To their Honours the magistrates of the First Collegiate Court of the Twentieth Circuit, based in TUXTLA GUTIÉRREZ, CHIAPAS: FREDDY GABRIEL CELIS FUENTES, MANUEL DE JESÚS ROSALES SUAREZ AND THE ACTING SECRETARY OF JUSTICE. Your Honours: By means of this letter we ask that when you undertake the analysis of the Motion for the Recognition of Innocence number 4/2012, which has been promoted in favour of Professor Alberto Patishtán Gómez, that you thoroughly review the arguments presented in this paper, taking into account the widest interpretation of the human rights of the petitioner in accordance with the provisions of the first and second paragraphs of Article I of the Constitution. We believe that the arguments presented by Professor Alberto Patishtán Gómez are convincing enough to determine that the isolated theses and dissertations of jurisprudence that are compiled in the Judicial Weekly and its Gazette are innovative public documents and as such, are effective in countering the evidence on which the conviction given to the teacher was based. We also believe that the Honourable Court cannot ignore the obvious fact, recognized not only by a large segment of the national and international civil society, but also by judicial authorities, the Federal Executive and the President of the State of Chiapas, of the violation of the fundamental rights of the teacher Alberto Gómez Patishtán to due process and the presumption of innocence. Sincerely
