(2) The holder of a technical approved person certificate shall not exercise privileges other than those granted by the approval and the appropriate rating held by such holder. (3) The holder of a technical approved person certificate shall not exercise the privileges unless they are a current and bona fide member of the technical approved person’s scheme, and that such privileges shall only be extended to other members of technical approved person’s scheme. Categories of aircraft 56.01.3 (1) An approved person certificate may be issued in respect of any of the following categories of nontype certificated aircraft: (a) aeroplanes,; (b) helicopters; (c) gyroplanes and gyro gliders; (d) microlights aeroplanes, including weight shift microlights (e) gliders, including power assisted and touring gliders; (f) manned captive and manned free balloons; (g) powered-paragliders, powered parachutes and powered-paratrikes as well as powered hang-gliders or any other powered derivative thereof. (h) all other aircraft non type certified aircraft not listed above. Classes of certificates 56.01.4(1) The classes of certificates for an approved person are – (a) APC1: an apprentice with a restricted basic maintenance certificate, in order to gain practical experience as prescribed in Document SA-CATS 56 under direct supervision of an AMO, APC5 or APC6 approved for the purpose; (b) APC2: an apprentice with a restricted basic maintenance and repair certificate having completed the APC1 program and examination, in order to gain further practical experience as prescribed in Document SA-CATS 56, under direct supervision of an AMO, APC5 or APC6 approved for the purpose; (c) APC3: a technical approved person having completed the APC2 program and examinations, and gained the experience as prescribed in Document SA-CATS 56, and approved for a basic maintenance certificate, and to gain further practical experience towards higher ratings as prescribed in Document SA-CATS 56, under direct supervision of an AMO, APC5 or APC6 approved for the purpose; (d) APC4: a technical approved person having completed the APC3 program and examinations, and gained experience as prescribed in Document SA-CATS 56, and approved for a general maintenance and repair certificate, and to gain further practical experience towards higher ratings as prescribed in Document SA-CATS 56, under direct supervision of an AMO, APC5 or APC6 approved for the purpose; (e) APC5: a technical approved person having completed the APC4 program and examinations, and gained experience as prescribed in Document SA-CATS 56, and approved for a general maintenance, repair and inspection certificate, and to gain further practical experience towards higher ratings as prescribed in Document SA-CATS 56, under direct supervision of an AMO or APC6 approved for the purpose; (f) APC6: a technical approved person having completed the APC5 program and examinations, and gained experience as prescribed in Document SA-CATS 56, and approved for a heavy maintenance, repair, and inspection certificate, which may include an approval for modifications and overhauls, in terms of 56.04.4(5) (c) and (d); (g) APC7: a natural person who has completed a build or assembly of a NTCA from start to completion and obtained an authority to fly for the specified aircraft, who may exercise the privileges and limitations of a technical approved persons as specified on their certificate (h) APC8: a technical approved person approved to inspect and sign out any amateur build, assembled, production, rebuild or restored non-type certified aircraft during all fazes and completion of such projects. Groups of Airframes and Engines 56.1.5 (1) The certificates referred to in sub-regulation (1) may be issued in one or more of the following groups: (a) Airframes are classified into the following groups: (i) Group 1 A– aeroplanes of wooden construction, with a MTOW of 5 700 kilograms or less; (ii) Group 1 B– aeroplanes of wooden construction, with a MTOW of 1200 kilograms or less (ii) Group 1 C– aeroplanes of wooden construction, with a MTOW of 600 (750??) kilograms or less; (iv) Group 2 A– aeroplanes constructed of composites, with a MTOW of 5 700 kilograms or less; (v) Group 2 B– aeroplanes constructed of composites, with a MTOW of 1200 kilograms or less; (vi) Group 2 C - aeroplanes constructed of composites, with a MTOW of 600 (750??) kilograms or less; (vii) Group 3 A – aeroplanes of fabric-covered tubular-metal construction, with a MTOW of 5 700 kilograms or less; (viii) Group 3 B – aeroplanes of fabric-covered tubular-metal construction, with a MTOW of 1200 kilograms or less; (ix) Group 3 C – aeroplanes of fabric-covered tubular-metal construction, with a MTOW of 600 (750??) kilograms or less; (x) Group 4 A– unpressurised aeroplanes of all-metal construction, with a MTOW of 5 700 kilograms or less; (xi) Group 4 B– unpressurised aeroplanes of all-metal construction, with a MTOW of 1200 kilograms or less; (xii) Group 4 C– unpressurised aeroplanes of all-metal construction, with a MTOW of 600 (750??) kilograms or less; (xiii) Group 5 – unpressurised aeroplanes of all-metal construction, with a MTOW exceeding 5 700 kilograms; (xiv) Group 6 – pressurised aeroplanes of all-metal construction, with a MTOW of 5 700 kilograms or less; (xi) Group 7 – pressurised aeroplanes of all-metal construction, with a MTOW exceeding 5 700 kilograms; (xii) Group 8 – aeroplanes constructed of composites, with a MTOW exceeding 5 700 kilograms; (xiii) Group 9 - rotorcraft powered by reciprocating engines, with a MTOW of 3175 kilograms or less; (xiv) Group 10 – rotorcraft powered by turbine jet engines, with a MTOW of 3175 kilograms or less; (xv) Group 11 – rotorcraft powered by turbine jet engines, with a MTOW exceeding 3175 kilograms; (xvi) Group 12 – balloons; (xvii) Group 13 – Gyro copters powered by reciprocating engines, with an MTOW of 2000Kg or less; (xviii) Group 14 – microlight aeroplanes including weight shift trikes with a MTOW not exceeding 450kg; and (b) (ixx) Group 15 – Gliders, power assisted gliders and touring gliders. (xx) Group 16 – powered-hang gliders, powered-paragliders, poweredparachutes and powered para-trikes or any other powered derivative thereof. (xxi) Group 17 - all other non-type certified aircraft not specified in this part, excluding parachutes. Engines are classified into the following groups: (i) Group 01 A – previously certified horizontally opposed normally- aspirated piston engines; and (ii) Group 01 B – all NTC aviation horizontally opposed normally- aspirated piston engines; and (iii) Group 02 A – previously certified horizontally opposed turbo-normalised, turbo-charged and supercharged piston engines; and (iv) Group 02 B – all NTC aviation horizontally opposed turbo-normalised, turbocharged and supercharged piston engines; and (v) Group 03 A – previously certified in-line piston engines; and (vi) Group 03 B – all NTC in-line piston engines; and (vii) Group 04 A – previously certified radial engines; and (viii) Group 04 B – all NTC radial engines; and (ix) Group 05 A – previously certified turbine jet engines; and (x) Group 05 B – all NTC turbine jet engines; and (xi) Group 06 – all other NTC engines, including automotive and non-aviation engines, and (xii) Group 07 – all two stroke engines, and (xiii) Group 08 – all Diesel and Turbo Diesel engines, and Group 09 – all electrical engines (xiv) Categories of Ratings 56.1.6 (1) The categories of ratings for an APC3: basic maintenance certificate for approved persons are – (a) (b) Category A rating, for all types of – (i) A1: aeroplanes registered in the Republic, either singly or in the groups referred to in regulation 56.01.3?; or (ii) A2: rotorcraft registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; Category C rating, for all types of engines installed in – (i) C1: aeroplanes registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; or (ii) C2: rotorcraft registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; and (4) The categories of ratings for an APC4: general maintenance and repairs certificate for approved persons are – (a) (b) Category A rating, for all types of – (i) A1: aeroplanes registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; or (ii) A2: rotorcraft registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; Category C rating, for all types of engines installed in – (i) C1: aeroplanes registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; or (ii) C2: rotorcraft registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; and (5) The categories of ratings for an APC5 general maintenance and APC6 heavy maintenance, repairs and inspections for approved persons are – (a) Category A rating, for all types of – (i) A1: aeroplanes registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; or (ii) A2: rotorcraft registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; (b) (c) Category C rating, for all types of engines installed in – (i) C1: aeroplanes registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; or (ii) C2: rotorcraft registered in the Republic, either singly or in the groups referred to in regulation 56.04.4; and Category W rating, for any maintenance, removal, refitting and inspections to – (i) class A: avionic, radio and radar equipment; (ii) class E: electrical equipment; (iii) class I: instrument equipment; or (iv) class O: combination of such equipment, installed in aircraft registered in the Republic. (e) Category X rating, for the removal, repair, installation and inspections of – (i) class 1: compasses; (ii) class 2 engine ignition equipment; (iii) class 3: fixed and variable pitch propellers; aa) Cat A; fixed pitch propellers of metal construction bb) Cat B; fixed pitch propellers of composite construction cc) Cat C; fixed pitch propellers wood dd) Cat D; variable pitch ground adjustable propellers of metal construction ee) Cat E; variable pitch ground adjustable propellers of composite construction ff) Cat F; variable pitch ground adjustable propellers of wooden construction gg) Cat G: all constant speed propellers (iv) class 4: instruments, including or excluding electrically operated instruments; (v) class 5: electrical equipment; (vi) class 6: automatic pilots; or (vii) class 7: avionic equipment, including or excluding equipment employing pulse techniques. (viii) class 8: welding; (i) Group 1: Aluminium frames or structures, or (ii) Group 2: Steel frames or structures installed in aircraft registered in the Republic. (6) The categories of rating for an APC 6 heavy maintenance, a Category B rating for airframe overhauls, modifications and inspection, subject to obtaining an approved facility certificate issued by the Director or the body designated in terms of Part 149 as the case may be, for all types of – (a) Category B rating, for groups and types of – (i) B1: aeroplanes registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; or (ii) B2: rotorcraft registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; (b) In the case of an APC 6 heavy maintenance, a Category D rating for engine overhauls modifications and inspection, subject to obtaining an approved facility certificate issued by the Director or the body designated in terms of Part 149 as the case may be, for all types of engines installed in – (c) Category D rating, for groups and types of engines installed in – (d) (i) D1: aeroplanes registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; or (ii) D2: rotorcraft registered in the Republic, either singly or in the groups referred to in regulation 56.01.3; and Category W rating, for any maintenance, repairs, removal, refitting and inspections to – (i) class A: avionic equipment; (ii) class E: electrical equipment; (iii) class I: instrument equipment; or (iv) class O: combination of such equipment, installed in aircraft registered in the Republic. (e) Category X rating, for the removal, repair, installation and inspections of – (i) class 1: compasses; (ii) class 2 engine ignition equipment; (iii) class 3: fixed and variable pitch propellers; aa) Cat A; fixed pitch propellers of metal construction bb) Cat B; fixed pitch propellers of composite construction cc) Cat C; fixed pitch propellers wood dd) Cat D; variable pitch ground adjustable propellers of metal construction ee) Cat E; variable pitch ground adjustable propellers of composite construction ff) Cat F; variable pitch ground adjustable propellers of wooden construction gg) Cat G: all constant speed propellers (iv) class 4: instruments, including or excluding electrically operated instruments; (v) class 5: electrical equipment; (vi) class 6: automatic pilots; or (vii) class 7: avionic equipment, including or excluding equipment employing pulse techniques. (viii) class 8: welding; (i) Group 1: Aluminium frames or structures, or (ii) Group 2: Steel frames or structures installed in aircraft registered in the Republic. (7) The categories of technical approved person instructor ratings that may be awarded to APC5 and APC6 approved persons are – (a) an APC5 Grade One technical approved person instructor rating; and (b) an APC 6 Grade Two technical approved person instructor rating. Competency 56.01.7 The holder of a technical approved person certificate shall not exercise the privileges granted by the approval and rating unless such holder maintains competency by complying with the appropriate requirements prescribed in this Part, Part 44 and the technical approved persons’ manual of procedure. Consumption of alcohol and drugs 56.01.8 No technical approved person shall – (a) carry out any maintenance on an aircraft, its components or equipment while the concentration of alcohol in any specimen of blood taken from any part of his or her body is more than 0.02 gram per 100 millilitres, or when under the influence of any drug having a narcotic effect; or (b) consume alcohol or take any drug having a narcotic effect whilst carrying out maintenance on an aircraft, its components or equipment. Language 56.01.9 A technical approved person shall have sufficient ability in reading, writing, speaking and understanding the English language to enable him or her to adequately carry out his or her responsibilities as an approved person. Register of approved persons 56.01.10 (1) The Director, or the organisation designated for the purpose in terms of Part 149, as the case may be, shall maintain a register of all approved person certificates issued, renewed or reissued in terms of this Part. (2) The register shall contain the following particulars – (a) the full name of the holder of the certificate; (b) the physical and postal address of the holder of the certificate; (c) the date on which the certificate was issued, renewed or reissued; (d) particulars of the ratings held by the certificate holder; (e) details of the physical place where work is performed as applicable; and (e) the nationality of the holder of the certificate. (3) The particulars referred to in sub-regulation (2) shall be recorded in the register within seven days from the date on which the certificate is issued, renewed or reissued. (4) The register shall be kept at a safe place at the office of the Director or, the organisation designated for the purpose in terms of Part 149, as the case may be. (5) The name, rating and currency details on the register referred to in sub-regulation (1) may be made available to any person upon formal application and providing reasons for applying for such details. Designation of examiners 56.01.11 (1) The Director, or the body designated in terms of Part 149, may designate examiners for a period not exceeding two years, in respect of the valid rating or ratings held by the examiner to conduct oversight and inspections on students, instructors, technical approved persons, approved facilities and aircraft on behalf of the designated body as instructed. – (2) The privileges referred to in sub-regulation (1) shall be exercised and performed according to the conditions, rules, requirements, procedures or standards as prescribed in Document SA-CATS 56. (3) The Director, or body designated in terms of Part 149, shall sign and issue to each designated examiner a document which shall state the full name of such examiner and contain a statement that – (a) (b) such examiner has been designated in terms of sub-regulation (1); and such examiner is empowered to exercise the privileges referred to in sub-regulation (1) and in on the. (4) The application to be considered for designation as referred to in sub-regulation (1) shall be accompanied by – (a) detail of the licence and ratings to which the application applies; and (b) the appropriate fee as prescribed in Part 187. (5) The designated body, authorised persons shall conduct oversight over Part 149 activities of a designated examiner on an annual basis. Re-designation as DE 56.01.12 (1) An application for renewal as designated examiner must be made on the prescribed form not less than 30 days prior to the date that the designation expires, together with the fee as prescribed in Part 187. (2) Submission of such application does not automatically entitle the applicant to continue to exercise the privileges of a DE after the expiry date. Register of DE’s 56.01.13 (1) The Director, or the designated body in term of Part 149 shall maintain a register of all DE’s. (2) The register referred to in sub-regulation (1) shall contain the following details – (a) name; (b) category and privileges of the designation or approval; (c) licences and ratings held; and (d) expiry date. Responsibilities of certificate holder 56.01.14 (1) The holder of an approved person certificate shall maintain a record of experience in the prescribed logbook up to date in which he or she shall record details of all maintenance, repairs, modifications, overhauls and inspections, carried out. (2) The format of the logbook and the manner in which it will be kept shall be as prescribed in CATS 56. Training 56.01.15 Training as required by this Part shall only be provided by the holder of an approved organisation in terms of this part, or an approval issued in terms of Part 141. Logbooks 56.01.16 (1) Any person presenting or undertaking training under the TAP scheme, or a holder of an TAP certificate shall maintain a logbook and shall record therein all work carried out on an aircraft and its components. (2) The form of and information to be contained in a logbook referred to in sub-regulation (1), and the manner in which such logbook shall be maintained, are as prescribed in Document SA-CATS 56. (3) No alterations of a logbook shall be made once it is signed off by a designated person. Suspension and cancellation of certificate and appeal 56.01.17(1) The procedure for the suspensions and cancellation of approved person certificate and appeal shall be prescribed in the technical approved persons manual of procedure. SUBPART 2: Technical Approved Person Certificate and Rating Requirements for approval 56.02.1 (1) An applicant for the issuing of a technical approved person certificate with the appropriate category and rating shall– (a) not be less than 18 years of age; (b) have successfully passed the theoretical knowledge examinations as determined by the Director, or the body designated in terms of Part 149, referred to in regulation 56.02.3; and (c) have submitted documented evidence of the required practical work experience as an APC 1 or APC 2 in accordance with the TAP manual of procedures, on the particular group, class or type of aircraft, engines, airframes, components and systems referred to in regulation Subpart 1. (2) an application for an APC 1 certificate shall be exempt from the provisions of (b and c) above Training 56.02.2 (1) An applicant for the issuing of an approved person certificate in classes APC3, APC4, APC5 and APC6, Category A rating, shall have successfully attended an approved training program with an approved facility, original equipment manufacturer or their agent as approved by the Director, or the body designated in terms of Part 149, as prescribed in Document SA-CATS 56, in the following classes, groups or categories; (a) for aeroplanes, in the respective groups of; (1) wood and fabric covered construction ; or (2) composite construction; or (3) tubular metal and fabric covered construction; or (4) all metal construction; and (5) any combination of the above, and (b) aeroplanes in the respective categories of; (i) microlights and weight shift aeroplanes with a MTOW not exceeding 450kg (ii) aeroplanes general with a MTOW not exceeding 600kg, or (iii) aeroplanes general with a MTOW not exceeding 1200kg, or (iv) aeroplanes general with a MTOW not exceeding 5700kg, or (v) Gliders, or (vi) Touring motor gliders, and (vii) any combination of the above, (c) for rotorcraft, in the respective categories of; (i) gyrocopters and gyro gliders with a MTOW no exceeding 2000kg, or (ii) helicopters with a MTOW not exceeding 3175kg, or (iii) helicopters with a MTOW not exceeding 5700kg, (c) for all other aircraft not listed above, in the respective categories of; (i) balloons, or (ii) powered powered-hang gliders, powered-paragliders, powered- parachutes and powered para-trikes or any other powered derivative thereof, or (iii) any combination of the above (2) An applicant for the issuing of an approved person certificate in classes APC3, APC4, APC5 and APC6, Category C rating, shall have successfully completed an approved training program with a facility, original equipment manufacturer or their agent as approved by the Director, or the body designated in terms of Part 149, as prescribed in Document SA-CATS 56, in the following classes, groups or categories; (a) for engines, in the respective categories of; (i) piston engines general, and (ii) horizontally opposed normally aspirated piston engines; or (iii) horizontally opposed turbo normalised, turbo charges and supercharged piston engines, or (iv) in-line piston engines, or (v) radial engines, or (vi) turbine jet engines general, or (vii) other NTC engines, including automotive and non-aviation engines, (vii) two strokes engines, or (viii) diesel and turbo diesel engines (ix) electrical engines, or (x) any combination of the above. (3) An applicant for the issuing of an approved person certificate in classes, APC5 and APC6, Category W rating, shall have successfully completed an approved training program with a facility, original equipment manufacturer or their agent as approved by the Director, or the body designated in terms of the Act, as prescribed in Document SA-CATS 56, in the following classes, groups or categories; (a) for equipment, in the respective categories of; (i) class A: avionic, radio and radar equipment; (ii) class E: electrical equipment; (iii) class I: instrument equipment; or (iv) class O: combination of such equipment, (4) An applicant for the issuing of an approved person certificate in classes and APC6, Category X rating, shall have successfully completed an approved training program with a facility, original equipment manufacturer or their agent as approved by the Director, or the body designated in terms of the Act, as prescribed in Document SA-CATS 56, in the following classes, groups or categories; (a) for equipment, in the respective categories of; (i) class 1: compasses; (ii) class 2 engine ignition equipment; (iii) class 3: fixed and variable pitch propellers; aa) Cat A; fixed pitch propellers of metal construction bb) Cat B; fixed pitch propellers of composite construction cc) Cat C; fixed pitch propellers wood dd) Cat D; variable pitch ground adjustable propellers of metal construction ee) Cat E; variable pitch ground adjustable propellers of composite construction ff) Cat F; variable pitch ground adjustable propellers of wooden construction gg) Cat G: all constant speed propellers (iv) class 4: instruments, including or excluding electrically operated instruments; (v) class 5: electrical equipment; (vi) class 6: automatic pilots; or (vii) class 7: avionic equipment, including or excluding equipment employing pulse techniques. (viii) class 8: welding; (1) Group 1: Aluminium frames or structures, or (2) Group 2: Steel frames or structures Theoretical knowledge examination 56.02.3 (1) An applicant for the issuing of an approved person certificate in classes APC3, APC4, APC5 and APC6, Category A rating, shall have successfully passed the applicable online examination prescribed in Document SA-CATS 56, in the following classes, groups or categories; (a) for aeroplanes, in the respective groups of; (6) wood and fabric covered construction ; or (7) composite construction; or (8) tubular metal and fabric covered construction; or (9) all metal construction; and (10) any combination of the above, and (d) aeroplanes in the respective categories of; (i) microlights and weight shift aeroplanes with a MTOW not exceeding 450kg (ii) aeroplanes general with a MTOW not exceeding 600kg, or (iii) aeroplanes general with a MTOW not exceeding 1200kg, or (iv) aeroplanes general with a MTOW not exceeding 5700kg, or (v) Gliders, or (vi) Touring motor gliders, and (vii) any combination of the above, (c) for rotorcraft, in the respective categories of; (i) gyrocopters and gyro gliders with a MTOW no exceeding 2000kg, or (ii) helicopters with a MTOW not exceeding 3175kg, or (iii) helicopters with a MTOW not exceeding 5700kg, (e) for all other aircraft not listed above, in the respective categories of; (i) balloons, or (ii) powered powered-hang gliders, powered-paragliders, powered- parachutes and powered para-trikes or any other powered derivative thereof, or (iii) any combination of the above (2) An applicant for the issuing of an approved person certificate in classes APC3, APC4, APC5 and APC6, Category C rating, shall have successfully passed the applicable online examination prescribed in Document SA-CATS 56, in the following groups and categories; (a) for engines, in the respective categories of; (i) piston engines general, and (ii) horizontally opposed normally aspirated piston engines; or (iii) horizontally opposed turbo normalised, turbo charges and supercharged piston engines, or (iv) in-line piston engines, or (v) radial engines, or (vi) turbine jet engines general, or (vii) other NTC engines, including automotive and non-aviation engines, (vii) two strokes engines, or (viii) diesel and turbo diesel engines (ix) electrical engines, or (x) any combination of the above. (3) An applicant for the issuing of an approved person certificate in classes, APC5 and APC6, Category W rating, shall have successfully passed the applicable online examination prescribed in Document SA-CATS 56, in the following classes, groups or categories; (a) for equipment, in the respective categories of; (i) class A: avionic, radio and radar equipment; (ii) class E: electrical equipment; (iii) class I: instrument equipment; or (iv) class O: combination of such equipment, (4) An applicant for the issuing of an approved person certificate in classes APC5 and APC6, Category X rating, shall have successfully passed the applicable online examination prescribed in Document SA-CATS 56, in the following classes, groups or categories; (a) for equipment, in the respective categories of; (i) class 1: compasses; (ii) class 2 engine ignition equipment; (iii) class 3: fixed and variable pitch propellers; aa) Cat A; fixed pitch propellers of metal construction bb) Cat B; fixed pitch propellers of composite construction cc) Cat C; fixed pitch propellers wood dd) Cat D; variable pitch ground adjustable propellers of metal construction ee) Cat E; variable pitch ground adjustable propellers of composite construction ff) Cat F; variable pitch ground adjustable propellers of wooden construction gg) Cat G: all constant speed propellers (iv) class 4: instruments, including or excluding electrically operated instruments; (v) class 5: electrical equipment; (vi) class 6: automatic pilots; or (vii) class 7: avionic equipment, including or excluding equipment employing pulse techniques. (viii) class 8: welding; (1) Group 1: Aluminium frames or structures, or (2) Group 2: Steel frames or structures (5) An applicant, who fails the online examinations referred to in sub-regulation (1), may apply for a remark to the designated body in terms of Part 149, as prescribed in the approved technical approved persons’ manual of procedure. Experience 56.02.4 An applicant for the issuing of a technical approved person certificate shall– (a) be the primary builder of, and having completed from start to finish, and obtained an authority to fly for his or her own aircraft; or (b) have completed the practical training and gained the minimum experience required at an approved maintenance facility or under direct supervision a holder of an instructor rating approved for the purpose, as prescribed in the approved technical approved persons’ manual of procedure, or (c) have obtained a recognised qualification, together with proven aircraft maintenance training and experience at an approved AMO or an approved original aircraft manufacturer, or an approved original equipment manufacturer, compatible with the particular rating prescribed in this regulation, as prescribed in the approved technical approved persons’ manual of procedure. Application for approval or amendment 56.02.5 (1) An application for the issuing of an approved person certificate or for an amendment thereof, shall – (a) be made on the appropriate form as prescribed by the Director or the Organisation designated in terms of Part 149, as the case may be; and (b) be accompanied by – (i) original or certified proof of – (aa) (bb) the identity document of the applicant; and experience documented in the prescribed maintenance logbook detailing the record of experience in all applicable groups, classes, categories and types together with annual summaries of the applicant; and (cc) all relevant qualifications attained; and (dd) if applicable: in the case of an owner builder that has completed their own build project and obtained an ATF for the same project, the build number, issued in terms of regulation Part 24, and the authority to fly, issued in terms of Part 24; such applicant may be issued with an APC7 for that specific aircraft only. (ii) original or certified proof that the applicant has(aa) passed the theoretical knowledge examination referred to in regulation 56.02.3; and (bb) successfully attended the training programs prescribed in regulation 56.02.2; and (2) (iii) any further documentation or requirements as may be determined by the organisation designated in order to determine the competence of the application before issuing a TAP certificate. (iv) two recent passport-size photographs of the applicant; and (v) the appropriate fee together with the billable hourly fee applicable to the application process as prescribed in Part 187, Application for a special approval of a first of type issue, amendment or addition of a certificate with a rating on newly registered aircraft shall be made to the Director, or the body designated in terms of Part 149, and accompanied by an original letter from the manufacturer stating that the applicant has successfully attended and passed the manufacture’s course as approved by the factory together with the appropriate authority, the Director, or the body designated in terms of the Act as the case may be. Issuing of certificate 56.02.6 (1) The Director or, the organisation designated for the purpose in terms of Part 149, as the case may be, shall issue an approved person certificate with the appropriate rating if the applicant complies with the requirements referred to in regulation 56.02.5. (2) The certificate shall be issued on the appropriate prescribed form. (3) The certificate shall specify as applicable the groups, classes, categories or ratings of the of aircraft and engines, and if applicable the name of non-type certificated aircraft and engines, its components or equipment in respect of which the holder of such certificate is entitled to exercise the privileges thereof. (4) Upon issuing of a technical approved person certificate, the applicant shall forthwith affix his or her signature in ink in the space on the certificate provided for such purpose. (5) The Director, or body designated in terms of Part 149, as the case may be, may at any time request further information as considered appropriate in order to support an applicant’s experience, knowledge or qualifications prior to the issue of a TAP certificate. Period of validity 56.02.7 (1) An approved person certificate issued in accordance with this Subpart shall be valid for a period of 12 months, calculated from the date on which the approval is issued or from the date of renewal of the approval if such approval is renewed in accordance with the provisions of regulation 56.02.8. (2) Any amendment of an approval person certificate shall be valid for the period for which the certificate is valid. Renewal of approved person certificate 56.02.8 (1) To renew an approved person certificate, the holder thereof shall– (a) within the 12 months preceding the date of expiry of the certificate, have carried out maintenance, inspections or repairs in accordance with their approvals on at least four aircraft within his or her categories, group(s), class(es) or rating(s); except in the case of an owner builder that may only perform maintenance or repairs on their own aircraft in terms of their APC7 approval. (b) within 30 days immediately preceding the date of expiry of such certificate, submit an application for renewal accompanied by– (i) a true copy of the TAP certificate held by the applicant; (ii) an original or certified record of experience logbook as proof of compliance with the provisions of sub-regulation (1)(a), (iii) where applicable, an original or certified proof of compliance of having attended approved continuous or refresher training programs in the group(s), class(es) or categories of ratings held and being renewed. (2) The application for the renewal of the certificate shall be made on the prescribed form. (3) The Director or the organisation designated for the purpose in terms of Part 149, as the case may be, shall renew the certificate if the applicant complies with the requirements referred to in sub-regulation (1). (4) The certificate shall be renewed on the appropriate prescribed form as per the TAP MOP. Reissue 56.02.9(1)(a) The holder of an approved person certificate that has expired due to the lapse of the period referred to in regulation 56.02.7 may apply to the designated body in terms of Part 149, as the case may be, for the re-issue of the expired certificate. (b) To qualify for the reissuing of the certificate the person needs to comply anew with the requirements prescribed in regulation 56.02.5. (2) Upon application for the re-issue of the expired certificate, the Director or, the organisation approved for the purpose in terms of Part 149, as the case may be, shall reissue such certificate if the applicant complies with the requirements prescribed in sub-regulation (1). (3) The provisions of regulations 56.04.11 and 56.04.12 shall apply with the necessary changes to an application referred to in sub-regulation (1). Privileges and limitations General 56.02.10 (1) Subject to the provisions of regulations 56.04.5 and 56.04.6, the holder of an approved person certificate – (a) shall not be authorised to grant permission to the constructor, owner or operator to fly his or her aircraft for the purpose of carrying out proving or test flights. (b) in the case of any inspection carried out on a non-type certificated aircraft in terms of regulation 24.01.8 shall be of a conditional nature in that the approved person carrying out the inspection shall not be required to guarantee the airworthiness of the aircraft. (c) in the case where an approved person issues a release to service for a non-type certified aircraft he or she thereby certifies that he or she is satisfied that the aircraft and all its equipment are serviceable for flight and that all maintenance has been carried out in accordance with the regulations, and with the aircraft’s accepted maintenance schedule. (d) who wishes to carry out welding on a non-type certificated aircraft shall be the holder of an appropriate welding certificate for the type of welding to be carried out. The certificate does not necessarily have to be for aircraft welding, but shall specify the type of welding, the equipment used and type of metals that the applicant is qualified in. (e) may not perform any other work not approved and specified on the AP certificate (2) the holder of APC1 certificate may perform – (a) basic maintenance as approved on NTCA under direct supervision of an AMO, APC5 or APC6 approved for the purpose, and that are rated on the same groups, categories, classes or types of aircraft in order to gain not less than one years’ experience as an APC1, towards an APC 2 rating as determined in CATS 56. (b) the holder of the APC1 certificate shall not(i) certify the aircraft or engine maintenance logbooks (ii) inspect any maintenance or repairs on aircraft, (iii) perform any repair, overhaul, or modification work on an aircraft or engine, (iv) certify a release to service for any aircraft. (3) the holder of APC2 certificate may perform – (a) basic maintenance or repairs as approved on NTCA under direct supervision of an AMO, APC5 or APC6 approved for the purpose, and that are rated on the same groups, classes or types of aircraft in order to gain not less than one years’ experience as an APC2, towards an APC 3 rating as determined in CATS 56. (b) The holder of the APC2 certificate shall not(i) certify in accordance the aircraft or engine maintenance logbooks (ii) inspect any maintenance or repairs on aircraft, (iii) perform any overhaul, or modification work on an aircraft or engine, (iv) certify a release to service for any aircraft. (4) (a) if he or she is the holder of a valid APC 3 Category A rating shall be entitled to perform - (i) basic maintenance on aeroplanes in accordance with their ratings and approvals, and gain not less than one years’ experience as an APC3, towards and APC4 rating; and (ii) work which the maintenance schedule relating to the specified type of aeroplane or rotorcraft authorises such holder to certify; and (iii) certify in the aircraft logbook(s) the maintenance performed, stating when and where the work took place and the outcome thereof. (iv) The holder of the APC3 Category A rating shall not – (b) perform any repair, inspection, overhaul, or modification work to an aircraft, (i) certify, in accordance with the regulations in Part 24 of these Regulations, the release to service of the non-type certificated aircraft following routine maintenance, providing that the release to service is not for the purpose or part of an annual inspection towards the issue or renewal of an ATF, unless the aircraft has been undergone a dual inspection by an APC 5 or APC 6 that has countersigned the aircraft maintenance logbooks and release to service. (5) (a) The holder of a valid APC 3 with a Category C rating, shall be entitled to perform – (i) basic maintenance on engines in accordance with their ratings and approvals, and gain not less than one years’ experience as an APC3, towards and APC4 rating; and (ii) work which the maintenance schedule relating to the specified type of engine or engines permits such holder to certify; (ii) certify in the engine logbook(s) the maintenance performed, stating when and where the maintenance took place and the outcome thereof. (b) the holder of APC3 Category C shall not – (i) perform any repair, inspection, overhaul, or modification work to an engine, (ii) certify, in accordance with the regulations in Part 24 of these Regulations, the release to service of the non-type certificated aircraft following regular maintenance or maintenance, providing that the release to service is not for the purpose or part of an annual inspection towards the issue or renewal of an ATF, unless the aircraft has undergone a dual inspection by an APC 5 or APC 6 that has countersigned the aircraft maintenance logbooks and release to service. (6) (a) if he or she is the holder of a valid APC 4 Category A rating shall be entitled to perform – (i) general maintenance and repairs in accordance with his ratings and approvals, and gain not less than one years’ experience as an APC4, towards and APC5 rating; and (ii). work which the maintenance schedule relating to the specified type of aeroplane or rotorcraft authorises such holder to certify; and (iii) certify in the aircraft logbook(s) the maintenance or repair work performed, stating when and where the maintenance or repairs took place and the outcome thereof. (iv) any adjustment, maintenance of the specified group or type of aeroplane or rotorcraft, including the installation or replacement of equipment, and minor components of such aeroplane or rotorcraft as approved, excluding its engine or engines. (b) The holder of an APC4 Category A maintenance certificate shall not(i) perform any inspection, overhaul, or modification work to an aircraft, (ii) certify, in accordance with Part 24 of these Regulations, the release to service of the non-type certificated aircraft following maintenance or repairs, providing that the release to service is not for the purpose or part of an annual inspection towards the issue or renewal of an ATF, unless the aircraft has undergone a dual inspection by an APC 5 or APC 6 that has countersigned the aircraft maintenance logbooks and release to service. (7) (a) if he or she is the holder of a valid APC 4 Category C rating shall be entitled to perform – (i) general maintenance of the group or type of engine or engines in an aircraft, and gain not less than one years’ experience as an APC4, towards and APC5 rating; and (ii) work which the maintenance schedule relating to the specified type of engine or engines permits such holder to certify; (iii) any adjustment of the specified type of engine or engines and the replacement of external components. (iv) certify in the engine logbook(s) the maintenance work performed, stating when and where the maintenance or repairs took place and the outcome thereof. (b) The holder of an APC 4 Category C rating shall not – (i) perform any inspection, overhaul, or modification work to an engine, (ii) certify, in accordance with Part 24 of these Regulations, the release to service of the non-type certificated aircraft following regular maintenance or maintenance and repairs, providing that the release to service is not for the purpose or part of an annual inspection towards the issue or renewal of an ATF, unless the aircraft has been undergone a dual inspection by an APC 5 or APC 6 that has countersigned the aircraft maintenance logbooks and release to service. (8) if he or she is the holder of a valid APC5 certificate, he shall be entitled to perform– (a) general maintenance, repairs and inspections carried out on the aircraft, and gain not less than one years’ experience as an APC5, towards and APC6 rating; and ; (b) in accordance with the requirements prescribed in Part 24 and Part 44, such maintenance, repairs, and inspections for the purpose of issuing or renewing the annual authority to fly, on a non-type certificated aircraft, its components and equipment as may be called for from time to time by and APC 3 or APC 4, or owner of the non-type certificated aircraft; (c) certify in the aircraft or engine logbook(s) as applicable, stating when and where, and the outcome thereof; (d) certify, in accordance with the regulations in Part 24, the release to service of the non-type certificated aircraft; (e) complete all applicable documents. (9) (f) and exercise in respect of a non-type certificated aircraft, the privileges of an authorised person, the duties and inspections, if so delegated in writing by the Director, or body designated for the purpose in terms of Part 149, as the case may be. (f) carry out oversight and inspections on a non-type certificated aircraft in accordance with the requirements prescribed in Parts 24, 44, 94 and 96 as may be called upon from time to time by the designated body for the purpose in terms of Part 149, if he or she is the holder of a valid APC5 with a Category A rating shall be entitled to perform and certify, in the aircraft logbook(a) general maintenance, repairs or inspections of the specified group or type of aeroplane or rotorcraft, including the installation or replacement of equipment, and minor components of such aeroplane or rotorcraft, excluding its engine(s) (b). work which the maintenance schedule relating to the specified type of aeroplane or rotorcraft authorises such holder to certify; and (10) if he or she is the holder of a valid APC5 with a Category C rating shall be entitled to perform and certify, in the aircraft logbook(a) general maintenance, repair or inspection, of the specified group or type of engine or engines and the replacement of external components, if such replacement does not involve dismantling the engine or engines. (b) work which the maintenance schedule relating to the specified type of engine or engines permits such holder to certify; (c) the installation and maintenance, other than the overhaul, major modification or major repair, of propellers and the reassembly of variable-pitch propellers which may have been dismantled for transport purposes; and (11) The holder of a valid APC5 with a Category W rating, shall be entitled to perform and certify in the aircraft logbook– (a) general maintenance, adjustments or inspections of such equipment; and (b) work which the maintenance schedule relating to the specified type of equipment permits such holder to certify; (c) (12) any installation of such equipment in aircraft and the replacement of components and parts of such equipment: Provided that no equipment shall be dismantled for the purpose of making internal replacements. if he or she is the holder of a valid APC6 certificate, shall be entitled to – (a) heavy maintenance, repairs and inspections carried out on the aircraft; and (b) carry out, in accordance with the requirements prescribed in Part 24 and Part 44, such maintenance, repairs, overhauls, or modifications, and inspections for the purpose of issuing or renewing the annual authority to fly, on a non-type certificated aircraft, its components and equipment as may be called for from time to time by an APC 3 or APC 4 and the constructor or owner of the non-type certificated aircraft; (c) (e) (f) certify in the aircraft or engine logbook(s) as applicable, stating when and where, and the outcome thereof; (i) all modifications or overhauls incorporated on the aircraft in accordance with regulation 44.01.10; and (ii) certify, in accordance with the regulations in Part 24, the release to service of the nontype certificated aircraft; (iii) complete all applicable documents. exercise in respect of a non-type certificated aircraft, the privileges of an authorised officer, inspector or authorised person, the duties and inspections as delegated in writing by the Director, or body designated for the purpose in terms of Part 149, as the case may be. carry out oversight and inspections on a non-type certificated aircraft in accordance with the requirements prescribed in Parts 24, 44, 94 and 96 as may be called upon from time to time by the Director, or body designated for the purpose in terms of Part 149, (13) if he or she is the holder of a valid APC6 with a Category A rating, shall be entitled to perform and certify, in the logbook– (a) general maintenance, adjustments, repairs or inspections of the specified group or type of aeroplane or rotorcraft, including the installation or replacement of equipment, instruments and minor components of such aeroplane or rotorcraft, excluding its engine or engines. (b) work which the maintenance schedule relating to the specified type of aeroplane or rotorcraft authorises such holder to certify; and (14) if he or she is the holder of a valid APC6 with a Category C rating, shall be entitled to perfrom and certify, in the logbook – (a) general maintenance, repairs, inspections or minor modification of the specified type of engine or engines and the replacement of external components, if such replacement does not involve dismantling the engine or engines. (b) work which the maintenance schedule relating to the specified type of engine(s) authorises such holder to certify; (a) the installation of the specified type of engine(s) in an aircraft; (b) the installation, maintenance, repair and inspection, other than the overhaul, major modification or major repair, of propellers and the reassembly of variable-pitch propellers which may have been dismantled for transport purposes; and (15) The holder of a valid APC6 with a Category W rating, shall be entitled to certify, in the logbook – (a) all maintenance, repairs, modifications or inspections of such equipment; and (b) work which the maintenance schedule relating to the specified type of equipment authorises such holder to certify; (c) any installation of such equipment in an aircraft and the replacement of components and parts of such equipment: Provided that no equipment shall be dismantled for the purpose of making internal replacements. (16) The holder of a valid APC6 with a Category B rating, shall be entitled to perform and certify, in the logbook – (a) heavy maintenance, repairs, inspections, overhauls or modifications, including trimming, spray painting, electroplating or machining, of the specified type of aeroplane or rotorcraft, excluding its engine or engines, except – (aa) the overhaul, repair, inspection or modification of such item, equipment or apparatus, which is to be inspected and certified by the holder of a Category X rating; and (bb) the installation, inspection and testing of such instrument, electrical equipment or radio apparatus, which is to be inspected certified by the holder of a Category W rating; (d) the manufacturing or replacement of structures, composites, components and parts, if the manufacturing or replacement of the structures, composites, components and parts is necessary for such holder to complete an overhaul, repair or modification which he or she will certify in the airframe logbook. (17) The holder of a valid APC6 with a Category D rating, shall be entitled to perform and certify, in the logbook – (a) heavy maintenance, repairs, inspections, overhauls, or modifications of the specified group or type of engine or engines, except the overhaul, repair or modification of the ignition equipment, other than the spark plugs, and of the propeller, starter and generator, which is to be certified in the engine logbook by the holder of a Category X rating; and (b) (18) the manufacturing or replacement of components and parts, if the manufacturing or replacement of the components and parts is necessary for such holder to complete an overhaul, repair or modification which he or she will certify in the engine logbook. The holder of a valid APC6 with a Category X rating, shall be entitled to perform and certify, in the logbook – (a) the installation and compass swing of the specified compasses; (b) the installation, overhaul, repair or modification of the specified engine ignition equipment, and replacements thereof; (c) the installation, overhaul, repair or modification of fixed and variable-pitch propellers, and replacements thereof in the applicable categories; (d) the installation, overhaul, repair or modification of the specified instruments; (e) the installation, overhaul, repair or modification of the specified electrical equipment, and replacements thereof; (f) the installation, overhaul, repair or modification of automatic pilots other than automatic pilots which operate on electronic principles; (g) the installation and in-flight adjustment of electronic automatic pilots; (h) the installation, overhaul, repair or modification of the specified avionic equipment, and replacements thereof; and (i) the carrying out of the specified welding processes in the applicable categories. SUBPART 3: GRADE ONE AND GRADE TWO TECHNIAL APPROVED PERSONS INSTRUCTOR RATINGS Requirements for grade one or grade two TAP instructor rating 56.03.1 An applicant for the issuing of a Grade One or Grade Two aircraft TAP instructor rating shall – (a) be not less than 21 years of age; (b) hold a valid Technical Approved Persons APC5 or APC6 certificate; (c) hold at least one valid rating; Provided that, where the applicant is the holder of a Category B or D rating for a particular group or type of an aircraft or engine, he or she shall also be the holder of a Category A or C rating, as applicable, for that group or type of aircraft or engine; (d) have successfully completed the training referred to in regulation 56.03.2; (e) have passed the theoretical knowledge examination referred to in regulation 56.03.3; and (f) have acquired the experience referred to in regulation 56.03.4. Training 56.03.2 An applicant for the issuing of a Grade One or Grade Two aircraft TAP instructor rating shall have successfully completed the appropriate training as prescribed in Document SA-CATS 56. Theoretical knowledge examination 56.03.3 (1) An applicant for the issuing of a Grade One or Grade Two aircraft TAP instructor rating shall have passed the appropriate written examination as prescribed in Document SA-CATS 56. (2) An applicant who fails the written examination referred to in sub-regulation (1), may apply for a remark after the appropriate period specified in Document SA-CATS 56. Experience 56.03.4 An applicant for the issuing of a Grade One or Grade Two TAP instructor rating shall comply with the requirements for the appropriate experience as prescribed in Document SA-CATS 56. Application for instructor rating 56.03.5 (1) An application for the issuing of a Grade One or Grade Two TAP instructor rating shall be made to the Director, or the body designated in terms of Part 149, as the case may be on the appropriate prescribed form. (2) The application referred to in sub-regulation (1) shall be accompanied by – (a) in the case of Grade One TAP instructor rating – (i) original or certified proof of – (aa) the identity document of the applicant; (bb) compliance with the requirements referred to in regulation 56.03.1(d), (e) and (f); and (cc) the applicant's competency to exercise the privileges referred to in regulation 56.03.8; (ii) a certified true copy of the APC 5 license and all relevant qualifications held by the applicant; and (iii) the appropriate fee as prescribed in Part 187; (b) in the case of Grade Two TAP instructor rating – (i) original or certified proof of – (aa) the identity document of the applicant; (bb) the servicing and overhaul experience record of the applicant; (ii) original or certified proof that the applicant has passed the theoretical knowledge examination referred to in regulation 56.03.3; (iii) a certified true copy of the APC6 licence and all relevant qualifications held by the applicant; and (iv) the appropriate fee as prescribed in Part 187. Issuing of instructor rating 56.03.6 (1) The designated body in terms of Part 149, as the case may be, shall issue a – (a) Grade One TAP instructor rating if – (b) (2) (i) the applicant complies with the requirements referred to in regulation 56.03.1; and (ii) the Director or body designated in terms of Part 149, as the case may be, is satisfied that the applicant is competent to exercise the privileges referred to in regulation 56.03.8. Grade Two TAP instructor rating if the applicant complies with the requirements referred to in regulation 56.03.1. The instructor rating shall be issued on the appropriate prescribed form. Period of validity 56.03.7 A Grade One or Two TAP instructor rating shall be valid for the period for which the TAP certificate is valid. Privileges of instructor rating 56.03.8 (1) The holder of a Grade One TAP instructor rating shall be entitled to – (a) give theoretical and practical instruction on any of the valid ratings held by him or her; and (b) act as an examiner in any of the valid ratings held by him or her, if approved by the designated body in terms of Part 149, as the case may be. (2) The holder of a Grade Two TAP instructor rating shall be entitled to give theoretical and practical instruction on any of the valid ratings held by him or her. Renewal of instructor rating 56.03.9 (1) To renew a Grade One or Grade Two TAP instructor rating, the holder thereof shall, within the 24 months preceding the date of expiry of the rating, have served for not less than six months as an TAP instructor. (2) An application for the renewal of the rating shall, within 60 days immediately preceding the date of expiry of such rating, be – (a) (b) made to the Director or body designated in terms of Part 149, as the case may be, in the appropriate prescribed form; and accompanied by – (i) in the case of Grade One TAP instructor rating – (aa) certified true copy of the APC held by the applicant; (bb) the appropriate fee as prescribed in Part 187; and (cc) (ii) original or certified proof of compliance with the provisions of sub-regulation (1) and the applicant's competency to exercise the privileges referred to in regulation 56.03.8; in the case of Grade Two TAP instructor rating – (aa) a certified true copy of the APC held by the applicant; (bb) the appropriate fee as prescribed in Part 187; and (cc) original or certified proof of compliance with the provisions of sub-regulation (1). (3) The designated body in terms of Part 149, as the case may be, shall renew the rating if the applicant complies with the requirements referred to in sub-regulations (1) and (2). (4) The rating shall be renewed in the appropriate prescribed form. (5) The renewal of the rating shall be valid for the period for which the TAP certificate is valid.
