Blackpool Council 16th Dec 2013 Planning Committee: Planning Application Reports – Update Notes Listed below are changes to the planning reports made as a result of additional information received since the publication of the agenda for this meeting. Case: Address: Update: Year: 13 0378 Land at Moss House Road, Blackpool The Head of Transportation had previously raised concerns over the potential for a ransom strip to be created along Laundry Road. It is now understood that Moss House Road is adopted highway providing public access to Laundry Road. As such, no issues are now identified. It is recommended that the following conditions be attached to any permission granted: (i) No deliveries shall be made to the shop unit hereby approved outside of the hours of 07:00 to 19:00 Monday to Friday and 09:00 to 19:00 on Saturdays, Sundays and Bank Holidays. Reason: In order to safeguard the residential amenities of the occupants of nearby properties in accordance with Policy BH3 of the Blackpool Local Plan 2001-2016. (ii) Before development commences, a scheme for the improvement of Moss House Road and Docky Pool Lane to include resurfacing, traffic calming, localised narrowing and access upgrades shall be submitted to and agreed in writing by the Local Planning Authority. Reason: In order to ensure safe and convenient access to and around the development for residents and visitors in File name: 116101884 Updated: Blackpool Council accordance with Policy AS1 of the Blackpool Local Plan 2001-2016. It is further recommended that the following advice notes be attached to any permission granted: The works require pursuant to condition 19 attached to this permission may require the developer to enter into an appropriate Legal Agreement with Blackpool Borough Council acting as Highway Authority. The Highway Authority may also wish to implement their right to design all works within the highway relating to this proposal. The applicant is advised to contact the Council's Built Environment Department, Layton Depot, Depot Road, Blackpool, FY3 7HW (Tel 01253 477477) in the first instance to ascertain the details of such an agreement and the information required. Blackpool Council operates a refuse collection and recycling service through the use of wheeled bins and sacks with most premises having 3 or 4 wheeled bins. The Council has purchased and provided these wheeled bins to all existing properties. However, it will be incumbent on developers and builders of new residential properties, including conversions, to provide these bins. Contact should be made with the Waste Services Section at Layton Depot, Plymouth Road, Blackpool, FY3 7HW or telephone 01253 476279 about the requirement, provision and cost of the wheeled bins prior to any resident moving in. The Council’s Waste Management team has raised concerns over the refuse tracking plans submitted with the application. More detailed refuse tracking plans have since been provided which appear to show that all properties could either be adequately accessed by a standard Blackpool Council refuse vehicle or would have access to a refuse presentation point within a suitable distance from which refuse would be collected. It has not been possible to fully consider these new plans in time for the submission of this update note. If any issues are identified, they will be reported at the Committee meeting. File name: 116101884 Updated: Blackpool Council 13 0483 Arncliffe, Sixth Avenue Amended plans have been submitted by the agent, which result in a reduction in width of the property by a metre. 13 0625 Former site of Margaret Clitherow Church ,Lytham Road Condition 13 to be deleted and an additional advice note added regarding secured by design 13 0649 Collegiate High School, Blackpool The design of the building has been amended slightly such that the louvres proposed above the window panels would no longer reflect the colours used on the end elevations of the different sections of the building. Additional planting has been proposed around the cycle store. Tussock mix planting areas have also been proposed around the playing fields in line with the comments of the Head of Parks and Greens to enhance biodiversity on the site. Amended comments have been received from the Environment Agency in consultation with United Utilities. In accordance with these comments it is recommended that the proposed drainage condition no. 12 be revised as follows: No development shall take place until a surface water drainage scheme for the site, based on sustainable drainage principles and an assessment of the hydrological and hydrogeological context of the development, has been submitted to and approved in writing by the local planning authority. The drainage strategy should demonstrate the surface water run-off generated up to and including the 1 in 100 year critical storm will be 30% less than the run-off from the existing site following the corresponding rainfall event. The scheme shall also include details of how the scheme shall be maintained and managed after completion. The scheme shall subsequently be implemented in accordance with the approved details before the development is completed. Reason: In order to prevent the increased risk of flooding, both on and off site, and reduce the File name: 116101884 Updated: Blackpool Council risk of the development contributing to a further reduction of Bathing Water Quality in accordance with Policy NE10 of the Blackpool Local Plan 2001-2016. The development approved by this permission shall proceed in strict accordance with the following documents and shall ensure that the surface water run-off from the proposed development discharging to the public combined sewer is reduced by at least 30% from existing rates up to and including the 1 in 100 year plus climate change storm event:• Collegiate & Highfurlong Schools North West Academies Civil & Structural Drainage Strategy Report for Carillion by Atkins (dated 07/11/2013 Revision 01) • drawings - 5119500-ATK-CH-D-7001 Rev03 and 5119500-ATK-CH-D-7002 Rev03 Reason: To reduce the risk of flooding off-site and ensure the development does not increase the risk of reducing Bathing Water Quality in accordance with Policy NE10 of the Blackpool Local Plan 2001-2016. Condition 13 to be updated to require the Biodiversity Enhancement Statement and timetable for implementation to be submitted before the new building is first brought into use. Additional lighting information has been submitted. As such it is recommended that condition 15 be amended as follows: Notwithstanding the information submitted, details of any lighting, including technical specifications, the appearance of any fixtures and the direction of illumination, shall be submitted to and agreed in writing by the Local Planning Authority before any external lighting works are first commenced. Reason: In the interests of the appearance of the site, to safeguard residential amenity, and to ensure that the lighting provided would not have a detrimental impact on biodiversity through the disturbance of habitat in accordance with Policies LQ1, LQ2, BH3 and File name: 116101884 Updated: Blackpool Council LQ6 of the Blackpool Local Plan 2001-2016. The lighting to be provided on site shall be as specified on drawing ref. 5124676-ATK-CH-XXDR-E-63-0010 Rev 01 unless otherwise first submitted to and agreed in writing by the Local Planning Authority. Reason: In the interests of the appearance of the site and the amenities of local residents in accordance with Policies LQ1 and BH3 of the Blackpool Local Plan 2001-2016. A consultation response has been received from the Lancashire County Council Highways Service as follows: The principle of the redevelopment in this location is considered to be acceptable. Lancashire County Council has no objection subject to a number of conditions being attached to any permission granted. These conditions should require the following: Construction Management Plan; A Travel Plan A scheme for the construction of site accesses to be submitted and agreed; A scheme for the layout of the car park to be submitted and agreed; A scheme of off-site highway works to be submitted and agreed. It is recommended that the last three schemes be submitted before development first commences and implemented before first use. A Construction Management Plan and Travel Plan have already been conditioned. It is recommended that the following conditions be attached to any permission granted: (i) Before works on the construction of the new building first commence, a car parking scheme detailing the areas available for use and those spaces to be marked out as accessibility spaces and car-share spaces shall be submitted to and agreed in writing by the Local Planning Authority. This agreed scheme shall then be implemented as part of the File name: 116101884 Updated: Blackpool Council development of the car parking areas and shall thereafter be retained. Reason: In order to ensure safe and convenient access for all users of the site and to encourage more sustainable methods of travel in accordance with Policy AS1 of the Blackpool Local Plan 2001-2016. (ii) Before works on the construction of the new building first commence, a scheme for the improvement of the access points onto Blackpool Old Road shall be submitted to and agreed in writing by the Local Planning Authority. This agreed scheme shall then be implemented as part of the development of the car parking areas and shall thereafter be retained. Reason: In order to ensure safe and convenient access to the site in accordance with Policy AS1 of the Blackpool Local Plan 2001-2016. (iii) Before works on the construction of the new building first commence, a scheme for the provision of signage and line painting to the existing bus drop-off area accessed from Blackpool Old Road shall be submitted to and agreed in writing by the Local Planning Authority. This agreed scheme shall then be implemented before the new school building hereby approved is first brought into use. Reason: In order to ensure safe and convenient access to the site in accordance with Policy AS1 of the Blackpool Local Plan 2001-2016. The concerns raised by the Head of Transportation have been discussed in detail with the applicant. It is understood that the existing situation with regard to pedestrian access across Blackpool Old Road is problematic. However, and as detailed, the capacity of the school is not changing and the funding available to the school for the redevelopment cannot be spent outside of the school site. Nevertheless it has been identified that the existing zebra crossing over Blackpool Old Road adjacent to the southern access point should be removed, and that a new pedestrian File name: 116101884 Updated: Blackpool Council refuge should be provided within the highway in the vicinity of the proposed main pedestrian access point. It is understood that, whilst there is a desire to deliver these improvements, there is no capacity for the Council as Local Highways Authority to undertake the works at the current time. (a) the removal of the existing zebra crossing over Blackpool Old Road adjacent to the southern access point and the provision of a pedestrian refuge within the highway in the vicinity of the proposed main pedestrian access point. The works required to be agreed by part (a) shall be implemented before the new school building hereby approved is first brought into use.
