The Water Quality Plan (Plan) for (Project name) dated (Date); located in the (Pressure Zone) Pressure Zone has been completed by (Engineers
Name) for (Owner/Developers Name) and is attached hereto. The Plan is prepared in compliance with and subject to the Annexation Agreement
dated (Date) (if applicable), Existing City Code, Utility Tariffs, and of Chapter 2 of the Water Line Extension and Service Standards, as amended.
The Plan does not reserve capacity in the water system. Significant changes to the Development Plan will require an addendum to this Plan.
Revisions to this Plan will be required if adjoining development occurs first.
The Owner/Developer agrees to follow the Plan and accepts responsibility for the costs associated with implementing the Plan. Noncompliance
with the Plan may result in the delay of building permits for (Project Name) until the Water Quality Requirements as defined in Chapter 2 of the
Water Line Extension and Service Standards are met.
(Owner/Developer Name) acknowledges that if the Plan requirements are not met for a period of at least ten days after notification of
noncompliance from Colorado Springs Utilities, Colorado Springs Utilities may initiate the Plan at (Owner/Developer Name)’s expense.
(Owner/Developer Name) acknowledges that the Colorado Springs Utilities Warranty and Bill of Sale for Water and/or Wastewater Facilities for
Infrastructure related to this Plan, is separate and not to be considered part of this Plan.
This Plan is subject to rights of setoff; Colorado Springs Utilities may set off, against any refund owed to( Owner/Developer Name), any amounts
that (Owner/Developer Name) owes to Colorado Springs Utilities as a consequence of this Plan. In the event Colorado Springs Utilities exercises
its right of setoff, it shall provide an accounting to (Owner/Developer Name) to the extent of the amount set off in lieu of the refund payment of
such amount.
