Stipulation Supplement 2013 - Mal Coombs Park
Commercial
General
1. The permittee is responsible for submitting post-use information and fee payment to BLM within fifteen (15) days
after the event. The number of participants per/day and the total gross receipts for sales are required information
to be included in the post-use report. Commercial use fees are calculated at 3% of gross receipts from the sale of
food, beverage, and/or merchandise.
2. Permittee must provide proof of insurance by submitting a valid & current insurance certificate showing coverage
for the following amounts:
a. Damage to property in the amount of twenty five thousand dollars ($25,000);
b. Damage to persons (bodily injury or death) in the amount of three hundred thousand dollars ($300,000);
and
c. Minimum annual aggregate limit of six hundred thousand dollars ($600,000)
 The insurance must name “The United States Government, its Agencies, Representatives, and
Authorized Right-of-Way Grantees as an Additional Insured” under this policy, and shall submit
a certificate from the insurer that such insurance has been obtained, is in force, and that the insurer
will give the United States thirty (30) days notice prior to cancellation or modification of such
insurance. The permittee shall indemnify and hold harmless the United States against any liability for
personal injury, loss of life, or property damage arising in any way from activities under the permit.
NOTE: The insurance certificate does not have to be submitted with the application but must be received by BLM
at least ten (10) days prior to your event. You may fax this to our office and mail the original if you wish. Your
permit will only be valid when we receive your insurance certificate.
3. The permittee shall provide a copy of the ABC license (permitting the distribution/sale of alcohol) to the BLM at
least ten (10) days prior to the start of the event.
4. The permittee shall comply with all Federal, State, County, and local governmental agencies having jurisdiction,
ordinances, regulations, orders, postings, or written requirements applicable to the area or operations covered by
the Special Recreation Permit (SRP). The permittee must contact and receive concurrence and license, where
required, from all other federal, state, county and local governmental agencies having jurisdiction. The permittee
shall ensure that all persons operating under the authorization have obtained all required Federal, State, and local
licenses or registrations. The permittee shall make every reasonable effort to ensure compliance with these
requirements by all agents of the permittee and by all clients or customers under the permittee's supervision.
Event Operations
5. An SRP only authorizes the use, for the time and in the area, as specifically described therein. Specifically, the
Permittee is authorized to use only the group-use area of Mal Coombs Park, which includes the BBQ area, picnic
tables, power station, etc. The remainder of Mal Coombs Park (i.e. lighthouse, path to tide pools, individual picnic
tables, etc.) will remain open to the general public. Event set-up may begin as early as 8:00 AM. All equipment,
materials, tables, chairs, trash, etc. must be removed by 10:00 PM. Porta-potties must be removed by the
following Monday if the event is on a weekend.
6. Permittee must provide sufficient trash bags, trash cans, and/or dumpster to contain all trash and garbage in a
sanitary manner. Permittee is responsible for hauling all trash away, including any trash that may have
accumulated in permanent on-site trash cans, by 10PM on the day (or last day) of the event. Trash may not be left
in or around existing trash cans intended for use by the general public.
7. Permittee is responsible for ensuring the responsible use of alcohol by event organizers and participants, including
preventing public drunkenness, event participants from driving under the influence, and to make certain that no
alcohol is available or served to persons under the age of twenty one (21). The use of wristbands is required to
identify event participants of legal drinking age.
8. The permittee shall erect a temporary perimeter fence to contain any windblown trash and to discourage nonparticipants from entering the permit area. The perimeter fence shall be cleaned of windblown debris prior to
dismantling.
9. Permittee shall provide first-aid services with the capability to insure that any accident victim may be located,
treated, and evacuated as needed.
10. Permittee may provide additional tables, chairs, and shade structures within the designated portion of Mal
Coombs Park. All of these must be removed by 10PM on the day (or last day) of the permitted event.
11. Permittee may use the main parking area, but must make every attempt to park efficiently to leave some parking
spots for the general public, since Mal Coombs Park is a popular destination spot, especially on weekends and
holidays. Permittee will provide at least two (2) parking monitors to help park vehicles efficiently, comply with
any parking requirements established by the Humboldt County Sheriff Department, Shelter Cove Resort
Improvement District (RID) , and BLM and ensure that the flow of traffic along Machi road is not obstructed for
2-way traffic. Permittee should coordinate with the RID to provide overflow parking at the Community
Clubhouse and should request guests to carpool to the extent possible to reduce parking overload.
Resource Protection
12. Permittee is required to provide two (2) additional porta-potties with wash stations to accommodate the
anticipated amount of participants and to maintain adequate sanitation and cleanliness of the toilet and wash
station site. The permittee must provide a trash can at the wash station site for collection of paper towel waste.
13. Live music, amplified music, and stereo music may only be provided at a reasonable sound level that will not
disturb Shelter Cove residents or visitors. In the absence of specific decibel requirements, “reasonable” sound
level is defined as the minimum level that the event participants may enjoy in the immediate vicinity of the event.
Amplified music shall be directed toward the ocean whenever possible. Live music associated with the event
must be terminated no later than 8:00 PM.
14. Permittee will be responsible for the prompt repair of any event-related damages to utilities and related
improvements to a condition which is at least as good as the condition just prior to the event. The permittee will
be responsible for the repair and/or restoration of any improvements placed on public lands by BLM or its
authorized users that may be damaged as a result of the event and/or actions of event participants.
I have read the special stipulations and certify that all event related operations shall be conducted in accordance
with the above listed stipulations as well as the thirteen (13) terms and conditions listed on the back of the permit
form 2930-1. I understand that a violation of any term, condition, or stipulation may result in the cancellation of
the Special Recreation Permit authorization.
