SALE AND SUPPLY OF ALCOHOL ACT 2012
Important information for applicants from 18 June 2013 to 18 December 2013 for all renewals,
specials and new on/off/club Licences.
The Sale and Supply of Alcohol Act 2012
New criteria in the Sale and Supply of Alcohol Act 2012 (“the Act”) has come into effect as of
18 June 2013.
Sections of the Act to have come into effect are: 3, 4, 5, 102, 103, 105, 106, 128, 129, 131, 132,
140, 141 and 142.
How will this affect my application?
ALL applications will still be considered under the Sale of Liquor Act 1989, but also using the
new broader criteria in the Sale and Supply of Alcohol Act 2012 (section 105).
The major changes are that Liquor Licensing Inspectors, Police and Medical Officer of Health
must now consider The Object of the Act, Design and Layout and Amenity and Good Order.
The Medical Officer of Health must now report on off-licence applications and special licence
applications.
What do I need to include in my application?
To assist the reporting bodies to make an informed assessment of the new criteria please
complete the three questions on the following page with as much information as you can.
The Object of the Act (section 4)
All applications must be considered in light of the object of the new Act:

The sale, supply, and consumption of alcohol should be undertaken safely and responsibly;
and
•
The harm caused by the excessive or inappropriate consumption of alcohol should be
minimised.
Harm includes crime damage, death disease, disorderly behaviour, illness or injury, directly or
indirectly caused or directly or indirectly contributed to by the excessive or inappropriate
consumption of alcohol. It also includes harm to society generally or the community directly or
indirectly contributed to by the excessive or inappropriate consumption of alcohol.

Amenity and Good Order (section 106)

What appropriate systems, staff, and training is in place or will be put in place to ensure
compliance with the law
•
Current and possible future noise levels (if relevant what they intend to do to mitigate them)
•
Current and possible future levels of nuisance and vandalism (if relevant what they intend
to do to mitigate them)
•
The number of other licensed premises in the area.

Design and Layout (section 105)
Design and layout can help reduce alcohol-related harm occurring within licensed premises.
For example, bar layout, seating, sound, lighting, access and a host of other design elements
can be used to improve security, reduce tension and improve the atmosphere in licensed areas.
Guidelines and examples on the types of concepts that design and layout could include are
contained in Crime Prevention Through Environmental Design (CPTED). Guidelines on CPTED
can be obtained through the Health Promotion Agency at http://www.alcohol.org.nz/researchresources/latest-resources.
Public Objections
Public objections may now be lodged raising the new criteria under section 105.
