How to determine if a student requires Residential treatment Facility as FAPE Present Levels of Performance indicates student is not making progress on IEP goals: Does student have a BIP and receiving counseling supports on IEP: 510, 515, 520 and/or 535? Is student experiencing increased success at school but not at home? Encourage family to seek support from other agencies. Yes No Increase counseling and behavioral supports. Despite increased services, student demonstrates lack of progress and increased display of problematic mental health related behaviors. Convene IEP meeting to review services and supports. May need further specific assessments (i.e. CANS) to determine whether student needs a more restrictive educational placement. Does student need additional assessments? Adjust goals, services, and supports. Placement may include a more restrictive placement No Yes Complete Assessment Plan; reconvene IEP team. Do results indicate need for residential placement? Yes LEA’s offer of FAPE is Residential Placement. It is inadvisable to name specific programs during IEP meeting. Describe setting instead. Placement in a residential treatment facility must be deemed by the IEP team to meet the criteria for LRE, as a result of compiled data that confirms that student cannot make educational progress without placement.
