AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE TOWN OF NAGS HEAD, NORTH CAROLINA BE IT ORDAINED by the Board of Commissioners of the Town of Nags Head, North Carolina, that the Code of Ordinances shall be amended as follows: PART I. That Chapter 15 Solid Waste Management, Sec. 15-7. Commercial establishment container requirements. be amended as follows: (a) All commercial establishments of more than two thousand (2,000) square feet shall be required to furnish a bulk container (see schedule in subsection (c) below) of the type approved by the director of public works. No rollout carts shall be used where bulk containers are required. The minimum requirements for bulk containers shall follow, as closely as possible, the schedule in subsection (c) of this section. (b) In the event that a commercial establishment of less than two thousand (2,000) square feet generates more refuse than can be handled by two (2) rollout carts, that establishment will be required after notification to provide a suitable bulk container loading pad, and a bulk container. (c) The minimum number and size of containers shall be as follows: (1) Multiple dwelling units, three (3) to four (4) units: one (1) two four-cubic-yard dumpster; (2) Multiple dwelling units, five (5) to (10) units: one (1) three four-cubic-yard dumpster; (3) Multiple dwelling units, eleven (11) to seventeen (17) units: two (2) three fourcubic-yard dumpsters; (4) Multiple dwelling units, eighteen (18) units and above: three (3) three fourcubic-yard dumpsters, or more if needed; (5) Trailer parks and mobile home parks: four (4) to six eight (68) cubic-yard dumpster capacity to be located at entrance of park; (6) Restaurants: four (4) yards/seventy-five (75) seats. Number of containers 1-50 seats = 1, 3-yard 51-75 seats = 1, 4-yard 76-150 seats = 2, 4-yard 151-225 seats = 3, 4-yard 226-300 seats = 4, 4-yard Cubic yards 3 (limit) 4 (limit) 8 (limit) 12 (limit) 16 (limit) 301-375 seats = 5, 4-yard 20 (limit) (7) Motels: seven four (74) yards/fifty (50) units. Number of containers 1-12 rooms = 1, 3-yard 12-25 rooms = 1, 34-yard 26-50 rooms = 1, 4-yard + 1, 3-yard 51-100 rooms = 2, 4-yard 101-150 rooms = 3, 4-yard 151-200 rooms = 4, 4-yard 201-250 rooms = 5, 4-yard Cubic yards 3 (limit) 34 (limit) 7 (limit) 8 (limit) 12 (limit) 16 (limit) 20 (limit) (8) Fishing piers: All piers shall be required to have a minimum of one (1) four-cubic-yard container. Additional containers shall be provided for the housing facilities as pertinent to this section; (9) Tackle shops: All tackle shops shall be required to have a minimum of three four (34) cubic yards; (10) Recreation and amusements: All shall be required to have a minimum of one (1) four-cubic-yard container. Additions shall be as deemed necessary by the amount and type of refuse generated; (11) Cottage courts: Number of containers 3-4 cottages = 1, 2-cubic yard 5-10 cottages = 1, 4-cubic yard 11-20 cottages = 2, 4-cubic-yard 21-30 cottages = 3, 4-cubic-yard 31-40 cottages = 4, 4-cubic-yard 41-50 cottages = 5, 4-cubic-yard Cubic yards 2 (limit) 4 (limit) 8 (limit) 12 (limit) 16 (limit) 20 (limit) (12) Grocery, retail, and office establishments: All grocery and retail stores and offices not listed above shall provide mobile rollout containers or bulk containers in accordance with the following schedule, which is based on the square footage contained within the exterior walls of each store. (13) and (14) NO CHANGES PART II. All ordinances or parts of ordinances in conflict with this ordinance are hereby repealed. PART III.
