Examples: Underlines or Strikethroughs 3.3.4.3 Performance Bond - Upon Contract execution, the successful bidder shall submit to DOR a performance bond in the form of a bond or an Irrevocable Letter of Credit issued by a commercial bank acceptable to DOR. Either specific form shall be acceptable to DOR. The performance bond shall be in the amount of five hundred thousand dollars ($500,000.00) fifty thousand dollars ($50,000.00) and shall be executed by a company authorized to do business in the State of Wisconsin. The bond shall provide funds to DOR in the event that DOR suffers any liability, loss, damage or expense as a result of the Contractor’s failure to fully and completely perform all the requirements of the Contract which include, without limitation, the Contractor’s obligation to pay liquidated damages, to indemnify DOR under circumstances described in the Contract and the Contractor’s obligations as required by the Contract throughout the Life of the Contract, and any renewals or extensions thereof. The bond may be subject to annual renewal at the Surety’s option, provided that the Contractor shall maintain a performance bond meeting the requirements of this section for the Life of the Contract. The Surety shall provide DOR with a minimum of ninety (90) days written notice prior to cancellation. 6.8 FORMAT OF BID RESPONSE c) Vendor References (DOA-3478) - Bidder shall include in its bid response a completed Vendor Reference Form, which is attached, listing all four (4) vendors with whom the Bidder has done business equal to that required by this solicitation within the last two (2) years. For each client/customer/buyer/organization listed, the Bidder shall include the company name, address, contact person, email and telephone number along with a brief description of the product/service, which was the basis for the business relationship. The Lottery shall determine which, if any references to contact to assess the quality of the product/service. Failure to verify the Bidders experience or technical ability through references may be grounds for disqualification. See Section 7.7. 7.7 BIDDER REFERENCES The Bid response shall include a completed Bidder Reference Form (DOA-3478) listing all four (4) names or companies with whom the Bidder has done business similar in size and scope as required by this RFB within the last two (2) years. For each organization listed, the Bidder shall include the company name, address, contact person, email address and telephone number along with a brief description of the commodity or service that formed the basis of the business relationship. The Lottery will determine which references to contact in order to assess the quality of the product or service. Failure to obtain verification through references may be grounds for disqualification.
