DISCHARGE OF FIREARMS BYLAW No. 521, 2011
A BYLAW TO REPEAL THE DISTRICT OF PORT EDWARD DISCHARGE OF
FIREARMS BYLAW # 358
A BYLWA TO REGULATE AND PROHIBIT THE FIRING OF FIREARMS WITHIN
THE MUNICPAL BOURDARIES OF THE DISTRICT OF PORT EDWARD
WHEREAS under section 8 of the Community Charter, the District Council is empowered to
regulate or prohibit the discharging of firearms and the use of bows; and
WHEREAS the District Council deems it necessary and expedient to regulate and prohibit the
discharging of firearms and the use of bows;
NOW THEREFORE the Council of the District of Port Edward, in open meeting assembled,
enacts as follows:
1. INTERPRETATION
In this Bylaw, unless the context otherwise requires:
“Bow”
means a bow as define in section 1 of the Wildlife Act, R.S.B.C. 1996,
c. 488;
“Conservation
Officer”
means a conservation officer as defined in section 1 of the Environmental
Management Act, R.S.B.C. 1996, C.118;
“Firearms”
means a firearm defined in section 1 of the Wildlife Act;
“Highway”
means a highway or an arterial highway as defined in section 1 of the
Transportation Act, R.S.B.C. 2004, c. 44;
“Peace Officer”
means a peace officer as defined in section 2 of the Criminal Code,
R.S.B.C. 1995, c. C-46; and
“Settle Area”
means any area zoned residential, commercial, or industrial in the Zoning
Bylaw currently in force in the District of Port Edward and includes any
highway abutting or adjacent to such zones.
REGULATIONS

No person may discharge any of the following within the area of the District of Port
Edward as shown in Map Schedule “A:
(a) Bow; or
(b) Firearm
3.
No person may discharge any of the following within the area of the District of Port
Edward within 500 metres of the highway, railway, or settle area, as shown in Map
Schedule “B”:
(a) Bow; or
(b) Firearm
4.
The provisions of this bylaw do not apply to a Peace Officer or Conservation Officer
lawfully engaged in the performance of his or her duties.
PENALTIES
5.
Any person found guilty of an offense against this bylaw shall be liable upon conviction
to a fine not exceeding $10,000 together with the costs of conviction, or in default of
payment thereof, a term of imprisonment not exceeding six months.
REPEAL
6.
The “District of Port Edward Discharge of Firearms Bylaw No. 358” is hereby repealed.
CITATION
7.
This bylaw may be cited as “District of Port Edward Discharge of Firearms Bylaw No.
521, 2011”.
