MODEL/CLIENT WAIVER AND RELEASE AGREEMENT
I, the undersigned (“MODEL/CLIENT”), for good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged, hereby agree and consent
to permit authorized hair technicians and stylists (“ARTISTS”) retained by HELIAS,
LLC. (“HELIAS LLC”) to perform coloring, cutting and/or styling of my hair for
purposes that may include trade show appearances, marketing efforts and/or
educational and instructional classes.
I understand and agree that HELIAS shall have the exclusive right to take
photographs and film of me (Hereinafter “PHOTOS”), and that HELIAS may utilize
the PHOTOS and my name and likeness for any lawful purpose including, but not
limited to research, marketing, advertising and promotion, without any further
consideration to me. Any and all PHOTOS shall be the exclusive property of
HELIAS, and HELIAS shall have the exclusive, worldwide rights to publish and to
cause to be published the PHOTOS in any form of electronic, video or print media,
including, but not limited to, magazines, websites, social media, publications, DVD’s,
cable and satellite television, etc.
I understand that, due to time limitations that may be involved, ARTISTS may be
unable to perform a “patch test” on my hair prior to the application of hair coloring
products and formulations. I am aware that a precautionary “patch test” is normally
advisable prior to the initial application of hair coloring products and formulation in
order to guard against unintended and unanticipated contingencies including, but not
limited to, undesired coloring effects, damage to hair and allergic reactions. With
knowledge of the foregoing, I hereby voluntarily waive the right to have a “patch test”
performed on my hair.
I further agree to waive, and to hold ARTISTS and HELIAS and their representative
agents, employees, representatives and shareholders harmless from, any and all
claims or potential claims arising from the taking and publication of the PHOTOS,
the coloring, cutting and/or styling of my hair, and the application of hair care and
hair coloring products and formulations to my hair, including but not limited to any
claims for liability, damages or personal injury, including and damages based on
allergic reaction, damage to my hair or improper hair coloring.
I HAVE READ THE FOREGOING AND AGREE TO THESE TERMS.
