Hereafter, you will find a short reminder of the main obligations that you may have as an importer and/or retailer in the EU following the inclusion of a substance in the candidate list together with a table showing the substances currently included in the candidate list, detailing their potential uses and the date of the inclusion in the candidate list. As an importer and/or retailer in the EU, you may have immediate legal obligations following the inclusion of a substance in the candidate list. With particular reference to SVHC in articles: As importer and/or retailer in the EU you have the obligation to inform customers about SVHC in the products supplied As importer in the EU you have the obligation to notify about SVHC contained in imported products Information duty Suppliers of articles which contain substances on the Candidate List in a concentration above 0.1% weight by weight (w/w) have to provide sufficient information to allow safe use of the article, upon request, to a consumer within 45 days of the receipt of the request. This information must contain as a minimum the name of the substance. This obligation applies as from the date of the inclusion of the substance in the candidate list. Notification duty Notification by importers of articles is required under when the following conditions are met: The substance has been included in the candidate list and The substance is present in the article above a concentration of 0.1% w/w and The total amount of the substance in the articles exceeds one tonne per producer or importer per year and FTA – Committed to free trade REACH Information note: updated candidate list of Substances of Very High Concern for Authorisation 3 The substance has not yet been registered for that specific use. Typically, a notification would include the company’s details, the identity of the substance, classification and labelling, and a brief description of the use. Timing for notification: For substances included in the Candidate List before 1 December 2010, the notifications have to be submitted not later than 1 June 2011. For substances included in the Candidate List on or after 1 December 2010, the notifications have to be submitted no later than 6 months after the inclusion. Further potential uses may be associated with the formulation of detergents and bleaches, photosensitive materials, the manufacture of pyrotechnic powder or the embalming / restoring of art products 13/01/2010 25 Lead chromate molybdate sulphate red (C.I. Pigment Red 104) Lead chromate molybdate sulphate red (C.I. Pigment Red 104) is used as a colouring, painting and coating agent in sectors such as the rubber, plastic and paints, coatings and varnishes industries. Applications comprise the production of agricultural equipment, vehicles and aircraft as well as road and airstrip painting 13/01/2010 26 Lead sulfochromate yellow (C.I. Pigment Yellow 34) 13/01/2010 27 Pitch, coal tar, high temp. Lead sulfochromate yellow (C.I. Pigment Yellow 34) is used as a colouring, painting and coating agent in sectors such as the rubber, plastic and paints, coatings and varnishes industries. Applications comprise the production of agricultural equipment, vehicles and aircraft as well as road and airstrip painting. The substance is further used for camouflage or ammunition marking in the defence area. Mainly used in the production of electrodes for industrial applications. Smaller volumes are dedicated to specific uses such as heavy duty corrosion protection, special purpose paving, manufacture of other substances and the production of clay targets 28 Tris(2chloroethyl)phosphate Is mainly used as plasticiser with flame-retarding properties for acrylic resins, polyurethane, polyvinyl chloride and other polymers. Other fields of application are adhesives, coatings, flame resistant paints and varnishes.
