The Mental Capacity Act 2005 The Mental Capacity Act 2005 came into full force on 1 October 2007. The Act applies to everyone who works in health and social care and is involved in the care, treatment or support of people over 16 years living in England and Wales, who are unable to make all or some decisions for themselves. In view of the importance of the Act and the implications it places on everyone who works in health and social care it is important that staff involved with adults who may lack capacity receive training around assessing capacity and best interest’s decision making. Basic Awareness (1/2 day) The aim of this course is to explain the basic provisions of the Act, to explain the Principles and who the Act effects. It will: Give an overview of the five core Principle of the Act Assumption of capacity Supporting people to make their own decisions and unwise decisions Assessing Capacity and making decisions in a person best interest Use of independent mental capacity advocates (IMCA) Substitute decision makers LPA, EPAs and Deputies Advance decisions to refuse treatment The new safeguards: - the Court of Protection, Public Guardian and Criminal offences Information sharing, research and the introduction of the Deprivation of Liberty Safeguards (DOLS) Training is aimed at:All staff who work in a professional capacity with adults who may be vulnerable and/or who may lack capacity to make decisions for themselves. The training is designed to provide participants with guidance to anyone who is working with and/or caring for adults who may lack capacity to make particular decisions. The course should enable staff to understand their responsibilities when acting or making decisions on behalf of those individuals who lack the capacity to act or make these decisions for themselves and how to record any actions taken. Complex Decision making (1 day) The aim of this course is to give staff involved in complex cases around assessment of capacity and best interest decision making. The course will reinforce the Principles of the Act and provide advice and guidance around assessing capacity. It will give staff an understanding of the requirements of the best interest checklist and balance sheet approach to best interest decision making, resolving disputes and when matters need taking to the Court of Protection. Deprivation of Liberty Safeguards (DOLS) Introduction (1 day) The aim of this course is to provide a background to the safeguards, who they apply to, roles and responsibilities. The course will also look at what is a Deprivation of Liberty, updates on case law, the process of assessment and authorisation, application of conditions, the role of the IMCA and the relevant person representative, reviews and unauthorised DOL, the role of the Court of Protection in dealing with appeals and authorising a DOL in settings other than a care home or hospital and the monitoring of the safeguards Training aimed at senior staff health and social care staff working in care homes and in hospitals:Service Managers, Team Managers, Principle Practitioners, Social Workers, Occupational Therapists, Assessment Officers, Reviewing Officers, DMBC Contracts and Commissioning staff. DOLS for Managing Authorities (1 Day) The aim of this course is to give staff working in Care homes and Hospital wards (Managing Authorities) an understanding of the DOLS process, which will include: What is a Deprivation of Liberty? Least restrictive care plans When and how to request an authorisation - standard and urgent Completing the forms and necessary paperwork The assessment process, roles and responsibilities It will also inform staff how decisions are made and action which needs to be taken after the assessment has been completed. What happens if a DOL is not authorised When should an authorisation be reviewed Responsibility to meet any conditions applied What happens when an authorisation ends.
