AI BREEDING CONTRACT - Goldhills Master Bronze 2014

to Goldhills Master Bronze B-46076 (AI Permit # 430___), during the 2014 breeding
season, via Shipped Fresh cooled semen or AI. Mare owner will pay Carrie MacWhorter
the agreed breeding fee of $500.
This agreement is subject to the following conditions: The non refundable booking fee of
$100. is due with this contract. The balance of $400. and the collection fee must be paid
for before any semen will be shipped. The collection fee is $325.. Collection fee may be
paid to either Carrie MacWhorter or directly to Murphy reproductive Services. Fee
includes the collection, processing and shipment of semen via next day air delivery on
FedEx or UPS. The mare owner must also proved a desired “Declared Value” for the
shipment.
The Mare Owner may choose to have semen shipped in an Equitainer or disposable
container. Equitainer use is recommended. For Equitainers, there will be a $300.00
deposit made by separate check made to Murphy Reproductive Services, for the cost of
the shipping container. Mare Owner is responsible for return shipping fees for the
container, which must be returned via next day air. A $25 per day fee will be charged for
each day in excess of 48 hours that the container is retained by the Mare Owner following
insemination. The deposit will be refunded when Mare Owner informs Stallion Manager
that the mare is 30 days in foal. If mare owner uses a container owned by them there will
be no container deposit. If Mare Owner requires a same day, counter-to-counter
shipment via airline there will be a extra charge of $175.
Live Foal guarantee: If the mare fails to conceive during the 2014 breeding season, the
Mare Owner may breed the same mare in the following years. A $100 booking fee is
payable for each season plus the collection and shipping costs. If a mare fails to
conceive, a different mare may be substituted upon approval. Once a mare conceives, if
the resulting foal is stillborn or dies before standing and nursing, the mare owner may
return the same mare or a different mare to be rebred. This guarantee will apply only if
notification of the foal’s death plus the breeding certificate issued by the Stallion Owner
is sent to the Stallion Owner by registered mail within 48 hours of the foal’s death.
Statements by a licensed veterinarian of the details of the foal’s death must follow within
10 days or the Live Foal Guarantee becomes null and void.
The live foal guarantee is expressly contingent upon the mare owner properly caring for
the pregnant mare. Proper care shall include, but shall not necessarily be limited to,
proper feeding and nutrition, regular deworming with products approved for pregnant
mares, vaccinations that are customary in the mare owners geographical area, and proper
intervention during foaling if necessary. The Mare Owner will be issued a valid breeding
certificate for the WPCSA by the Stallion Owner when the mare is checked in foal, all
paperwork has been returned, and all fees and/or expenses have been paid. A
replacement fee of $25.00 will be charged if the Mare Owner loses a breeding certificate.
The Mare Owner understands that the stallion will not be available when he is away at
shows. All unavailable dates will be given to the Mare Owner. The stallion is otherwise
guaranteed to be available for breeding, barring any unforeseeable circumstance, only if
the Mare Owner or his/her agent notifies the Stallion Owner no later than noon (pacific
time) the day before the date when a semen specimen is required to be collected and
shipped. For the purpose of this contract, the term “breeding season” shall be defined as
the period from February 1, 2014 to July 1, 2014 at which time all breeding will be
discontinued until the following season. Shipments may be made after July 1st upon
request, but will be subject to our availability at the time.
This contract is not assignable or transferable without written consent. A copy of the
mare's registration papers must be included with this contract for all registered Welsh
Mares. When the mare owner signs and returns this contract (and it is signed by Carrie
MacWhorter, Zephyrus Welsh), it becomes a binding contract on both parties, subject to
the above terms and conditions. The mare owner irrevocably agrees that his/her sole
recourse against Zephyrus Welsh with respect to the performance or non-performance of
this contract is return of the stallion service fee, less the booking fee. Stallion services
fees are not refunded unless the stallion dies or becomes unfit for service. In that
eventuality, the mare owner may choose a refund of the service fee, or choose a breeding
to another stallion owned by Zephyrus Welsh. The terms of this contract shall be
governed by the laws of the State of California.
