Expression of interest Mobile Food Vans Yarraville Gardens The City of Maribyrnong is committed to supporting local business whilst activating street life and public space activities, with unique experiences and opportunities for residents and visitors alike. It recognises that Mobile Food Vans play an important role in creating vibrancy and activity by providing an efficient, high quality and accessible food service for the local community. Due to the popularity of Yarraville Gardens as a food van hub, the number of food vans operating at this location is restricted to a maximum of 10 vans at any one time. To maintain a safe environment for consumers and to create an improved application process for food van operators, a permit to conduct business at Yarraville Gardens is required ensuring that a space is available to operate at appropriate times. Permits types Two Mobile Food Van permits are available within the City of Maribyrnong. “Special“ Mobile Food Van Permit This permit allows for food van operators to conduct their business at all locations within the City of Maribyrnong, which comply with the conditions of the permit, including Yarraville gardens. “Standard” Mobile Food Van permit This permit allows for food van operators to conduct their business at all locations within the City of Maribyrnong, which comply with permit conditions with the exception of Yarraville Gardens. Application requirements “Special” Mobile Food Van permits are subject to EOI application which will be advertised by Council on an annual basis and require a minimum fee of $3250 for the 2015/16 financial year. Applicants wanting to secure a permit, must offer a price equal to or higher than the minimum fee in order for the application to be considered. “Standard” permits are issued through the submission of an application for a period of 12 months on an ongoing basis. The Standard Mobile Food Van permit is set at $2500 for the 2015/16 financial year. The successful applicant/s will be required to operate the sale of food in strict conformity with the conditions of the permit and other such legislative requirements specific to Health and food handling requirements. 1 Expression of interest Applications for an expression of interest (EOI) must be in writing on the attached application form, providing the following information. The Council is not bound to accept the highest proposal or any application b. The application will not be deemed approved until the Council has notified such acceptance to the applicant in writing 2 “Special” Permit Conditions Location Ten dedicated parking bays are available and located on the northern side of Somerville Road, between Hyde Street and Whitehall Street, Yarraville – adjacent to Yarraville Gardens, please refer to map below. These bays are to be used by valid Special Permit holders only Yarraville gardens, other users Please note that on the third Saturday of each month, the Yarraville Farmers Market operates within the Yarraville Gardens close to Somerville Rd until 12:00pm., vendors will not be permitted to set up prior to 12:00pm on those days without written approval from City of Maribyrnong. This is subject to change at the discretion of City of Maribyrnong. General Conditions 1. The operator must present the permit for inspection whenever requested by a member of the Victoria Police force or by an Authorised Council Officer . Mobile food Vans/trucks will leave the site when not operating and during restricted periods Each mobile food Van/Truck must have Food Act 1984 Registration with the Principal Council. All vendors selling food shall operate in strict compliance with all relevant Laws, Acts and Regulations Food vans/trucks must be maintained and comply with the relevant standards and not appear to be unsightly or contain graffiti The operator must abide by all parking restrictions and must not create an obstruction on any road, thoroughfare or footpath The operator must observe and maintain a safe environment for the public from street traffic. Serving window only on left side of vehicle when parallel parked Ice cream vendors may stop whenever hailed by the public and are not permitted to permanently stop outside schools The operator is to follow reasonable directions by a member of the Victoria Police force or by an Authorised Council Officer This permit is granted to the business and for a listed vehicle and is not transferable and is NOT for multiple vehicles and if the business is sold the new owners must re-apply Mobile food Van/Truck operators will not place on Council land any furniture, flood lights, advertising boards, banners, sails or any other thing without a valid street furniture permit other than an approved litter bin The area immediately surrounding the mobile food Van/Truck is to be kept free of litter during the hours of operation a. Appropriate litter bins must be provided by the operator to service the needs of patrons b. Litter generated by the mobile food Vans/Trucks is to be picked up and deposited within the operator’s own bins. c. Mobile food Van’s/Truck’s litter must not be placed in public street bins Unless the business is an ice cream van, amplification of music or sound is NOT permitted. Must hold current Public Liability insurance of a minimum of $20 million for the full permitted period and must fully indemnify the Maribyrnong City Council. Council is to be notified in writing of any changes occurring to any public liability insurance 3 15. Any proposed changes to types of food listed on this application must be communicated in writing to Council prior to the changes occurring 16. The operator is not to create a nuisance to nearby residents or adversely affect 17. 18. 19. 20. 21. 22. surrounding businesses, a distance of 100 meters must be maintained from any fixed food operating businesses Operators are not permitted to attend any Sporting, Festival or Community Event, without Council’s written consent. A distance of 100m must be maintained from the reserve or site while the event is taking place. Mobile food Vans/Trucks operators must provide evidence that they comply with ‘Energy Victoria’ The use of musical or sound amplification equipment is NOT permitted Failure to comply with the permit conditions in any way may result in Council giving written notification of cancellation from any right to operate within the City of Maribyrnong.
