DEVELOPMENT CONTROL, 14th August 2006 APPENDIX Planning Permissions Granted by the Committee Details Application 06/0220 Use part of first floor premises in connection with existing casino, at The Sandcastle, Promenade. Conditions: 1 The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990 (as amended). 2 The development shall be carried out in accordance with the plans, drawings and details hereby approved, unless prior written agreement is given by the Council as Local Planning Authority to any slight variation. Reason: To ensure the development proceeds in compliance with this permission. 3 No part of the development shall be occupied prior to the implementation of the approved Travel Plan (or implementation of those parts identified in the approved Travel Plan as capable of being implemented prior to occupation). Those parts of the approved Travel Plan that are identified therein as being capable of implementation after occupation shall be implemented in accordance with the timetable therein and shall continue to be implemented as long as any part of the development is occupied. Reason: In order to ensure appropriate provision exists for safe and convenient access by public transport, cycle, and on foot as well as by car, in accordance with policy AS2 of the Blackpool Local Plan 2001-2016. 4 The evacuation plans specified in the flood risk assessment accompanying this application shall be implemented as part of this permission. Reason: To ensure that users of the site can be evacuated safely in the event of flooding, in accordance with policy NE10 of the Blackpool Local Plan 2001-2016. 5 The gaming area of the casino shall be restricted to the ground floor of the building only and shall occupy no more than 800 square metres of floorspace (excluding the card room). Reason: In order to comply with the provisions of policy RR5 of the Blackpool Local Plan 2001-2016 in relation to small scale extensions/improvements to existing casinos. REASONS FOR DECISION: The proposal has been considered in relation to policies RR1, RR5, RR11, NE10, AS1 and AS2 of the Blackpool Local Plan 2001-2016 and is in accordance with those policies and there are no other material considerations which weigh sufficiently against the proposal such as to warrant refusal. DEVELOPMENT CONTROL, 14th August 2006 APPENDIX Planning Permissions Granted by the Committee Application 06/0445 Details Erection of 2 wind turbines, solar panels, rainwater harvesting and geothermal heat pump, at the former Lido pool, Lytham Road. 1 The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990 (as amended). 2 The development shall be carried out in accordance with the plans, drawings and details hereby approved, unless prior written agreement is given by the Council as Local Planning Authority to any slight variation. Reason: To ensure the development proceeds in compliance with this permission. 3 At the reasonable request of the Local Planning Authority, following a complaint to the Council relating to noise emissions from the wind turbines, the Developer shall measure at its expense the level of noise emissions from the wind turbines (inclusive of existing background noise) as directed by the Local Planning Authority. Reason: In the interest of residential amenity and in accordance with policy BH3 of the Blackpool Local Plan 2001-2016. 4 In the event of the operation of the wind turbines causing noise problems to sensitive properties, as informed by the outcome of condition 3, the operation of the turbines shall thereafter be restricted to between 0700 hours and 2300 hours on any day. Reason: In the interests of residential amenity and in accordance with policy BH3 of the Blackpool Local Plan 2001-2016 5 The wind turbines and any associated plant shall be supported on adequate proprietary anti-vibration mounts as necessary to prevent the structural transmission of vibration and regenerated noise within adjacent or adjoining premises, and these shall be so maintained thereafter. Reason: In the interest of residential amenity and in accordance with policy BH3 of the Blackpool Local Plan 2001-2016. REASONS FOR DECISION: The application has been considered in relation to National Planning Policy Statement 22: Renewable Energy; Regional Planning Guidance 13, Policy ER13 Renewable Energy and Energy Efficiency; Joint Lancashire Structure Plan Policy 25 Renewable Energy; and policies LQ2, LQ8, BH3, AS1 and AS7 of the Blackpool Local Plan 2001-2016. It is considered to be in accordance with those policies and there are no other material considerations which sufficiently against the proposal such as to warrant refusal. DEVELOPMENT CONTROL, 14th August 2006 APPENDIX Planning Permissions Granted by the Committee Application 06/0463 Details Erection of a part single storey/part two storey front extension to form lift shaft and first floor side extension to concert room, Tyldesley Conservative Club, Palmer Road. 1 The development hereby permitted shall be begun before the expiration of three years from the date of this permission. Reason: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990 (as amended). 2 The development shall be carried out in accordance with the plans, drawings and details hereby approved, unless prior written agreement is given by the Council as Local Planning Authority to any slight variation. Reason: To ensure the development proceeds in compliance with this permission. 3 Notwithstanding the details of the materials shown on the submitted plans details of materials to be used on the external elevations shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. Reason: In the interests of the appearance of the locality, in accordance with policy LQ14 of the Blackpool Local Plan 2001-2016. 4 The first floor extension shall not be used until it has been provided with sound insulation to accord with the Building Regulations 2000 (as amended). All such insulation shall thereafter be retained. Reason: To safeguard the living conditions of the neighbouring properties, in accordance with policy BH3 of the Blackpool Local Plan 2001-2016. REASONS FOR DECISION: The extensions proposed have been considered in relation to policies BH3, LQ1 and LQ14 of the Blackpool Local Plan 2001-2016 and are in accordance with those policies and there are no other material considerations which weigh sufficiently against the proposal such as to warrant refusal. DEVELOPMENT CONTROL, 14th August 2006 APPENDIX Planning Permissions Granted by the Committee Application 06/0525 Details Erection of a detached two storey dwelling with associated access (reserved matters), at land adjacent to 23 Ashley Close Conditions: 1 Details of materials to be used on the external elevations shall be submitted to and agreed in writing by the Local Planning Authority prior to the development being commenced. Reason: In the interests of the appearance of the locality, in accordance with policy LQ4 of the Blackpool Local Plan 2001-2016. 2 Prior to the development hereby approved being first brought into use the car parking provision shown on the deposited plans shall be provided and shall thereafter be retained. Reason: In the interests of the appearance of the locality and highway safety, in accordance with policies LQ1 and AS1 of the Blackpool Local Plan 2001-2016. 3 Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or Order revoking and re-enacting that Order) the garage shall not be used for any purpose which would preclude its use for the parking of a motor car. Reason: In the opinion of the Local Planning Authority the retention of parking space within the site is of importance in safeguarding the appearance of the locality and highway safety, in accordance with policies AS1 and LQ1 of the Blackpool Local Plan 2001-2016. 4 Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any Order revoking and re-enacting that Order) no enlargement of the dwelling the subject of this permission shall be carried out without the express consent of the Local Planning Authority. Reason: To safeguard the living conditions of the occupants of nearby residential premises, in accordance with policy BH3 of the Blackpool Local Plan 2001-2016. 5 The premises shall be used for permanent residential occupation and for no other purpose (including any other Class C3 of the Schedule to the Town and Country Planning (Use Classes) Order 1987 or any Order revoking and re-enacting that Order). Reason: To safeguard the living conditions of the occupants of nearby residential premises, in accordance with policies RR2 and BH3 of the Blackpool Local Plan 20012016. 6 The obscure glazed screen to the rear first floor balcony, as indicated on the submitted plans, shall be provided prior to the dwelling being first occupied and shall thereafter be retained. Reason: To safeguard the living conditions of the occupants of the neighbouring premises to the south, in accordance with policy BH3 of the Blackpool Local Plan 2001-2016. REASONS FOR DECISION: The proposal would be contrary to the provisions and underlying objectives of policy RR5 of the Blackpool Local Plan 2001-2016 that limits casino development within Blackpool to regional casino development on the RR6.1 former Central Station site, large or small casino development at the Winter Gardens, and small scale extension of and/or improvements to existing casinos. Application 06/0300 Use of part ground floor, part first floor and second floor of premises as a casino, showbar, restaurant and ancillary facilities at Palatine Buildings, Promenade. REASONS FOR DECISION: The proposal would be contrary to the provisions and underlying objectives of policy RR5 of the Blackpool Local Plan 2001-2016 that limits casino development within Blackpool to regional casino development on the RR6.1 former Central Station site, large or small casino development at the Winter Gardens, and small scale extension of and/or improvements to existing casinos.
