Date: October 2010 Project No: Y9114 SECTION 1 – PROJECT OVERVIEW The purpose of the scheme is to protect the town of Bray, County Wicklow from flooding from the River Dargle. The Works consist of the design and construction of flood defences, river widening and regrading along the lower reaches of the River Dargle. The works extend over approximately 3.3 km of the river from the N11 Bridge to the DART Harbour Bridge. The flood defences are required to provide protection against a 1 in 100 year fluvial flood and 1 in 200 year tidal flood which has been predetermined and the Contractor will be required to design the defences to a specified flood level. The Contractor is also required to design and construct a large bore culvert at Bray Bridge, the only vehicular bridge in Bray Town, to act as a fourth arch to the bridge .Bray Bridge must remain open for the duration of this work. The River Dargle is an ecological and archaeological sensitive environment. The Contractor will be responsible for retaining the services of a suitably qualified and licensed Archaeologist and Ecologist to oversee the design and construction of the works and to comply with any restrictions or obligations imposed by the planning process. The proposed works involve significant construction works in the centre of Bray Town in close proximity to residential and commercial premises. There will be significant Traffic and Noise Management issues. Information relating to outline designs that is provided with the Tender documents is for the Tenderer’s information and assistance in preparing their Tender. The Tenderer takes full responsibility for the sufficiency of their Tender. The Contractor, in accordance with the Conditions of Contract and associated constraints and requirements, is to design and then construct the flood defences required. The Contractor shall ensure that his design is consistent with the parameters used in the Physical Model and detailed in the Physical Model Report in Volume D of the Contract Documents. The scheme comprises a variety of flood defences including construction of new sections of earth embankments, demolition and rebuilding of river walls with extensive stone and timber/timber-type facing, channel excavation and regrading, and river bank strengthening. A range of landscape treatments in and adjacent to the river are proposed to mitigate the impacts of the scheme on the local environment along the river corridor. Works undertaken by the Contractor shall include, but are not limited to: Review, assessment and verification of information provided by the Employer’s Representative; Detailed design including hydraulic, geotechnical, structural, civil and environmental design of all components of the Works and any temporary works; Provision of Contractor’s Documents and information for review by the Employer’s Representative in a logical manner; Page 7 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Procurement, construction, installation and completion of the Works in accordance with the approved programme; Appointment of a Project Liaison Officer to co-ordinate and oversee all third party liaison as required by An Bord Pleanala and as detailed in the Contract Documents; Appointment of suitably qualified Ecologist, Archaeologist and Landscape Architect as required under the Contract; Preparation of detailed landscaping plans and designs, liaison and agreement with the relevant parties affected by such plans. Undertaking the roles of Project Supervisor Design Process (PSDP) and Project Supervisor Construction Stage (PSCS) under the Safety, Health and Welfare at Work (Construction) Regulations 2006, or any amendment thereof effective at the time of the Contract. Liaison with all affected service providers; detailed design and construction/installation of all service diversions as required; payment to all service providers where required; negotiation of and payment for all or any wayleaves required for service diversions. Compliance with all constraints as detailed in all or any of the Contract Documents. Compliance with all statutory requirements. Liaising with landowners, occupiers and third parties prior to and during the detailed design and construction of the works. Co-ordination and co-operation with the Employer’s Representative; Submission of all as-built records and drawings and the compilation of the design files and the Safety File; Making good any defects; The Contractor’s specific attention is drawn to the fact that the EIS identifies that the River Dargle is a salmonoid river and as such in-stream works are permitted between 1st May and 30th September only. It is a restriction of the EIS that the works commence at the upstream end and proceed downstream in order to facilitate the recovery and re-colonisation of any disturbed areas of the river. However due to the progression of bridge widening project at Bray Bridge the Contractor shall prioritise the works in AREA 2 and must undertake the design and construction of the flood defence works immediately adjacent to Bray Bridge in the first summer season (May to September) on site, excluding the works to Bray Bridge if he so desires. The Contractor shall only programme for undertaking works in AREA 2 or AREA 2A during the first summer season (May – September) or from the second summer season (May – September) to Contract end. Page 8 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 The Contractor shall note that the works outlined under Area 2A (Culvert at Bray Bridge) may not proceed to construction under this contract. The Contractor is required to include the works as part of his tender providing a design and costing of the works but the Employer will confirm prior to contract signing whether these works will be undertaken as part of this contract. Further details of the contractor’s obligations are given in this document and other contract documents. While this document attempts to collate all the requirements, restrictions, etc for the scheme it is the responsibility of the Contractor to review all of the relevant documentation and to ensure that all requirements, restrictions, etc are addressed and accommodated as part of his design build submission. Page 9 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 SECTION 2 – PROJECT DESCRIPTION 2.1 General The Contractor is required to construct the works in accordance with the restrictions as set out in the EIS, commence at the upstream end and proceed downstream in order to facilitate the recovery and re-colonisation of any disturbed areas of the river. However due to the progression of bridge widening project at Bray Bridge the Contractor shall prioritise the works in AREA 2 and must undertake the design and construction of the flood defence works immediately adjacent to Bray Bridge in the first summer season (May to September) on site, excluding the works to Bray Bridge if he so desires. The Contractor shall only programme for undertaking works in AREA 2 or AREA 2A during the first summer season (May – September) or from the second summer season (May – September) to Contract end. The Contractor is responsible for the detailed design of the works which must comply with the requirements of the EIS. The aesthetic finish of the proposed works shall be in accordance with the EIS. However the Contractor shall note that material contraventions of the EIS may be submitted for approval to the local planning authority. The local planning authority does not guarantee that any such contraventions or amendments to the existing planning will be approved. The Contractor shall note that the works outlined under Area 2A (Culvert at Bray Bridge) may not proceed to construction under this contract. The Contractor is required to include the works as part of his tender providing a design and costing of the works but the Employer will confirm prior to contract signing whether these works will be undertaken as part of this contract. The works have been spit into six AREAS. The limits of these AREAS are detailed on drawing Y9114–C–101 and are referenced in various locations throughout the Contract Documents. In brief these areas are as follows: Area 1 – Harbour Bridge to Bray Bridge, where works include the construction of flood defences along each bank and the deepening and widening of the river channel Area 2 – Bray Bridge, where works include lowering of the riverbed at Bray Bridge, the structural underpinning of Bray Bridge and the construction of flood defences along each bank Area 2A – Culvert at Bray Bridge, construction of a 7.4m x 4.0m culvert around Bray Bridge. Area 3 – Bray Bridge to the western edge of People’s Park, where works include widening and deepening of the river channel, the replacement of existing river walls and the construction of flood defences along each bank Page 10 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Area 4 – Western edge of People’s Park to La Vallee, where works include regrading and excavation of the river channel, enhancement of existing defences, provision of additional defences and construction of a debris trap Area 5 – La Vallee to N11 Bridge, where works include deepening and widening of the river channel and the provision of additional defences. Please note that these AREAS are different to the ZONES referred to in relation to the requirements of Inland Fisheries Ireland (IFI). The ZONES, as shown on drawing Y9114–C– 101, for the purpose of fisheries are as follows: Zone 1 – N11 Bridge to downstream end of La Vallee Zone 2 – Downstream end of La Vallee to the downstream end of The Slang Zone 3 – Downstream End of The Slang to Upstream End of People’s Park Zone 4 – Upstream End of People’s Park to Bray Bridge The Contractor’s attention is drawn to the phased completion of the works and the requirements for the completion of each AREA prior to the commencement of the next AREA. 2.2 Work Areas 2.2.1 Area 1 – Harbour Bridge to Bray Bridge The works in this area include the design and construction of new embankments and new stone clad flood defence walls to accommodate the required flood defence levels. The works will also entail the construction of a reinforced concrete (RC) retaining wall on the boundary of golf course and Ravenswell Road, the provision of an emergency flood relief channel along north side of the RC retaining wall, realignment of the river upstream of the Harbour Bridge to provide an improved approach to the bridge piers, the structural underpinning of existing walls, river widening and regrading work, removal of weir downstream of Bray Bridge, extension of existing pipe outfalls and installation of new non return valves. The aesthetic finish for the works in this area will be in accordance with EIS. All proposed finishes shall be submitted to the Employer’s Representative for approval. It is the proposed that the aesthetic finish of the works will be as close as possible to the finish of the existing walls to ensure that the visual impact of works is minimised in so far as possible. The works as proposed in the vicinity of the golf course lands have been amended since the preparation of the EIS. The revised proposal is outlined on drawing Y9114–C–103. The revised proposals relate to the flood defence works proposed at the boundary between the golf club and Ravenswell Road. The works proposed in all other areas are as outlined in the EIS. The Contractor’s attention is drawn to the fact that at the time of writing it is envisaged that the golf course will remain open for the duration of the works and the Contractor is required to accommodate this in his proposals for construction and traffic management. Page 11 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 The emergency flood relief channel shall extend from Castle Street, past the rear of Dwyer Park through the Golf Club Lands. The existing wall at the intersection of St Laurence’s Terrace and St. Columcille's to the rear of Superquinn shall be removed. The emergency flood relief channel shall be designed to accommodate a maximum flow of 20m 3/s. This flow shall discharge by gravity into the main river channel upstream of the Harbour Bridge via outfalls through the defence line along Ravenswell Road. Non-return valves shall be installed on the outfalls to prevent ingress of flood water. The non-return valves shall be designed so that they can discharge the 20m 3/s with the emergency channel water depth at 2.25m AOD. The works in this area abut the railway bridge at Bray Harbour. Iarnroid Eireann have strict requirements for works in the vicinity of rail bridges and other Iarnroid Eireann infrastructure. It is the Contractors responsibility to refer to the guidance document I-DEP-0120 “Guidance on Third Party Works” and to liaise closely with Iarnroid Eireann regarding the interface between the Iarnroid Eireann infrastructure and the Contractor’s proposed design. The design of the works in this area shall take full cognisance for all and any requirements as set out by Iarnroid Eireann. The Contractor shall keep the Employer’s Representative fully informed of the discussions with Iarnroid Eireann and provide the Employer’s Representative with the opportunity of attending any liaison meetings. The Contractor shall take account of all time restrictions that are outlined by IE. Works in this area will also need to take account of all other construction works that may be active on site during the construction period of these works. The contracts that are envisaged to be on site at the same time as this contract are outlined in Section 3 below. However this is a non-exhaustive list and the Contractor may have to liaise and coordinate with other third parties. The proposed works for the south bank are to include reinstatement of the right of way. This is to be a nominal 2m wide path with a compacted stone fill surface; the depth of construction, the requirement for sub-base and the requirement for separation membranes or for strengthening geotextiles is to be determined by the detailed design. The Contractor’s attention is drawn to the Invasive Species Survey contained in Appendix D however the Contractor’s must satisfy himself as to the accuracy of this survey and allow in his costs for this survey to be repeated at intervals during the works as recommended by his Ecologist and agreed by the Employer’s Representative. The Contractors attention is drawn the An Bord Pleanala approval in relation to the CPO and contained in Volume D. 2.2.2 Area 2 – Bray Bridge The Contractor’s attention is drawn to the requirement that the works in AREA 2 must be prioritised and that the defence works immediately adjacent to Bray Bridge must the designed and constructed the flood in the first summer season on site (May to September). It is the Contractor’s decision whether he will undertake the required structural works to Bray Bridge at this time or during the second summer season on site. However the Contractor shall note that the construction of proposed pedestrian bridges adjacent to Bray Bridge will be undertaken between the two summer seasons (i.e. October to April). Design drawings for these works are included in Volume D of these Contract Documents and further details are provided under Section 3 of these Works Requirements. Furthermore the Contractor shall only programme for undertaking works in AREA 2 or AREA 2A during the first summer season (May – September) or from the second summer season to Contract end. River regarding works in the vicinity of Bray Bridge will require the Contractor to undertake extensive underpinning and other work structural works to ensure that the structural integrity of the bridge is unaffected. The Contractor must submit detailed design proposals for these works demonstrating that the proposed works can be carried out without risk to the safety and integrity of the bridge. Extreme care shall be exercised during underpinning works at Bray Bridge so as not to damage the existing structure or fabric. The Contractors attention is drawn the An Bord Pleanala approval in relation to the CPO and contained in Volume D. 2.2.3 Area 2A – Culvert Option at Bray Bridge The Contractor shall note that the works outlined here may not proceed to construction under this contract. The Contractor is required to include the works as part of his tender providing a design and costing of the works but the Employer will confirm, prior to contract signing, whether or not these works will be undertaken as part of this contract. The works in this area will include the design and construction of a 7.5m x 4.0m box culvert on the northern side of Bray Bridge including the diversion and protection of any services required by the design of these works. The proposed culvert shall have straight internal walls and tie-in to the existing river walls with a smooth transmission, the opening shall be free from obstructions with clear internal dimensions of 7.4m wide x 4m deep culvert at all times including at the angle at which the culvert intercepts the existing walls. The opening in the existing wall created by the culvert shall be finished with natural stone cladding to match exiting, where possible existing river wall stones shall be reused. The works to install the culvert will involve significant works in relation to diversion of services. The Contractor is responsible for all costs associated with all and any works associated with services and the diversion and/or protection of same. The Contractor shall include for all costs associated with such works and shall ensure that his programme takes account of working all third parties and their associated services. Services drawings are provided with in the information pack. These drawings are for information only and it is the Contractor’s responsibility to satisfy himself as to the accuracy and completeness of these records. The installation of the proposed culvert will require that an existing stone arch under Ravenswell Road, adjacent to Bray Bridge, is blocked up. As stated in the EIS the arch will be incorporated into the aesthetic finish of the flood defence wall with the facing to both elevations of the filled in arch to be in natural stone to match existing surrounding masonry. The Contractor must ensure that the works do not lead to the spreading of the noxious weeds along the River Dargle. The Contractors attention is drawn the An Bord Pleanala approval in relation to the CPO and contained in Volume D. 2.2.4 Area 3 – Bray Bridge to the western edge of People’s Park The works in this area comprise of the construction of stone clad flood defence walls, structural embankments and any other necessary works to accommodate the required flood defence level. The works will also entail widening and regrading of the river bed. As indicated on the specimen design the works in Area 3 also entail the excavation of a large section of People’s Park between the junction with St Laurence’s Terrace and Bray Bridge. This area of People’s Park will be incorporated into the river channel. A pedestrian boardwalk cantilevered off the new proposed flood wall will be provided in this area. Drawing B237-165 of the specimen drawings provides an outline graphical representation of the expected aesthetic finish of the boardwalk. The walkway shall be tied into the existing ground level at People’s Park and at Bray Bridge. The required flood defence wall level shall not be compromised by the boardwalk at the point where the boardwalk passes over the defence to the dry side. The Contractor is responsible for the detailed design of the boardwalk ensuring that it compiles with the performance specification and all relevant design standards. The works in Area 3 also involve the diversion of 900 mm sewer that crosses the river at People’s Park in the vicinity of the Swan Stream. Currently the sewer crosses from the northern bank to the southern bank of the river upstream of the Swan Stream. Following the completion of flood defence works the pipe will be significantly proud of the new river bed level, therefore it is proposed to divert the sewer as shown on drawings Y9114–C–105. The Contractor is responsible for the detailed design of the sewer; the drawings provided are for Page 16 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 information purposes. The Contractor must incorporate this sewer as part of his detailed design for the scheme ensuring that the overall capacity of the flood channel is not reduced by the inclusion of this sewer. It is noted that it may be necessary for this pipe to partially exposed as it runs parallel to the flood defence and the Contractor must adequate protect the pipe if this is the solution the Contractor proposed. The sewer diversion must also be designed to prevent any ingress of water into the sewer. The Contractor must ensure that the works do not lead to the spreading of the noxious weeds along the River Dargle. The Contractors attention is drawn the An Bord Pleanala approval in relation to the CPO and contained in Volume D. 2.2.5 Area 4 – Western edge of People’s Park to La Vallee In addition to the construction of stone clad flood defence walls, structural embankments and any other necessary works to accommodate the required flood defence level and widening and regrading of the river bed, the works in Area 4 will entail the construction of a culvert approx 1.2m x 1.0m to carry the County Brook through the embankment proposed in this location. The culvert shall have a similar invert to the existing brook and have suitable headwalls at each end to allow the brook to pass through the new embankment without erosion or scouring of the embankment. The exact size and design requirements for this culvert must be agreed with Inland Fisheries Ireland and will be such as to not impede any Page 17 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 fish spawning potential that currently exists on the County Brook. The design of this element of the works shall allow for the required fish passage to maintain the spawning potential of the stream, as directed by Inland Fisheries Ireland, as well as incorporating measures to prevent flood waters back flowing from the River Dargle up the County Brook and causing flooding behind the flood defences. Area 4 also includes a debris trap consisting of elliptical concrete piers. The propose of the debris trap is to trap large debris and prevent it from travelling further downstream and causing blockages in more populated and congested areas. The Contractor is responsible for the detailed design of the debris trap including the proposed secondary flow channel that will be provided at the Slang to cater for flows in the event that the debris screen becomes blocked. In this event the Contract shall ensure that there is still sufficient capacity in the river to main the required flood defence level. A lower embankment at the debris trap is to be provided to separate the main channel and secondary channel as shown on the drawings. The crest level of the lower embankment is to be 300 mm above design flood level. The contractor shall ensure that any existing defences that are to be retained as part of his design shall meet the requirements of the performance specification and any other relevant applicable design standards. He will carry out any necessary strengthening and repair works that are required to ensure that the works as a whole have the required design life and provided the required flood defence. Existing flood defence walls are to be inspected and appropriate strengthening works/ underpinning works carried out where the new river profile will compromise their integrity. Damaged or poor condition existing gabion baskets are to be repaired and refilled with a quality of materials and stone to match the existing undamaged and good condition baskets. The works in Area 4 also involve the regrading of a large portion of land at the Slang. The area in question is colloquially known as Rehills Lands. It is proposed to raise the level in this area by approximately a 1m by spreading suitable excavated material over the lands. Suitable environmental testing of the excavated material will be undertaken prior to placement to confirm suitability. In addition the Contractor must ensure that such works do not lead to the spreading of the noxious weeds. The Contractor’s attention is drawn to the Invasive Species Survey contained in Appendix D however the Contractor’s must satisfy himself as to the accuracy of this survey and allow in his costs for this survey to be repeated at intervals during the works as recommended by his Ecologist and agreed by the Employer’s Representative. At several places the outline proposals involve deepening the river adjacent to existing river walls and defence structure. At these locations the existing feature is to be investigated and assessed for stability with the proposed new river depth and profile. Where necessary the existing defence feature is to be strengthened and /or underpinned to allow dredging of the river to the new profile but leave the wall/river feature with appropriate factors of safety against failure under all foreseeable loading or combined loading cases including but not limited to; rising river levels, rapid drawdown of flood waters and temporary localised excavations. The Contractor must ensure that the works do not lead to the spreading of the noxious weeds along the River Dargle. The Contractor’s attention is drawn to the Invasive Species Survey contained in Appendix D however the Contractor’s must satisfy himself as to the accuracy of this survey and allow in his costs for this survey to be repeated at intervals during the works as recommended by his Ecologist and agreed by the Employer’s Representative. It is the Contractor’s responsibility to liaise with IFI as specified in Section 3.1 and determine the exact requirements and conditions of work and incorporate all such requirements in the design submission. Again the Contractor should note that the fishery ZONES refer to different sections of the works to the works AREAS defined above. Before commencing works the Contractor must undertake a survey of the existing river bed to establish such things as the existing bed slope, the riffle & glide locations and locations of existing boulders and stilling ponds. The Contractor shall liaise with IFI regarding the scope of this survey as in general the purpose of the survey is to record information on the existing channel to allow it to reinstated as per existing insofar as possible. 2.2.2 Zone 1 – N11 Bridge to downstream end of La Vallee There appears to be insufficient space to construct a stepped channel in this area however the Contractor shall undertake a survey to confirm the exact width of the channel. If there is insufficient space the final channel will be the same width as the existing channel, approx 3.5m – 4.0m. If the survey demonstrates that there is sufficient space in the opinion of IFI for a stepped then the wetted area/low flow channel will be 3.5m – 4.0m. The step in the channel can be as minimal as 250 mm but greater would be preferred. The Contractor will agree this dimension with IFI however his design must allow adequate flood capacity in the river. The Contractor’s design will be to return the riverbed to the existing slopes, incorporating the riffle and glide and replacing the boulders at the same depth and location insofar as possible at the lower design bed level. 2.2.3 Zone 2 – Downstream end of La Vallee to the downstream end of The Slang Page 20 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Along the Slang there is sufficient area to provide a two stage/stepped channel. The wetted area/low flow channel will be the same dimensions as that of Zone 1 but will tie into the existing bed width in Zone 3, approx 4m – 4.5m. The low flow channel will be maintained tight to the northern bank insofar as possible along the length of the Slang. The step in the channel can be as minimal as 250 mm but greater would be preferred. The Contractor will agree this dimension with IFI however his design must allow adequate flood capacity in the river. The Contractor’s design will be to return the riverbed to the existing slopes, incorporating the riffle and glide and replacing the boulders at the same depth and location insofar as possible at the lower design bed level. 2.2.4 Zone 3 – Downstream End of the Slang to Upstream End of People’s Park Similar to Zone 1 it appears that there is insufficient space to construct a stepped channel in this area. The width of the low flow channel will be approximately 1m narrower than the current wetted area, thus having a width of approx 3.5m – 4m. However the low flow channel will be centrally located within the width of the river in this location. There is also a requirement to introduce deflectors along the length of Zone 4. These will be at approx 20m centres. They will consist of boulders approx 0.5m – 1m diameter with approx 30T of stone for each deflector. Page 21 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 SECTION 3 – THIRD PARTY CONSENTS AND INTERFACES 3.1 Works in a Water Course The River Dargle is a spawning ground for various aquatic species including salmon and trout. Therefore the Contractor must liaise with Inland Fisheries Ireland (IFI) prior to and during both design and construction. The Contractors design must accommodate the requirements of IFI with regards to the protection of the aquatic environment as well as the necessary measures and design requirements for the sustainability of the aquatic environment and all associated habitats. No works, including site setup and site clearance, will be permitted without the prior approval of IFI. The Contractor must allow in his tender for all costs associated with this work including liaison with IFI and the design and construction of all permanent and temporary measures required by IFI. The Contractor must also allow sufficient time in his programme to undertake the necessary liaison and works to satisfy the requirements of the IFI. The Employer’s Representative must be informed of all designs, requirements and agreements. Further details of the requirements of IFI are provided in other section of the works requirements. 3.2 Planning Consent The Environmental Impact Statement (EIS) scheme has been approved by An Bord Pleanála. The Contractor is required to construct the works in accordance with the restrictions set out in the EIS and all other restrictions or clarifications contained in the Contract Documents. The Contractor is responsible for the detailed design of the works and should note that material contraventions must be submitted for approval to the local planning authority. The local planning authority does not guarantee that any such contraventions or amendments to the existing planning will be approved. 3.3 Possession of the Site The Employer has secured by compulsory purchase the lands as outlined on the Compulsory Purchase Order (CPO) drawings included with these Contract Documents. The Contractor shall be allowed possession of the site in accordance with Section 7 of the Conditions of Contract and in a manner appropriate to his approved programme and method of working, and shall take account of any traffic, environmental or other working restrictions or requirements, as detailed in these Works Requirements. The Contractor must ensure that the Works are designed and constructed within the limit of these lands. The Contractor’s attention is drawn to the phased completion of the works and the requirements for the completion of each phase prior to the commencement of the next phase. 3.4 Landowners Detailed negotiations have been undertaken as part of the compulsory purchase order (CPO) process for the project. The landowners affected by this process have been consulted throughout the development of the scheme, with the detailed proposals often being the Page 22 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 subject of close scrutiny by the affected landowners. The Employer will provide a list of all the landowners who have been subject to the CPO process as well as any other landowner information that is known. It is the Contractor’s responsibility to assess this information and satisfy himself as to the accuracy of this information. The Contractor will be responsible for negotiating access and compensation to any lands specifically required as a result of his specific design or method of construction that is outside the CPO boundary. The Contractor shall play a proactive role in maintaining landowner liaison and as discussed in other areas of the Works Requirements the Contractor must appoint a Public Liaison Officer who will undertake this role specifically. The Contractor shall promptly inform the Employer’s Representative of any specific queries or concerns on the part of the landowners, land occupiers, or their agents. The Contractor shall negotiate access and working methods with the appropriate landowners and shall keep residents and tenants informed of the programme and implications. The Contractor’s attention is specifically drawn to the security of third party sites which shall not be compromised during, or as a result of, the Works. The Contractor shall note that no construction activities will be permitted until security fencing has been erected. The Contractor shall include the costs of all third party liaison works including negotiations for access and accommodation works in his tender. The Contractor shall take every precaution to ensure that his employees do not trespass or cause nuisance to any lands outside the site. Trespass of any kind will be regarded as a serious offence and may lead to a request by the Employer for the removal of the offending work-person from the Site. 3.5 3.5.1 Interfaces with Other Construction Contracts General It is expected that there will be other public construction contracts on site in the vicinity of the flood defences works during the same time period that these works are being undertaken. The Contractor is expected to liaise with the Contractors undertaking these works and develop accommodating methods of works so as to minimise insofar as possible disruption to either contract. Details of three other possible construction contracts are provided below but this is a non-exhaustive list and the Contractor may be required to accommodate other contracts. 3.5.2 Bray Shanganagh Pipelines and Stormtank It is proposed to construct two new pipelines under the bed of the river from Bray Pumping Station, adjacent to the DART Bridge in Bray Harbour, to connect to the new Bray Shanganagh Treatment Plant. Design drawings for these pipelines are included in Volume D of these Contract Documents. However the Contractor is expected to liaise with the both the designers and the Contractors for these works to ensure that the design of the flood defence works accounts for these pipelines. The Contractor is also expected to develop Page 23 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 accommodating methods of works so as to minimise insofar as possible disruption to either contract. The Employers Representative will provide the Contractor with the relevant contact details. In addition it is proposed to construct a new storm tank in the golf course lands. While the location of the proposed storm tank should not impact on the design or construction of the flood defence works the Contractor must familiarise himself with the scope of these works as his method statements and traffic management plans must accommodate the safe ingress and egress of construction traffic associated with these works. The Contractor is required to agree any traffic management arrangements with the contractor undertaking these works. Following the completion of the storm tank construction the Contractor must liaise with Dun Laoghaire Rathdown County Council (DLRCC) regarding access for operation and maintenance. The Contractor must comply with these requirements. Design drawings for these works are included in Volume D of these Contract Documents. The Employers Representative will provide the Contractor with the relevant contact details 3.5.3 Widening Works to Bray Bridge It is proposed to construct new pedestrian walkways on both sides of Bray Bridge to allow for removal of the current footpaths and the inclusion bus lanes in the roadway over Bray Bridge. The proposed design includes for abutments to be constructed adjacent to the current bridge abutments. Design drawings for these works are included in Volume D of these Contract Documents. The Contractor is expected to liaise with the both the designers and the Contractors for these works and develop accommodating methods of works so as to minimise insofar as possible disruption to either contract. The Employers Representative will provide the Contractor with the relevant contact details. This work is currently programmed to be on site between the two summer seasons available to the Flood Defence Contractor. Therefore the Flood Defence Contractor shall not programme for undertaking works in Area 2 or Area 2A outside of the summer season (May – September) or until after the second summer season (October to Contract end). 3.6 Third Party Agreements & Notifications The Contractor is required to liaise with all parties affected by the works prior to and during both the design and the construction period as detailed in these Works Requirements. The Contractor shall include the cost of all such liaison and all resultant requirements/agreements in his tender. The Contractor will be responsible for all the costs associated with securing the necessary permits required to undertake the works. The Contractor shall allow sufficient time in his programme to obtain such licences including requirements for public liaison and advertisement. The Contractor is responsible for compliance with any restrictions than may be imposed as part of the granting of any permit. All such costs will be borne by the Contractor. Page 24 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 The Contractor shall liaise with the following third parties prior to commencing the Works and to agree with these parties the methods of working and programme. This consultation process is mandatory. Consultations shall include, but are not limited to the following (Please note that this list is not exhaustive and does not relieve the Contractor from his statutory duties): Authority 1. Aquatic Ecology Inland Fisheries Ireland 12. Terrestrial Ecology National Parks & Wildlife Service 13. Archaeology National Monuments Service 14 Public Transport Dublin Bus, Iarnroid Eireann, Finnegan Buses, etc 3.7 Statutory Undertakers The locations of Statutory Undertakers apparatus have been illustratively shown on the drawings contained in these Contract Documents. These locations have been taken from the information supplied by the relevant Statutory Undertakers and have been indicated only where they are located within or adjacent to the working areas and may not be exhaustive. The Employer takes no responsibility for the accurateness of the information shown on these drawings. It is the Contractors responsibility to satisfy himself, by whatever means he deems necessary, as to the location and extent of such items and to account for such things in the design and construction of the works. It is the Contractor’s responsibility to identify if any Page 25 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 diversions are required for the works and to include in his tender all and any cost associated with such works. The programme for the works should also take account of the time period for such works. Page 26 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 SECTION 4 – RESTRICTIONS AND OBLIGATIONS 4.1 Phasing and Programme No in-stream works are permitted except from the 1st May to the 30th September or as agreed with Inland Fisheries Ireland. The Contractor shall not programme for undertaking works in Area 2 or Area 2A outside of the summer season (May – September) or until after the second summer season (October to Contract end). The Contractor must commence construction from the upstream end of the works and progress the works towards the downstream end. The Works are divided into five distinct areas and the Contractor must complete the works in one area insofar as is practical prior to commencing works in the next area. The extent to which the works must be completed prior to moving to the next area will be agreed on a case by case basis with the Employer’s Representative. However for the purposes of programming and cash flow the Contractor should assume that all works in one area must be complete prior to work commencing in the next area. Any assumptions made to the contrary are at the Contractors own risk. The programme shall be developed so as not to worsen the flood protection level of service at any location upstream or downstream of the Works. Excavation and widening works within the river channel shall be undertaken prior to construction of defences in any stretch of the river. 4.2 Notice of Construction Activities The Contractor is required to provide a minimum of six weeks notice of the date at which the Contractor intends to commence construction to all third parties affected by the works. However it is Contractors responsibility to research and comply with any statutory notification periods that may be required for the Works. In addition the Contractor shall comply with any restrictions regarding landowner notifications as required by the Employer 4.3 Working Hours Normal working hours shall be 0800 and 1800 Monday to Friday and 0800 and 1300 on Saturdays. No work shall be executed outside normal working hours, on Sundays or Public Holidays without the prior written acceptance of the Employer’s Representative. Such acceptance will be influenced by the time of sunset/sunrise, anticipated noise, odour and artificial light emissions from the Works, use of public roads and any other considerations that could cause disturbance to members of the public. However in relation to sections of the works which impact on traffic working hours where lane closures are not required are 7am to 7pm Monday to Friday and 7am to 1pm on Saturdays. Working hours where lane closures are required (Castle Street) are 8pm to 7am Monday to Thursday and 8pm Friday to 11am Saturday. However written approval for these works must Page 27 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 be obtained from the Employer’s Representative. This approval will be forthcoming provided that the Contractor can demonstrate that all relevant stakeholders have been informed and there are no outstanding objections to the works. The Contractor shall ensure that the issue of working hours is addressed in construction stage traffic management plan. 4.4 Site Limits The limts of Works Area availible to the Contractor for the construction of the works is outlined on the specimen drawings and the area of land secured under the CPO process is shown on the CPO drawings, both sets of drawings are contained in Appendix D of the Contract Documents. The Lands, Rights of Way and Wayleaves acquired for the Works will be handed over to the Contractor as soon as possible after the Instruction to Commence has been issued. If the Contractors design requires land outside of that shown on the CPO drawings and in the possession of the Employer, the Contractor will be fully responsible for all the costs associated with acquiring the land and as well as negotiating and agreeing such items with any affected landowners. Where the Contractor negotiates such agreements he must keep the Employer and Employer’s Representative up-to-date with proceedings and the details of such agreements. However neither the Employer nor Employer’s Representative will participate in the negotiation process. The Contractor will be responsible for putting in place any legal agreement for lands outside of the CPO which will contain permanent works, will be sterlised by the permanent works or will required for access for maintainence. However such agreements are subject to approval by the Employer. The Contractor must take account of any recommendations or otherwise made by the Employer in relation to such agreements. The Contractor is responsible for discharging all costs associated with such agreements. The Contractor shall ensure that the title of any lands acquired or easements agreed in this manner will be transferred to the Employer. The Contractor shall make his own arrangements with and make all payments to the owners and occupiers for the use of any additional land outside the limits of the easements and Working Areas, which he may require for the purpose of the Contract, including land for temporary storage of materials, topsoil dumps, site accommodation etc. The Employer’s Representative shall be notified of the details of any such arrangements made. The Contractor shall keep records of the dates of his entry onto and departure from all property and land of each owner and occupier, together with the dates of the erection and removal of all enclosures, and shall furnish copies of these records when required by the Employer’s Representative. He shall keep and furnish copies of similar records in respect of Page 28 Client: Project Title: Bray Town Council River Dargle Flood Defence Works roads, footpaths and thoroughfares. Date: October 2010 Project No: Y9114 The Contractor shall maintain photographic records taken before, during and after works are carried out within privately owned property. The Contractor will be deemed to have satisfied himself as to the conditions of access onto, across, and egress from the various Sites. Such arrangements are to be agreed at least two weeks in advance of that section of work commencing with the owner/ occupier of the land and no claim for extra payment arising out of any difficulties in this respect will be allowed. The Contractor shall maintain the access roads at all times to the satisfaction of the Employer’s Representative. Where the Works interfere with existing access routes, temporary accesses shall be provided across the working width at suitable locations agreed with owners/occupiers. The Contractor shall take every precaution to ensure that his employees do not trespass or cause nuisance to any lands outside the site. Trespass of any kind will be regarded as a serious offence and may lead to a request by the Employer for the removal of the offending work-person from the Site. The following Condition is deemed to be incorporated in the Contract: “The Contractor acknowledges and agrees that insofar as planning permission or other consents or permits may be required to be obtained by the Contractor in relation to his specific proposals for the carrying out and completion of the Works that the Contractor shall be responsible for obtaining, at his own cost, such permission, consents or permits. Further, the Contractor acknowledges and agrees that he shall not be entitled, notwithstanding any other provision of the Contract, to any extension of time for the completion of the Works or to any compensation or payment by reasons of any necessity to obtain or delay in obtaining any such planning or other consents or permits” 4.5 Flood Events The Contractor’s proposed methods of construction must take account of the Flood Management Plan that is currently active in Bray Town and is included in Volume D of the Contract Documents. To ensure flood protection is available the Contractor shall have procedures in place and agreed with the Employer before any works can take place. The procedures will ensure availability of critical personnel from the Contractor 24hrs a day and any day for the duration of the Works. The likelihood of a flood event occurring during construction is the same as in any other year. Although existing defences will be removed and replaced with new structures, the contractor must ensure that the risk of flooding is not increased during the works. This will impact upon the appointed contractor’s phasing of the works as areas of Bray Page 29 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 cannot be left undefended. If necessary the contractor will have emergency procedures in place to reinstate defences if required by the onset of a flood emergency. The contractor must ensure that all possible precautions are taken in the setting up of the site compounds so that the risk of materials or debris being washed away and causing damage during a flood event is minimised. Although the river is a spate river and as such little advance warning of flood events is possible, the contractor must monitor both long and short term weather forecasts so that machinery and personnel can be prevented from entering the river during times of high rainfall and high tide events. Monitoring of the flow in the upstream catchment may be used as an aid to predict high flow events. No machinery shall be left in the river overnight or outside of normal working hours. The Contractor shall not carry out any works which will lead to a deterioration of the flood defence standard without the prior acceptance of the Employer’s Representative. Such acceptance will only be granted in exceptional circumstances and only for short periods in controlled conditions. Any temporary lowering of the flood defence shall be capable of being reinstated by the Contractor within six hours of a flood warning. 4.6 Advanced Weather Warning System The Contractor is required to provide an Advanced Weather Warning System for the duration the Works. Such a system shall be designed to provide adequate response time to prepare for flash floods or similar adverse conditions that may pose health and safety risks to those carrying out these works, as well as risks to the working environs and to the public in general. This system may include subscriptions to meteorological services, a system to monitor the saturation levels of the upstream catchments and any other service(s) which may supply relevant predictive information with regard to the flows in the River Dargle. The Contractor is required to submit details of the proposed system to the Employer’s Representative for review prior to the commencement of the works. 4.7 Project Liaison Officer The Contractor shall employ a Project Liaison Officer (PLO) who shall be responsible for keeping the public informed on all aspects of the works. The PLO will be the sole point of contact for all landowners and no other member of the Contractor’s staff shall contact landowners regarding the Works unless specifically agreed with the landowner. The Employer’s Representative shall be informed of all landowner issues and discussions. The PLO shall be available at all reasonable times to respond to complaints and comments from members of the public and from public and private enterprises affected by the Works. The PLO shall also supervise and manage the following activities: Page 30 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Set up a project specific website, that will be linked to the Bray Town Council website, providing information on the proposed scheme including the proposed design/construction works, works progress, appropriate contact details and any other relevant information as agreed with the Employer’s Representative. Update the website and distribute leaflets on a monthly basis with information on the works that were completed in the previous month, works that are ongoing, works that will be undertaken in the coming months and traffic management arrangements. Provide up-to-date details on the website of traffic management arrangements on daily basis or as appropriate when the traffic management arrangements change. Provide traffic updates and information on disruptions to local radio/press as well as national associations such as AA Roadwatch on daily basis. Issue flyers informing the public of the existence of the website, providing a brief outline of the works and providing details of the PLO contact details (telephone and email) as well as details of the Employers Representative. Repeat this exercise at least every 3 months. Attendance at Client and/or Town Council Meetings as required by the Client for the during of the works. All public relations documentation, including updates to the proposed website must be agreed with the Employer’s Representative prior to publication. 4.8 Communications Plan The Contractor shall maintain a communication plan for each scheme with details of all planned and actual communications with third parties relating to the scheme. This shall be updated throughout the contract with significant changes highlighted in the progress reports. Any leaflets or information notices issued by the Contractor to members of the public shall be produced to the Employer’s standard format. 4.9 Prompt Attention to Complaints or Causes for Complaint The Contractor shall take immediate steps to eliminate the source or cause of an event that results in, or could result in, justifiable third party claims for compensation. The Employer’s Representative shall be fully informed of any such complaint and of actions taken to eliminate the cause of the complaint, or to mitigate the effects of the event. 4.10 Contract Notice Sign The Contractor is responsible for the supply, maintenance, erection and dismantling of 3 No. Public Information Boards and 3 No National Development Plan Boards for the entire duration of the works, which are to be generally located at locations to be agreed on site with the Employer’s Representative. The Public Information Boards shall be to an agreed detail, similar to the typical detail shown on Drawing No. Y9114-C-106. The text and logos on the signs shall Page 31 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 clearly visible / legible and the signs shall have a waterproof finish. These shall be erected prior to work commencing on site and dismantled upon completion of the works. The signs shall be stoved aluminium and be equipped with minimum of 2 rails, spaced to suit the gate post cross bars, to permit fixing of the signs to the gate posts using appropriate aluminium fasteners to provide a secure and vandal proof fixing detail. 4.11 Traffic Management The Contractor’s attention is drawn to the Design Stage Traffic Management Plan contained in Preliminary Health and Safety Plan in Volume D of the Contract Documents. It is the responsibility of the Contractor to fully develop this outlined plan in conjunction with all the relevant parties. The Contractor shall comply with recommendations made by the Local Authority on access routes, site access points, signage, highway cleaning, and making good any damage to the highway. The Contractor shall submit details of their proposals for traffic management and signing to the Employer’s Representative for their acceptance. The Contractor shall ensure that access is possible along all roadways and footpaths at all times, unless closure or disruption has been agreed in advance with the local authority and other parties affected by the closure. Where delivery of materials is from adjacent roads, the Contractor shall provide appropriate signs and traffic control in the form of stop/go boards or traffic lights around any vehicles temporarily parked on the roads. The Contractor shall not allow any vehicle, item of plant or similar to park on the public highway or verge whilst on business connected with the Works excepting for delivery of materials or within the defined working areas. 4.12 Temporary Fencing The Contractor shall be responsible for the provision of all temporary fencing and gates to the working areas, to ensure the protection of equipment, materials, operatives, as well as prevention of vandalism, public hazard and disturbance to adjacent land/ vegetation to be protected and retained. Temporary fencing and gates are to be agreed with landowners and shall also be sufficient to discharge the Contractor’s obligations under the Contract and Health and Safety legislation. Where existing or diverted footpaths pass alongside working areas, the Contractor shall ensure that the footpath is adequately fenced off from all traffic and construction activities. The Contractor shall provide all the necessary signs and barriers. The fencing in public areas shall comply with the recommendations for “Works On or Adjacent to Public Roads” or an equivalent standard. Suitable warning lights shall be erected at 25m intervals along the fencing in/adjacent to public access ways during the hours of darkness. These shall be maintained in proper working order to the entire satisfaction of the Employer’s Representative. Page 32 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Temporary fencing to all working areas of the site shall be provided and maintained under this contract. It shall be kept free of graffiti and bill posting. The fencing shall comply with current, best practice recommendations for works on or adjacent to public roads. In private land, the fencing shall be sufficient to prevent the access of livestock onto Working Areas and must be to the prior approval of the Employer’s Representative. Suitable warning lights shall be erected at 50m intervals, or where the Employer’s Representative deems necessary, along the protective barriers during the hours of darkness. These shall be maintained in proper working condition to the entire satisfaction of the Employer’s Representative. Temporary fencing and security gates around the site compound shall be erected and maintained for the duration of the contract and dismantled upon completion. Temporary tree protection measures shall be provided were necessary to prevent any damage to trees that are to remain under the final scheme. As a minimum the locations, extents and fencing specifications identified on the Specimen drawings and in section 5.7 of the EIS shall be implemented in advance of construction operations to the satisfaction of the Employer’s Representative. 4.13 Site Security The Contractor is responsible for the security of the site, including any plant, equipment, stores and offices. He shall include all such costs in his tender. 4.14 Progress Reports The Contractor shall prepare monthly progress reports for the Employer’s Representative. An electronic copy of each report shall be circulate to an agreed distribution list at least two days prior the monthly site progress meeting. The report shall be provided to a format agreed with the Employer’s Representative and shall include the following information: (i) Detailed reports of construction and design progress achieved (ii) Details of proposed work in the following month (iii) Details of drawings, designs and submissions to be submitted to the Employer’s Representative for acceptance in the following month (iv) An updated programme (v) An updated payment / expenditure profile and out-turn cost estimate (vi) Details of significant changes to the communications plan (vii) Updated risk registers. 4.15 Progress Photographs The Contractor shall provide a set of digital photographs on CD at monthly intervals to the Employer’s Representative. The positions and timing of the progress photographs shall clearly indicate daily progress at all active sites. The CD shall be given to the Employer’s Page 33 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Representative at the monthly progress meeting or at any other time as reasonably requested. Such photographs shall be deemed to be the property of the Employer (Bray Town Council). The cost of such photography and the compilation of photos onto CDs should be included in the Tender Total. The Contractor shall arrange for an independent, professional, photographer to photograph the progress of the work on a monthly basis. The number of photographs may be varied by the Employers Representative from month to month depending on the progress of the work, but shall average 50 No. digital colour prints to be submitted to the Employer’s Representative in any given month. The digital photos must be submitted in CD format and be clearly labelled and dated. 4.16 Project Team Workshops To facilitate close co-operation and communication between the Employer, the Employers Representative and the Contractor and key subcontractors/suppliers a number of workshops will be held, to be attended by key members of their staff. These will be in addition to attendance at meetings such as progress meetings and will not replace the requirement for acceptance of submissions by the Employer’s Representative. The Contractor shall include within their tender for attendance of key personnel from the Contractor’s staff, the Designer’s staff and key subcontractors/suppliers staff at workshops which shall include the following at a minimum: One Site Inspection One Detailed Design Development Workshop One Handover Workshop These workshops shall typically be of one day’s duration and shall be held at appropriate dates to be agreed with the Employer’s Representative. The Contractor shall include the cost of such workshops in his tender including the provision of appropriate facilities and refreshments. 4.17 Programme 4.17.1 General This clause describes the requirements for the preparation, submittal, update and revision of the Contractor’s programme. The requirements are in addition to or expand upon the requirements set out in Clauses 4.9 of the Conditions of Contract. Page 34 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 The Contractor’s programme shall be used by the Contractor to plan and execute the Works. The programme will also be used by the ER to monitor progress and be the basis for the assessment of extensions of time and the effect of delay on the progress of the Works. The programme shall be produced by the Contractor in the following phases: Initial Programme - An initial programme for the first three months of work Detailed Programme - A programme (incorporating the Initial Programme) for the totality of the Works, which shall be submitted to the ER for review. If the ER comments on it, this programme shall be revised and resubmitted for acceptance as set out in the Contract. Updated Programme - The Detailed Programme shall be updated with actual progress and saved at least a monthly basis for record purposes. The Contractor may submit for review by the ER other revisions to the Detailed or Updated programmes. No objection by the ER to any phase of the Contractor’s programme makes the programme a contract document, or mandates that the Works shall be constructed strictly in accordance with the programme. The Contractor at all times remains responsible for the construction of the Works. If at any time there is a dispute or difference between the Contractor and ER over any matter concerning the Contractor’s programme, then immediate steps should be taken by either party to have the dispute settled. 4.17.2 Submission of programme Within two weeks of the Contract Date, and before the Starting Date, the Contractor shall submit to the ER for its information an Initial Programme showing the order in which the Contractor proposes to carry out the works anticipated in the first three months following the award of the Contract. The Initial Programme shall have regard to the contract completion dates and any other milestones, and/or restraints set out in the Contract. Within four weeks of the Contract Date, the Contractor shall submit to the ER for its review a programme for the whole Contract (incorporating the Initial Programme) showing the order of procedure in which the Contractor proposes to carry out the Works. This Detailed Programme shall have regard to the contract completion dates and any other milestones, and/or restraints set out in the Contract. Thereafter, if the actual progress does not conform to the Detailed Programme, the ER is entitled to require the Contractor to submit to the ER for review a revised programme showing the order of procedure and periods necessary to ensure completion of the Works by the contract completion dates. The Contractor shall furnish Method Statements and such other details and information as the ER may reasonably require to review the Detailed Programme. Page 35 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 The Contractor shall supply the ER with an electronic copy of each programme, together with a print out bar chart or tabular report in a pre-agreed format. All programmes shall be prepared and submitted using Microsoft Project planning software. Within 10 working days of the Contractor submitting a programme complete with all the information required by this paragraph to the ER for review, the ER will comment on the programme. The Contractor shall take account of the comments and resubmit the programme within a period of 10 working days. If the ER does not comment on the programme within 15 working days, the ER shall be deemed to have no further comments on the Updated Programme. By agreement, the Contractor and the ER may dispense with printouts of the various forms of the Contractor’s programme, but under no circumstances may they dispense with the submission of the required electronic copies. 4.17.3 Default in submission of programmes In the event that the Contractor does not submit to the ER a programme for review in accordance with the information outlined above or does not regularly update the Detailed or Updated Programme within 15 days of a request from the ER, the Employer shall be entitled to withhold from the Contractor 15% of any payment to be made to the Contractor until a Detailed or Updated programme is revised and submitted. 4.17.4 Preparation of Programmes 4.17.4.1 The Initial Programme The Initial Programme shall show the first three months’ work in the same level of detail as is required for the Detailed Programme set out in paragraph 4.3 below, but only insofar as it applies to the first three months of the Contract Period. The Initial Programme shall also be presented as a programme in bar chart form showing the detailed activities in the period covered by the network diagram, together with the major activities and milestones in the remainder of the period of the Contract. The Initial Programme shall be presented as or be accompanied by the schedules referred to in paragraph 4.4 and, if necessary, paragraph 4.5 below. 4.17.4.2 The Detailed Programme The programme submitted by the Contractor in accordance with paragraph 2.2 above becomes the Detailed Programme for the purpose of monitoring the progress of the Works. The Detailed Programme shall form the Contractor’s basic strategy for the completion of the Works by the contract completion date. The programme may either be at the direction of the Page 36 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 ER in a linked bar chart format or precedence network format prepared using techniques acceptable to the ER and shall show as far as reasonably practicable: The activities in all work packages including those by the principal sub-contractors and suppliers, statutory undertakers, those contractors and suppliers directly employed by the Employer and others. The earliest and latest start and finish dates for every activity in each work package. Activities shall include all scope activities and any activities or time durations expected in addition to scope activities. Access dates for each phase or section. The earliest and latest start and finish dates for each phase or section, including dates when the Contractor plans to complete work to allow the Employer and others to do their work. Milestone and Key Dates. Holiday periods. Dates by which design work or drawings to be produced by the Contractor or subcontractors or suppliers will be submitted to the ER for review and dates by which comments on such design work or drawings will be required by the Contractor, allowing time for submittals, re-submittals and reviews. Dates by which samples to be produced by the Contractor will be submitted for approval by the ER and dates by which approval of such samples will be required by the Contractor, allowing time for submittals, re-submittals and reviews. Procurement periods and delivery dates for the major items of goods, plant and materials. Dates by which work will be ready for testing by the ER/Employer. Details and dates of any information required from the Employer. Provisions for float, time risk allowances, quality control procedures, health and safety requirements. Provision of a contingency for delays to the Date of Substantial Completion of the Works caused by Compensation Events in accordance with Clause 9.4 of the Conditions of Contract The Detailed Programme shall also be presented as schedules showing an analysis of the network including: A schedule of all activities tabulated in order of earliest starting date and showing for each activity: Activity number and brief description; Preceding and succeeding activity numbers; Duration; Earliest and latest starting and finishing dates; Total and Free float. Page 37 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 A schedule of leads and lags with (if requested by the ER/Employer) reasons for them. Excessive leads and lags, negative lags or open/hanging activities, use of fixed dates and any other programming activities that can have the effect of creating false criticality or inhibiting the programme from reacting dynamically to change should be avoided. A schedule of all activities lying on the paths containing the least float, namely the critical activities. A schedule identifying the days of working per week, shifts per working day and holidays. Where multiple calendars are used, this information shall be provided for each of the calendars, accompanied by a schedule indicating the calendar applicable to each activity. A schedule giving details of the Contractor’s resource requirements in terms of manpower, gang sizes, tradesmen, work rates, items of plant or equipment and materials and quantities of work allowed for in sufficient detail to explain the Contractor’s activity durations. Activities that may be the Contractor’s activity durations. Activities that may be expedited by use of overtime, additional shifts or any other means shall be identified and explained. The Detailed Programme shall also be presented with or be accompanied by the following schedules: A schedule of all submittals and material procurement activities, including time for submittals, re-submittals and reviews and time for fabrication and delivery of manufactured products. The interdependence of procurement and construction activities shall be included in the schedule. A schedule giving the monetary value of each activity for cash flow purposes. The sum of the monetary values shall total the Contract amount. The schedule shall also give the payment items applicable to the activity monetary values. A schedule giving the information stated in the paragraph below. The Detailed Programme shall be prepared in sufficient detail to ensure the adequate planning, execution and monitoring of the work. Activities should generally range in duration up to 28 calendar days (single trade activities with uniform rates of progress might be considered as an exception) and the number of activities with duration of less than seven calendar days should be kept to a minimum to make progress monitoring more manageable. The Detailed Programme shall take into account all time risk allowances, including time for the weather conditions (rain, wind, frost and snow) reasonably to be anticipated by the Contractor. The Contract time has been defined on the assumption that the weather conditions will conform to at least a 10 year average of the conditions prevailing at the Site. Page 38 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 The Contractor shall provide this data and a summation of the assumed number of adverse weather days per month to the CA with the programme. 4.17.4.3 Methods of Construction and Temporary Works At the same time as the Contractor submits the Detailed Programme, the Contractor shall submit to the ER for its review a general description of the arrangements and methods of construction and Temporary Works designs the Contractor proposes to adopt for the carrying out of the Works (‘the Method Statement’). The Method Statement should be fully crossreferenced to the activities in the programme. The Contractor shall submit to the ER sufficient information as may be considered reasonably necessary by the ER to interpret, evaluate and undertake a purposeful review the Method Statement. The Contractor shall, whenever required by the ER, furnish for its information further and more detailed particulars of the Contractor’s Method Statement. Should the Contractor wish to change a Method Statement or should the ER subsequently object to a Method Statement then the Contractor shall submit a revised Method Statement to the ER for its review. No objection by the ER to the Contractor’s Method Statement does not make the Method Statement a contract document, or mandate that the Works shall be constructed strictly in accordance with the Method Statement. The Contractor at all times remains responsible for the construction of the Works in accordance with the Contract or the Works Requirements or Legal Requirements. 4.17.4.4 Cash flow estimates Within four weeks of the Contract Date the Contractor shall submit to the ER for its information a detailed cash flow estimate, in quarterly periods, of all payments to which the Contractor considers it will be entitled to under the Contract. The Contractor shall subsequently submit such revised cash flow estimates at quarterly intervals based on the Updated Programme, if required by the ER. 4.17.4.5 Revising and updating the programmes The Detailed Programme The Detailed Programme (or, if the Detailed Programme has already been updated, the Updated Programme) and the corresponding Method Statement if required by the ER shall be revised by the Contractor within 10 working days of the Contractor changing its methods and/or sequences of working or, if the changes are frequent, revised at least every month. The programme shall also be revised within 10 working days of the grant by the ER of an extension of time, or whenever circumstances arise that in the opinion of the ER affect the progress of the Works. Each revision to the programme shall be submitted to the ER for its Page 39 Client: Project Title: review. Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Each revised programme submitted for review shall be presented as or be accompanied by the Schedules referred to in the sections above, together with any amendments to the Method Statement. The Updated Programme The Detailed Programme shall be updated for actual progress at least once every month and the updates shall be archived as separate electronic files for record purposes. The updates shall include all scope activities and any additional activities carried out or time durations experienced in addition to the scope activities. Actual progress shall be recorded by means of actual start and actual finish dates for activities, together with percentage completion and/or remaining duration of currently incomplete activities. Any periods of suspension of an activity should be noted in the Updated Programme. Each Updated Programme shall be submitted to the ER for his review as a record. It is possible (if the Works have been delayed) that these Updated Programmes will show completion later than the contract completion dates. In this event the ER’s review of such programmes will not constitute acceptance of the delay(s). The Updated Programmes will be used by the ER to monitor the Contractor’s performance against the Detailed Programme, forecast work to be performed in the subsequent period and to assess extensions of time at the time the cause of delay occurs. In order to provide effective monitoring of performance, the Contractor shall also provide to the ER the progress reports as described and the cash flow estimates described above. The final Updated Programme may be used as the as-built Programme. Page 40 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 SECTION 5 – DRAWINGS AND REPORTS 5.1 Environmental Impact Statement & Approval A full copy of the Environmental Impact Statement is contained in Volume D of the Contract Documents. The scheme approval received from An Bord Pleanála based on this EIS is contained in Volume D of the Contract Documents. 5.2 Specimen Drawings The specimen drawings provided are those drawings submitted to the An Bord Pleanála as part of the EIS process and additional drawings amending or adding the information presented in the original O’Connor Sutton Cronin drawings. The drawings show the indicative design, the works boundary, the tree protection measures and other key plans. A full set of the drawings is provided in softcopy in Volume D of the Contract Documents, both in PDF and AutoCAD format. These are provided for information only and responsibility for the design rests with the Contractor. 5.3 CPO Drawings A full digital set of the drawings is provided in Volume D of the Contract Documents. 5.4 Reports 5.4.1 Physical Model Report In 2008 HR Wallingford Ltd undertook a hydraulic model study to assess the effects of the proposed flood relief scheme on flood water levels. The report contains results of the tests carried out to predict the effect of the flood defence and flood alleviation measures on peak flood water levels. The report is contained in Volume D of the Contract Documents. 5.4.2 Site Investigation Reports Four number site Investigation reports are included in Volume D of the Contract Documents. These reports relate to four different site investigation contracts that were undertaken at various times with the limits of the proposed works. These are provided to the Contractor without warranty. The reports are as follows: IGSL Report, River Flood Defence Works, October 2010 Byrne Looby Report, River Dargle Flood Study Phase 2, November 2009. IGSL Report, Dargle Bridge, August 1999. JBBarry/IGSL Report, River Dargle Flood Protection Contract 1, May 1989. The position of the boreholes and trial holes are shown in the Site Investigation Factual Reports. The results of the site investigations, including borehole logs, trial pit logs, slit trench logs, grading analysis, and the results of all testing, are contained in the Site Investigation Factual Reports. Details on the location of some services are also provided. Page 41 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 The results in the Site Investigation Factual Reports are given for the information of the Contractor. The Contractor is to draw his own conclusions and interpretation from the reports provided. 5.4.3 Invasive Species Report Natura Environmental Consultants undertook an exercise in 2010 to map the current locations of the various invasive species along the length of the works. This report is contained in Volume D of the Contract Documents. This document is provided to the Contractor without warranty. 5.4.4 Preliminary Hydrogeological Assessment A preliminary study of the effects of the works on the hydrogeology of the area has been undertaken. This is included in Volume D of the Contract Documents and the Contractor should be aware of the recommendations of this report and account for them in his design. The Contractor is required to undertake a detailed Hydrogeological Assessment based on his design and the impact it will have on the ground movement in the area. Page 42 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 SECTION 6 – PERFORMANCE SPECIFICATION 6.1 General The Contractor is required to construct the works in accordance with the restrictions as set out in the EIS. The Contractor is responsible for the detailed design of the works but should note that material contraventions of the EIS must be submitted for approval to the local planning authority. The local planning authority does not guarantee that any such contraventions or amendments to the existing planning will be approved. It is the Contractor’s responsibility to reference all materials provided with the Contract Documents and to establish a full and comprehensive list of all restrictions. The Contractor’s attention is specifically drawn to the Environmental Impact Statement (EIS), the EIS Approval from An Bord Pleanala (ABP), the Planning and Wayleave documents, the Works Requirements and all other relevant reports, studies and information provided in the Contract Documents. In addition the Contractor must also comply will all current legislation and building regulations. 6.2 Planning Permissions and Other Consents, Permits The following Condition is deemed to be incorporated in the Contract: “The Contractor acknowledges and agrees that insofar as planning permission or other consents or permits may be required to be obtained by the Contractor in relation to his specific proposals for the carrying out and completion of the Works that the Contractor shall be responsible for obtaining, at his own cost, such permission, consents or permits. Further, the Contractor acknowledges and agrees that he shall not be entitled, notwithstanding any other provision of the Contract, to any extension of time for the completion of the Works or to any compensation or payment by reasons of any necessity to obtain or delay in obtaining any such planning or other consents or permits” Page 43 Client: Project Title: 6.3 Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Hydraulic Performance Parameters 6.3.1 General Detailed Hydraulic Modelling has been undertaken for the flood defence scheme. The results of this work are contained in Volume D primarily in the report entitled “River Dargle at Bray, Ireland – Flood Defence Scheme: Physical Model Study, Report Ex 5956, Release 5.0, March 2009, HR Wallingford”. The specimen design drawings also include some information on the required flood defence levels as does the Environmental Impact Statement. However the Contractor must satisfy himself as to the accuracy of the information contained in any of the documentation that forms part of the Contract. The Physical Model Study examined several scenarios, the outline performance specification is given below but the Contractor must review all the information provided and ensure that the hydraulic design of the scheme is in compliance with all recommendations made in the provided literature. In addition the hydraulic design shall be in accordance will all relevant industry standards. 6.3.2 Design Flood Return Period As the River Dargle is tidally influenced at Bray, the following Joint Probability has been adopted as the design Return Period (RP) 200 year RP tide (3.50m OD) and 1 year RP fluvial flood (145 m 3/s) 100 year RP fluvial flood (i.e., 300 m3/s) and MHWS (Mean High Water Spring of 1.59m OD) tide 6.3.3 Design Water Levels and Velocities The Physical Model was simulated for various scenarios of flood alleviations measures. For example, Simulation 1 was for the existing condition whereas Simulation 10 for the Optimised Flood Defence Scheme. Water surface levels at design flood at various locations along the river are presented in Table 82 and 85 of the Physical Model Study whereas flow velocities are presented in Tables 87 and 90 respectively. 6.3.4 Design Considerations The above report does not recommend for any specific design parameter, except some issues mentioned in Appendix O of the Physical Model Study (see below). Therefore, the design parameters are generally those based on best practice and used in Ireland for civil engineering works. Appendix O of the Report has listed the following issues those have to be considered while designing the scheme: High discharge river flows arrive at the site rapidly High flow velocities and depths associated with river flood discharges Page 44 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 High flow velocities through harbour entrance associated with high discharge river flows Importance of maintaining re-graded/re-aligned channel profile in order to improve standard of flood defence Importance of maintaining flood walls / embankments in order to improve standard of flood defence Provision for safe construction and maintenance of debris trap Implication of local scour at the piers/abutments of Bray Bridge for the structural integrity of the bridge Provision for safe operation and maintenance of trash /security screen at entrance to flood relief channel Provision of ventilation for flood relief channel Maintenance, in clean and working order, of pipes/slots in flood relief channel Maintenance, in clean and working order, of the non-return valves in the pipes in the flood relief channel 6.3.5 Freeboard The Required Flood Defence Level shown on the Specimen drawings includes an allowance for freeboard, equal to 500 mm upstream of Bray Bridge, where fluvial influences dominate, and 760 mm downstream of Bray Bridge, where tidal influences dominate. Any steps in the defence crest level shall maintain this minimum freeboard above the Design Flood Water Level shown on the Specimen drawings. 6.3.6 Transition Structures The Contractor shall design and provide suitable transition structures between adjacent flood defence components. Transition structures shall be designed to maintain the integrity of the flood defence both in terms of the crest level and in the prevention of seepage flows. 6.3.7 Erosion Protection Where erosion protection is needed, either in areas as shown on the Specimen drawings or as determined through the detailed design by the contractor it shall be suitable for the design life of the defences and the appearance sympathetic to the location. Erosion protection shall be designed so that it ties into the upstream and downstream alignment without causing local points of erosion at the interface. 6.3.8 Low flow channels Important characteristics for good salmonoid habitat are 140mm ≤ water depth ≤ 280mm, 0.22m/s ≤ flow velocity ≤ 0.38 m/s. This should be considered in the design and construction of the low flow channels. However the Contractor is responsible for agreeing such design parameters with Inland Fisheries Ireland. Page 45 Client: Project Title: 6.3.9 Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Drainage The defences shall not detrimentally affect the hydraulic performance or structural integrity of any existing surface water, foul water or combined drainage systems at any river level up to the crest level of the defences. A number of outfalls exist along the length of the flood defence scheme. Every effort has been made to record these services and to illustrate them on the site survey drawings. However it is the Contractors responsibility to satisfy himself as to the accuracy and completeness of this information. All existing outfalls shall be incorporated in the Contractor’s design flood defences. The Contractor shall make all the necessary provisions to ensure that existing surface and foul water drainage arrangements are not impeded by the presence of the defences in flood or non-flood states. The planning approval for the works granted by An Bord Pleanála contains a condition that an examination of the potential groundwater movements be undertaken as part of the detailed design. The Contractor must undertake this work as part of the detailed design and ensure that the works do not detrimentally alter current drainage regimes. Any such effect must be rectified as appropriate. The Contractor should take note of the Hydrogeological Assessment Report contained in Volume D and the considerations for design outlined therein. In the event of the new defences being overtopped by flood-water during a flood and when river levels begin to subside, there will be a need to release trapped flood water from the land side of the defences. The Contractor shall make allowances in his design for such an occurrence along the whole length of the works. Particular reference is made to the centre of Bray, the removal of a wall adjacent to Castle Street Shopping Centre and the construction of bollards. Furthermore surface water flows from Dwyer Park through the Golf Club Lands shall be intercepted by the Emergency Flood Relief Channel as shown on the specimen drawings. This will discharge into the River Dargle upstream of the Harbour Bridge. All proposed outfalls shall include a non-return valve on the outlet into the river. Futhermore the Contrators design shall take account of surface water run-off paths which currently drain freely to the River Dargle. The final design shall make provision for the transfer of such flows to the river to prevent properties/land becoming saturated behind the proposed flood defences. All non-return valves shall be duckbill or tideflex valves. Any non-return valves and associated structures which pass through the flood defences shall be designed to accommodate design water level and all other relevant dead and imposed loadings, including impact from floating debris. Consideration shall be given to future access to non-return valves for maintenance and inspection. Where appropriate, non-return valves shall be positioned to allow safe access for maintenance purposes. Proposals for future access to non return valves shall be included in the Contractor’s design. Page 46 Client: Project Title: 6.4 6.4.1 Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Structural Performance Parameters Design Working Life The required design life for all structures shall be 100 years. The design life for cladding shall be a minimum of 50 years. Furthermore the design life of the boardwalk and all of its components is to be a minimum of 50 years. The Contractor will be required to demonstrate that the design life has been satisfied. 6.4.2 Standard of Defence The defences shall prevent the ingress of flood water from the River Dargle and relevant sections of tributaries through any pipes, ducts, culverts, permeable ground or around the defences. This shall also apply to the location where the proposed defences link in with existing defences. Connection details must be considered and submitted for each of these locations. 6.4.3 Water loading All structures and embankments shall be designed to resist flood water at crest level for a 12 hour period and to remain stable when overtopped to a depth of 100mm. Walls adjoining public roads should also be designed to withstand vehicle impact loading, in accordance with IS EN 1991-2, IS EN 1991-1-7 and NRA / DMRB TD 19/09. Structures must be stable in a post flood rapid drawdown condition, that is with the river returned to normal levels and landward groundwater level is at the surface. Walls protruding above ground level must resist wind loading in accordance with IS-EN-1991-1-4 General Actions – Wind Actions. Flood defence walls must be designed to resist the possibility of future soil creep and not be susceptible to damage from tree roots. 6.4.4 Seepage Steel sheet pile seepage cut-off walls or similar shall be provided as necessary. They shall be installed to sufficient depth to prevent seepage. The Contractor shall provide design calculations to demonstrate this. 6.4.5 Existing Defences Existing structures may be retained if the Contractor can demonstrate that they have sufficient residual life. The Contractor shall confirm the structural condition of any existing element which will form any part of the flood defences. The stability of the Works under loaded conditions shall not rely on the unknown strength or stability of the existing defences. Where appropriate the Contractor shall undertake necessary investigations, design work, modifications and strengthening works to the existing structures to ensure they meet the design requirements and asset life for the scheme. Where the existing defences are left in place then they shall be in a safe and stable condition and finished to an acceptable appearance. The defences shall not detrimentally affect the stability of existing tidal Page 47 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 defences, fluvial defences, river banks and adjacent or connecting structures. The Contractor must ensure the structural stability of the existing structures is maintained at all times both under design loading and during construction works. The Contractor must demonstrate this to satisfaction of the Employer’s Representative prior to undertaking any works in the vicinity of existing defences. Where works involves excavation next to, underpinning of, sheet piling or work associated with existing walls, gabions, bridge piers, bridge abutments or other similar structures the Contractor shall submit a method statement specifically addressing how the protection of the existing walls or structures etc are to be undertaken. Any damage which does occur will be repaired at the Contractor’s own cost. Existing walls and structures within the vicinity of any proposed excavation works must be assumed to require underpinning until proven otherwise to the satisfaction of the Employer’s Representative. 6.4.6 Foundations Foundation levels of new walls along the river at or below bed level shall be constructed such that the bottom of the foundation will note be subject to scour taking into account the regraded level for the river. Regraded levels are taken as linearly interpolated between known hard points. These hard points are currently derived from the existing survey data; the Contractor shall verify the accuracy of this information and confirm the suitability of the re-grade lines that are derived from it. 6.4.7 Corrosion The Contractors attention is drawn to the fact that the flood defence walls must be designed to withstand the environmental actions which they will be subject to. All materials must be designed to withstand a saline environment, river environment and chemical attack from constituents of the soil. The corrosion resistance of the materials must take into account a 100 year design working life each element of the structure. 6.4.8 Cladding to Walls Cladding shall be suitably robust to withstand all reasonably foreseeable loadings including hydrostatic loading from flood waters and impact from floating debris. Cladding shall be suitably attached to the proposed defence wall using a suitable fixing system and spacing necessary to withstand the anticipated loading and to meet the required design life of the defences. Where stone cladding is required consideration shall be given in the design to filling any voids between the cladding and the structural element (sheet pile, concrete wall etc) or other means to prevent movement of the cladding under hydrostatic pressure. Where timber or similar cladding is required consideration shall be given in the design to the cavity between the cladding and the structural element (sheet pile, concrete wall etc). The cavity Page 48 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 must be designed in such a way as to prevent debris lodging in it and also to prevent corrosion from moisture and stagnant water. The fixings shall be designed and specified so that staining or discolouring of the cladding does not occur in the future as a result of any weathering or degradation of fixings. All connections (bolts, washers etc) must be designed to withstand corrosion from the environment and be compatible with the protection system used on the main steel and cladding elements. 6.4.9 Boardwalk The new pedestrian walkway along Dargle Road shall be designed to cantilever off the new defence wall on the river side of the defence. Drawing B237-165 of the specimen drawings provides an outline graphical representation of the expected aesthetic finish of the boardwalk. Further details of the proposed finish are provided under the Architectural Performance Specification. The walkway shall be tied into the existing ground level at People’s Park and at Bray Bridge. The required flood defence wall level shall not be compromised by the boardwalk at the point where the boardwalk passes over the defence to the dry side. The wall supporting the boardwalk must be designed as a flood defence wall which will also support the dead load of the cantilevered boardwalk and all imposed loads (variable actions) as stated in IS EN 1991 – 1 on the cantilevered boardwalk. The boardwalk must be designed to support imposed loads (variable actions) as per category “C5” Table 6.1 IS EN 1991 – 1 – 1, in conjunction with IS EN 1991 – 1 – 3 Snow Actions & 1991 – 1 – 4 Wind Actions and all other relevant sections of IS EN 1991 – 1, including load model 4 (crowd loading at 5KN/m 2). The design should take account of additional load factors including thermal effects, accidental damage, loading from rising flood waters and moving flood waters underneath, impact from floating debris during flood conditions, submersion in flood water. The design of the walkway shall take account of access and surfacing shall be suitable for wheelchairs as well as pedestrian traffic. The minimum width of decking shall be 2.5m. 6.4.10 Culvert The proposed culverts must be designed in accordance with IS EN 1991-2 Traffic Loads on bridges, IS EN 1992-2 design of concrete structures – bridges and IS EN 1993-5 Design of steel structures – Piling. 6.4.11 Embankment Design Newly formed embankments and re-profiled embankments to suit the proposed cross section profile are to be designed with suitable stability measures to protect the embankment against erosion or deformation. These measures may include earth reinforcement and or scour protection mats or similar. Embankments shall have maximum side slopes of 1 in 2 unless Page 49 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 otherwise shown on the specimen drawings. The Contractor shall provide erosion protection to exposed sections of embankment as indicated on the Specimen drawings where fluvial flows or anticipated traffic dictates. Sufficient impermeable layers and filter layers must be incorporated in to the embankment design so as to prevent erosion of the slopes. The Contractor will be responsible for obtaining a source of material for the flood defence embankment fill. All material and methods used shall comply with the relevant sections of Series 600: Earthworks of the NRA specification for Roadworks, in particular table 6-1 and appendix 1-5. 6.4.12 Debris Trap The proposed debris trap in Area 4 shall at a minimum consist of elliptical concrete piers dimensions 1.65m by 0.5m maximum width; the top of the pier shall to terminate 300 mm above design flood level. The piers should form a gentle arc across the river channels with a maximum clear opening between each pier and river bank of 4000 mm. The foundations of the piers should be designed to withstand hydrostatic and debris loading from a differential water level across the debris trap of 1500 mm. Bottom of pier foundations will not be subject to scour taking into account the regraded level for the river. Finish of the pier is to be fair faced concrete. The debris trap will be accessed and cleaned by in river vehicles from the upstream side. Exact positioning of the debris trap piers is to be detailed on detailed construction drawings and agreed with the employer’s representative before construction. 6.4.13 Railings and Handrails Railings/Handrails are required at locations where there is a risk to members of the public from unprotected edges of the flood defences or in accordance with the relevant health and safety requirements. All railings and handrails which are not in the vicinity of traffic and are not required to act as a crash barrier must be designed to resist horizontal loads in accordance with category C5 of IS EN 1991-1-1 Table NA.5. The railings / handrails and all of the connections must be designed to resist external conditions close to a marine environment. Page 50 Client: Project Title: 6.5 6.5.1 Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Architectural Performance Parameters General The Contractor’s attention is drawn to the finishes stipulated in the EIS and on the specimen drawings. The Contractor shall submit details and samples of all proposed finishes to the Employer’s Representative and the Planning Authority prior to the commencement of works. The planning authority will have the right to reject any proposed material or finish it does not deem in keeping with the local environment. The Contractor should be aware that the River Dargle is a saline environment, subject to varying water levels. All works, including finishes and fixings, shall be designed to resist the deleterious effects of such an environment. The design life for cladding, the boardwalk and all the components both systems shall be a minimum of 50 years. The Contractor will be required to demonstrate that the design life has been satisfied. The Contractor shall note that where cladding or other finishes are shown on the specimen drawings, detailed in the EIS or specified elsewhere in the Contract Documents these finishes shall be provided to both the land side and the river side of the proposed flood defence structure. 6.5.2 Stone Cladding The stone cladding shall be of Wicklow Granite or other natural stone of similar colour to the existing environment. All stone shall be derived from the same quarry to ensure that it is of consistent colour and texture. Samples of all proposed finishes shall be provided to the Employer’s Representative and the Planning Authority prior to the commencement of works. The planning authority will have the right to reject any proposed material or finish it does not deem in keeping with the local environment. 6.5.3 Timber/Timber Type Cladding The timber/timber type cladding shall be designed to blend with the receiving environment as far as possible and reduce the overall visual impact of the scheme. Samples of all proposed finishes shall be provided to the Employer’s Representative and the Planning Authority prior to the commencement of works. The planning authority will have the right to reject any proposed material or finish it does not deem in keeping with the local environment. 6.5.4 Boardwalk The boardwalk shall be of good contemporary design and in keeping with the natural setting; the design should allow good visual access to the river for users. The boardwalk is located in a saline environment and the proposed materials will account for this. All metallic elements, including mechanical fixings, are to be manufactured from stainless steel. All connections (bolts, washers etc) must be designed to withstand corrosion from the saline environment and be compatible with the main steel and timber elements. The walking surface of the boardwalk Page 51 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 must be non-slip surface and be sufficiently durable to cater for foot traffic. The walking surface shall be manufactured to meet the required design life. The decking shall be non– structural and will be able to be replaced from walkway level without removal of the handrail or need for access from below or from the river. Any materials to be used in the construction of the boardwalk must be resistant to spray from the river water which may contain chlorides. 6.5.5 Roads and Footpaths Paving materials shall be designed sensitively to visually integrate with the location. They should utilise typically used local materials and detailing, and where appropriate matching paving as necessary to tie in to existing footpaths and surfacing, particularly where reinstatements are required. Sections of new footpath or surfacing should be designed with finishes and detailing appropriate to the setting and context following consultation with all interested parties. 6.5.6 Railings and Handrails The railings and handrails shall be of good contemporary design and in keeping with the natural setting; the design should allow good visual access to the river for users. The proposed materials will account for the saline environment and must be resistant to spray from the river water which may contain chlorides. Samples shall be provided to the Employer Representative and the Planning Authority for approval prior to the commencement of works. The planning authority will have the right to reject any proposed material or finish it does not deem in keeping with the local environment. Page 52 Client: Project Title: 6.6 Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Ecological Performance Parameters 6.6.1 General An Environmental Impact Statements (EIS) under SI 1217 or SI 1199 has been prepared for these Works. The effects and requirements (known and anticipated) of the EIS shall be incorporated in the design, procurement, delivery, construction and testing of the Works. The EIS is a legally binding document. The Contractor shall control their work in accordance with the EIS. Natura Environmental Consultants undertook an exercise in 2010 to map the current locations of the various invasive species along the length of the works. This report is contained in Volume D of the Contract Documents. Further surveys regarding the habitat locations of kingfishers, otters and rare plant may be undertaken by the Client during the appropriate timeframe prior to contract award. These surveys are recommended as part of the EIS to provided further clarity on known restrictions and if undertaken they will be furnished to the Contractor prior to the commencement of the works as further information to that already provided in the EIS. The Contractor must comply with the restrictions of the EIS. 6.6.2 Contractor’s Ecologist The Contractor is required to employ a suitably qualified Ecologist who will assist the Contractor in ensuring the Works are carried out with minimal environmental impact and in accordance with the EIS. The Contractor’s Ecologist will be responsible for reviewing the ecology studies already undertaken and satisfying himself to the adequacy of these studies and the recommendations thereof. The Contractor’s Ecologist will be responsible for liaison with the National Parks and Wildlife Service, Inland Fisheries Ireland and all other relevant bodies as well as securing all required permits and licences to undertake the works. A full programme for ecological works shall be submitted to the Employer’s Representative prior to the commencement of any works. This programme will demonstrate how the ecological works are scheduled in conjunction with the construction works and shall make allowances for any delays that may be incurred due to these works. The Contractor shall allow in their prices for any disruption as a result of any such delays. The role of the Contractor’s Ecologist will include but is not limited to the following: Liaison with National Parks and Wildlife Service, Inland Fisheries Ireland and any other relevant party, Undertaking all and any required surveys pre, post or during construction Providing the Employer’s Representative with progress reports on environmental matters Inspecting and assessing the working areas and access routes with regards to environmental impact Identifying, implementing, and documenting mitigation and enhancements Page 53 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Producing a report at design stage on the Contractor’s proposed design detailing the impacts of the propose design and construction, mitigation measures to be undertaken and detailing the long-term impacts of the proposed design. Producing a report on completion the scheme and on completion of the Contract outlining the environmental issues and actions Overseeing the re-creation of appropriate habitats on the works and working areas Ensuring appropriate and sufficient environmental scientists are involved in a timely manner in the design development and delivery phases of the Contract Producing a schedule for environmental performance monitoring following the completion of the scheme to comply with the requirement of the EIS and the planning approval. 6.6.3 Invasive Species The Contractor shall assume that invasive weeds will be present at the majority of the sites where significant earth moving is proposed. The Contractor shall make due allowance for this contamination in the relocation of arisings from earth moving activities, either within the scheme proposals or for their disposal off site, to ensure all work is undertaken according to legislative requirements that there is no further spread or proliferation of invasive weeds. Invasive weed species including Japanese Knotweed and Giant Hogweed are present on the Site. The Contractor shall ensure that all locations affected by these species are located and recorded prior to any works commencing on site to establish the requirement for the implementation of suitable methods of working to deal with the species identified. All method statements to be approved by the Employer’s Representative in advance of the Works commencing. The Contractor shall ensure that operations in areas where these species are present, as a minimum, follow the guidelines as provided by the Environment Agency to prevent the spread or proliferation of these species. Where these plants are to be removed as part of the Works the plants and contaminated soil shall be handled and disposed of off site to the Environment Protection Agency guidelines. Giant Hogweed poses a health and safety risk and the Contractor shall ensure that workers are fully briefed to take the necessary safety precautions before working in areas affected by this species with suitable PPE. Where invasive plants have been removed from soft landscape areas the reinstatement of those areas shall include the backfilling of the excavation with suitable grade subsoil and topsoil to match existing profiles; and immediate planting and establishment of native planting to provide ground cover and prevent re-colonisation of invasive species. Where native planting is inappropriate to the location (such as amenity parkland areas or third party property) the Contractor shall submit alternative planting proposals for approval by the Employer’s Representative. 6.6.4 Ecological Constraints on Construction Activities Page 54 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 The Works are located in an environmentally sensitive area. Constraints and requirements highlighted by the EIS with respect to the design and construction of the scheme are covered by the planning permission and conditions attached. The Contractor shall take measures to limit and mitigate for any environmental impacts, at a minimum these measures are those detailed in the EIS. The Contractor shall study and implement these measures, major elements of which at the construction stage are: Further consideration of the potential for disturbance to contaminated land Hold documented meetings with interested parties Carry out walkover surveys of each site prior to commencement of works to identify presence of any protected species and fence off any vulnerable areas. Incorporate environmental enhancements into the Works Undertake environmental awareness training for site personnel 6.6.5 Faunal Surveying and Works Areas that might be affected by construction activities will include access routes for construction traffic, areas for storage of excavated materials, site materials storage areas, site depots etc. These have not been detailed in present proposals for the various flood relief scheme options, and will require faunal surveying at a later stage. Prior to any works commencing, a pre-construction survey for otter holts shall be conducted by the Contractors Ecologist at appropriate season (winter). If a holt(s) is found, appropriate mitigation will be required, which may include the construction of artificial holts to replace loss of natural holts. Such work would be carried out under licence from the National Parks & Wildlife Service. 6.6.6 Badgers, Otters and Bats Preconstruction badger survey shall be conducted in winter. Should a badger sett be found where disturbance will occur, appropriate mitigation measures will be necessary. Preconstruction survey for otter holts shall be conducted in winter and mitigation measures taken as appropriate. Otter ledges to be included in revised bridge structure, allow otters access by means of inclines downwards to the river at each end, on southern side of culvert. Expert advice should be sought where culverts are proposed for tributary streams. The Contractor shall make due allowance for the carrying out of a detailed bat survey by a fully approved bat specialist, prior to the commencement of construction works, at older buildings, structures and trees in the vicinity of scheme proposals. The Contractor shall programme their works to take account of the findings of that survey and the seasonal constraints, which the presence of bats would bring about. The Contractor shall make provision for further bat mitigation measures, which may include the installation of artificial bat roosts, as part of the Works. Mature or ivy-covered trees that require felling will be felled under supervision of a bat specialist during March, April, May or September, October, November 6.6.7 Greater Yellow Cress Page 55 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Great Yellow Cress was discovered in 1966 at the south bank of the River Dargle adjacent to the sewerage treatment works/Seapoint Court and is still existent there. This is the only occurrence of this species in County Wicklow and thus is of significant importance. The transplantation, storage and translocation of the Greater Yellow Cress must be carried out. The species can be collected as seedling and/or mature plants during autumn or preferably spring and maintained at a suitable (and safe) location for the duration of the project. It will be subsequently re-located to a site as close as possible to its current location on completion of the works. A plant ecologist familiar with the species will be retained by the Contractor to oversee these works. Volume D contains a quotation and works description for these works. 6.6.8 Bats and Birds Trees which are to be removed should first be assessed for likely bat roosting opportunities by the Contractors Ecologist/bat specialist and then felled during the spring months of March, April and May or the autumn months of September, October and November. However the bird breeding season will need to be considered during the spring period. A bat box scheme will be put in place to off-set the loss of any bat roosts. Approx 5 – 10 Schwegler bat boxes of the 2F design would suffice. These may be placed on selected deciduous trees in the locality of the removed roosts. Bat boxes if required must be place prior to any construction works being undertaken. Retention of riparian vegetation is recommended were feasible. Alternatively an appropriate landscaping and planting programme based on native tree and shrub species, is required to restore riparian habitats. Plants that emit their scent at night could be planted to attract insects during the hours of darkness. If works are planned during the nesting season (1st March to 31st August) a survey will be carried out by the Contractors Ecologist to establish the exact location of kingfishers nests and works at active nest sites will not be permitted during nesting season. As a known nest site will be destroyed, provision will need to be made to provide an alternative site. This should preferably be in a regraded sand/gravel cliff in the same general location to where the existing nest hole is. Expert advice will be sought from NPWS. vegetation is recommended were feasible. Retention of riparian Alternatively an appropriate landscaping and planting programme based on native tree and shrub species such as willow and alder, is required to restore riparian habitats. 6.6.9 Vegetation Management Wildlife Act 2000, restricts the cutting, grubbing, burning or destruction by other means of vegetation growing on uncultivated land or in hedges or ditches during the nesting and breeding season for birds and wildlife (1st March to 31st August). If an exemption is required the Contractor is fully responsible for obtaining such consents from the NPWS or any other relevant authority. Retention of riparian vegetation is recommended where feasible for the protection of the Kingfisher & other bird species. The Contractors Ecologist shall advise on Page 56 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 the suitability of certain planting combinations at the individual locations. Mitigation measures to protect trees that will remain with special attention to the south bank between Glenwood, through Killarney Glen to the N11 Bridge. Trees which may be vulnerable to damage during the construction works to be identified before construction works begins and the appropriate tree protection measures, as recommended by the Landscape Architect implemented. 6.5.1 Reinstatement Following the completion of the flood defence scheme, or sections thereof, a programme of habitat reinstatement should be initiated. The most important element of this will be the return of the riverbed material removed prior to the re-grading of the river. This material, cobbles, sand and gravel, will provide the material necessary for the river to recover more quickly to a more natural state, and one more suitable for the support current macroinvertebrate community and salmonid population. Where the riverbank is to be left in place, or merely reprofiled suitable terrestrial works should be considered to encourage the recolonisation of the banks by riparian vegetation, to allow more a more natural riparian zone emerge and to reduce the input of suspended solids into the river from bare soil on the river banks. 6.6.10 Dust, Sediment and Mud Dust and mud resulting from the Works shall be reduced as far as possible through the use of wheel washers, road cleaners and damping down of the site. Construction management plan shall incorporate the practices outlined in CIRIA’s “Control of Water Pollution from Construction Sites”. During dry periods, water sprays may be required to minimise dust. Temporary stockpiling of soil should be designed to minimise exposure to wind. Measures will be implemented to reduce the release of sediment into the watercourse. Any storage of sand/gravel/soil should be kept away from watercourses. 6.6.11 Site after Care Once works have been completed and site compounds are no longer required the compounds will be decommissioned and re-instated to its original condition. Page 57 Client: Project Title: 6.7 Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Archaeological Performance Parameters 6.7.1 Contractor’s Archaeologist The Contractor is required to employ a suitably qualified and licensed Archaeologist to undertake the required archaeological surveys and monitoring works. The Contractor’s Archaeologist will be responsible for reviewing the archaeological studies already undertaken and satisfying himself to the adequacy of these studies and the recommendations thereof. The Contractor’s Archaeologist will be responsible for liaison with the National Heritage Service and all other relevant bodies as well as securing all required permits and licences to undertake the works. A full programme for archaeological works shall be submitted to the Employer’s Representative prior to the commencement of any works. This programme will demonstrate how the archaeological works are scheduled in conjunction with the construction works and shall make allowances for any delays that may be incurred due to the discovery of materials of archaeological potential. The Contractor must account for the cost of all archaeological works in his tender price. In the event of archaeological features being uncovered, the Contractor shall seek the advice of the National Monuments Section, Department of the Environment, Heritage and Local Government. The Contractor shall submit reports describing the results of the works to the relevant authorities. The Contractor shall allow in their prices for any disruption as a result of slow working and any archaeological finds, and also reschedule their works elsewhere at short notice. 6.7.2 Archaeology The following is a non-exhaustive list of archaeological requirements taken from the Environmental Impact Statement that is including in Volume D of these documents. The information is provided here for information but it the Contractor’s responsibility to satisfy himself as the accuracy and completeness. The following mitigation measures from Section 5.9.5.2 of the EIS, which conform to best standard practice, are offered: A programme of archaeological investigations/excavations must be undertaken with respect to the bridge piers/foundations of the former bridge at Bray Bridge. This will allow for the remains to be ‘preserved by record’, thus reducing the overall specific impact of the scheme on such features. Ideally such work should be undertaken in advance of the commencement of construction works. A pre-development wading and metal detecting survey of the existing river channel within the Zone of Archaeological Potential and at the confluence of Swan and County Brook streams and in the area of Engineering Measure D9 (Debris Trap) should be undertaken Page 58 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 in advance of the commencement of works. In the event that any possible features of archaeological potential might be uncovered then the advice of the National Monuments Section, Heritage and Planning Division, Department of the Environment, Heritage and Local Government should be sought. A pre-development metal detecting survey should be undertaken of the existing river bank where it is proposed to undertaken ground reduction/excavation works. These areas are located along the southern side of Area 3 (Maltings Upstream and Glenwood Areas), the northern (Coburg Estate and County Brook) and southern (Redhills) sides of Area 4 and the southern bank of Area 5. All topsoil stripping/general ground reduction works of the areas outlined in Item 3 above, as well as all such works within the Zone of Archaeological Potential and Bray Golf Course lands, should be monitored by an archaeologist. Such monitoring should be complimented with continuous metal detecting in order to allow for an assessment of the artefact bearing potential of the soil. The removal of the top 300mm of river bed material from all of the area upstream of Bray Bridge should be monitored by an archaeologist. It is noted that this material will be stored for re-instatement (EIS Section 3.5.4). In the event of archaeological features being uncovered during the course of such works, then the advice of the National Monuments Section, Heritage and Planning Division, Department of the Environment, Heritage and Local Government should be sought. Reports describing the results of the works should be submitted to the relevant authorities upon completion of the works. In that regard, funds should be made available for report publication. 6.7.3 Architectural Heritage The impacts with respect to structures of architectural heritage interest are outlined in Section 5.9.4.3 of the EIS. In that regard, it is not envisaged that the proposed scheme will cause any negative impacts to any Protected Structures. The following mitigation measures are offered with respect to Bray Bridge (Site CH-11) and Ravenswell Road Bridge (Site CH-12): Extreme care should be taken during the underpinning works at Bray Bridge in order that the existing structure/fabric of the bridge is not accidentally damaged by machinery. Consideration should be given to the removal of vegetation on the facades of Bray Bridge and remedial works such as re-pointing. Page 59 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 A full architectural survey of Ravenswell Road Bridge should be undertaken in advance of the construction of the box culvert. This should include both a measured and photographic survey. This will allow for the feature to be ‘preserved by record’. Re-use of the stone should be considered with regard to blocking-up the arch on the riverside (southern) façade. In addition, a section/profile plan of the bridge should be undertaken during construction works. Copies of the survey should be deposited with the NIAH, Irish Architectural Archive and Bray Town Library for future study. The stonework of the northern façade should be numbered and recorded on the survey plans and consideration should be given to the reinstatement of this façade upon completion of the box culvert. Page 60 Client: Project Title: 6.8 6.8.1 Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Landscaping Performance Parameters Contractor’s Landscape Architect The Contractor is required to employ a suitably qualified and licensed Landscape Architect to The Contractor’s Landscape Architect will be undertake all landscape design work. responsible for reviewing the studies already undertaken and satisfying himself to the adequacy of these studies and the recommendations thereof. The Contractor’s Landscape Architect will be responsible for producing detailed landscaping plans that are sympathetic to the project environs and take account for planning and landowner requirements. A full programme for landscaping works shall be submitted to the Employer’s Representative prior to the commencement of any works. This programme will demonstrate how the landscaping works are scheduled in conjunction with the construction works. The Contractor must account for the cost of all landscaping works in his tender price. 6.8.2 Landscape Design Standards Landscape works are to conform to the current British Standards, particularly BS4428: 1989 for General Landscape Operations. Landscape design, specification and subsequent implementation of the works shall be undertaken according to best practice as far as is practicable within the scope of the scheme. In designing the landscape proposals the Contractor shall comply with the requirements of An Bord Pleanála as set out in the Environmental Impact Statement (EIS) and those of the Employer’s Representative. All tree protection measures, vegetation clearance operations, planting and seeding works shall be designed and programmed to the satisfaction of the Employer’s Representative in advance of works commencing on site. The Contractor shall be responsible for the preparation and submission of approved method statements for associated works such as handling, disposing and working in the vicinity of Japanese Knotweed as part of the design phase of the works. Tree protection measures, vegetation clearance operations, planting and seeding works shall be designed and programmed to suit the appropriate seasons of working for the elements involved according to best practice, current British Standards and the EIS. Tree protection measures and vegetation clearance operations shall be designed to minimise existing vegetation loss on site without unnecessarily restricting construction operations. All soft works design and specifications shall conform to the required British Standards, in particular BS3936 for nursery stock trees and shrubs and BS5236 for planting of trees in the advanced nursery stock category and the relevant standards as set out by the Horticultural Trades Association. Page 61 Client: Project Title: 6.8.3 Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Tree Protection Measures The Contractor shall be responsible for the preparation of detailed Tree Protection Plans to inform the erection of temporary tree protection measures in the locations illustrated on the specimen design. Tree protection measures to ensure Root Protection Areas of trees to be retained must be adequately marked out and ring-fenced in advance of works commencing. Suitable permissions shall be obtained by the Contractor as necessary to undertake the works without restriction to the construction programme or seasonal windows available for the works required. 6.8.4 Vegetation Clearance Operations The Contractor shall be responsible for the preparation of vegetation clearance plans and an accompanying programme to the satisfaction of the Employer’s Representative in advance of works commencing. The plans shall clearly identify all vegetation to be removed and where appropriate either cross reference the Tree Protection Plans or combine information. The Contractor shall allow for sufficient site inspection time to agree the extent of the work with the Employer’s Representative in advance of works commencing. The programme shall clearly illustrate any seasonal restrictions including bird nesting season. Any periods required to accommodate ecological input such as bat potential surveys or site supervision for section felling shall also be clearly identified in the programme and resourced by suitably qualified personnel. 6.8.5 Landscape Design and Specification The planting design shall follow the principles and outline planting palette as set out on the specimen drawings. Planting plans shall be developed by the Contractor including planting schedules clearly identifying species, plant numbers, mix proportions, and nursery stock specification sufficient to allow full implementation of the works to the satisfaction of the Employer’s Representative. Planting specifications shall be sufficient to ensure adequate supply, delivery, handling and planting of all nursery stock to allow the successful establishment and development of the scheme to the satisfaction of the Employer’s Representative. Planting (or seeding) design shall allow for adequate supply and preparation of a suitable quality planting medium such as topsoil or subsoil (where relevant for aquatic and marginal vegetation in the river corridor or for wildflower seeding). Wherever practicable the design shall allow for suitably excavated material to be utilised as planting medium (unless affected by invasive weed species or excessive perennial weed population/seed bank). The Contractor shall be responsible for determining the suitability excavated material for each respective use on site and shall demonstrate this suitability to the Employer’s Representative. The design shall consider the import of compost to BS PAS100 to mix with suitably excavated material of suitable quality to generate adequate volumes of planting medium fit for the Page 62 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 purpose of the landscape elements proposed and to the satisfaction of the Employer’s Representative. Where topsoil import is required, topsoil shall conform to BS3882:2007 however import volumes shall be minimised in favour of use of suitably excavated material wherever practicable. All planting medium shall be free draining but also moisture retentive and adequately nutritious to sustain plant life. Topsoil analysis to be undertaken for all topsoil imported to the site to determine the topsoil compliance requirement in accordance with BS3882:2007 including contamination status assessment for potential deleterious impact on human health, flora and the built environment. Planting specifications shall allow for the supply of adequate means of nutrition to last for two years after planting (subject to planting type and best practice requirements). Plants shall be protected from rabbit damage for three years (where appropriate for inclusion in the design) though protection shall not detract from the plant’s performance. Adequate support shall be specified as appropriate for the planting design including underground guying for all semimature trees utilising an approved proprietary guying system to the satisfaction of the Employer’s Representative. The Contractor shall provide additional construction details as necessary to illustrate planting proposals, tree pit detailing, means of support, irrigation and aeration facilities (for semi-mature trees) and all sundries associated with the planting works in sufficient detail for approval by the Employer’s Representative. In all locations where planting (particularly tree planting) is to be accommodated the Contractor shall give due consideration to the eventual size, spread, root area and all associated maintenance requirements during the establishment period and subsequent long term maintenance (such as watering, pruning, thinning operations, replacement). The design shall allow for provision of measures such as root barriers as appropriate to protect flood defences, services, hard surfacing and other structures from future tree root activity. Where vehicle access is required for maintenance purposes the paving leading up to the location must be capable of withstanding loading and vehicle tracking. 6.8.6 Landscape Works The Contractor shall work to enhance the landscape wherever possible within the scope of the proposals as set out on the Specimen drawings. Hard and soft landscape elements as a minimum shall meet the Employer’s Requirements and comply with the requirements of An Bord Pleanála as set out in the Environmental Impact Statement (EIS). In particular, the Contractor shall pay due regard to achieving high quality of finish to all hard landscape elements, particularly where new flood walls are constructed; incorporate suitable terrestrial works to encourage the recolonisation of the banks by riparian vegetation; and endeavour to replace any existing planting removed for construction with local provenance native species as appropriate to the location, prevalent site conditions and intended future maintenance levels. Page 63 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 6.8.6.1 General Landscape Operations All tree felling and surgery; planting and seeding works shall be carried out to the satisfaction of the Employer’s Representative by appropriately trained staff or sub-contractors, who are members of an appropriate trade organisation. All tree works to be in accordance with BS5837 Trees in Relation to Construction and undertaken within the appropriate seasonal windows with ecological supervision if deemed necessary and to the approval of the Employer’s Representative. All planting and seeding works shall be carried out at appropriate seasons when weather and ground conditions do not threaten the successful establishment of landscape finishes or nursery stock. Any trees, plants or other landscaping works which do not satisfactorily establish shall be replaced with material matching the original specification at the next available seasonal window for the works required. Any trees or plants which fail shall be removed and disposed of immediately and replacement made at the next appropriate planting window. All Plant material shall conform to BS3936 for nursery stock trees and shrubs and BS5236 for planting of trees in the advanced nursery stock category. All plant delivery, handling and planting of nursery stock to be in accordance with the guidance of the Horticultural Trades Association. Plants should be supplied with an adequate supply of nutrients to last for two years after planting. Plants should be protected from rabbit damage for three years. Damage protection should not detract from the plants’ performance. A weed free area of 1 square metre should be maintained around the base of each plant for a minimum of three years after planting. 6.8.6.2 Japanese Knotweed and Notifiable Weed Species The Contractor shall carry out works as appropriate to prevent the spread of notifiable weeds and other noxious weed species such as Japanese Knotweed according to current legislative requirements and Environment Agency guidance including the Knotweed Code of Practice 2007. The Contractor shall follow their approved procedures according to the Method Statements as produced during the design phase unless otherwise agreed with the Employer’s Representative. All areas of Japanese Knotweed identified shall be clearly ringfenced with appropriate signage to identify the hazard to the satisfaction of the Employer’s Representative. These areas shall be maintained as such for the duration of the works or until such time as the area is cleared or treated to accommodate the works. The Contractor shall be responsible for providing all site personnel with toolbox talks at the start of the works to ensure all personnel are adequately briefed regarding the presence of Japanese Knotweed and associated working procedures. The Contractor shall also be responsible for the completion of a programme of herbicide treatment using appropriately qualified personnel, Page 64 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 materials and methods of application appropriate to the location and site constraints. This treatment programme shall operate for the duration of construction operations and shall be agreed in advance with the Employer’s Representative. The Contractor shall undertake all necessary procedures to prevent the spread of Japanese Knotweed by site vehicles and machinery used during the construction period including all necessary provisions where wheel wash facilities are in use as stipulated in other sections of this specification. 6.8.6.3 Vegetation Clearance and Protection Other than the approved vegetation to be cleared as illustrated on the Specimen drawings, no existing trees, shrubs or other plants shall be removed without the permission of the Employer’s Representative and Local Planning Authority. No trees or shrubs shall be felled or cleared within the bird-nesting season. However, if additional vegetation clearance is deemed essential within the bird-nesting season the Contractor shall obtain the prior approval of the Employer’s Representative and the work shall be undertaken under the guidance and supervision of an appropriately qualified ecologist if approval to proceed is granted. The Contractor shall take all precautions to protect, in the course of their work, existing vegetation from malicious or accidental damage and also ensure that no branches shall be lopped and no roots over 50mm diameter are severed from vegetation to be retained adjacent the works where no works has previously been specified. All works shall be carried out in accordance with BS5837: Guide for Trees in Relation to Construction. Tree protection measures and locations as identified on the Specimen drawings shall be implemented and maintained for the duration of the works without exception unless otherwise advised by the Employer’s Representative. The Contractor shall be responsible for the implementation of Tree Protection Plans to inform the erection of temporary tree protection measures in the locations illustrated to ensure Root Protection Areas of trees to be retained are adequately marked out and ring-fenced in advance of works commencing. The Contractor shall obtain the services of an Arboricultural Association approved consultant as necessary to advise on tree protection and Root Protection Areas. All tree works to be undertaken by an Arboricultural Association approved contractor in a manner that causes no adverse effects on trees or vegetation to be retained adjacent the works. No spoil, soil material, construction materials or rubbish shall be stored or tipped within 3m of existing shrubs, hedges or the Root Protection Area or canopy spread (whichever is the largest) of any trees. No fires shall be lit at any location within the works boundary. Tree root damage and soil compaction shall be prevented by the use of tracking on approved haul routes beyond the Root Protection Area of any trees or hedgerows to be retained in or adjacent the works area. The Contractor shall submit proposals for approval and provide Page 65 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 temporary ground protection measures as necessary for any trees requiring protection as identified by the Employer’s Representative. 6.8.6.4 Seeding and Planting Requirements for Establishment The locations of all proposed grassed and planted areas including riverside and woodland trees, specimen trees, native shrub, riverside edge planting, woodland understorey and ornamental groundcover planting including plant species are illustratively shown on the Specimen drawings. Any additional trees and vegetated areas which are lost as a result of the permanent or temporary works are to be replaced by a size and species as agreed with the Employer’s Representative and LPA. The requirements for illustrative purposes, of each type of planting, are as follows: Soft defences (i.e. of earth construction) and reinstatement of grassed areas shall be grass seeded or turfed with a species mix and sowing rate appropriate to the site, function and maintenance requirements to the satisfaction of the Employer’s Representative. Local provenance native species shall be considered and given priority wherever practicable. However, due to the difficulties in sourcing local provenance seed (or seed mix for turf) the Contractor shall consider the use of local or regionally sourced seed mixes in order to provide a continuous grass cover free of pests, disease and predominantly free of perennial or annual weeds. The Contractor shall consider conventional or hydraseed application of seed as deemed appropriate for the location and conditions. Grass cover shall be sufficient to provide stability to slopes where situated on flood defence embankments. All other areas of grass reinstatement shall establish sufficient ground cover to be deemed fit for purpose. Amenity grass areas in parks, public accessible areas or private property shall achieve total ground cover once established. Seeding of less formal river edge and naturalistic areas shall give priority to the use of native species of local provenance including suitable wildflower or wet grassland mixes. These areas are likely to establish much slower and total ground cover is not essential in terms of a measure of successful establishment but should still be to the satisfaction of the Employer’s Representative. Structural planting including riverside and woodland trees and riverside shrub planting shall comprise substantial blocks of native trees and shrubs. Plants shall be native and prevalent in the area or as approved by the Employer’s Representative. Planting shall be dense using predominantly smaller nursery stock (transplants) at 1m to 2m centres to achieve acceptable establishment rates subject to ultimate design requirements and location. Planting shall be either notch planted into prepared existing or made ground, or individually pit planted where necessary. A proportion of larger whips, feathered trees and standards shall be incorporated where appropriate to achieve early visual impact where screening function is desirable. Nursery stock shall primarily be planted in bare root form (with the exception of gorse and Page 66 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 broom). All planting shall receive regular maintenance for the duration of the establishment period and subsequently as set out in the LMP. Specimen trees proposed for parkland locations including Peoples Park and Seapoint Court shall be planted as semi-mature nursery stock (20-25cm girth). Each tree shall be supported by underground guying and include a suitable irrigation tube with vandal proof cap. Nursery stock shall be planted either root balled or from container or air pot grown. Tree pits shall be of sufficient depth to accommodate the root ball of each tree and to dimensions and detail (including backfill requirements) to be agreed with the Employer’s Representative. Individual trees shall be planted straight and develop true to form with a balanced crown, strong centre leader and be predominantly free of pests and diseases with no damage arising from handling, delivery, planting or maintenance operations. All planting shall receive regular maintenance for the duration of the establishment period and subsequently as set out in the LMP. Riverside edge planting shall be planted directly into the reinstated top 300mm of the river bed or adjacent river bank in the locations as illustrated on the Specimen drawings. Nursery stock specification shall suit the required species and locations, and the Contractor shall allow for any additional works required to accommodate plant material where optimum planting depths are required for aquatic and marginal species (such as provision of planting ledges). Planting shall be regarded as inoculation of the areas indicated on the Specimen drawings with densities and coverage as appropriate to establish a viable population within reasonable financial limits. All planting rates and areas to be agreed with the Employer’s Representative. Ongoing establishment and vegetation development to be monitored in liaison between the Contractor and the Employer’s Representative in order to agree and inform any re-planting requirements during the establishment period. Understorey woodland buffer planting and ornamental ground cover mixes shall be planted in the locations as illustrated on the Specimen drawings. Nursery stock specification shall primarily be containerised stock with the exception of hawthorn in the woodland buffer mix which can be planted in bare root form subject to seasonal constraints. Planting densities and species combinations shall be appropriate to the location and function. Woodland buffer planting shall provide an effective edge to the existing tree cover and planting locations shall be selected to reduce competition from overhanging trees. All groundcover planting shall be containerised and be planted at sufficient densities to readily achieve ground cover within 3 years of planting. All ornamental groundcover mix planting shall be mulched using a minimum 75mm depth ornamental bark mulch to reduce weed competition and improve water retention throughout the planting area during the establishment period. Page 67 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 All arisings from planting operations shall be removed from site including plant crates, pots, labels, packaging and any excess materials including topsoil and compost unless otherwise directed by the Employer’s Representative. All planting operations shall be undertaken with due consideration for prevention of pollution of the watercourse; residential and public access to properties, footpaths, highways and other public areas affected directly or indirectly by the works. Private gardens, public and communal areas shall be reinstated to as near as possible their pre-entry condition and to the reasonable satisfaction of the landowner. Where the works directly affect private grounds or gardens, the Contractor shall liaise directly with the landowner and/or occupier to ensure their requirements are taken into account during the construction phase. An approved landscape architect and landscape contractor shall undertake garden reinstatement where required within the scope of the works. Details of plants shrubs and trees which will be removed as part of the Works shall be recorded in the form of a schedule for each property by an approved horticulturist and equivalent replacements, where possible, reinstated on completion. 6.8.7 Area Specific - Landscape Works 6.8.7.1 Area 1 – Harbour Bridge to Bray Bridge The Contractor shall replace any areas of vegetation cleared to accommodate the works within Area 1 with native species as scheduled and illustrated on the Specimen drawings. General riverside planting to include aquatic and marginal species (Riverside edge and grass planting Type A) and native shrub planting (Riverside shrub planting Type B). All other location specific planting is described below as individual landscape measures including amenity areas, semi-ornamental and groundcover planting requirements. Proposed soft defences including the embankment along the southern edge of the river (and areas of earth reinforcement) will be seeded using a suitable grass seed mix to establish grass cover and stabilise the embankment face to the approval of the Employer’s Representative. Locations suitable for planting of native shrub species (Type B) along the proposed embankment shall be agreed with the Employer’s Representative. Planting locations shall be selected to ensure there is no conflict with the stability of the flood defences. All proposed planting areas to be seeded (in advance of planting works where feasible) to provide grass cover to planting plots. Where new sections of stone clad flood defence walls are proposed along the river edge within Area 1, aquatic planting (Type A) shall be implemented at intervals and in sufficient densities to inoculate the regraded river bed and provide reasonable visual screening along the toe of the structure. The Contractor shall agree the extent and location of all in-river planting with the Employer’s Representative. Golf Club Lands: In locations where trees and hedgerows are removed along the golf course boundary to accommodate new wall and embankment construction woodland trees shall be Page 68 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 planted in locations and suitable densities to visually integrate the proposed structure along the golf course side of the defences. The embankment shall be seeded with a suitable native grass seed mix (in advance of tree planting where feasible). Topsoil or topsoil feathering over subsoil shall be considered subject to grass seed mix used and agreement with the Employer’s Representative. Between the proposed wall lines native tree and shrub planting shall be accommodated as illustrated on the Specimen drawings with groundcover planting to establish a low maintenance cover throughout. Tree planting shall be adequately detailed and installed to allow for suitable drainage of the root zone and irrigation as needed where trees are planted between the proposed retaining walls. Groundcover to be planted in combinations of single species groups to the approval of the Employer’s Representative. Seapoint Court Defences: the Seapoint Court defences shall be landscaped to a detail agreed with local residents and the Employer’s Representative including provision of a footpath with railings as necessary to secure the river side of the path. Native tree and shrub planting including riverside and woodland trees, and riverside shrub planting (Type B) shall be incorporated along the footpath route to replace existing vegetation removed to accommodate the works and provide a suitable setting for the pedestrian route. Parkland tree planting (semi-mature Prunus avium ‘Plena’); understorey woodland buffer and groundcover planting shall be included around the proposed lawn area (using a suitable amenity grass seed mix) as illustrated on the Specimen drawings. The Contractor’s design shall take due consideration of public safety measures and landscape maintenance requirements throughout. Riverside edge and grass planting (Type A) shall be implemented as illustrated on the Specimen drawings to re-vegetate river edge planting within the channel following regrading works. Abattoir Defences: Native shrub planting shall be implemented to replace any existing vegetation removed to accommodate the works in this location. The Contractor shall allow for and agree with the Employer’s Representative additional works as necessary to assist with the tidy up of this location which has become derelict and overgrown. Regrading of Riverbed: Riverside edge and grass planting (Type A) as illustrated on the Specimen drawings shall be implemented in locations and at densities to the approval of the Employer’s Representative to inoculate the river bed edges with the species as scheduled. Planting shall be design and implemented to form natural communities, with random combinations of single species blocks of planting sufficient to re-introduce and colonise suitable aquatic and marginal species in these locations and to visually integrate the new flood defence structures. Page 69 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Site Compound and Temporary Landtake Reinstatement: Temporary landtake areas including the site compound within the golf club lands shall be reinstated using a suitable grass seed mix to the approval of the landowner and the Employer’s Representative. 6.8.7.2 Area 3 – Bray Bridge to the western edge of People’s Park The Contractor shall replace any areas of vegetation cleared to accommodate the works within Area 3 with native species as scheduled and illustrated on the Specimen drawings. General riverside planting to include aquatic and marginal species (Riverside edge and grass planting Type A) and native shrub planting (Riverside shrub planting Type B). All other location specific planting is described below as individual landscape measures including amenity areas within People’s Park and the Maltings. Locations suitable for planting of native shrub species (Type B) along the proposed defences shall be agreed with the Employer’s Representative. Planting locations shall be selected to ensure there is no conflict with the stability of the flood defences. All proposed planting areas to be seeded (in advance of planting works where feasible) to provide grass cover to planting plots. Where new sections of stone clad flood defence walls are proposed along the river edge within Area 3, aquatic planting (Type A) shall be implemented at intervals and in sufficient densities to inoculate the regraded river bed and provide reasonable visual screening along the toe of the structure. The Contractor shall agree the extent and location of all in-river planting with the Employer’s Representative. People’s Park: The mature trees to be removed to accommodate the works along the southern boundary of the park shall be replaced with semi-mature (20-25cm girth) specimen horse chestnuts (Aesculus hippocastanum). This line of trees shall be extended to the extent as illustrated on the specimen drawings to provide a formal parkland feature along the full southern boundary of the park adjacent the river. Tree spacing shall be regular and equal with sufficient space to allow for the full development and mature crown spread of each tree without the requirement for thinning. The adjacent footpath shall be fully reinstated following completion of the works and areas of amenity grassland re-seed using a suitable amenity grass seed mix to the approval of the Employer’s Representative. The Contractor shall allow in the design for any suitable measures necessary to protect the flood defence wall and reinstated footpath from future root activity and development (such as a proprietary root barrier). Each tree shall be supported by underground guying (no aerial stakes or ties to be used) and fitted with aeration and irrigation tubes to facilitate healthy growth and maintenance. Riverside edge and grass planting (Type A) shall be implemented along the toe of the proposed flood defence walls within the river to re-establish vegetation removed to accommodate the works in this area. The site compound and any areas of temporary landtake within the park shall be fully reinstated to suit existing amenity grass cover. Page 70 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Maltings Housing: Vegetation removed to accommodate the works in this location shall be reinstated where appropriate with native shrub planting (Type B) within narrow (1500mm) strips adjacent the river as illustrated on the Specimen drawings. Native woodland trees shall be considered where appropriate to the location (primarily for measure C4). Riverside edge and grass planting (Type A) shall be implemented along the toe of the proposed flood defence walls within the river to re-establish vegetation removed to accommodate the works in this area. The location, area and density of planting shall be agreed with the Employer’s Representative. Glenwood Excavation: Planting measures shall be incorporated similar to measures C4 and C5 with combinations of native shrub planting (Type B) and riverside edge and grass planting (Type A) to reinstate areas of vegetation removed to accommodate the works. 6.8.7.3 Area 4 – Western edge of People’s Park to La Vallee The Contractor shall replace any areas of vegetation cleared to accommodate the works within Area 4 with native species as scheduled and illustrated on the Specimen drawings. General riverside planting to include aquatic and marginal species (Riverside edge and grass planting Type A) and native shrub planting (Riverside shrub planting Type B). All landscape measures comprise combinations of these treatments within Area 4 including measures D1-3, D7-9. Individual measures are described below where additional issues are to be addressed. Locations suitable for planting of native shrub species (Type B) along the proposed defences shall be agreed with the Employer’s Representative. Planting locations shall be selected to ensure there is no conflict with the stability of the flood defences. All proposed planting areas to be seeded (in advance of planting works where feasible) to provide grass cover to planting plots. Where new sections of timber clad flood defence walls are proposed along the river edge within Area 4, aquatic planting (Type A) shall be implemented at intervals and in sufficient densities to inoculate the river bed edge and reinstate areas of vegetation removed during the works. The Contractor shall agree the extent and location of all in-river planting with the Employer’s Representative. Upper Dargle Road Residents Embankment: The Contractor shall consult with the residents as necessary to agree landscape reinstatement along the proposed section of embankment. Planting shall comprise native shrubs (Type B) as illustrated on the Specimen drawings where riverside vegetation is cleared to accommodate the works. Planting locations shall be selected to ensure there is no conflict with the stability of the flood defences. Rehills Land: The Contractor shall ensure that re-grading and import of soil material within the fill area as illustrated on the Specimen drawings does not detrimentally affect existing vegetation to be retained including woodland trees along the southern edge of the working area. Root Protection Areas of all trees along the work perimeter in this location to be Page 71 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 protected by tree protection measures as previously outlined. Reinstatement works to include riverside edge and grass planting (Type A) including a suitable native grass mix for all regraded areas. Location, total area and density of planting in this zone to be agreed with the Employer’s Representative. Planting shall be implemented to inoculate this area rather than achieve total coverage. Woodland trees to be planted in dense, scattered individual blocks to re-establish vegetation cover within native grassland in proportions to be agreed with the Employer’s Representative. Planted plots shall be seeded with the same native grass mix (in advance of planting operations where feasible) to provide grass cover throughout the establishment period. 6.8.7.4 Area 5 – La Vallee to N11 Bridge The Contractor shall replace any areas of vegetation cleared to accommodate the works within Area 5 with native species as scheduled and illustrated on the Specimen drawings. General riverside planting to include aquatic and marginal species (Riverside edge and grass planting Type A) and native shrub planting (Riverside shrub planting Type B). Landscape measures comprise combinations of these treatments within Area 5 including measure E2 which ties in with works to Area 4 (Rehills Land) including additional native woodland trees as illustrated on the Specimen drawings. Where embankment reprofiling requires, soft defences shall be re-seeded with a suitable native grass seed mix to ensure establishment of grass cover to stabilise the slopes. Grass seed mix, sowing rate and method of seeding to be approved by the Employer’s Representative. Page 72 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 SECTION 7 – WORKS SPECIFICATION 7.1 General Appendix 1 to the Works Requirements contains the General Works Specification for the works. The Contractor shall reference this Specification in relation the required standards for the materials and workmanship for the project. If there is an ambiguity between information contained within any of the contract documentation the stricter interpretation of the information shall apply unless agreed otherwise with the Employer’s Representative. It is noted that working room is limited for most of the areas due to development adjacent to the river, typical of the urban character of the watercourse. In some cases, work on the flood defences will need to be carried out from the river, which will limit the periods of the year during which construction may be carried out. 7.2 7.2.1 Compounds and Site Access Access and Site Boundaries Site Boundaries are as shown on the Specimen drawings and the Contractor will be provided with the digital version of the CPO boundary to allow accurate setting out. The Employer will provide reach agreements with all landowners to permit access for the Contractor within the boundaries shown on the Specimen drawings. The Contractor may negotiate separately for additional lands, accesses and site compound he deems necessary for the construction of the works in accordance with his design and method of works. The Contractor must keep the Employer’s Representative informed of all such negotiations and provided details of the negotiated agreement. Indicative access points to all the working areas are shown on the Specimen drawings however no permissions have been negotiated with the affected landowners for these access points. The Contractor must undertake negotiations for any access points to the river that do not pass through lands which were subject to the CPO process. All delivery vehicles supplying the site should be scheduled to miss the peak usage times of the surrounding roads. Wheel wash facilities should be supplied at all access points to the working areas, where they meet public and private roads. The Contractor shall make provisions as necessary for measures to prevent the spread of Japanese Knotweed in relation to all wheel wash facilities at sites where the weed is present. The Contractor is to ascertain the exact restrictions on the bridges from the Local Authority, and design, plan and programme their works accordingly. The Contractor shall not allow any vehicle, item of plant or similar, either belonging to themselves or their Subcontractors, suppliers or visitors to park on the public highway or the verge thereto, or impede the use of the said highway. Page 73 Client: Project Title: 7.2.2 Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Contractor Compounds The specimen drawings indicate the location of three available areas for the location of site compounds. The Employer will endeavour to provide at least the two areas shown in the People’s Park as this land is owned by the Employer. However the third location is in third party ownership and the Contractor must engage in consultations with this party to ensure possession is granted. Any other areas required by the Contractor will be subject to negotiations between the Contractor and the landowners. The Contractor shall note that it is not permissible to establish site compounds or material stores on public highways. 7.2.3 Notice of Entry A formal notice of intention to commence the Works on each area of the Works will be given by the Employer, to owners and occupiers of all the land as designated by the working areas shown on the Specimen drawings. The notice shall be as long as is reasonably practicable and will not normally be given less than 14 days before entry, other than in an emergency. To this effect the Contractor will be required to give the Employer 4 weeks notice of their intention to commence construction works in a particular section. 7.3 7.3.1 Site Facilities Contractors Site Accommodation The Contractor shall be responsible for leasing any land that may be required for locating his offices and storage areas. The Contractor is responsible for all leasing, setting up, secure fencing, temporary roads, demobilising, restoration costs, etc. These costs must be included by the Contractor in his tender. The selection and use of land for leasing by the Contractor for construction of the works must comply with all necessary permits for use of the land, and must take cognisance of all access and traffic management requirements. The Contractor is responsible for all costs incurred for the installation, supply and removal of water, electricity, telephone and any other services required at the site. The Contractor shall provide, maintain and keep in good sanitary condition adequate sanitary accommodation for the use of all people engaged on the Works, and shall remove, disinfect, and clear away on completion. 7.3.2 Site Accommodation for Employer’s Representatives Staff Offices for the exclusive use of the Employer’s Representatives staff shall be located within the Contractors secured site compound. These offices shall be supplied and erected before commencing construction works. The Contractor will be required to include in his rates for the leasing of any land that may be required for the Employer’s Representatives offices and car parking area. He shall also be responsible for the setting up, fencing, temporary roads etc., demobilising and restoration costs including the provision of a hard standing area and for the provision of services to the hard standing area where the offices are to be located. The Contractor is responsible for the maintenance of the site accommodation, hard standing and perimeter fence for the duration of the Contract. Page 74 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Offices for the Employer’s Representative must be installed and have electricity (heating and lighting), land line telephone, high speed broadband connection, answering machine, fax machine and adequate fire fighting equipment, before commencing the construction works. The offices shall be properly weathered with adequate ventilation. They shall be secure and the Employer’s Representative shall be provided with keys to the external doors and all individual office doors and lockable storage areas. The Contractor shall provide, maintain and clean for the period of the execution of the Works and remove on final completion or when directed, office and storage accommodation for the exclusive use of the Employer’s Representative. Office accommodation shall be located on the site and have the following: (i) Office area of not less than 36m². (ii) Storage area not less than 3m² for the Employer’s Representative’s equipment. (iii) Kitchen area of not less than 6m². (iv) Dedicated meeting room to suits 10 people. (v) Separate toilet facilities with W.C., W.H.B with hot and cold water services, soaps, towels, etc. Male and female facilities to be provided. (vi) Hardstanding for parking for at least eight motor vehicles for the exclusive use of the Employer’s Representative’s Representative and his staff shall be provided immediately adjacent to the site offices. (vii) 3 No drawing cabinets for the exclusive use of the Employer’s Representative and his staff. (viii) Office furniture and fittings, including 4 desks and 4 chairs, 1 meeting table to suit 8 – 10 people and 10 chairs (in a dedicated meeting room) for the exclusive use of the Employer’s Representative and his staff. The Contractor should include in his tender for the provision and maintenance of the Employer's Representative accommodation, services, equipment, office stationary, consumables and all other operating and running costs for the duration of the contract. 7.3.3 No Residential Accommodation on Site Caravans or other accommodation for residential use will not be permitted. The Contractor will not be allowed to have staff or workmen living on any part of the Site. In the case of accommodation for Night Watchman or Security Personnel, such arrangements must be subject to the Employer’s Representative’s approval. The Contractor shall ensure that no caravans or huts are brought on to the Site for use as sleeping accommodation except as may be approved by the Employer’s Representative and the Contractor shall ensure that all workers (except security guards) leave the Site at the conclusion of each day. The Contractor shall obtain all Page 75 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 necessary approvals and permissions required for site offices and accommodation. 7.3.4 Cleanliness of the Site Public roads used for access to and from the site and other areas shall be kept clean and swept daily, or more frequently if required by the Employers Representative, to keep them free from mud, dust and debris, as is reasonably practicable. Existing public highways, including footpaths, used by vehicles of the Contractor, their sub-contractors and suppliers shall be kept clean and clear of all dirt, mud or other materials dropped by the said vehicles. The Contractor shall make available at all times a road sweeper and other such plant and equipment as may be necessary to keep the road clean as required by this clause or the local authority or other interested party. The working area, including the site compound for the Employer’s Representative staff shall also be maintained in a tidy condition. The Contractor shall instruct all persons engaged on the Site to use the sanitary equipment provided. Any person found disobeying this instruction is guilty of misconduct and may be instantly dismissed from the Site by the Employer’s Representative. 7.3.5 Electricity & Telecom Supply The Contractor shall make his own arrangements for the provision of an adequate temporary power supply, and back-up supplies for the duration of the contract. The Contractor shall satisfy the Employer’s Representative, by production of any required “connecting up” certificates, etc., of the worthiness of any electrical installations. The Contractor shall install, maintain, and disconnect on completion of the Contract, an electricity supply to the Employer’s Representative’s site office. 7.3.6 Water Supply The Contractor shall make his own arrangements for the provision of an adequate temporary drinking / potable water supply, which shall be included for in his rates. The Contractor shall pay all charges for the connection into the public main, where allowed, and for all water charges during the course of the contract. The Contractor shall install, maintain, and disconnect on completion of the Contract, a potable water supply to the Employer’s Representative’s site office for use by the Employer’s Representative’s staff. 7.3.7 Sanitary Services The Contractor shall make arrangements for the connection of the relevant sanitary services to the sewer network, which shall be included for in his rates. The Contractor shall pay all charges for the connection into the public sewer, where allowed, and for all charges during the course of the contract. The Contractor shall install, maintain, and disconnect on Page 76 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 completion of the Contract, a connection to the Employer’s Representative’s site office for use by the Employer’s Representative’s staff. The Contractor shall provide such sanitary equipment as may be considered necessary for the convenience of the workforce to avoid fouling the Site or surrounding land. All sanitary equipment shall be regularly cleaned and properly maintained. 7.4 7.4.1 Services and Equipment for the use of the Employer Provision of Phones The Contractor shall provide for the installation and maintenance of telephone equipment (3 No. external lines) for the exclusive use of the Employer’s Representative staff for the duration of this Contract. The equipment will include for 4 No. fixed extensions (at a minimum), 4 No. mobile (GSM) phones and a broadband modem connection via a suitable router. All line rental charges and call charges for the Employer’s Representative’s fixed line, mobile telephones, fax machine, automatic telephone answering machine and broadband will be paid by the Contractor for the duration of this Contract and for 4 months after the date of Substantial Completion. The Contractor will supply, install and maintain, for the duration of the Contract and for 4 months after the date of Substantial Completion a suitable digital Automatic Telephone Answering Machine. The Contractor will supply, install and maintain, for the duration of the Contract and for 4 months after the date of Substantial Completion a plain-paper fax machine on a dedicated telephone line. The tender total is deemed to include removal of telephones, modems, fax machines, and answering machine at the end of the contract. 7.4.2 Digital Camera The Contractor shall provide two number digital cameras for the sole use of the Employer’s Representative. This digital camera shall be 7 Mega Pixels or greater, with a minimum of 3 x optical 4 x digital zoom with video function and sound, USB connectivity. The camera shall come with the appropriate computer software and 4GB memory card. 7.4.3 Survey Instruments The following survey equipment will be supplied and maintained under this Contract for the use of the Employer’s Representative staff for the duration of the contract: 1 No. Total Station with tripod and 3-Prism reflectors. 2 No. quick-set levels (automatic levelling) and tripods. (N11 Wild or acceptable alternative with circular scale). 4 No. 5 metre staffs (telescopic, graduated in metres etc. with level bubbles). 4 No. 8 metre steel tapes, nylon covered open frame type. The Contractor shall replenish these supplies over the duration of the Contract as directed by Employer’s Representative. 7.4.4 Protective Clothing The following shall also be supplied, for use by the Employer’s Representatives staff: 10 No. pairs (sizes to be advised) Safety Boots. 5 No. pairs of waders (assorted sizes) 10 No. sets of protective, water-proof clothing. 10 No. White Hard-Hats 10 No Hi Viz vests The Contractor shall replenish these supplies over the duration of the Contract as directed by Employer’s Representative. 7.4.5 Attendance on the Employer’s Representative The Contractor shall provide for attendance on the Employer’s Representative on site. This shall be available on demand at all hours during which the Contractor is working on site. Such labour and attendance may include: Assistance in checking the setting out of the Works. Assistance in measuring the Works. Cleaning and maintaining the equipment provided to the Employer’s Representative’s representative. 7.4.6 The provision of tools, pegs etc. for setting out and checking the Works. Computer Equipment to be Provided The Contractor shall include for the provision and maintenance of 4 no. of the following computer equipment for the sole use of the Employer’s Representatives staff; Pentium 4 3.2 GHz, 2 Gb RAM (min) Laptop Computer or equivalent 160 GB HDD 17” S.V.G.A colour screen Integrated Two button mouse, keyboard and CD-RW/DVD-ROM, 100BaseT NIC External DSL Modem, Ethernet, 1.024Mbps A3 / A4 Colour DeskJet Printer Page 78 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Windows 7 Professional Microsoft Project 2007 Microsoft Office Professional AutoCAD LT 2010 Anti-virus Software Date: October 2010 Project No: Y9114 The Contractor shall provide consumable replenishment for computer equipment used by the Employer’s Representative’s staff for the duration of the contract and for 4 months after the date of Substantial Completion. 7.4.7 Site Vehicles The Contractor shall provide 2 No. new 4WD Vehicles, Mitsubishi L200 Double cab, 2.5l diesel, or equivalent, for the sole use of the Employer’s Representative staff for the duration of this Contract. The Contractor shall maintain, tax, insure and provide fuel for these vehicles for the duration of the contract and for 4 months after the date of Substantial Completion. 7.5 7.5.1 Surveys and Setting Out Ordnance Datum, Pre-Contract Levels, and Reference Points The levels referred to in the Specification and on the drawings relate to Ordnance Datum Malin Head. All existing levels shall be verified on site by the Contractor prior to construction work commencing. The Contractor shall establish and maintain reference pegs and temporary bench marks of approved design appropriate for setting out and checking the works. Before removal of any reference pegs or marks the Employer’s Representative’s approval must be obtained. All surveys shall be referenced to the Irish National Grid and to Ordnance Datum Malin Head. 7.5.2 Topographical Survey and Setting Out Existing topographical survey data of the site is shown on the Specimen drawings. No warranty is given as to the accuracy of the survey and the Contractor should satisfy himself of the adequacy and accuracy of the data. The Contractor shall verify the value of any Ordnance Survey Bench Mark and grid system, which may be used in the design and setting out of the Works. This is to be agreed with the Employer’s Representative. The Contractor shall set out the works and notify the Employer’s Representative when setting out is ready for checking with sufficient notice to enable him to carry out his own checks in advance of the construction works commencing and to make any minor alterations to the route, if required. The Employer’s Representative shall arrange for checking to allow the Contractor to proceed with the Work. Any such approval given by the Employer’s Representative will not relieve the Contractor of his responsibility to construct the Works adequately and accurately. In connection with setting out the Contractor shall maintain on site all instruments, measuring equipment, pegs, sight rails, and other things necessary for the proper setting out and checking Page 79 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 of the Works. 7.5.3 Line and Level The Contractor is to design and construct the flood defences to the line and level indicated on the specimen drawings. At the commencement of construction the Contractor shall mark out the alignment of the Works Boundary line and the line of the proposed defences in all sections of the Works as indicated on the specimen drawings. If deemed necessary the Employer’s Representative may then make minor adjustments to the defences to suit the site conditions or the Contractor may agree an alternative design with the Employer’s Representative. The flood defences shall be constructed to achieve the levels shown after long term settlement. The Contractor shall indicate with their design how long term settlement is assessed/ calculated and how it is to be monitored post construction. The superstructure of the flood defences shall be constructed to the profiles, elevations and the aesthetical appearance as shown on the specimen drawings or as describe elsewhere in these Contract Documents. 7.6 Condition Survey of Existing Properties & Land The Contractor is required to undertake a pre-construction and post-construction condition survey of all properties and land adjacent to the Works Areas. These surveys are to be carried out by a suitably qualified independent firm of engineers, whose details shall be submitted by the Contractor to the Employer’s Representative for approval in accordance with Clause 5.4 of the Conditions of Contract. The Contractor is to forward details of the company and CV of the personnel carrying out the survey to the Employer’s Representative for approval. The full scope of the properties to be surveyed shall be agreed with the Employer’s Representative. 7.7 Water for Works All water required for the construction of the Works, testing of pipelines or for any other purpose shall be provided by the Contractor, at his own cost. 7.8 Material Storage Materials can only be stored in the compound areas secured by the Contractor or in fenced-off work areas within the extents of the agreed wayleave. Material storage at roadside or in public areas will not be permitted. The storage of dangerous compounds including contaminated materials will not be permitted unless 24-hour security arrangements are in place. 7.9 Soil Sampling Excavation and Disposal Suitable sampling and chemical analysis of the soil/subsoil will be undertaken prior to its excavation. Any soil that is to be excavated and disposed of shall be sampled, analysed and Page 80 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 classified to determine the most suitable disposal outlet. Any soil that is to be reused on-site shall be sampled and analysed to confirm its suitability. 7.10 Excavated Material Disposal of surplus excavated material shall be the responsibility of the Contractor and shall be carried out strictly in accordance with the Waste Management Act. The Contractor should note in this regard that the regulations governing the disposal of excavated materials/builder’s rubble require the transfer of such waste material only to sites authorised for the acceptance of the material by the Environmental Protection Agency. The Contractor is required to maintain a Disposal Record Log, in accordance with the Construction & Demolition Waste Management Regulations, for examination by the Employer’s Representative, which will include the following information for all disposed material: The date the material was removed A description of the material The amount of material removed at that time By whom the material was removed (Name and Company) The intended destination of the material Receipt for acceptance of the material 7.11 Ground Water Monitoring and Design for Ground Water Groundwater levels are to be monitored in areas where sheetpile walls or cut-off measures are to be installed. A ground water monitoring programme shall be proposed by the contractor for approval by the Employer’s Representative. This programme shall allow for monitoring before, during and after implementation of the proposed flood alleviation measures. The contractor’s design shall take account of existing ground water and suitable measures shall be taken to prevent increase in ground water as a result of the proposed works. The Contractor shall reference the Hydrogeological Report contained in Volume D of Contract Documents and shall take account of the recommendations therein. The Contractor is required to produce a detailed hydrogeological assessment for the scheme based in his detailed design demonstrating the effect of the works on the hydrogeology of the surround environment. 7.12 Reinstatement 7.12.1 General Any lands or otherwise disturbed during the Works shall at a minimum be returned to there original condition unless detailed otherwise in the Contract Documents. 7.12.2 Roads & Footpaths All paving and surfacing materials shall be designed fit for purpose, easily cleaned and detailed to allow for ease of repair. All hard-surface finishes to utilise high quality materials Page 81 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 and finishes to the approval of the Employer’s Representative in keeping with the aims of the scheme. Paving and access design shall allow for pushchair and mobility impaired access (including wheelchairs) and due consideration shall be given to surface finishes, materials and gradients with respect to relevant building codes. Paving materials shall be designed sensitively to visually integrate with the location utilising typically used local materials and detailing where appropriate and/or matching paving as necessary to tie in to existing footpaths and surfacing, particularly where reinstatements are required. Sections of new footpath or surfacing should be designed with finishes and detailing appropriate to the setting and context following consultation with all interested parties. All restoration works are to comply with the requirements of the Department of the Environment and Local Government Manual “Guidelines for the Opening, Backfilling and Reinstatement of Trenches in Public Roads”. Public roads affected by the works shall be reinstated in accordance with Part M and Traffic Management Guidelines i.e. dropped kerbs/tactile etc. to provide for mobility impaired road users irrespective of the status prior to the commencement of the works. The Contractor shall inspect the condition of all roads, including footpaths and verges either public or privately owned, which will be used for access to the Site during the Contract Period and shall agree their conditions with the Employer’s Representative and the appropriate third party before the Contract commences. The Contractor, at their own expense, shall repair all such roads, footpaths and verges upon completion of the Contract to a condition at least as good as before the work commenced. In the event of any interference with road markings, the Contractor shall arrange for immediate replacement with temporary markings and to permanent markings restored as soon as is practical. Road markings shall comply with Clause 1211 of the NRA Specification for Roadworks 7.12.3 Riverbed and Banks Existing riverbed material shall be removed to a minimum depth of 300mm, stored and reinstated to the exiting locations following regrading of the riverbed. Suitable terrestrial works should be considered to encourage the recolonisation of the banks by riparian vegetation. Any planting or vegetation removed or damaged during the construction shall be reinstated to a condition at least as good as before the work commenced. 7.12.4 Temporary Works Areas The Contractor shall reinstate the surfacing of all site compounds and access routes on completion of the Works. The Contractor shall clear the site and remove all site offices and accommodation as soon as is practicable after completion of the Works on that part of the Page 82 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Site. All temporary land take areas affected by compaction arising from construction activity and operations shall be ripped where appropriate using suitable machinery to sufficient depth necessary to alleviate any compaction. Ripping shall be undertaken in advance of reinstatement of topsoil profiles and landscape finishes. Topsoil profiles shall be reinstated to match the profiles as they existed prior to the works. Any boundary walls, planting or vegetation removed or damaged during the construction shall be reinstated to a condition at least as good as before the work commenced. 7.13 Operational and Maintenance Requirements The future operational and maintenance requirements of the scheme shall be clearly set out by the Contractor in the Proposed Maintenance Plan. The defences shall be designed to ensure the following Operational and Maintenance Requirements are complied with: 7.13.1 Operational Requirements The future operational requirement for the completed flood defence scheme shall include but not be restricted to the following parameters: The permanent access requirements are shown on the specimen drawings. Pedestrian access to the bed of the watercourse where shown shall provide safe access and egress for a labourer and a wheelbarrow and shall be at least 1.5m wide. The existing vehicle access ramp off Dargle Road adjacent to Rivervale shall be maintained to provide safe access and egress to the debris trap for a 15-tonne tracked excavator leaving 0.75m clearance on each side of the excavator, maximum gradient shall be 1 in 10. All landscape elements shall be designed to allow suitable access for all associated operational scheme maintenance activities including non-landscape maintenance operations and third party activities such as Statutory Undertakers. Plant and tree species shall be designed and located to prevent future conflict with accesses, footpaths, roads, services, buildings or other structures as far as can be practicably predicted. Landscape design shall be appropriate to the location within the scheme with reasonable establishment and ongoing maintenance requirements. Planting design shall avoid inappropriate siting of proposed vegetation which might incur excessive maintenance input or successive replacements. 7.13.2 Maintenance Requirements Maintenance with the exception of landscape elements shall be limited to routine maintenance (not required at a frequency greater than once a year) and major maintenance (no more frequently that every 5 years). The defences should be designed to ensure that maintenance is not required more frequently than as set out. Access for operations staff and associated maintenance equipment should be provided. In particular access for Land Rovers Page 83 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 and ride on grass cutting equipment must be provided to all embankments of suitable gradient to allow mowing. Allowance shall be made for cleaning of the silt trap at The Slang on an annual basis and any other debris and silt accumulations from traps included in the scheme. 7.14 Use of Recycled Materials The Contractor shall use his best endeavours to make maximum re-use of materials in the Works. The Contractor shall prepare a strategy to demonstrate how this will be accomplished. Opportunities for recycling shall follow “The reclaimed and recycled construction materials handbook” (CIRIA C513: 1999). The definitions of new (primary), secondary and recycled materials shall be as follows: New (primary) materials - basalt, clay, crushed rock, granite, gravel, limestone, sand, sandstone, other stone, concrete (ready mix) and other naturally occurring materials. Secondary materials - china clay waste, china/pottery etc, colliery spoil, combustion residue, foundry sand, quarry waste, refractories, shale, slate waste, furnace slag pulverised fly ash (PFA), furnace bottom ash, etc. Recycled materials - brick, crushed concrete, glass, masonry, processed road surface, etc. Top soil should not be included nor materials that are reused on-site. Material that is moved to another site should be counted. Beach nourishment materials that are taken from one part of a beach, or offshore, should be recorded separately. Percentage recycled materials = Secondary + recycled materials used Total materials used Expressed as a percentage to one decimal place. 7.15 Use of Sustainable Resources The Contractor shall use best endeavours to use sustainable resources in the Works. All timber and timber sheet materials shall be from a sustainable source. Materials which cannot demonstrate this should not be used unless maximum supply of sustainable materials has been sourced and the Contractor can demonstrate best endeavours to source sustainable supplies. Sustainability should be demonstrated with the Forest Stewardship Council (FSC) Chain of Custody (CoC) certification. Partial FSC CoC or other proof of sustainability may be used with the prior written approval of the Employer’s Representative if it can be demonstrated that the full chain is not available. Page 84 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 The Contractor shall consider the import of PAS100 compost (from approved sources only) to supplement site won soil material for use as landscape growing medium where existing site topsoil is not found to be suitable and topsoil import is required to complete the works. 7.16 Noise and Vibration The Works are in a location that will affect many residents businesses and the general public. Every effort shall be made to reduce noise and vibration through careful selection of plant, screening and working hours. The Contractor shall ensure that the best practicable means are employed to minimise the noise and vibration resulting from their operations and complies with the recommendations and requirements of BS 5228: Code of Practice for Noise Control on Construction and Demolition Sites. In particular the Contractor shall ensure that; All vehicles, plant and machinery used during the operations shall be fitted with effective exhaust silencers and that all parts of such vehicles, plant or machinery shall be maintained in good repair and in accordance with the manufacturers’ instructions, and shall be so operated so as to minimise noise emissions; Only ‘sound reduced’ compressors or other alternatives approved by the Employer’s Representative shall be used, and any equipment or panel fitted by the manufacturer for the purpose of the reduction of noise shall be maintained and operated so as to minimise noise; Any pneumatic operated percussive tools shall be fitted with approved mufflers or silencers which shall be all kept in good repair; Any machinery which is in intermittent use shall be shut down in intervening periods of non-use or where this is impractical shall be throttled back to a minimum; Stationary plant, e.g. pumps, compressors, generators, shall be situated as far as possible from residential property and acoustic screens erected if required by the Employer’s Representative. Other plant and machinery shall be screened if necessary; Plant known to emit noise strongly in one direction shall be, where practicable, orientated so that noise is directed away from noise-sensitive areas; That as far as practicable their operations shall be not so noisy as to be a danger to those on or about the Works or to be a nuisance to the neighbourhood; If there are any especially sensitive residents, such as the elderly or people convalescing, the option of providing alternative accommodation for the duration of high-noise works is made available; Where necessary the Contractor installs piles using ‘silent piling’ techniques. Elsewhere the use of noise reducing hydraulic pile drivers and/or a non-metallic dolly between the hammer and the driving helmet may be acceptable; Page 85 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Use of air Noise monitoring is carried out at sufficient intervals and locations to ensure that there is reliable data for management of the project in accordance with BS 5228 procedures; and That consultation is undertaken with residents to inform them of the duration and timing of high noise works. 7.16.1 Vibration Monitoring 4 No. calibrated vibrographs shall be provided, maintained and operated on site at all times during excavation works, piling and sheet-piling operations (if any). An operator skilled in their use shall be made available by the Contractor during all such operations. Readings shall be taken at various pre-selected locations during the Works. Locations will be selected by the Employer’s Representative. The Contractor shall provide for continual monitoring at the adjacent structures and services during the course of the Contract, in particular during sheet piling, excavation, rock removal and pumping operations. Resultant ground wave velocities shall be limited to the following: (i) 20mm /sec. at existing walls (ii) 10mm/sec at any structure or existing service 7.16.2 Noise Suppression and Monitoring The Contractor shall ensure that the level of noise resulting from the construction of the works does not constitute a nuisance, and that noise emissions conform to the requirements of B.S. 5228: Noise control on construction and open sites. All plant shall be adequately silenced to conform to the requirements of B.S. 5228. The Contractor shall supply and have available during the course of the Contract 4 No suitable and approved sound monitoring stations. The noise monitoring stations shall be provided, maintained and operated on site at all times during excavation works, piling and sheet-piling operations (if any). An operator skilled in their use shall be made available by the Contractor during all such operations. The Contractor shall provide for continual monitoring during the course of the Contract, in particular during sheet piling, excavation, rock removal and pumping operations. Noise restrictions shall be as follows: Normal Working Hours: Shall not exceed ambient background noise by more than 10 dB (A) or shall not be greater than 65 dB (A) whichever is the lesser, measured at equivalent continuous sound level. Outside Normal Working Hours: 55 dB (A) equivalent continuous sound Level and 40 dB Page 86 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 (A) equivalent continuous sound level between 11.00pm - 8.00am The noise levels given above shall apply at the fencing surrounding the work areas or at adjacent residential properties as agreed with the Employer’s Representative. The Contractor shall supply and have available during the course of the Contract suitable and approved sound monitoring equipment. Readings of background ambient noise and noise resulting from construction operations shall be made from time to time, as directed by the Employer’s Representative. The Contractor will be required to use mains - powered (or approved alternative) electric pumps and equipment outside normal working hours. 7.17 Pollution Control The Contractor shall comply with all relevant environmental legislation. In particular, on no account shall any contaminants, excavated materials or ground waters be allowed to discharge or migrate into any watercourse, drain or highway. The Contractor shall be liable for any prosecutions and costs associated with non-compliance including any charges made in respect of watercourse pollution, destruction or disruption of any fishing interest or local authority or private interest due to their activities. Advice on water pollution control and waste regulation is available from the Environment Protection Agency's environmental information officer and website. 7.18 Protection of Existing Services & Structures On, Under or Over the Site. All necessary precautions shall be taken during the course of the works to prevent movement or damage to any existing premises, outbuildings, walls, services etc. The Contractor shall indemnify the Employer against any claim for avoidable damage to existing structures / services caused by his operations. The existing services in the area include, but are limited to, the following: Watermains Foul sewers Storm sewers Telecom cables Electricity Cables Cable TV Ducts Street lighting cables The approximate locations of existing services are shown on the Utility drawings provided in Volume D of the Contract Documents. It is the Contractor’s responsibility to confirm the exact location of all services with the relevant service authority prior to commencing on site. The Contractor is to liaise with the relevant Authorities to confirm the exact locations of any services Page 87 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 affected by the Works and to identify any constraints the Authority may impose. Where the proposed works interfere with any existing services, it shall be the Contractor’s responsibility to liaise with the relevant Authority regarding the exact location and depth of these services and to ascertain their permanent protection requirements, if any. The tender total should allow for complying with any protection requirements of the relevant Authorities. Any pipes with less than 900mm cover to crown shall be protected by a suitable concrete surround or other proposal. Trial pits or slit trenches may be required to establish the location and level of existing services in the vicinity of the proposed pipeline in advance of the Works. These shall be excavated by hand, using air-operated tools as necessary and shall be done in conjunction with and to the approval of the relevant Authority. No excavation by mechanically operated machines shall be permitted, unless with the express prior approval of the relevant service authority and the Employer’s Representative. The locations of the existing services encountered during these investigations are to be mapped. The Contractor is to ensure that construction traffic does not cross any existing services other than at locations agreed with the relevant Authority, where the Contractor has carried out temporary works, to the satisfaction of the relevant Authority, to ensure that no damage is caused to these services by construction traffic If it shall be necessary for services to be diverted or for works to be carried out on services within or adjacent to the works, the Contractor shall be responsible for the proper timing and coordination of all work carried out by himself and by others in connection with service installations, for providing attendance, for serving notices or keeping the service owners and providers advised of the details of his programme for those parts of the works affecting their installations. For this purpose, he will arrange for co-ordination/liaison meetings to be held on site at approximately monthly intervals at dates and times agreed with the Employer’s Representative and the Contractor shall be free, subject to the approval of the Employer’s Representative, to hold meetings at shorter intervals if he considers it to be appropriate. Throughout the duration of the works, the Contractors shall keep up to date records (and produce drawings) of the position, size and type of all services encountered or affected by the works and shall include these records with the Records of the Works as outlined in Clause 7.1.6. The Contractor shall allow in his programme and tender total for all work or time associated with service installations or diversions. The Contractor shall allow for all costs associated with restricted working above, below, and in the vicinity of existing services. Page 88 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 7.19 Tributaries The Contractor shall not obstruct the flood flow path of any tributaries such as to reduce the flood defence level of service. This particularly applies to works on County Brook. 7.20 Maintenance of Public Rights of Way The Contractor shall be responsible for constructing and maintaining safe accesses to all public rights of way affected by both the temporary and permanent works. 7.21 Existing Land Drains & Culverts The Contractor is responsible for locating, protecting and diverting (if required) existing land drains and culverts in order to facilitate the Works. Costs associated with restricted working above, below, and around existing drains, whilst ensuring adequate drainage of fields at all times, is deemed to be included in the Contractors tender total. 7.22 Rock Excavation The rates for rock excavation shall include for breaking out by hand or use of rock breaking machinery subject to the restrictions on noise and vibration outlined in this specification. Blasting will not be permitted. 7.23 Temporary Works The design, fabrication and installation of all temporary works, necessary for the Works to be constructed, shall be the responsibility of the Contractor. He shall submit detailed proposals and drawings of such temporary works to the Employer’s Representative for comment. The review of such proposals or drawings shall not relieve the Contractor of his total responsibility for the adequacy or safety of such temporary works. 7.24 Records The Contractor shall keep a record of all construction activities that could give rise to third party claims. These records shall include details of ground vibrations during piling or similar activities, road closures and obstructions, spillage of construction materials outside the Site, other off site accidents, movement of heavy or wide vehicles, emission of odours and any other activity or event that might give cause for complaint. 7.25 As Constructed Drawings The Contractor shall prepare record details, at regular intervals throughout contract, updating the Employer’s Representative’s original drawing in such a way as to show the actual construction with all pertinent levels, measurements, construction details, or details of building construction or installation for which he is responsible. Regular intervals shall be deemed to mean every 3 months or every 500m of, whichever is completed first. Co-ordinates of the centre-line of the pipe must be recorded and clearly shown on the drawings at maximum 20m Page 89 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 intervals and at all bends and fittings. These co-ordinates must be in Irish National Grid to two decimal places. The Contractor shall submit such details to the Employer’s Representative who, when satisfied that the drawings conform to the requirements of this Clause, shall arrange for the completion of drawings for final presentation in the form of ‘As Constructed Drawings’ to the Employer or his Representative. This shall include survey information of the as-built structures and details of services encountered. 7.26 Record of the Works The keeping and maintaining of Works records shall form an important element of the Contract. Records shall include the following, where applicable: Pre-construction records: - records of services, levels, properties, structures, roads and footpaths, sewer and other surveys etc. Records of settlement and settlement monitoring. Records of progress of the works, details of delays, etc. Records of vibration and vibration monitoring. Records of ground stabilisation works. Records of concreting works. Records of volumes of materials and types of materials excavated. Safety records. Quality control records. “As Constructed” Records. Records of any testing completed during the works. Other recording as the Employer’s Representative may see fit, and as may be necessitated by the Contractor’s method of working. The Contractor shall allow the appropriate staffing resources to adequately keep and maintain these records throughout the Contract. This shall consist of one technically trained member of the staff, permanently based on site. The person(s) shall be proficient at use of computer software for record keeping. The person(s) shall work on a continual basis with the Employer’s Representative’s staff in recording the progress of the works. The procedures and measures to be adopted shall be agreed at an early stage in the Contract. The records shall be kept in digital format and appropriate computer software shall be used for storage of records. Upon completion of the Works, the Contractor shall compile all records into an indexed and referenced “Record of the Works”, suitable for handing over to the Employer. The “Record” shall be supplied in paper format (3 number of copies), and in a suitable digital format. These records shall become the sole property of the Employer. Page 90 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 SECTION 8 – HEALTH AND SAFETY 8.1 General The Contractors attention is drawn to the requirements in Clause 6.3 of the Instructions to Tenderers – “Health and Safety Requirements”. The Contractor must comply with all current health and safety regulations and in particular the Safety, Health and Welfare at Work Act 2005 and the Safety, Health and Welfare at Work (Construction) Regulations 2006. A complete list of Irish Health and Safety legislation is available from the Health and Safety Authority, Publications Department, 10 Hogan Place, Dublin 2 or on the Health and Safety Authority web site www.hsa.ie. Under the Safety, Health and Welfare at Work (Construction) Regulations Contractors are required to appoint a competent Safety Co-ordinator from their organisation for the duration of the contract. The Contractor must be prepared to accept this responsibility and to allocate the necessary resources to comply with these regulations. The Contractor shall comply with the "Guidelines for Working on Roads – Guide to the Safety, Health and Welfare at Work (Construction) (Amendment) (No 2) Regulations 2008 (SI No 423 2008)" available from the above website. The Contractor shall comply with all safety instructions and guidelines issued by the ESB. The Contractor shall comply with all safety instructions and guidelines issued by the Eircom. 8.2 Preliminary Safety and Health Plan The Contractors attention is drawn to the Preliminary Safety and Health Plan which is included with the tender documents. This document should be incorporated into the Safety and Health Plan for the construction stage. The Safety and Health Plan for the construction stage shall contain a signed copy of the Contractors safety policy. It shall fully consider the contract restrictions and programming issues identified in this specification. The Safety and Health Plan for the construction stage needs to be developed before the commencement of the construction stage. It should, however, be continuously updated as the site work progresses. This document then becomes part of the safety file at the end of the contract period. 8.3 Emergency Arrangements – Contacts The Emergency Contact List, in the Employer’s standard form shall include the names of at least two responsible representatives of the Contractor and the telephone numbers at which they can be contacted at all times outside normal working hours Page 91 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 SECTION 9 – CONTRACTOR’S DOCUMENTS 9.1 Tender Stage The technical assessment of the different proposals submitted by the individual Tenderers requires the provision of a substantial level of detail in the tender submission. This section provides details of the minimum information requirements to be provided by the Tenderers with their submission and which will be used in the assessment of the technical merits of the proposal. The information provided will also be used to determine whether the Tenderer’s proposal is compliant with the Employer’s Requirements. The information requirements detailed herein are listed to ensure that the Tenderer provides details regarding specific issues and topics that the Employer has identified as being of particular relevance to the technical assessment of the proposals. The Tenderer is required to present the requested information in a similar structure to the detail provided below to facilitate the assessment of the proposal. Tenderers who consider that their proposals contain features of particular merit, which would not be reflected by a straightforward response to the detailed information requirements, are encouraged to provide any relevant additional information. This additional information should be included within the requested information requirements and presented in a manner compatible with the structured layout provided by the inclusion of additional sections or sub-sections as appropriate. Tenderers are particularly advised that failure to present the requested information in a structured concise and comprehensible layout may result in reduced marks being awarded for the technical merit of the proposal. Specifically the Tenderer will not be given the benefit of the doubt regarding his proposal if the details provided cannot be readily understood by the Employer for reasons of lack of clarity or poor presentation. The Tenderer is required to submit two hardcopies of his technical proposal, including A3 drawings as well as two PDF digit copies of the submission, including drawings. The Tender Submission should be presented in four-ring presentation binders, the minimum number of binders should be used, and individual sections should be printed double-sided. The Contractor is required to ensure that the digital copies of the submissions are referenced and presented in the same clear format as the hardcopies. 9.1.1 Covering Letter and Executive Summary A covering letter and executive summary is considered to be an important part of the Tenderer’s Proposal, and consequently the Tenderer is required to provide these elements within his proposal. The Covering Letter should be the central reference for the Tenderer’s Proposals and should include the following elements: Page 92 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Confirmation of the identity of the Contractor, constituent bodies, if any, and subconsultants and subcontractors; Summary of the basis for the Tender Proposal, by reference to the relevant documentation, existing site conditions and any other relevant factors; Confirmation that the submitted proposal is compliant with the Employer’s Requirements and the Planning Requirements and other Statutory Approvals; Identification of any deviations from the Employer’s Requirements, which should be detailed in a separate section of the proposal; Identification of any assumptions incorporated into the Tender Proposal as a result of any ambiguities, or other factors, and which should be detailed in a separate section of the proposal The Executive Summary should be a concise summary of the technical details of the Tenderer’s Proposal, and should be limited to approximately two to three A4 pages of text, supplemented by no more than four A3 schematics. The Executive Summary should provide details of the Tenderer’s technical proposals for both the Design/Build Works. The details provided for the Design/Build Works should be concerned with identifying the works to be constructed in each AREA of the site and the critical programme dates for this part of the contract. The Executive Summary should not contain any details in respect of the financial proposal or the Tenderer’s capabilities. 9.1.2 Documents to be Submitted at Tender Stage The Contractor is required to submit the following documents as part of his tender proposal. They will be used to award the qualitative marks as outlined in Appendix 6 to the Instructions to Tenderers. 9.1.1.1 Proposed Programme The proposed programme shall detail the design and the Construction Work identifying each phase of the works separately. Furthermore it shall identify how the work will be constructed taking account of the all the limitations and exclusion periods identified in the Works Requirements and EIS and shall include a programme for landowner liaison and public relations. Programme shall also account for Employer's Representative's Design Review periods and other such timescales identified under the Conditions of Contract. The Contractor’s attention is drawn to the layout and presentation details for the programme as detailed in Section 4 of the Works Requirements. 9.1.1.2 Proposed Method Statement The Contractor shall prepare a detailed method outlining his proposed methods of managing, planning and constructing the works. Each phase of the works will be identified separately and the MS shall outline how the Contractor plans to address all the limitations, requirements Page 93 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 and exclusion periods identified in the Works Requirements and EIS. This MS shall be linked to the work items outlined in the Proposed Project Programme and shall specifically address the limitations and exclusion periods identified in the Works Requirements and EIS. 9.1.1.3 Proposed Traffic Management Plan. With reference the Design Stage Traffic Management Plan contained in Volume D of the Contract Documents the Contractor shall prepare a traffic management plan (TMP) outlining his proposed methods of managing this element of the works. The TMP will identify each phase of the works separately and shall outline how the Contractor plans to address all the limitations, requirements and exclusion periods identified in the Works Requirements and EIS. 9.1.1.4 Mitigation of Environmental Impact The Contractor shall provide detailed information on how his proposed design and construction methodology has been devised to limit the impact of the works on the environment. The information shall be project specific and shall identify each phase of the works separately. 9.1.1.5 Proposed Public Relations Plan This plan will identify who will be responsible for Public Relations, it will identify the propose Public Liaison Officer providing details of his/her experience to undertake the role. The plan will also provide details in relation to how the Contractor proposes to manage pubic relation issues from Contract Award to Contract Completion. The plan shall make specific reference to items such as public awareness, publicity and complaints procedures. 9.1.1.6 Proposed Design for the Flood Defence Walls The Contractor shall provide drawings, material specifications, design philosophy and any other documentation he deems necessary to demonstrate the Employer’s Representative what his proposed design of the Works shall be. The Contractor is specifically required to provide information regarding the architectural and visual finishes and materials proposed for the project. Additional marks will be awarded for proposals to reuse/recycle materials and for the use of materials and construction methods with reduced CO 2 emissions. The Tenderer is required to confirm that his proposals for the Design / Build Works are compatible with the existing Statutory Approvals for the Works. Alternatively the Tenderer is required to confirm that he accepts the risk and responsibility associated with obtaining any required Statutory Approvals and that he has included in his Tender for any associated costs. 9.1.1.7 Proposed Detailed Landscaping Plan This item will be marked on the basis of a design package and drawings from a landscape architect. The proposed design will take account of the requirements of the EIS and will aim Page 94 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 to return the receiving to it original condition as soon as practical. The use semi-mature and mature planting in place of saplings is preferred. 9.1.1.8 Proposed Maintenance Plan The Maintenance Plan shall identify when and how maintenance will be required. It will cover all items of the design from landscaping to architectural and structural elements. It will identify what inspections should be carried out, when these inspections should be undertaken and outline a methodology for the upkeep of the various elements of the scheme including how access can be gained to the various areas following the completion of the works. In addition it will provide details on how elements of the scheme such as cladding can be replaced in the event that they become damaged. 9.1.1.9 Detailed Methodology for Project Control At a minimum this will identify the procedures for supervision of the construction phase, communication with the Employer/Employer's Representative and proposed measures to adequately integrate design and construction activities. 9.1.1.10 Methodology for Management of Safety during Construction The Contractor shall provide details of how he plans to manage the project safely during the construction phase including information on the proposed security arrangements for the works. The Contractor shall provide a written confirmation that the Contract Period is adequate for the safe construction of the Works. 9.1.1.11 Project Quality Plan The Contractor shall provide details of the proposed quality plan for the works. 9.2 9.2.1 Additional Information Required Prior to Tender Award Pension and Sick Pay Scheme It will be a condition of the award of this Contract that the main Contractor and all sub-contractors (domestic or otherwise) appointed by him will be required to provide evidence of membership of a Pension and Sick Pay Scheme, and to the satisfaction of the Employer prior to the signing of a Contract. 9.2.2 Tax Clearance Certificates In the case of a Contractor resident in the Republic of Ireland it shall be a pre-condition of an award of contract that the Tenderer shall within a stated period produce a current Tax Clearance Certificate or a Sub-Contractors C2 Certificate. Application forms (Ref. TC1 or TC3) for such Tax Clearance Certificates may be obtained from the Local Authority. Completed forms should be forwarded to the Office of the Revenue Commissioners, Sarsfield House, Francis Street, Limerick. Page 95 Client: Project Title: Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Non-resident Contractors and their proposed sub-contractors will require a statement from the Revenue Commissioners of the Republic of Ireland that they are satisfied as to the suitability for tax purposes of the Tenderer to be awarded a contract. They should apply to the Office of the Revenue Commissioners, Nenagh, Co. Tipperary for this statement, which should then be forwarded to the Local Authority. The Contractor and all sub-contractors (domestic or otherwise) shall continue to hold, in good standing, current issues of all such certificates for the duration of the works and the maintenance period and until final payment has been made. 9.2.3 Health and Safety Requirements The Contractor’s attention is drawn to the obligations arising under the relevant Clauses of the General Conditions of Contract consequent upon the Safety, Health and Welfare at Work (Construction) Regulations 2006 (S.I. No. 504 of 2006) and any amendment thereof (“the Regulations”). On the award of the Contract, the successful Tenderer will be appointed by the Employer as Project Supervisor (Design Phase and Construction Stages) in accordance with the provisions of the Regulations. The Contractor shall employ a Health and Safety Co-ordinator for the design and construction stages pursuant to the provisions of paragraph 11(2) and 17 (2) of the Regulations. The Tender Total shall include all costs which may be incurred by the successful Tenderer for this contract in complying with its obligations pursuant to the Regulations, including the cost of co-operating with the Project Supervisor (Design and Construction Stages) in co-ordinating activities with other contractors and/or sub-contractors on site. The Tenderer shall, if requested, submit his Safety Statement pursuant to Section 20 of the Safety, Health and Welfare at Work Act, 2005 to the Employer’s Representative. 9.2.4 Insurances Prior to award of the Contract the Contractor shall provide details of the terms of the insurance they propose to put in place or which they already hold and intend to use, to meet the requirements of the Conditions of Contract. Where the insurance terms submitted for approval provide for an excess sum i.e. a provision under which the insurer is not liable for the first €XXXX of a claim or for claims below that figure, the Contractor must include with a statement undertaking responsibility for dealing with third party claims, or parts of such claims within the excess amount. Page 96 Client: Project Title: 9.3 Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Design Build Works 9.3.1 Contractor’s Documents for Acceptance The Contractor shall submit detailed designs and drawings for acceptance by the Employer’s Representative after the Contract is awarded. Details of the form of submission, recipients, programme for submission etc shall be agreed at the start-up meeting following contact award. Although electronic submission is anticipated, the contactor shall provide up to two hard copies of submissions at no extra cost if requested to do so by the Employer’s Representative. The Contractor shall design and fully detail the Works to ensure they are constructed in an efficient and co-ordinated manner. The Contractor shall not commence any construction work until the relevant Contractor’s Documents have been submitted to the Employer’s Representative for comment and no comments have been given or the time specified for such has expired. All drawings submitted to the Employer’s Representative shall be thoroughly checked by the Contractor before submission. Information submitted by the Contractor shall include the following: layout plans of the proposed works with leading dimensions; general arrangement drawings of all principal components of the Works including plans, sections and elevations; Design calculations. The Contractor shall continually update the Contractor’s Documents throughout the design and construction stages to record all changes and developments in the designs. 9.4 As Built Contract Drawings The Contractor shall prepare ‘as-built’ drawings for the schemes in .dwg format to suit AutoCAD and in .pdf format. As built drawings shall include works below ground such as: service crossings, areas where weak ground is replaced, location of diverted services, obstructions to piling, location of walls and culverts whether left in place or not, change in detail of works below ground, unidentified services etc. As built drawings shall be produced using coordinates referenced to Irish National Grid. The Contractor shall supply draft .pdf sets of the ‘as-built’ drawings to the Employer’s Representative for review and on acceptance of these the Contractor shall supply the final .pdf and .dwg copies as well as a full set of the final hardcopy drawings. Page 97 Client: Project Title: 9.5 Bray Town Council River Dargle Flood Defence Works Date: October 2010 Project No: Y9114 Handover and Completion To ensure that the Employer’s staff are fully conversant with the scheme before handover, a structured handover process is required. This shall include a Handover Plan defined below, a handover workshop and training of the Employer’s staff if required. 9.5.1 Handover Plan The Contractor shall submit a handover plan to the Employer’s Representative at least six weeks prior to the anticipated completion date for the scheme. This shall comprise: The Maintenance Management Plan including the Landscape Management Plan element Details of the handover workshop and other training to be provided including handouts and proposed dates Health and Safety information As built drawings 9.5.2 Handover Workshop A handover workshop shall be held at each scheme a minimum of two weeks prior to anticipated completion. This shall include: A familiarisation tour of the scheme An overview of the environmental and landscape elements in terms of design intentions relating to long term maintenance and management Training in the operation of mechanical and electrical plant for operations staff if applicable. An overview of the information held in the Health and Safety File, the maintenance management plan and any operation and maintenance manuals Any unusual or innovative elements of the scheme described by reference to the as built drawings The handover workshop shall take place before, and shall be a condition precedent to, completion of the scheme. The client reserves the right to identify and retain title on materials during the course of the contract. This shall be done in writing by the client. Reuse of materials as much as possible is encouraged. Natural stone forming existing walls and parapets etc should be reused and incorporated back into the finished works as far as practicable.
