The following policy statement has been adopted by the Calderdale CAB District Management Committee (DMC): 1.1 The DMC accepts that in society groups of individuals are discriminated against on the grounds of race, colour, ethnic or national origin, religion, creed, disability, gender, being gay, lesbian, bisexual or trans-gendered, class, age, marital status or living with HIV/AIDS or related conditions. The bureau is convinced that it is morally wrong to hinder equality of opportunity on these grounds and further, recognises that passive policies will not in themselves provide a remedy. The bureau therefore undertakes to take positive steps to redress discrimination and to achieve equality of opportunity. 1.2 In addition to its social responsibility, the bureau recognises the statutory requirements laid down in the Race Relations Act, the Sex Discrimination Act, the Disabled (Employment) Acts of 1944 and 1958 and the Disability Discrimination Act 1995. It accepts and wishes to comply with the recommendations set out in the 1984 Commission for Racial Equality Code of Practice, the 1985 Equal Opportunities Commission Code of Practice, and the Code of Good Practice on the Employment of Disabled People. The bureau welcomes and supports the first positive legislative reference to lesbian and gay men contained in the European Commission's Code of Practice on Sexual Harassment 1991. 1.3 The bureau recognises that all relevant legislation promotes discrimination against lesbians, gay men and bisexuals. In particular it notes Section 28 of the Local Government Act 1988. The Rehabilitation of Offenders Act 1974 - Exemption Order l975 - discriminate against gay men by holding them liable for supposed crimes for which there is no heterosexual equivalent. 1.4 The bureau recognises that people who are HIV positive or are living with AIDS frequently experience discrimination. The bureau opposes all such discrimination on these grounds and will engage in positively combating this discrimination. 1.5 Although this Policy Statement concentrates on employment, it is the bureau's intention also actively to pursue equality of opportunity in the provision of all its services to the community and in its relationships with other providers of advice and services. The bureau accepts the need to challenge the notion that equal treatment is simply, and literally, a matter of treating everyone the same: that equal treatment is the same treatment. Additional steps may often be required to ensure equally appropriate treatment in relation to need. 1.6 In order to maintain good employment practice, the bureau recognises the need for a clear statement of its policy on equal opportunity. Good practice in the form of consistent criteria for selection, training, grievance and disciplinary procedures for paid staff will be established, used and monitored within the bureau, as will all other conditions of employment and work practices. Good practice in the form of consistent criteria for the selection, training and support of volunteers will also be established, used and monitored within the bureau. 1.7 This policy applies to all potential and actual staff, paid staff and volunteers and will be made known to all staff and applicants for jobs. Codes of Practice on Recruitment and Selection, Training, Conditions of Service and other areas of employment practice will be developed to facilitate the implementation of the policy.
