CITY OF MORO SPECIAL COUNCIL MEETING MINUTES OF APRIL 17, 2014 The Moro City Council met for a Special Council Meeting on, Tuesday, April 17, 2014 @ 7:00 PM at the Moro City Hall. The following were present Mayor Andy Anderson; Councilors Bert Perisho, Jim Payne, Seth VonBorstel, Bryan Cranston; Rene’ Moore-City Administrator (CA/PM); John EnglishDirector of Public Works (DPW). Visitors – via telecom were Preston Van Meter and Aaron Lawler from Kennedy/Jenks, City Engineers. WASTEWATER SYSTEM IMPROVEMENT PROJECT….. The Moro City Council met for a Special Council Meeting to approve and authorize the added loan amount from IFA and award contract to be able to move forward with the Wastewater Improvement Project. Amendment Number 1 – This amendment is made and entered into by and between the State of Oregon, acting by and through the Oregon Infrastructure Finance Authority (IFA) and the City of Moro, and amends the Financing Contract dated April 23, 2013, for Project, Number Y13007. The purpose of this amendment is to increase the Loan Amount to pay for engineering and construction cost overruns. Amend the Key Terms in Section 1 of the Contract as follows: Estimated Project Cost: $2,098,470 Loan Amount: $1,348,470 Grant Amount: $750,000 There was a motion (von Borstel/Cranston) authorizing the Mayor to sign Amendment Number 1 as written. Motion Carried Unanimously Resolution Number 2014-02 – Resolution No. 2014-02 of the City of Moro authorizing a Financing Loan from the Water Fund by entering into a Financing Contract with the Oregon Infrastructure Finance Authority (IFA). There was a motion (Perisho/Cranston) to authorize the Mayor to execute Resolution No. 2014-02 stating the Financing Contract and Promissory Note and such other documents as may be required to obtain financial assistance including a grant from the IFA in the amount of $750,000 and a financing loan from the IFA on the condition the that principal amount of the loan from IFA is not in excess of $1,348,470 and the interest rate is 1% per annum. Motion Carried Unanimously City of Moro, Promissory Note – For the value received, the City of Moro unconditionally promises to pay in lawful money of the USA to the order of the State of Oregon, acting by and through the Oregon Infrastructure Finance Authority (IFA), the principal sum of $1,348,470 or as much as is disbursed under the contract, plus interest on each disbursement at the Note Interest Rate of 1% per annum, from the disbursement date until paid. There was a motion (Cranston/von Borstel) authorizing the Mayor to sign the Promissory Note. Motion Carried Unanimously IFA Project Budget – There was a motion (Cranston/Perisho) approving the new budget for the Wastewater Improvement Project being… Motion Carried Unanimously Construction $1,722,150 Construction Contingency $150,000 Engineering $216,320 with a balance of $98,897 remaining Legal fees $10,000 Special Council Meeting Minutes April 17, 2014 Engineer’s Recommendation of Award for the Wastewater System Improvement Project – The City of Moro received and opened bids from contractors at 2:00pm on March 20 th, 2014 for the Wastewater Improvement Project for which the Contract Documents were prepared by Kennedy/Jenks Consultants. Construction includes: Removal of biosolids and land application Install 1,000 feet of 10” gravity sewer pipe with 5 manholes Install new wastewater influent channel with screen and 3” parshall flume Modifications to raise the elevation of lagoons 2 and 3 Construction of a new lagoon 4 Demolition of existing lagoon level control structures and construct new lagoon transfer piping and structures. Construction of new chlorine contact basin and chlorination feed equipment Construction of new final effluent irrigation pump station Associated site work, fencing, and potable water systems piping, electrical work, instrumentation, painting and demolition. The apparent lowest bid was submitted by Anchor Construction Contractors of Othello which was withdrawn on March 25th, 2014 due to errors and omissions in their bid. K/J also determined Anchor Construction to not be a qualified contractor to complete the work. Therefore, the second lowest bid submitted by R&G Excavation is considered the lowest bid with a base price of $1,662,000 along with two bid alternates #1 $53,550, #2 $6,600. Based on the information gathered, K/J recommends the City of Moro award the Wastewater System Improvements Project to R&G Excavating Inc. for a base bid amount of $1,662,000 and Bid Alternates 1 and 2 for $53,550 and $6,600, respectively. The total recommended award to R&G Excavating with base bid and alternates is $1,722,150. There was a motion (Perisho/von Borstel) to award R&G Excavating Inc. the Wastewater Improvements Project from recommendations of our Engineers, Kennedy/Jenks for $1,722,150, contingent on the final signing of the funding package from IFA. Motion Carried Unanimously The City’s intent to award within seven days after the issuance of the Notice of Intent to Award Contract will expire on April 25, 2014. At that point the City can issue a Notice to Proceed. The first priority of the project will be the removal of biosolids and land application. K/J will be directly in contact with the farmer to make sure this proceeds smoothly. There will be a “kick off” meeting for the project between all three parties, being….the City of Moro, Kennedy/Jenks Engineering and R&G Excavating. Date and time of the meeting to come. OTHER ITEMS – New City Hall – Rene’ Moore (CA/PM) shared with the Council and Mayor a spreadsheet for costs associated with the constructing of the New City Hall. After all the value engineering that took place the project came in at $277,384. One payment has been made to Griffin Construction in the amount of $27,187. Ms. Moore will be keeping a close eye on the budget and everything else in relation to the new City Hall. There was discussion about the curbing around the parking lot. The discussion was to remove the extruded curbs and continue the concrete curbing on the outside of the future parking area. The City has contacted Bloom Construction to see what it would cost to remove the dirt of the future parking Special Council Meeting Minutes April 17, 2014 area and add gravel so the concrete curbing could be continued. Rene’ Moore (CA/PM) shared the layout of the office area with the new privacy counter that will be constructed to help with safety of the people in the office area. People will enter the office up to the counter instead of walking directly into the office desk area. John English (DPW) brought up the topic of gutters on the building. Yes, there will be gutters and he will have his drain pipe ready to go when we have a better idea of location. VACATION – John English (DPW) shared with the Council he would like to take some vacation time from June 20-25.
