that he/she is aware that, pursuant to Chapter 5, paragraph 1.1.1, of the Network Code, if a request is made to book
transportation capacity at Entry Points interconnected with foreign pipelines, when submitting an offer to buy capacity or when
acquiring capacity through trading in accordance with the provisions of Chapter 7, paragraph 1.1, of the Network Code, the
aforesaid Company must declare that it has obtained the necessary import authorisations from the Ministry of Economic
Development and that the capacity requested or subject to trading respects the duration limits and daily contractual maximum
and daily average quantities set out in its own import contracts.

UNDERTAKES
1) to request capacity in relation to Entry Points:
only when the aforesaid Company has, if required, an authorisation from the Ministry of Economic Development to
import natural gas, in accordance with the provisions of Article 3, paragraph 1 of Italian Legislative Decree 164 of 23rd
May 2000 “Implementation of Directive 98/30/EC concerning common rules for the internal market in natural gas”:
only when the aforesaid Company has Import Contracts;
in accordance with the timeframes and daily contractual maximum and daily average quantities set out in said Import
Contracts;
2) to declare that the aforesaid requirements have been met in accordance with the procedures established in the Network
Code.
