This contract is between _______________________________________, hereafter referred to as Mare Owner, and DynaCare Horse Ranch , hereafter referred to as the Breeder. This contract entitles the Mare owner to one service to the stallion Hesa Perty Jay , hereafter referred to as the Stallion, AQHA # 3590621 during the 2016 breeding season. This contract is subject to the following conditions:
1) The Stallion fee of $550.00 includes a non-refundable booking fee of $100.00 which is payable upon execution of this contract. If contract is signed and booking fee is paid prior to 10/31/2015., Stallion fee will reduced by $250. If contract is signed and booking fee is paid between 11/01/2015 and 12/31/2015, Stallion fee will reduced by $200. If contract is signed and booking fee is paid between 01/01/2016 and 2/15/2016, Stallion fee will reduced by $150. All registered AQHA mares will receive a $50 discount during the 2016 breeding season. When the mare arrives at the Ranch for a live cover breeding an additional deposit of $100 will be due. The balance plus all other expenses must be paid at the time the Mare is picked up.
Mare Owner may not remove Mare from Breeder’s possession until all expenses are paid in full. (Additional fees and deposits are required for AI – see Cooled Transported Semen section, if applicable)
2) Breeder agrees to provide suitable facilities for the care and feed of the mare and/or foal while in her custody. Mare Owner agrees to pay for the care at a rate of $8.00 per day. ($9.00 wet)
3) The breeding season for this contract is from February 15 th, 2016 thru June 15 th, 2016.
4) This contract is for live cover unless #18 is initialed below and AI terms are signed.
5) The Mare shall be in healthy and sound condition, free from infectious, contagious, or transmissible disease. A veterinary certificate shall accompany the mare, showing her a) to be in sound breeding condition; b) to be free from infection; c) to have proof of negative coggins test (non Arizona Mares); d) to have a current vaccination for equine influenza, tetanus, and rhinopneumonitis. Any Mare arriving without such certificates will be examined, cultured and vaccinated by Breeder’s
D.V.M. at the Mare Owner’s expense. Breeder reserves the right to refuse Mare if not in satisfactory condition. Mare Owner may substitute another mare within the same breeding season if Breeder does not accept said Mare.
6) A photocopy of the Mare’s registration papers must accompany this contract.
7) Mares must be halter broke. Mare’s rear shoes must be removed. If not removed prior to breeding Breeder will have them removed by her Farrier at the Mare Owner’s expense.
8) DynaCare Horse Ranch agrees to diligently try to settle said mare. If the mare does not settle, Mare Owner will hold
DynaCare Horse Ranch harmless. Mare Owner will have the option to remove Mare from the ranch after breeding cycle is completed, however there will be no guarantee of a live foal for any mare leaving the ranch if not checked in foal within 34 days by their veterinarian. DynaCare Horse Ranch must be notified that Mare has been confirmed in foal or not. The Mare
Owner can also leave the Mare at the ranch for our veterinarian to check her in foal. Daily Mare Care rates will apply.
9) This contract contains a Live Foal Guarantee . A live foal means that the foal should stand and nurse for a period of 5 days.
If the Mare should miscarry, abort or be proven barren after leaving the Breeder’s premises, the Mare owner has privileges to return the Mare for breeding during the current breeding season, or the following year’s breeding season. If the foal is stillborn then the Mare Owner has privileges for the 2017 breeding season. Return breeding privileges will be guaranteed only if proper notification is given. Proper notification is defined as follows: Written certification by a licensed veterinarian within 7 days that the Mare has mis-carried, aborted or produced a non-viable foal.
10) This contract also comes with a Color Foal Guarantee . The color guarantee is as follows: Mares, that do NOT contain a gray gene, will be guaranteed to produce a foal that will be one of the following colors: grullo, dunskin or dun w/ black points. A mare that contains the gray gene will not receive the Color Foal Guarantee.

11) The Breeders Certificate will be issued only after the Mare Owner has notified DynaCare Horse Ranch that the mare has produced a live colored foal and all the breeding fees/bills on the Mare have been paid in full. (Stallion owner requests that at least 1 photo of the foal be provided)
12) Should the stallion die, be sold by the owner, or become unfit for service prior to settling the Mare, the 2016 breeding fee will be refundable, thereby canceling this entire contract. If the Mare dies or becomes unfit to breed before being pronounced safe in foal, the Breeder has the option to either a) accept another mare as a replacement, or b) refund the breeding fee, thereby canceling this entire contract.
13) This contract is non-assignable and non-transferable. The Breeder strongly recommends that the Mare Owner carry full insurance on the Mare and/or foal.

14) Both parties agree that DynaCare Horse Ranch, their agents or employees are not liable for death, sickness and/or accident including consequential damage caused to the Mare and/or foal and the Mare Owner is not liable for death, sickness and/or accident including consequential damage caused to the Stallion.
15) In the event it becomes necessary to refer debts arising from this contract to an attorney for collection, or if a suit is instituted hereon, Mare owner agrees to pay all reasonable court costs and attorney’s fees incurred in the suit or collection process.
Along with a 10% annual interest on all past due invoices.
16) Mare Owner further agrees that this contract is made and entered into in the county of Pima in the state of Arizona and it shall be interpreted, enforced and transacted under the laws of the said state and within the designated county, regardless of the manner of solicitation.
17) Mare Owner’s signature on this contract certified that he/she has read and fully understand all the terms and conditions outlined herein and accepts this contract as a legal binding agreement of the owner, owner’s heirs, successors and assigns.
This contract represents the entire agreement between the parties. No other agreements or promises, verbal or implied are included unless specifically stated in writing.
18) AI - COOLED TRANSPORTED SEMEN Clients ONLY.
Please initial this line if you are breeding via cooled semen and have read and agree to the additional terms below. a)An additional Collection/Shipping Fee of $ 400.00
will be charge b)All required paperwork including a check for all fees is due at least two weeks PRIOR to shipment of semen. c)The Breeder needs at least 36 hours notice prior to shipment. The Mare Owner must call the Breeder on the first day of the Mare’s cycle to alleviate any possible delays. An additional fee of $50 will be charged for
“Same Day” collection and shipping. d)The Collection Fee includes two doses of cooled semen per shipment. The semen can ONLY be used to inseminate one mare. Any attempt to breed more than one mare will void this contract. The Collection Fee also includes shipping costs via Express Mail overnight delivery. Alternative shipping arrangements can be made at the Mare Owner’s expense.
Each additional shipment will be $300 that must be paid PRIOR shipment of more cooled semen. e)The Mare Owner agrees to return the Equitainer to the Breeder within 72 hours of receipt. The Equitainer can be returned thru the regular US Postal Service.
f)Breeder agrees to ship to Mare Owner semen that will be viable for a minimum of 36 hours after leaving the
Breeder’s possession. Breeder is not responsible for lost, delayed or damaged semen caused by the shipping company, and makes no representation or warranties of any kind with respect to the semen, except that it is said
Stallion’s semen and was viable at time of shipment.
