In particular it was suggested by some of the attendees at the pre-examination hearing that they or people they knew had been led to understand that representations made in relation to earlier consultations would be carried forward and that they would therefore not need to make further representations at subsequent stages. In accordance with its indications at the Pre-hearing meeting the City Council sets out herein a response to the matters raised for the benefit of the examination. As the Inspector will be aware the City Council has provided the relevant documents to the examination as Core Documents (CDLP 3.1 et seq) under the heading “Local Plan Consultation”. These include in particular the Statement of Community Involvement - April 2007 (CDLP 3.1); Local Development Framework Core Strategy Options Stage Consultation Statement January 2010 (CDLP 3.2); Canterbury District Local Plan Preferred Option Consultation Draft Consultation Statement 12 June 2013 (CDLP 3.3); Canterbury District Local Plan Publication Draft Consultation Statement May 2014 (CDLP 3.4); and Canterbury District Local Plan Submission draft Consultation Statement 18 November 2014 CCC (CDLP 3.5). In addition the City Council has carried out a review of consultation letters that were sent to those making representations. As set out in the Local Plan Consultation documents referred to above, at each stage of local plan preparation the Council has contacted those consultees held on the database which includes persons / organisations who a) have asked to be kept informed of the local plan b) have made comments on the local plan and c) are statutory consultees. The advice given to consultees and letters that were sent out in relation to the consultations carried out are available within the Consultation Statements referred to above. The consultation statements also attach the public notices that were published and articles within Kentish Gazette and District Life magazine together with copies of posters. It is understood that the concerns raised do not relate to the consultation carried out in respect of the Core Strategy Options Report conducted in 2010 but to the subsequent plan consultations in 2013 and 2014. For ease of reference the pro-forma letters in relation to the 2013 and 2014 consultations therefore are reproduced in the following appendices attached hereto, in chronological order. In addition the letter notifying the public that the plan had been submitted is also attached. Appendix 1 contains the general letter and email text setting out the details of the Preferred Options Local Plan - June 2013. Appendix 2 contains the general letter and email text setting out the progress on processing the representations – January 2014. Appendix 3 contains the general letter setting out the details of the publications draft which was also included in the emails – June 2014. Appendix 4 contains the general letter notifying the public of submission– November 2014. It is noted that there is reference within the June 2014 general letter and email following the invitation to make comments on the draft plan that “only representations received by the closing date will be considered by the Inspector. If you wish to appear at the Examination, you will need to make comments at this stage, although the Inspector will have access to comments made at previous stages. Comments made at this stage will be forwarded to the Planning Inspector for consideration as part of the Examination”. It is understood that this is the text that Mr Baker specifically referred to at the pre-hearing meeting. In accordance with this advice the Inspector does indeed have access to those comments made at an earlier stage as do the public. The comments in this letter and indeed in the letter read as whole cannot, in the Council’s view, reasonably be read to suggest that this advises people wishing to make comments on the latest version of the plan should rely upon earlier representations and not comment on the latest version of the plan. Specific reference was also made at the pre-hearing meeting to information or a letter published in the Kentish Gazette. The Council is unfortunately not clear what is being referred to or indeed which letter. The Council is seeking to obtain a copy of the letter from consultees. It has also been unable to identify any correspondence sent to Ms Blatherwick’s son. The Council has not at this point been able to identify a specific letter published in the Kentish Gazette. The Council has published its legal notifications within the Kentish Gazette which are contained in the Consultation Statements and has also considered the articles and press statements within both the Kentish Gazette and District Life magazine. Again none of the wording in these publications supports the contentions being made. The Council has at every stage of the plan process which has had to evolve in light of changing legislation and plan procedures as well as Government policy sought to and achieved extensive and thorough public engagement. The documents that are before the Inspector clearly show this. The Council is also committed to assist the Inspector as best it can with the examination as well as the public and if further concerns are raised or further evidence is submitted the Council will of course respond accordingly.
