In accordance with Article 6-1 of the Law of the Republic of Kazakhstan dated
February 11, 1999 "On Plant Quarantine", The Government of the Republic of Kazakhstan
DECREES:
1. Approve the attached Rules for the patrolling of the Republic of Kazakhstan
from quarantine objects and foreign species.
2. The following are repealed:
Governmental decree of the Republic of Kazakhstan dated August 1, 2003 # 773 "On
Approval of the Regulations for the Protection of the Republic of Kazakhstan from
quarantine objects" (SAPP of the Republic of Kazakhstan, 2003, # 31, p. 311);
2) Paragraph 2 of additions and changes that are made to certain decisions
of the Government of the Republic of Kazakhstan, approved by the Government of the
Republic of Kazakhstan dated May 13, 2008 # 454 "On amendments and additions to some
decisions of the Government of the Republic of Kazakhstan" (SAPP of the Republic of
Kazakhstan, 2008 , # 24, p. 241).
3. This regulation shall come into force after ten calendar days after its first
official publication.

Regulations
for patrolling of the territory of the Republic of Kazakhstan
from quarantine objects and foreign species
1. General provisions
1. These regulations for patrolling of the Republic of Kazakhstan from quarantine
objects and foreign species (hereinafter - Regulations) are developed in accordance with
the Law of the Republic of Kazakhstan dated February 11, 1999 "On Plant Quarantine" and
"Customs Union Agreement on Plant Quarantine" dated December 11, 2009 and determine the
procedure for the protection of the territory of the Republic of Kazakhstan from
quarantine objects and foreign species.
2. The following basic concepts are used Regulations:
withdrawal certificate - a document issued by the state inspector on plant
quarantine to withdraw the contaminated products in the quarantine procedure and in
cases established by the legislation of the Republic of Kazakhstan;
disinfection of quarantineable products - treatment of quarantined products by
pesticides, including fumigants (gas disinsection), refrigeration (cooling of fruits)
for the destruction of quarantined and other harmful organisms, as well as the use of
mechanical methods of cleaning of cargo and vehicles for their release from weeds;
Patrolling of the Republic of Kazakhstan from quarantine objects and foreign
species - a set of phytosanitary measures aimed at ensuring order and conditions of
import, export, domestic transportation and sale of quarantined products, as well as for
activities on plant quarantine;
phytosanitary examination of quarantined products - study of samples taken from
the batch of quarantined products to identify quarantine objects, foreign species and
other harmful organisms and to determine their species composition;
batch of quarantined products - quantity of quarantineable products, intended to
shipping by one vehicle in one destination to one recipient;
quarantine laboratory - state institution fixed-site laboratory, equipped with
devices and literature on the quarantine objects, which examines samples of imported and
domestic products subject to quarantine, in order to identify quarantine objects and set
of objects belonging to the quarantine and foreign species;
quarantine examination - visual inspection of the batch of quarantined products
associated with the opening of the packaging of goods or cargo space of the vehicle or
tanks, containers and the other places where quarantined products may be located,
allowing to explore any part of the quarantined products, as well as to carry out the
sampling from different parts quarantined products;
quarantine inspection certificate - a document, indicating the quarantine status
of the quarantine products and the cargo space of the vehicle at the time of the party
visual inspection of quarantined products associated with the opening of the packaging
of goods or cargo space of the vehicle or tanks, containers and the other places where
quarantined products may be located, allowing to explore any part of the quarantined
products, as well as to carry out the sampling from different parts quarantined
products; issued by the state inspector on plant quarantine;
quarantine report - a document, notifying the authorized body on plant quarantine
upon the impending arrival of quarantine products, its condition and (or) need for a
detailed inspection in final destination;
the act of return - a document, issued by the state inspector on plant quarantine
for return of an unliable imported quarantine products, or in case of carrier's waiver
to provide quarantine products for the control of plant quarantine;
authorized body for plant quarantine (hereinafter - the authorized body) - the
central executive body carrying out the management and implementation of the state
policy in the field of plant quarantine, as well as inter-sectoral coordination within
their powers;
plants - living plants and parts thereof, including seeds;
activities on plant quarantine - a system of governmental measures aimed at
organizing and carrying out work to identify, locate and eliminate hotspots of
quarantine objects, decontamination, technical processing, treatment and disposal of
contaminated products subject to quarantine products, disinfection and cleaning of
buildings and vehicles;
plant enclosures - products of vegetable origin in the mail, hand luggage and
passenger baggage, subject to the control of plant quarantine;
external quarantine of plants - plant quarantine aimed at preventing the import of
quarantine objects from import quarantine products and export of quarantine objects from
export quarantine products;
vegetable products - unprocessed material of plant origin (raw materials), which
by its nature and (or) method of processing is the risk of penetration into the
territory of the Republic of Kazakhstan and (or) distribution of quarantine objects;
internal plant quarantine - plant quarantine aimed at preventing the spread of
quarantine objects within the Republic of Kazakhstan, early detection, localization and
elimination of hotspots of quarantine objects;
refrigeration - cooling of fresh citrus fruits in special containers to disinfect
fruits from the fruit flies and their larvae;
transit country - a country through which quarantine products passes without
storage, dividing into parts, repackaging and free of infection by quarantine objects in
this country;
phytosanitary control station - a division of the authorized body department,
located on the territory of the border and customs checkpoints (checkpoints across the
state border of the Republic of Kazakhstan, which coincides with the customs boundary of
the Customs Union), equipped with the necessary equipment and devices, exercising state
supervision in the field of plant quarantine;
list of quarantineable products - the list of quarantined products subject to
state control in the field of plant quarantine;
quarantine inspection - visual inspection of quarantine products, including
vehicles, individuals baggage, as well as cargo containers, without opening the
packaging, packaging and sampling.
3. Carrying out activities on plant quarantine aimed at protecting the territory
of the Republic of Kazakhstan from quarantine objects, their identification,
localization and liquidation, implementation of control and supervision over compliance
with legislation in the field of plant quarantine.
4. Activities on plant quarantine apply to:
seeds and planting material of agricultural, forest and ornamental plants, plants
and their parts (cuttings, bulbs, tubers, fruits) and other products of plant origin;
collection of insects, plant pathogens, herbaria and seed collections;
plant enclosures in postal items, hand baggage and luggage of passengers;
vegetables, fruits, berries, mushrooms and nuts, peanuts, flour, cereals,
coffee beans, cocoa beans, dried fruit and vegetables, tobacco and raw sugar;
food, fodder and technical grain and its products, copra, malt, meal, oil cake,
cotton fiber, spinning flax and other crops, medicinal herbs, as well as hides and wool;
packaging timber, packaging materials (except synthetic), monoliths and soil
samples;
vehicles arrived from other countries or from the quarantine zone;
territory and premises of organizations, peasant farms (farmer), gardens and
suburban farms that produce, harvest, store, process and sell products of plant origin;
agricultural land, forest, water and land of other purposes.
5. Individuals, business leaders and organizations whose activities are related to
the manufacture, sale, and transportation of plant products in these organizations
define the personnel responsible for the implementation of quarantine measures and
ensure conditions for their work.
2. Preservation scheme during importation of quarantined products
(external plant quarantine)
6. Individuals and legal entities during formation of contracts for the supply of
quarantined products into the territory of the Republic of Kazakhstan get the necessary
information from authorized body upon quarantine measures for import prevention of
quarantine objects and ensure execution of conditions of entry, established by the
Government of the Republic of Kazakhstan.
7. Import into the Republic of Kazakhstan of quarantined products is exercised
only through phytosanitary control posts at the appropriate phytosanitary requirements
for quarantine of imported products and the presence of phytosanitary certificates of
national quarantine services-exporting countries issued for each shipment of quarantined
products, in accordance with the list of quarantined products, approved by the
Government the Republic of Kazakhstan.

11. Import into the Republic of Kazakhstan of quarantineable products, as well as
vehicles, infected by quarantine objects and foreign species is not allowed, in
accordance with the list of quarantine objects and foreign species approved by the
Government of the Republic of Kazakhstan or interstate agreements on cooperation in
plant quarantine.
12. The import quarantineable product is transported through the territory of the
Republic of Kazakhstan in covered or insulated, serviceable and sealed containers,
pressurized containers, cars, vans, refrigerated lorries and other vehicles.
13. Allowed the importation of the following quarantineable product bearing the
latent form of infection by quarantine objects, with a condition of its mandatory
inspections within the introduction-quarantine nurseries:
samples of seeds and planting material for scientific and breeding purposes and
variety trials;
samples of seeds and planting material as an exchange between research institutions and
botanical gardens.
13-1. It is allowed to import without a phytosanitary certificate of national
quarantine services of exporters countries following products:
1) in the hand luggage of passengers, crew members of ships, aircraft, carriages,
motor vehicles, upon condition that products are not planting or seed material or
potato;
2) wood packaging materials and fixing them in the presence of a special mark is
the international standard in accordance with the International Standard for
Phytosanitary Measures # 15 "Guidelines for regulating wood packaging material in
international trade";
3) quarantineable products, located in the vehicle and intended for food purposes
of commands and crews of these vehicles, without the right to their removal beyond the
means of transport. Food stocks in vehicles, infected by quarantine objects as
prescribed by the state inspector on plant quarantine shall be disinfected, destroyed or
be sealed in special storage facilities for the period of the vehicle on the territory
of the Republic of Kazakhstan.
14. Customs clearance of quarantineable products is carried out after the passage
of the state supervision in the field of plant quarantine with the corresponding mark of
state inspectors on plant quarantine and phytosanitary certificates for commoditytransport documents for permission to import (export).
15. The importation of quarantineable products by foreign diplomatic missions,
consular offices, representations of international organizations located on the
territory of the Republic of Kazakhstan, as well as persons who enjoy privileges and
immunities shall be in accordance with these Regulations, unless otherwise provided by
the legislation of the Republic of Kazakhstan and international treaties ratified by the
Republic of Kazakhstan
16. The state supervision in the field of plant quarantine of quarantineable
products on phytosanitary checkpoints is carried out by state inspectors on plant
quarantine phytosanitary control posts of the authority.
17. The state supervision in the field of plant quarantine and inspection on
phytosanitary control posts, in the destinations of quarantine products carried out
before or simultaneously with the customs examination of quarantineable products with
registration in the form of the relevant act, in accordance with Annex 3 to this
Regulation.
18. State inspector on plant quarantine explains owners of quarantineable products
current legislation in the field of plant quarantine of the Republic of Kazakhstan,
verifies compliance with the phytosanitary requirements of imported quarantineable
products, the presence of a phytosanitary certificate of the national quarantine service
of the exporting country, by inspection of transport, quarantine products. If during
inspection of surface or package the detection of organisms unravel, or similar in
morphology to the quarantine objects, plant disease symptoms, signs of damage of
quarantineable products by quarantine objects, during the inspection of quarantineable
products on its surface, in a package, exercises quarantine inspection. Sampling
procedure shall be done upon quarantineable products, study them on-site in order to
detect quarantine pests, plant diseases and weeds In case of impossibility to determine
the quarantined objects on-site, samples and objects are passed to the Republican
quarantine lab to confirm the species of objects to the quarantine species.
19. If the carrier refuses to impose quarantine products for state supervision in
the field of plant quarantine, it shall be returned to the exporting country at the
expense of the owner, whereof the inspector on plant quarantine shall intimate the
authorized body, border and customs authorities of the Republic Kazakhstan with
registration of return act in a form, in accordance with Annex 4 to this Regulation.
20. Regulated products, which are found in the quarantine objects shall be
returned, decontaminated, treated of quarantine weeds or shall be object for technical
processing. Expenses related to disinfection, cleaning or processing of quarantineable
products, shall be paid by its owners.
If the infected by quarantine objects quarantineable products cannot be
decontaminated, cleaned, processed and there are no conditions to return, then this
product shall be seized and destroyed in accordance with the procedure established by
the Government of the Republic of Kazakhstan.
Seeds and seedlings infected by quarantine objects of special scientific or other
value, for the treatment of their owners may be transferred to check in introductionquarantine nurseries. After the elimination of infestation by quarantine objects seeds
and planting materials are returned to their owner.
Withdrawal of quarantineable products (including the mailing, hand luggage and
luggage) carried by the state inspector on plant quarantine, whereas withdrawal act is
done in accordance with Annex 5 to this Regulation.
21. After passing the quarantine inspection of quarantineable products and
activities on plant quarantine state inspector on plant quarantine puts the stamp of
established form on accompanying inventory transportation documents upon the passage of
state supervision in the field of plant quarantine with permission to import to the
destination and gives its owner the act of quarantine inspection on form according to
Annex 3 to this Regulation.
Cargo operations (reloading on other vehicles) with quarantineable products on
phytosanitary control posts are made by the owners by permissive of the state inspector
on plant quarantine, after the state supervision on plant quarantine.
The act of quarantine inspection in the absence of violations of legislation in
the field of plant quarantine shall be issued within one day.
22. Imported quarantineable products, as well as vehicles that have passed
quarantine inspection and passed customs clearance on phytosanitary control posts are
not subject to secondary quarantine examination at the final destination of
quarantineable products.
23. Secondary inspection of quarantineable products and vehicles, sampling for
analysis and expertise in the destination of quarantineable products to complete customs
clearance are carried out by state inspectors on plant quarantine of the authorized body
with the subsequent examination to establish the species composition of pests, plant
diseases and weeds, the results of which shall be drawn inspection with a record about
the conditions of use of these products in the form, according to Annex 3 to this
Regulation.
Belonging of the objects to quarantine types is supported by the Republican
quarantine quarantine laboratory.
Period of the species composition of quarantine objects with a certificate for
phytosanitary examination for:
pests and weeds - up to 3 business days;
plant diseases - up to 10 working days.
24. In case of quarantine facilities at the destination of quarantineable products
entering the state inspector on plant quarantine of the authorized body takes measures
as defined in paragraph 20 of this Regulation.
25. Export from the Republic of Kazakhstan of quarantineable products should be
subject to the conditions provided for by interstate treaties and agreements of the
Republic of Kazakhstan in the field of plant quarantine, as well as the requirements of
the National Plant Quarantine Service of the importing countries.
26. The export of quarantineable products from the Republic of Kazakhstan is
allowed only through presence of certificate of the authorized body of phytosanitary in
accordance with Annex 7 to this Regulation.
27. Individuals and legal entities to obtain a phytosanitary certificate provide
into territorial division of the authorized body following documents:
1) application by form, in accordance with Annex 8 to this Regulation. An
application may be filed as an electronic request, certified by the electronic digital
signature of the applicant through the web portal of "electronic government»
www.egov.kz;
2) an identity document of the applicant - for individual, a certificate* or
certificate of state registration (re-registration) of legal entity - for legal entity;
3) an identity document of the authorized representative and a document certifying
the powers of representation of the applicant;
4) in the presence of the phytosanitary requirements of the importing country import quarantine permission of the importing country, translated into the state or
Russian language or copies of contracts, which stipulates the phytosanitary
requirements.
*Note: certificate of state (record) registration (re-registration) of the legal
entity (branch, representative office), issued before the entry into force of the Law of
the Republic of Kazakhstan dated December 24, 2012 "On amendments and additions to some
legislative acts of the Republic of Kazakhstan on state registration of legal entities
and registration of branches and representative offices, "is valid until the termination
of the legal entity.
28. Quarantine status of quarantineable products exported set by state inspectors
on plant quarantine in place of the original shipment and, secondarily, in sea and river
ports (marinas), railway stations, airports, postal services organizations, internal
trade facilities, bus terminals (bus stations) and other facilities when reloading
(formation) of export consignments. When exporting without reloading, phytosanitary
control posts are only supervising the proper design of the phytosanitary certificate.
29. Phytosanitary certificates are issued and certified by personal signature and
seal (stamp) of the established sample of state inspector on plant quarantine, who
inspected quarantineable products on the basis of act on examination of quarantineable
products. In the case of the export of quarantineable products from quarantine zones on the basis of phytosanitary examination of quarantineable products, confirming the
absence of quarantine objects, which is set by referring to the quarantine zone. A
phytosanitary certificate is issued for each batch of quarantineable products and
quarantine shall certify its condition, to have information about decontamination,
performing other additional quarantine requirements for the supply of these products.
A phytosanitary certificate or a reasoned refusal to issue it is made in a period
not exceeding five working days from the filing date to receive it.
30. The original phytosanitary certificate is issued to the sender of
quarantineable products; a copy is kept in the authorized body.
3. Preservation procedure of domestic shipment of
quarantineable products (internal plant quarantine)
31. State control and supervision in the field of plant quarantine quarantineable
products in the territory of the Republic of Kazakhstan is carried out by state
inspectors on plant quarantine of the authority.
32. Inter-regional transportation of quarantineable products are carried out in
the presence of the quarantine certificates issued by the state inspector on plant
quarantine of the territorial division of the authorized body, in accordance with Annex
9 to this Regulation.
Issuance of quarantine certificates for export of quarantineable products from
quarantine areas of the Republic of Kazakhstan is carried out by state inspectors on
plant quarantine of the territorial division of the authorized body.
33. For quarantine certificate individuals and legal entities present following
documents:
1) application form, in accordance with Annex 10 to this Regulation, to the
authorized body, or as an electronic request, certified by electronic digital signature
of the applicant, through the web portal of "electronic government» www.e.gov.kz, and
provide state inspector on plant quarantine with quarantineable products to determine
the status of the quarantine;
2) an identity document of the applicant - individual, a certificate* or
certificate of state registration (re-registration) of the legal entity - for legal
entity;
3) an identity document of the authorized representative and a document certifying the
authority to represent the applicant.
*Note: certificate of state (accounting) registration (re-registration) of the
legal entity (branch, representative office), issued before the entry into force of the
Law of the Republic of Kazakhstan dated December 24, 2012 "On amendments and additions
to some legislative acts of the Republic of Kazakhstan on state registration of legal
entities and registration of branches and representative offices, "is valid until the
termination of the legal entity.
Quarantine certificate is issued and certified by personal signature and seal
(stamp) of the established sample of state inspector on plant quarantine, who inspected
quarantineable products on the basis of act on examination of quarantineable products.
In the case of the export of quarantineable products from quarantine zones - on the
basis of phytosanitary examination of quarantineable products, confirming the absence of
quarantine objects, which is set by referring to the quarantine zone. Quarantine
certificate is issued for each batch of quarantineable products and quarantine shall
certify its condition, to have information on the implementation of additional
quarantine requirements for the supply of these products.
Quarantine certificate or a reasoned refusal to issue it is made in a period not
exceeding three working days from the filing date to receive it.
34. Re-routing of quarantineable products in transit or final destination made by
request of the owner of quarantineable products with the permission of the authorized
body, on whose territory these operations are carried out.
Imported quarantine products subject to second time quarantine examination in its
final destination.
34-1. if the carrier refuses to impose quarantine products for state supervision
in the field of plant quarantine, goods shall be returned to the sender.
4. Procedure for decontamination of quarantineable products and cleaning vehicles
35. Vehicles and subject to quarantine products are subject for disinfection,
quarantine infected objects, products, which disinfection is provided in the
phytosanitary requirements for imported quarantineable products, as well as vehicles and
quarantineable products in a quarantine which potentially dangerous matter, as
prescribed by the state inspector on plant quarantine.
36. When identifying objects in quarantine quarantineable products on
phytosanitary control stations decontamination works are carried out at checkpoints
across the state border of the Republic of Kazakhstan in fumigation chambers, stacks,
the holds of ships and barges, wagons, containers, and other types of transport.
Refrigeration of citrus crops realized in cold storage owners of quarantineable
products under the control of state inspectors on plant quarantine.
37. All kinds of transport vehicles after import quarantineable products as well
as products from quarantine areas of the Republic of Kazakhstan shall be subject to the
mandatory purification of waste destruction, and if necessary - fumigation in areas
defined by the state inspector on plant quarantine.
Preparation of vehicles and quarantineable products to the fumigation carried out
by its owners or transport organization under the guidance of experts’ fumigation units.
38. During the disinfection of quarantineable products in other countries imported
products are checked by experts of fumigation teams on residual fumigants.
39. Disinfection and cleaning, refund or processing infected objects quarantine
quarantineable products, opening and packing of goods, luggage, parcels, shipping them
to the place of decontamination and back are made at the expense of owners of
quarantineable products.
5. The procedure of quarantine actions by individuals and legal entities
40. Individuals and legal entities whose activities are related to the production,
harvesting, processing, storage, transportation and sale of quarantineable products:
1) provides a systematic inspection of crops, areas, warehouses, where the
quarantineable products are stored;
2) when detecting the quarantined objects within one working day shall notify the
authorized body;
3) not using for sowing the seeds clogged by quarantine weeds;
4) stores separately and purifies quarantineable products harvested in the
acrozone of quarantine objects;
5) at least once a year carries out preventive disinfection of storage space,
where keeps the quarantineable products;
6) observe and comply with the requirements of the legislation of the Republic of
Kazakhstan in the field of plant quarantine and regulations of the authorized body on
relevant activities upon plant quarantine.
6. The procedure of quarantine actions by local executive bodies
41. Local executive bodies of regions (city of republican status, capital) keep
records of quarantine facilities and provide information to authorized bodies and
interested parties.
In districts and rural districts for maintaining of records of quarantine objects
reserves an expert by decision of the local executive body of the region (city of
republican status, capital).
42. According to the requirements of state inspectors on plant quarantine in the
quarantine areas at railway stations, sea and river ports (quays), airports, bus
stations (bus stations), on objects of domestic trade, postal organizations and other
objects must be organized activities by physical and legal entities upon plant
quarantine, by the owners of these objects, as well as public authorities.
43. According to the authorized body within the period of 10 calendar days shall
decide on the establishment of a quarantine area with the introduction of quarantine
regime or its abolition in their respective territories.
7. The procedure for the imposition and removal of the quarantine
44. In case of identifying of quarantine objects, quarantine zones are set by type
of quarantined object, indicating the boundaries of its distribution.
The authorized body in conjunction with the local executive body of the region
(city of republican status, capital):
1) determines the phytosanitary control stations;
2) develops a list of quarantine restrictions and activities on plant quarantine;
3) Brings the list of quarantine restrictions and activities on plant quarantine
within one working day to individuals, legal entities and the habitancy of quarantine
zone.
45. Prohibition measures or restrictions shall be force into application in
quarantine areas on the export of infected quarantine objects quarantineable products.
The export of quarantineable products of quarantine areas outside the region (city
of republican status, capital) are allowed through organized temporary phytosanitary
control posts and in the presence of quarantine certificate; outside the Republic of
Kazakhstan - in the presence of a phytosanitary certificate.
Contaminated quarantineable products taken out of the quarantine area are subject
to refund, cleaning, disinfecting or transferring it to the processing organization.
Contaminated quarantineable products, with the impossibility of its disinfection
or processing shall be seized and destroyed in accordance with the legislation of the
Republic of Kazakhstan.
46. Pratique of area is carried out by results of a systematic survey.
In case if during the three years since the establishment of quarantine zones
there have been identified no quarantine objects, then this are shall be pratique of
quarantine zone by the authorized body.
