2015 Player Contract
This document sets out your obligations as a player in the AIHL. You
should read it carefully and get advice on it if needed.

Scope
1.
The parties agree to act in good faith toward one another and to comply with the purpose, spirit and intent of this
Player Contract.
2.
The parties agree that the Player is an amateur player and that nothing in this Player Contract gives rise to a
contract of employment or a contract of service or changes the Player’s playing status from an amateur to a
professional.
3.
Where the Player is a minor or otherwise at law has no legal capacity to provide consent or agreement with respect
to his rights and obligations under this Player Contract, the Player’s Guardian agrees to provide such consent or
agreement on his behalf.
Term and Termination
4.
This Player Contract commences on the date of execution and continues until four (4) weeks following the
conclusion of the 2015 AIHL season.
5.
This Player Contract may be terminated:
(a)
at any time if both parties consent;
(b)
by either party on written notice with immediate effect, if the other party breaches any of its obligations and
has not remedied that breach within 21 days of receiving a notice from the non-defaulting party requiring
the breach to be remedied;
(c)
if the Player is found to be guilty of serious misconduct in accordance with the AIHL Code of Conduct; or
(d)
if the Player is an import player (as defined in AIHL’s Rules and Regulations), by the Team giving 30 days
written notice.
5.2
This Player Contract will automatically terminate if the Team’s license to participate in the AIHL competition is
terminated.
Team Obligations
6.
The Team must:
(a)
provide the Player with training opportunities and quality coaching so he can play elite ice hockey in
Australia;

(b)
provide a playing, training and travelling environment that is free of any unreasonable risk to the Player’s
health and safety;
(c)
provide adequate adult supervision for all activities that the Player is involved with in connection with the
Team; and
(d)
release the Player from any obligations under this Player Contract while he is selected to compete for a
national representative team without prejudice to any rights the Player has under this Player Contract.
Player Obligations
7.
The Player must:
(a)
play and train the best of his abilities at all times;
(b)
obey all reasonable directions of the Team and AIHL;
(c)
play in all matches in which he is selected to play, unless he obtains a valid medical certificate confirming
that he is unfit to play or receives prior permission from the Team not to play because of another valid
reason (such as family obligations, prior commitments etc);
(d)
punctually attend all Team training sessions, meetings and events, unless expressly excused by the
Team;
(e)
comply with the Team’s reasonable requirements about preparing for matches, attending social functions,
behaviour and dress (including while on the ice during a match);
(f)
not play or train for ice hockey with another AIHL club or team, without first obtaining the Team’s
agreement in writing;
(g)
ensure all debts to the Team are paid upon termination of this contract;
(h)
do everything that is reasonably necessary to achieve the best possible physical condition for playing ice
hockey, and when requested by the Team, submit to fitness tests or medical examinations;
(i)
if requested, provide the Team with a letter of clearance from his last team before he plays his first match
with the Team; and
(j)
without prejudice to the AIHL Code of Conduct, not knowingly or recklessly do, write or say anything which
is likely to (i) jeopardise the Team’s relationship with the AIHL, any other team in the AIHL or the Team’s
sponsors; or (ii) bring the Player, Team, AIHL, IHA or the game of ice hockey in disrepute.
8.
While the Player is participating as a member of the Team — including at any time while on any road trip — the
Player acknowledges and agrees that he must not have in his possession, or use, any tobacco, alcohol or illicit
drugs. If the Player violates this rule during a road trip, he acknowledges that the Team’s manager or coach may
immediately send the Player home.
Parties bound by the Rules
9.
The parties agree to be bound by the rules of the AIHL competition designated as such by the AIHL, including but
not limited to any by-laws, rules of the game and any other rules, codes, policies, procedures or regulations (as
implemented by the AIHL from time to time) (the AIHL Rules) and acknowledge that these documents are
incorporated into, and form part, of this Player Contract.
10.
The parties further acknowledge that the Team, the AIHL and the sport of ice hockey would be damaged by any
impairment of public confidence in the honest and orderly conduct of the game, or the integrity and good character
of its players, and therefore they expressly agree that the Player will be subject to any disciplinary action that the
AIHL or the Team considers reasonable, when delivered in accordance with the AIHL’s Rules and Regulations.

11.
The Player agrees to be bound by, and comply with, the Team’s rules and regulations (as specified by the Team
from time to time). In the event that a Team’s rule or regulation is inconsistent with the AIHL Rules, the AIHL Rules
apply to the extent of the inconsistency.

12.
The parties acknowledge and agree that nothing in this Player Contract prevents the Player from playing or training
for a national representative team sanctioned by Ice Hockey Australia (IHA), provided that he gives reasonable
notice to the Team of his commitment.
13.
The Player warrants and confirms that he is registered with IHA as a player, does not have any outstanding debts
to IHA, and if applicable, possesses a valid international transfer card.
Liability
14.
The Player acknowledges and accepts the inherent risks associated with ice hockey that may result in personal
injury and agrees that he freely assumes those risks.
15.
The Player agrees not to bring any claim or proceeding or similar of any nature whatsoever against the Team or the
AIHL (or their respective directors, officers or employees) for any damage, loss (including economic loss), injury or
liability or similar of any nature whatsoever the Player may suffer in participating in, or being excluded from, a game
(or in relation to a game, including training and associated travel).
16.
Except for liability that cannot by law be excluded, the Team and the AIHL exclude all liability of any nature
whatsoever to the Player in tort (including negligence), contract or otherwise for acts or omissions of the Team and
the AIHL (or their respective directors, officers or employees) arising out of or in relation to games, this Player
Contract or otherwise.
Medical Treatment
17.
The Player must
(a)
promptly report any injury, illness or ailment to the Team immediately (including any injury, illness or
ailment which prevents, or is likely to prevent, him from performing his obligations under this Player
Contract);
(b)
respond fully and in good faith to all questions from the Team’s medical advisor in relation to his health;
and
(c)
18.
comply with the AIHL Anti-Doping Policy, including by providing samples for drug testing if he is required to
do so.
The Player consents to, and must undergo, any medical, health, fitness and dental treatment as may be reasonably
prescribed by the Team’s medical advisor in respect of any injury or illness sustained in the course of playing for
the Team.

19.
The Player acknowledges that he may be photographed or recorded while participating in the AIHL. The Player
grants the Team and the AIHL a non-exclusive perpetual licence to use his name, image, voice, signature, number,
likeness and any other indicia or forms of his identity in any form or medium without any compensation to the
Player.
Disputes
20.
In the event that a dispute arises between the parties that cannot be resolved by an open discussion between them,
the parties agree that the matter will be referred for determination by the AIHL A request for determination by an

aggrieved party shall be made in writing and addressed to operations@theaihl.com and copied to the other party.
The request must contain a precise statement of the dispute and the relevant facts.
Confidentiality
21.
Each party must not make any public comment or disclosure in relation to this Player Contract, except with the prior
written consent of the other party, where required by law or to obtain professional advice, including lawyers or
accountants.
Notice
22.
Any notices required to be given under this Agreement shall be deemed to have been given if delivered by any
means to the address of the recipient as specified on the first page of this Player Contract.
General
23.
Each party must do or cause to be done all acts and things necessary or desirable to give effect to, and refrain from
doing all acts and things that could hinder performance by any party, of this Player Contract.
24.
The parties acknowledge and agree that the AIHL or IHA can directly enforce any rights they have under this Player
Contract.
25.
This Player Contract constitutes the entire agreement between the parties and supersedes any and all preceding
agreements.
26.
This Player Contract shall be governed by and construed in accordance with laws of the State in which the Team is
located.
