TERMS OF BUSINESS
Introduction
“Genesis” refers to Genesis Recruitment Solutions (A division of Genesis IT&T
Pty Ltd – ABN: 94 122 767 006) and any subsidiary.
“Candidate” means any person introduced by Genesis to your company who
is subsequently hired by your or an associated company within 9 months of
the introduction.
Acceptance of Terms of Business
The Client accepts these Terms of Business:
 by signing a copy of this agreement and returning to Genesis
 by emailing confirmation to proceed
 by interviewing or offering a position to a Candidate supplied by
Genesis
Confidentiality
Information supplied by Genesis to the Client organisation is strictly
confidential and cannot be provided to a third party without the consent of
Genesis. Similarly, Genesis will respect the Client’s confidentiality and will not
disclose any information to a third party without the agreement of the Client, or
unless we are legally required to do so.
Personal Information
The Client agrees to comply with the National Privacy Principles contained in
the Privacy Act 1988 (as amended) with regards to Candidate information
provided to the Client by Genesis. This information cannot be disclosed to a
third party without express permission by Genesis and the Candidate.
Personal information can only be used by the Client for the primary purpose
for which it was intended, for example to assess the Candidate’s suitability for
employment.
Confirmation of Services
These terms of business are deemed to be the basis of our agreement in the
provision of a Candidate to your organisation as per attached Schedule 1.
Introduction of a Candidate
The introduction to you of a Candidate is confidential and you must not directly
or indirectly introduce a Candidate supplied by us to any other potential
employer without the consent of Genesis. If you directly engage a Genesis
Candidate OR if you introduce the Candidate to another potential employer
who subsequently engages them, then you will be liable to pay the full fee in
accordance with our Fee Structure.
Liability
While Genesis makes every effort to maintain high standards, we cannot
accept liability for any loss, damage or expense of any nature that may result
from the provision of our services.
Replacement Guarantee
A three-month guarantee period will apply to all assignments. This guarantee
means that if the Candidate leaves your employment within 3 calendar months
of commencement Genesis will replace them, once only, with no further fee
being charged, subject to conditions below;
 The Candidate does not leave as a result of redundancy or of a change
in his/her role, or
 Our full fee is not paid within 21 days of invoice date, or
 We are not given the exclusive opportunity to replace the original
candidate.
If, subject to above conditions, we are unable to replace the original Candidate
within two calendar months of their finish date, you will be issued with a credit
of 50% of the fee paid. This credit can be used against any further permanent
placement made by Genesis with you within 12 months of the original
Candidate’s start date.
Variations
No variations to these Terms are acceptable unless agreed in writing by a
Director of Genesis.
Fee Structure
The Genesis Fee Structure is based on the candidate’s starting annual salary
package. The package includes base salary, car (valued at $15,000 per
annum) and Superannuation.
For assignments, where Genesis is used exclusively:
Salary package under $100,000 per annum
Salary package of or over $100,000 per annum

For assignments where Genesis is used in conjunction with other
methods of recruitment:
Salary package under $100,000 per annum
Salary package of or over $100,000 per annum

For Executive Search Assignments:
All salary levels*
*One third of total estimated fee paid on acceptance of Executive Search
Assignment. Balance payable on commencement of candidate.
For Overseas Assignments:
All Salary levels

Display advertising expenses and out of pocket expenses, such as
accommodation and travel, will be charged at cost. These and any other
additional expenses will not be incurred without your prior approval, but once
approved will be charged irrespective of whether a candidate is appointed.
All fees and expenses are due strictly within 21 days of invoice date.
