Making of Bye Laws to Prohibit the Consumption of Intoxicating Liquor at St. Mullins, Tinnahinch and the Barrow Track. Members welcomed report from J. Crowley on proposed Bye Laws prohibiting the consumption of intoxicating liquor on the streets and in public places at St. Mullins Village, The Barrow Track between St. Mullins and Tinnahinch and Tinnahinch Village. Members welcomed the proposals and said they would like to see the Bye Laws extended to cover the whole of the Barrow Track and other areas such as Tullow. Members also said that Garda presence and enforcement are key issues and that Carlow County Council writes to the Minister for Justice for more Gardai to police these areas. A discussion took place in relation to security in Carlow Town Park with increasing anti social behavior. This issue is to be raised at next Joint Policing Committee meeting. Councillor Browne expressed regret at attack on family on boat trip on the River Barrow at Carlow Town. He requested that this Council write to the family stating that this Council will endeavour to do everything it can to ensure such incidents do not happen again. Councillor Phelan also called for security or CCTV for Carlow Town Park for the summer months. Councillor Lacey advised that work on the provision of a child swing at Carlow Town Park has commenced. Proposed by Councillor T. Kinsella Seconded by Councillor W. Quinn AND Following a showing of hands it was unanimously resolved:‘That we, the Members of Carlow County Council hereby approve Bye Laws to prohibit consumption of intoxicating liquor at St. Mullins, Tinnahinch, and the Barrow Track as set out below in accordance with Section 200 of the Local Government Act, 2001. St. Mullins: That part of County Carlow comprising of the village of St. Mullins and its environs. The Barrow Track: That part of County Carlow comprising of the track/pathway/towpath known as the Barrow Track between St. Mullins and Tinnahinch. Tinnahinch: That part of County Carlow comprising of the village of Tinnahinch and its environs’. 2. The Covenant of Mayors Mr. J. Crowley in his report to Members advised that the ‘Covenant of Mayors’ is an European wide movement of Local Authorities joining forces in an effort to promote energy efficiency and the use of renewable energy resources, as part of the E.U. Commitment to achieve a 20% CO2 reduction by 2020. The Covenant of Mayors was discussed at the July meeting of Council and Members approval was now sought to mandate the Cathaoirleach to sign the Convenant adhesion form. Proposed by Councillor F. Consider Chief Executive’s Report on submissions received on Proposed Amendment No. 1 to the Joint Spatial Plan for the Greater Carlow Graiguecullen Urban Area 2012-2018, incorporating the Carlow Town Environs Local Area Plan 20122018. The Chief Executive advised Members of the proposed Amendment No. 1 of the Joint Spatial Plan for the Greater Carlow Graiguecullen Urban Area 2012-2018 incorporating the Carlow Town Environs Local Area Plan 20122018. The proposed Amendment is to rezone four parcels of land located on the Kilkenny Road currently zoned as ‘Amenity and Open Space’ to ‘Residential 1’ zoning. The areas of each parcel of land are as follows: Parcel no 1 2 3 Area of Parcel 0.23 hectares 1.93 hectares 0.88 hectares 4 4.23 hectares Members had for consideration the Chief Executives report outlining submissions received following the public consultation process on the proposed amendment. The report included responses to the issues raised and recommendations which take account of the proper planning and sustainable development of the area. Ms. Arlene O’Connor, Acting Senior Executive Planner gave an overview for Members on the proposed Amendment outlining the original proposal and the proposal placed on public display. A lengthy discussion took place in relation to the proposal regarding the area of land contained in parcel no.1. In relation to the proposal for land parcel no. 1 Councillor Phelan requested that the land parcel be extended by approximately 280 sq. metres. Ms O’Connor indicated that this was the maximum that the area could be extended due to it bounding a flood risk area. Councillor Ahern stated that the purpose of the Amendment was to reflect zonings which were in place prior to the Joint Spatial Plan 2012-2018 being adopted. She stated that the Map on page 10 of the Chief Executives report is inaccurate. She said that an existing dwelling was not included as proposed residential 1 zoning and the relevant maps did not show the indicative use. Councillor Ahern requested that the matter be deferred. Councillor Ahern also indicated that she would not be supporting the proposal on the basis that the dwelling was not included. A vote was taken in relation to the Amendments to the lands in parcels 2, 3 and 4. The recommendation by the Chief Executive in relation to parcels of land 2, 3 and 4, as set out in Chief Executives Report was proposed by Councillor A. Ahern and Seconded by Councillor F. Phelan. In relation to the recommendation in the Chief Executive’s Report in respect of land parcel no. 1 Councillor A. Aherne proposed in view of the map and the Chief Executive’s Report that the proposed ‘Residential 1’ zoning be amended and increased to reflect the current status of the land immediately to the south west where a house already exists. Councillor Ahern proposed the following:(i) Land adjoining land parcel no. 1 to the south west be rezoned to reflect existing dwelling and shed (ii) Land adjoining land parcel no. 1 immediately to the north should be rezoned ‘residential 1’ as far as possible (iii) The Amendment to be placed back on Public Display This proposal was seconded by Councillor Phelan. Conference registration fees are to be included on list of forthcoming conferences detailed on Council Agenda. This concluded the business of the meeting.
