How to change or nominate a premises supervisor (DPS)
(not for changes to the premises supervisor)
Who can apply to change the DPS or nominate a person as a DPS?
 the holder of a premises licence where the licence allows the sale or
supply of alcohol
 the holder of a premises licence where there is an application to vary the
licence to allow for the sale or supply of alcohol.
How do I apply?
You have to apply to the Council where the premises is located.
Application forms for variations are available from Hackney Licensing Services on
request or can be downloaded from the Council website at
www.hackney.gov.uk/licensing or from the Department of Culture, Media and
Sport at www.dcms.gov.uk.
What do I need to hand in to the Council?
To make a valid application, you need to submit the following to Hackney
Licensing Services:

application form completed and signed with the proposed DPS name and
address

proposed DPS consent form

the premises licence or it’s appropriate part. If that is not practicable,
you must give reasons for why you are not enclosing this.

A statement, if requested, for the immediate effect of the variation.

the relevant fee
You must also do the following:
Send a copy of your application with all relevant documents to any current
DPS and the Police on the same day you apply to the Council.
If your application does not comply with the above, we will return it and you
will need to reapply making sure you complete all outstanding matters.
How much will a premises licence cost?
£23.
Who can object to my application?
Only the Police can object. They will only do this if they think that there are
exceptional circumstances, which mean that granting the variation would
undermine the crime prevention licensing objective.

objection by way of notice.

When will I find out whether I have been granted the variation?
We will make every effort to process your application quickly and efficiently,
however, there is no set time limit to do this by.
How will you decide whether to grant me a variation?
Where the above application requirements have been fulfilled and there are no
relevant representations the variation will be granted subject to any mandatory
conditions.
Where representations are made, the Council will hold a hearing to consider
these and the promotion of the crime prevention licensing objective.
If all parties agree that the hearing is unnecessary, through conciliation, a hearing
can be avoided. For more information please contact us or refer to Appendix 4:
Conciliation.
If your application is granted, you must notify your current DPS if you have
one, that he/she is replaced. If your application is withdrawn or rejected you
must notify your current DPS. Failure to notify is a criminal offence.
What is the situation where I want my application to take immediate effect?
You may want to do this because your current DPS has left the premises. If you
make such an application, it will take effect as soon as it is received by us, up
until your application has been granted, withdrawn or rejected.
If my application is rejected or unfavourable, can I challenge the Council’s
decision?
You have the right of appeal to a Magistrates Court within 21 days of being
notified of that decision.
