On motion of Mr. , seconded by Mr. , the following resolution was offered:
RESOLUTION NO.
A resolution authorizing the Chairman or, in his absence, the Vice
Chairman of the Jefferson Parish Council to execute Cooperative
Agreement LaGov No. 2000099310 by and between the Louisiana
Department of Natural Resources, State of Louisiana and the Parish of
Jefferson, a copy of the Agreement is annexed hereto and made a part
thereof and marked Exhibit 1 for identification herewith.
The
Cooperative Agreement provides fifty two thousand, sixty three dollars
($52,063.00) from the State to assist the Parish in implementing the
Local Coastal Zone Management Program from July 1, 2015 through
June 30, 2016. (Parishwide)
WHEREAS, Jefferson Parish has an approved Local Coastal Zone Management
Program and is prepared to continue the program; and
WHEREAS, the Louisiana Department of Natural Resources shall contribute a
maximum of fifty two thousand sixty three dollars ($52,063.00) for said program; and
WHEREAS, the Parish of Jefferson shall contribute a minimum of forty three
thousand and sixty-three dollars ($43,063.00) in in-kind services for said program for a
total of ninety five thousand, one hundred twenty-six dollars ($95,126.00) ; and
NOW THEREFORE, BE IT RESOLVED by the Jefferson Parish Council of
Jefferson Parish, Louisiana, acting as governing authority of said Parish:
SECTION 1. That the Cooperative Agreement LaGov No. 2000099310, by and
between the Louisiana Department of Natural Resources, State of Louisiana and the
Parish of Jefferson, a copy of the Agreement, annexed hereto and made a part
herewith, provides fifty two thousand sixty three dollars ($52,063.00) from the State of
Louisiana, Department of Natural Resources to assist with implementing the Local
Coastal Zone Management Program from July 1, 2015 through June 30, 2016, be and
is hereby ratified.
SECTION 2. The agreement includes a provision to protect, defend, indemnify,
save and hold harmless the State of Louisiana, all State Departments, Agencies,
Boards and Commissions, its officers, agents, servants, and employees, including
volunteers from and against any and all claims, demands, expense and liability arising
out of injury or death to any person or the damage, loss or destruction of any property
which may occur or in any way grow out of any act or omission of the Parish of
Jefferson, its agents, servants and employees, or any and all costs, expense and/or
attorney fees incurred by the Contracting Party as a result of any claims, demands,
and/or causes of action except those claims, demands, and/or causes of action arising
out of the negligence of the State of Louisiana, all State Departments, Agencies,
Boards, Commissions, its agents, representatives, and/or employees.
SECTION 3. The Parish of Jefferson shall contribute a minimum of forty three
thousand and sixty-three dollars ($43,063.00) in in-kind services.
SECTION 4. The grant in the amount of fifty-two thousand sixty three dollars
($52,063.00) is to be charged to Account No. 21640-1291-234-XXXX (16414-XXX).
Sub-project numbers will be assigned once the cooperative agreement is executed.
SECTION 5. The Louisiana Department of Natural Resources shall reimburse
Jefferson Parish in four (4) quarterly payments of $13,015.75 for all eligible costs
incurred under this project.
SECTION 6. The Director of the Department of Environmental Affairs is hereby
authorized to submit quarterly reports and requisitions for payment.
SECTION 7. That the Council Chairman or, in his absence, the Vice-Chairman, be
and is hereby authorized to execute any and all documents necessary to give full force
and effect to this resolution.
