Monday to Friday from 9.00am – 5.00pm. Any person is eligible to object. Anyone wishing to object or make representations must lodge with the Clerk of the Licensing Board a written notice of objection or representation by the last date for lodging objection/representations as contained in the notice of application on the Council’s Website or the Site Notice at the Premises. It is the responsibility of the person making the objection or representation to ensure that the Board has received it and it may be helpful to lodge it in one of the following ways: Delivered by hand within the time specified; or Posted (by registered or recorded or special delivery post) so that in the normal course of post it might be expected to be delivered within that time; or Faxed within that time and an acknowledgement of the fax is kept; or Emailed within that time and an acknowledgement of the email is kept. It is the responsibility of the person making the objection or representation to ensure that the Board has received it. Grounds for objecting Any person may, by way of notice to the Licensing Board1. object to the application on any ground relevant to one of the grounds for refusal specified in section 23(5), a. that the subject premises are excluded premises, b. that the application must be refused under section 25(2), 64(2) or 65(3), c. that the Licensing Board considers that the granting of the application would be inconsistent with one or more of licensing objectives,* d. that, having regard toi. that nature of the activities proposed to be carried on in the subject premises, ii. the location, character and condition of the premises, and iii. the persons likely to frequent the premises, the Board considers that the premises are unsuitable for use for the sale of alcohol e. that, having regard to the number and capacity ofi. licensed premises, or ii. licensed premises of the same or similar description as the subject premises in the locality in which the subject premises are situated, the Board considers that, if the application were to be granted, there would, as a result, be overprovision of licensed premises or licensed premises of that description, in the locality 2. make representations to the Board concerning the application, including, in particular, representationsi. ii. in support of the application, as to modifications which the person considers should be made to the operating plan accompanying the application , of as to condition which the person considers should be imposed. iii. *Licensing Objectives preventing crime and disorder securing public safety preventing public nuisance protecting and improving public health protecting children from harm
