cats By-law.
CLAUSES
The effect of each clause of the by-law is as follows:
Clause 1
Title
Establishes the short title of the by-law.
Clause 2
Authorising law
States the primary legislation under which the by-law is made.
Clause 3
Purpose
Sets out the policy objectives of the by-law.
Clause 4
Commencement, revocation and expiry
Provides for the by-law to revoke previous by-laws (dealing with the same
subject matter). Also states the expiry date of the by-law.
Clause 5
Application
Specifies that the by-law is subject to the Council's Permits and Penalties
applies throughout the Council area subject to any resolution of Council
applying the by-law to certain areas or generally with exceptions.
Clause 6
Interpretation
Defines particular words and phrases used in the by-law.
Clause 7
Limits on cat numbers
Provides that a person must not without Council's permission keep in any
premises (with the exception of approved catteries) more than two cats or any
cat of or over three months of age, unless the cat is an identified cat within the
meaning of the Dog and Cat Management Regulations 1995.

Clause 8
Cats not to be a nuisance
Provides than an owner or occupier of premises is guilty of an offence if a cat
or cats kept or allowed to remain on the premises causes a nuisance by
reason of noise or odour, wandering from the premises or the aggressive
nature of the cats.
Clause 9
Enforcement
Provides that a cat management officer may enforce compliance with the bylaw by ordering any person to stop the breach or take action to remedy the
breach; that such orders are mandatory; and if not complied with, the cat
management officer may take action reasonably required to have the order
carried out, and recover the costs of doing so.
ADMINISTRATIVE AND POLICING STRATEGIES
The by-law will be policed by inspection, the issue of warnings, expiation notices or by
prosecution if necessary.
NATIONAL COMPETITION POLICY
The Council has considered and assessed the objectives of this by-law and is satisfied that
where competition may be restricted as a result of a permit being required from the Council
for certain acts, events or activities, the benefit to the community outweighs the cost and
there is no alternative means open to the Council to control these activities.
CONSULTATION
This by-law has been submitted to the Dog and Cat management Board for comment
pursuant to section 90(5) of the Dog and Cat Management Act 1995 and the Council has
considered the recommendations of the board concerning the by-law.
The by-law was advertised for public comment in accordance with section 249 of the Local
Government Act 1999. [INSERT NUMBER] submissions were received. The Council has
given reasonable consideration to all submissions and has revised the by-law in response to
the submissions where considered appropriate.
