Auto-fill Agreement
To assist you in keeping your oil tank from running out of oil the “Auto-fill Agreement” authorizes
Priestley & Son’s Oil Company to fill your oil tank on a periodic basis at times when it seems beneficial or
necessary to help keep you from running out of heating oil. We will bill you at the market price for residential
heating oil for that day of delivery. The cost of heating oil does vary widely and we have little or no control over
the cost of product. We try to guess at when your need for oil may arise and attempt to save our customers
money on heating fuel by utilizing our “educated guess” as to whether we should rush to bring you oil before
foreseeable price increases or wait for an anticipated price decrease. Either way it is only a guess and anybody’s
guess can be right or wrong. Most importantly we want to keep you from running out of heat so we may bring
oil to you when your tank is running low or we may bring it when it is only partially empty. At any rate, it will be
filled at the oil company’s discretion and timing, otherwise it would not be an “auto fill” program. We will
attempt to keep you from running out of oil, but we make no guarantees or warrants. Many factors could affect
ability to prevent a run out, such as an increase in usage, un-drivable road and weather conditions, availability of
product, labor or equipment and any number of other conditions. We will do OUR BEST to keep you fueled up.
As an “Auto-fill” customer you promise to pay the full amount billed to you promptly (within 30days
maximum for cash discount pricing). If you wish to discontinue being an “auto-fill” customer, or if your oil tank
is disconnected, decommissioned, removed or otherwise incapacitated or no longer used you will notify this
oil company, Priestley & Son’s Oil Company, both by telephone and by written letter so that an unwanted
delivery does not occur. Neither of us wants to deal with the situations which can occur with an unwanted
delivery, therefore you are agreeing to notify us immediately for any condition that would cause an unwanted
delivery, whether it is financial or due to conditions with your heating equipment and/or fuel tank. Once you
notify us to discontinue your auto-fill service, you will not be put back on the “Auto-fill” program until we
receive a new, signed and dated copy of this agreement. Any collection costs, collection agency fees, late
payment fees, interest, attorney fees for any action necessary under the performance of this Agreement will be
billed to you, the customer, and you hereby agree to pay promptly.
We are happy to have you as our customer and want to keep our relations with you and all of our
customers happy and beneficial. Therefore this agreement is simply written to spell out expectations and
promises so that things are not assumed.
