April 5, 2013 Valued Customer This letter is intended to update you with regard to Microscan’s compliance with the Decree no. 2012-232 of 17 February 2012 on the annual declaration on substances at Nanoscale in application of article R. 523-4 of the Environment code. Microscan understands this information is necessary to comply with new French regulations (collectively, the “Nanoscale Regulations”) that require annual declarations of nanoscale substances. (There are certain exceptions to this general definition for graphene flakes, single wall carbon nanotubes, and specific substances with environment, public health, safety and/or competitiveness concerns). The Nanoscale Regulations apply to any nanoscale substance on its own, contained in a mixture or intended-to-be-released under normal conditions of use. Examples of products that may contain substances at nanoscale size as defined by the Nanoscale Regulations include, but are not limited to, lubricants, toner, and other possible mixtures. Microscan has determined, to the best of its abilities, that its products do not have particles that meet the Nanoscale definition, and as such does not have a reporting obligation as required by the Decree.
