Crossbows and Handguns and Drones - Oh My!

As legislative sessions continue across the country, the archery and bowhunting community is paying particular attention to the state of New York, where the governor has made a personal challenge to the state Legislature to take action on the longlanguishing subject of crossbows for use during the general archery season.

And elsewhere across the country, a variety of measures are seeing action that could affect archers and bowhunters in specific states.

New York

In his State of the State address last month, Gov. Andrew Cuomo encouraged New York lawmakers to legalize crossbow hunting as part of his statewide push to attract visitors to the state's natural sites, while also calling for $40 million to establish 50 public access sites around the state for hunting, fishing, bird-watching and hikers.

"The governor's announcement ... will help pave the way for the state's sportsmen and -women to legally use crossbows in

New York State," read a statement issued by the NY Crossbow Coalition President Rick McDermott. "Over the past few decades, the number of hunters has steadily declined. With the governor's support, we are hopeful that the Legislature will agree to take action to reverse this trend by allowing DEC to provide additional hunting opportunities for crossbow hunters."

A specific bill to place the regulatory authority for crossbow use with the Department of Environmental Conservation is anticipated, but has not been officially introduced.

Maryland

Senate Bill 231, which would permit bear-hunting archers in western Maryland counties to carry handguns for personal protection, passed the full Senate Wednesday, Feb. 12, by a 43-2 margin. It now moves to the House of Delegates for action. A similar bill introduced in the 2013 session failed to pass.

While state-by-state regulations vary, most simply permit those with valid state concealed handgun permits to carry while bowhunting. Still, at least 16 states continue to prohibit bowhunters from carrying a firearm for protection.

Senator George Edwards (R) - Garrett, Allegany and Washington Counties sponsored the bill.

Virginia

Following years of disappointments, hunters in Virginia are encouraged by a pair of bills that would permit Sunday hunting on private land with landowner permission.

House Bill 1237 was approved last week and sent to the Senate Committee on Agriculture, Conservation and Natural

Resources. Senate Bill 154 is expected to go before the full Senate later this week. The bill provides that a person may hunt waterfowl, subject to restrictions imposed by the Director of the Department of Game and Inland Fisheries, and a landowner and his immediate family or a person with written permission may hunt or kill any wild bird or wild animal, including nuisance species, if they hunt on the landowner's property.

Although generally considered a popular bipartisan effort, the bills are expected to face pushback from some rural area representatives and the Virginia Farm Bureau.

Alabama

Senate Bill 340 proposes an Amendment of the Constitution of Alabama 1901, amending Amendment 597, to clarify that the people have the right to hunt, fish, and harvest wildlife subject to reasonable regulations that promote conservation and management of fish and wildlife and preserve the future of hunting and fishing. If approved by the Legislature, the

Amendment would go before voters during the next General Election.

Also in Alabama, Senate Bill 240 would prohibit the use of unmanned drone aircraft to interfere with legal hunting or fishing activities or otherwise used to harass.

"No person shall willfully and knowingly prevent, obstruct, impede, disturb, or interfere with, or attempt to prevent, obstruct, impede, disturb, or interfere with any person in legally hunting or fishing pursuant to the rules and regulations of the Department of Conservation and Natural Resources and the law of the State of Alabama. The prohibition in subsection

(a) includes, but is not limited to, the use of a drone to intentionally and knowingly harass a person who is legally hunting or fishing."

The measure passed the Alabama Senate Feb. 12 and currently is awaiting action in the House Committee on Agriculture and Forestry.

Utah

And finally, Utah House Bill 268, which would have allowed restricted individuals, including convicted felons, to possess archery equipment for lawful hunting and recreational purposes, was tabled and is likely dead. The bill, sponsored by Rep.

Brian Greene (R) Pleasant Grove, sought to redefine what constitutes a "dangerous weapon" as it related to restricted individuals.

Under the measure, archery equipment, including crossbows, would be specifically excluded from the category of dangerous weapon.
