I _______________________________________ agree to the conditions set out hereunder:
1a. A current contract is required at the beginning of each season for each mare.
1b. A non-refundable BOOKING FEE of $350 is required with a new contract. This is deductible off the service fee.
1c.. The total service fee of $1100 is to be paid on or before the mare’s arrival to EVDS.
Please note: Mares will not be served unless the full service fee has been paid.
1d. All accounts for agistment and other vet work/charges not specifically included in the service fee is to be paid in full on collection of the mare.
1e. When purchasing chilled semen for $880 inc GST – apart from the first collection and packaging , which IS included in the service fee, there is a non-refundable collection fee of
$330 for each subsequent shipment PLUS FREGHT COSTS. Full payment of this fee must be made before the semen is sent. On weekends and public holidays surcharges may apply. The collection fee for subsequent collections is in addition to the one time service fee of $880 which includes the first collection and packaging, must also be paid in full before any shipments will be made.
1f. When purchasing frozen semen for $660 – there will be a non-refundable surcharge for transportation costs in the dry shipper canister (approx $330 but is variable depending on where it is sent in Australia) and full payment of this fee must be made before the semen is sent. This surcharge is in addition to the service fee of $660 – for three “mare doses”, which will suffice for 3 cycles. A refundable deposit of $330 on the dry shipper tank will also be charged and required to be paid prior to shipping the frozen shipper tank.
2 No contract is said to have been made until the complete Breeding Contract and nonrefundable deposit is received by EVDS Pty Ltd. Payment information is found at the end of this contract.
3a. No refunds will be given.

3b. In the event of the mare not falling pregnant the owner may negotiate a ‘free return’ with
EVDS. A veterinary certificate must be provided by the owner to prove that the mare is not in foal. The “Free Return” does not include agistment or handling fee charged per cycle.
4. Due to (a) the number of visiting mares, (b) quarantine restrictions on stallions involved with semen export, (c) nervous mares, (d) chronic infections, (e) foal proud mares, (f) safety considerations or (g) any other circumstance deemed appropriate – EVDS Pty Ltd reserves the right to use Artificial Insemination techniques without prior owner consultation. This is a very gentle way to get a mare in foal and many difficult breeders will happily conceive using this method. It is equally, if not more successful than live cover serving, and will not incur any further costs than live cover.
5. In order to minimise stallion use, maximise stallion fertility and maximise mare conception,
EVDS Pty Ltd reserves the right to direct and implement policy on follicle testing, pregnancy testing and subsequent drug therapy, such as antibiotics, prostaglandin, oxytocin, ovulation drugs and uterine flushes. At all times minimising the cost to the mare owner and maximising the successful conception without compromising the mare’s wellbeing, which will be the highest priority.
6a. Mares must not have hind shoes on if they are to be served. If the mare is shod behind, we reserve the right to remove the shoes with the costs borne by the owner. If necessary on therapeutic grounds, the shoes will be covered with padding and bandage when being served, at additional costs.
6b. EVDS Pty Ltd may refuse to inseminate the mare if:
(i) The mare poses an unacceptable danger to herself, her handlers or the EVDS clinic and or property,
(ii) The mare is unsuitable for breeding, as determined by the EVDS Veterinarian in his/hers absolute discretion; or

(iii) The breeder fails to comply with clause 7.
The mare owner or agent must ensure that on arrival at EVDS (52 Duncans Lane, Clarenza
NSW), the mare will be:
(a) halter broken and able to be led;
(b) known to have a vaccination history by the owner, regardless of whether vaccinated or not. Should your mare contract a disease that is vaccinatable against, such as Tetanus,
Strangles, Hendra, Herpes, Salmonella whilst at EVDS, there can be no claims made against
EVDS whatsoever to compensate for loss or treatment, cost to isolate her etc. It is the mare owner’s responsibility to protect the mare against these diseases through vaccination at least 2 weeks prior to arrival at EVDS.

Unshod on back feet free of illness and disease; and
(e) free of injury, except as disclosed in this contract.

8. Rates are as follows:
Agistment per day – mares will be hand fed, yarded separately to minimise risk of injuries from other mares etc.

9. EVDS Pty Ltd staff will take all reasonable care, but shall not be liable to the owner or the agent in the event of the death of the mare (s) or in the event of the same receiving any injury or suffering any illness howsoever arising.
10. There is a “ live foal guarantee” for live cover, chilled and frozen semen services. A veterinary certificate must be supplied to EVDS stating the reason why there was no live foal and EVDS must be notified immediately. In most cases a ‘Free Return’will be negotiated.
11. In the event of the stallion being unavailable – due to death, injury, competition commitments or sold – EVDS will offer an alternative stallion where possible. Mares not covered as a result of the stallion being unavailable will not be compensated for daily charges and or any other costs but a ‘free return’ may be negotiated’.

12. Agents please be aware – if signing on behalf of an owner who subsequently defaults on payment the agent then becomes liable for all outstanding costs.
