Office of Educational Technology at the NH Department of Education NH e-Learning for Educators a program of the MEMORANDUM OF AGREEMENT: Course Facilitation/Instruction THIS AGREEMENT is entered into on this date: Date Month, Year by and between the New Hampshire Department of Education (NH DOE) on behalf of the New Hampshire e-Learning for Educators (NHeLFE) Initiative and Instructor Name, an independent contractor. The contractor shall serve as OPEN NH Instructor for the course titled: Enter Course Number and Name Here which is scheduled to run in the Enter Session and Year here Session of OPEN NH. 1. Instructor Name will perform services to be rendered in association with the OPEN NH e-Learning for Educators agreement grant. Participation will be supervised by the NH e-Learning for Educators project coordinator on behalf of the New Hampshire Department of Education. Attached are the qualifications required and the scope of services authorized under this contract as well as a detailed list of the information to be submitted by the contractor. All services performed by a facilitator/instructor, otherwise employed are to be performed outside of the regular scope of employment and / or work day. 2. Facilitator/Instructor fees shall be paid to Instructor Name upon completion of the above stated work and submission of an invoice as shown below: Number of Learners Stipend Not to exceed 8 - 15 16 - 25 $90.00 / learner $1500 $1350 $1500 Note: Registration numbers will be based on those remaining in the course after the initial drop period (during the online orientation week) has passed. 3. Total facilitator/instructor fees for a single course shall not exceed $1,500.00. This agreement will be funded by the NH E-Learning for Educators project. 4. This agreement is subject to termination if either the above designated course does not run in the session indicated, or if any other conditions in this agreement are not met. 5. Neither party shall have the right to assign or transfer its rights or obligations under this agreement without the written consent of the other party. This agreement shall not be subject to modification or amendment except by written agreement with the appropriate authorized signatures. 6. Payment shall be made upon receipt all required paperwork and of a signed invoice showing the facilitator/ instructor’s name, mailing address and social security number and the dates of specific service provided and amount claimed. The final invoice is to be received by NH e-Learning for Educators Project Coordinator upon completion of the course and not before. A signed Memorandum of Agreement must be in place prior to the start of the course. The duration of this agreement is: Start Date of Course through End Date of Course. Either party, upon receipt of a 30-day written notification, may terminate this agreement. Should either party terminate the agreement without completion of the work to be performed there shall be no expectation of payment of facilitator/instructor stipends. 8. The Project Coordinator for the NH e-Learning for Educators program, or his or her designee, will review and approve all invoices submitted for payment. Invoices submitted by employees of the New Hampshire Department of Education must be reviewed and signed by the Project Coordinator, as well as the Project Director and the NHDOE Division Director. 9. All provisions of this agreement shall be construed according to the laws of New Hampshire. 10. It is expressly understood and mutually agreed that any New Hampshire e-Learning for Educators commitment of funds herein shall be contingent upon the receipt and availability by New Hampshire Department of Education by funders under the program for which the agreement is made. They serve as conduits between the NH e-Learning for Educators Project Coordinator and Leadership Team and the participating learners in the Online Professional Education Network for New Hampshire (OPEN NH), professional development courses, facilitating the online instruction and professional development of the participants who engage in NH e-Learning for Educators / OPEN NH courses. Qualifications Instructors must have the following qualifications: Demonstrated experience and expertise in a specific content area in which instruction is required. A Master’s degree from a recognized institution of higher learning. Online course facilitator/instructor preparation and/or experience through an e-Learning for Educators approved program or pathway. Demonstrated ability to create and maintain working relationships as required by the scope of services. Ability to present oral and written presentations of findings as required by the scope of services. Demonstrated ability to anticipate, prepare, analyze, and prepare plans and/or programs as required by the scope of services. Required Information Instructors shall provide the following information to the NH e-Learning for Educators Project Director or Coordinator for the e-Learning for Educators grant: 1. A completed Memorandum of Agreement for facilitation of an OPEN NH course to the Project Coordinator. 2. An updated professional resume including education and experience on file with the Project Coordinator. 3. A list of at least three professional references with contact names, phone numbers, and addresses, provided upon request. Scope of Services An online facilitator/instructor is required to provide various services to NH e-Learning for Educators. These will include: 1. Take and successfully complete the e-Learning for Educators Online Facilitation Course, offered through the NH e-Learning for Educators training program, or demonstrate equivalent training and knowledge in online instruction and pedagogy. 2. Attend at least one face to face instructor’s meeting prior to the start of the session, and/or attend at least one face to face orientation session and help facilitate the orientation program, and continue the online orientation in their course. 3. Prepare a course syllabus and complete the general rubric criteria, distribute them to their participants, or post them in their course and/or deliver to the OPEN NH Project Coordinator for posting online. 4. Update a given course shell, adding additional materials and content as deemed necessary, checking course links for appropriate content, reporting broken links to the appropriate parties, finding alternative or up to date links as necessary to maintain the integrity of the course. 5. Adhere to the guidelines and requirements of the NH e-Learning for Educators – Plymouth State University partnership, insuring the academic rigor of their courses and that the availability and opportunity for graduate credits are known to their participants and the information is posted in their course. 6. Conduct and successfully deliver one OPEN NH online professional development course to New Hampshire educators. 7. Facilitate unit discussions within the course with the purpose of insuring rigor and incorporation of content into the discussion comments of the participants. 8. Assess participants according to the course grading rubric, calculate grades, and maintain them in the course gradebook. 10. Complete and distribute Course Completion Certificates to participants upon satisfactory completion of the course. 11. Respond to emails and/or communications from the OPEN NH coordinator, fellow instructors, and course participants in a timely and respectful manner. 12. Participate in the Online Professional Education Network as needed, according to their availability, willingness, and ability. 13. Present oral and/or written presentation/summary of course outcomes and evaluation/assessment of course delivery, rigor, and relevance, for purposes of program evaluation and improvement, if asked. 14. Complete and submit all required payroll paperwork to NHPTV and PSU partners to insure prompt payment of OPEN NH facilitation stipend and PSU adjunct faculty stipends. 15. Submit Final Grade Report and Instructor Invoice to OPEN NH Program Coordinator within 10 days of course completion date. Failure to submit invoices, or submission beyond 17 days of course completion, will result in delayed processing and payment of stipend. Compensation Compensation for course instruction is paid to the instructor at $90 per enrollee per course up to a maximum of $1500 per course. Compensation may be reduced due to failure of the facilitator/instructor to fulfill the requirements listed in the scope of work section. The amount of the reduction in compensation will be determined by the NH e-Learning for Educators leadership team and based on the scope of work requirements completed by the instructor. Courses co-instructed by a team of instructors will receive $1500 for the entire course. The co-instructors should determine how the scope of work will be divided among the instructor team and the agreed upon split in course stipend. The information should be included on the contract and invoice sent to the NH e-Learning for Educators project coordinator. Participants who take NH e-Learning for Educators /OPEN NH courses for graduate credits through Plymouth State University are required to submit a Reflection Paper at the end of the course. The Reflection Paper should follow the guidelines for reflection papers used by the NH e-Learning for Educators /OPEN NH courses and be assessed using the approved assessment rubric. The course grade should be calculated using both the course grading rubric and the reflection paper rubric. Plymouth State University will compensate the instructor for their time and submission of grades through the Plymouth State portal. All instructors should have the appropriate paperwork submitted to Plymouth State University prior to the completion of their course. Plymouth State University assumes the responsibility for compensation to their course instructors.
