Granite Countertop Installation & Care Contract for:

Signing of the Contract and Deposit
$39 Granite requires a minimum of 50% deposit as well as a signed and initialed invoice before any production on your countertop
begins. Once the deposit is given to $39 Granite and this contract is signed, the deposit shall not be refundable. If you are not going to be
at the installation or need to leave before the installation is completed, a check must be left with the installers prior to the installation. If
you are paying the balance with a credit or debit card, this must be done one business day prior to installation. If you are present at
the installation, you may make payment by check or cash at the time of completion of the installation. If payment of the balance is not
present or you refuse to pay the installers when they complete the installation, our installers will not install or will remove the granite
and you will be responsible for a revisit fee of $250. From the time of template, the normal time until completion is 1 –2 weeks.
However, depending upon our work flow your granite may take a shorter or longer time to complete. Delays from the customer not
picking out their slab(s), allowing our templater access to the jobsite or having cabinetry improperly installed may delay the installation.
Customer agrees to allow $39 Granite to use pictures of your job in promotional materials. INT ____
Change Orders
The original proposal is based in the agreed specification shown on the invoice. Any changes made after the signed proposal will result
in additional charges. This would include, but not be limited to, such changes as addition of backsplashes, changing sinks, changing edge
profile, changing color, etc. For the interest of our clients as well as ourselves, we do not accept any verbal change orders. INT ____
Templates
To make the template more accurate, $39 Granite requires that the customer be on site. The customer must have everything removed
from the existing countertops prior to time of template. At times, it will not be necessary to template particularly for small jobs. Any
delay getting information from you, our customer, will delay the installation. If there are any unforeseen changes required at this time,
the templater will have the customer sign off these changes. There may be an additional cost depending on the changes made. The
templater makes the final square footage total that will be the amount to be charged. INT ____
Removal of Existing Countertops
Customer’s responsibilities are to remove the top drawers of the cabinets. And unless otherwise contracted with $39 Granite, the
customer is responsible for disconnecting all plumbing, remove the old sinks, disconnect the cook top and remove, removal of old
countertops and move any appliance that may be obstructing the installation process. If $39 Granite has to remove any drawers,
plumbing, electrical or appliance, $39 Granite will not be held liable for any damage. $39 Granite will remove, when contracted for at an
additional cost, and dispose your existing countertop for your new granite countertops. This will be done in a demolition style. Though
$39 Granite tries to remove the old countertops carefully, damage may occur to your existing sheetrock, cabinetry and tile. The customer
will be responsible for all repairs to the sheetrock, cabinetry and tile. The removal includes hauling the old countertops away. If the
customer would like to keep a portion or all of the old countertops, please notify the installers at the time of the tear out. The new
granite countertop surface may not be at the same level as the old countertop. The thickness of granite is typically different than other
countertop surfaces. $39 Granite will not be responsible for the back end wall surface finishing/treatment or restoration. INT ____
Plumbing and Electrical Work
$39 Granite does not do any plumbing or electrical work. When plumbing or electrical work is supplied by $39 Granite, it is done through
an independent contractor that carries their own liability and worker’s compensation insurance. $39 Granite will not be responsible for
any damage caused by this contractor. It is best for the customer to call a handyman, plumber and/or electrician to do any disconnection
or reconnection of water, gas and/or electrical lines. When plumbing is contracted through $39 Granite, $39 Granite will only provide
simple disconnection and reconnection of sink drain lines and faucets. This service only includes the turning off of the water under the
sink at the shut off valve. The contractor for $39 Granite will disconnect the water supply lines that go to the faucet. They will also
disconnect the drain line from the sink and the disposal (if existing). The disconnection service is provided prior to the granite installation.
After granite is installed and there is an undermount sink, the sink will have to “dry in” overnight before any reconnection of plumbing
can occur. The reconnection is only for connecting supply lines to the faucet and the reconnection of drain lines to the sink and if
supplied, disposal will occur in the same configuration as when disconnected. If any other plumbing needs such as shut off valve
replacement, change of configuration, replacement of disposal, etc. will cost more. Any customer supplied faucet hardware, $39 Granite
nor the contractor can be held responsible for the reliability of the quality, functionality and workmanship of that hardware. All
disconnection and reconnection of gas lines are the responsibility of the customer. INT ____
Granite is a Natural Material
Granite is made by nature. Therefore, color and pattern variations can occur within the same slab of stone. Also, you may notice tiny
holes, indentations or fissures that will be in the granite. This is normal as it is real stone from the earth. Granite is a porous material and
can stain. Periodic sealing will be required. Though the granite is sealed at the factory and is sealed again by our installers, the tiny holes
and indentions are not affected by the sealing process. As well, consistency of the composition of granite varies so you may see minor
waves on the edges.
At $39 Granite, we insist on our customers to select their own slabs. However, $39 Granite purchases the slab(s) and owns the material.
Customers only pay for the amount of material that is used. It will be the determination of $39 Granite to utilize the slab to maximize
the usage of the slab. Color variations are a natural occurrence and as such there is no warranty on any color variations. Once a slab has
been selected, the customer approves the usage of the slab.
At times, customers provide slab(s) to $39 Granite. $39 Granite will use that slab for the job intended in a way that maximizes the usage
of the material. $39 Granite shall take NO RESPONSIBILITY for the quality a slab purchased by the customer and delivered to $39 Granite.
If the granite breaks for any reason, NO REFUND SHALL BE GIVEN nor will $39 Granite provide any replacement without customary
charges. Any portion of a slab that is leftover (i.e. A remnant), that portion will remain the customer’s property for one month from the
time of installation of their original order. After the one month period, $39 Granite will not store the remnant and it becomes the
property of $39 Granite. INT ____
Why are there seams?
$39 Granite tries very hard to minimize the number of seams in your granite countertop. However, there are occasions when a slab is
not long enough to be used for your installation. Also, depending upon the configuration of our installation, $39 Granite may need to use
a seam to prevent damage to your granite countertop in transport or during the installation process. When a seam is used, $39 Granite
makes every attempt to minimize the appearance of the seam. INT ____
Condition of the Underlying Structure
The condition of the cabinet, flooring, wall plaster, sheetrock, subfloor and joists are the responsibility of the customer. $39 Granite is
not responsible to fix any setting or inadequate construction of the cabinets, knee walls, floor or surrounding structure. If the structure is
not sound to adequately support granite countertops, the warranty will be void. $39 Granite will shim stone countertops to level the
countertop to a point so the seams line up, which may create gaps under the granite countertop. Homeowners will be responsible for
any trim work required including sheetrock repair, painting, replacing trim and caulking. INT ____
Installation and Cutting of Granite on Location
Countertop installation may have some cutting or drilling on the location. If that is the case, there will be stone dust or powder and or
cutting fluid (water mixed with stone powder) spreading out on the location site. The customer will be responsible to hang plastic
sheeting to minimize the granite dust dispersion. The $39 Granite installer will try to minimize the dust and will only clean the
countertop part after the installation. The detail cleaning other than the countertop will be the customer’s responsibility. Customers
need to remember that this is a “construction zone”. Therefore, it may be necessary during the installations to cut into sheetrock to
install the new countertop. As well, if the countertops are going into a tight area, the installer may scrape, nick, gouge or cut into the
sheetrock. This is necessary to insure a tight fit and to minimize seams. Also, we recommend, for the protection of your belongings, that
the customer remove top cabinet drawers and cover items in lower cabinets. For the safety of your installers please have all pets and
children placed safely away from the construction area. Please have the area where the installers are bringing in the granite countertops
clear of any furniture and/or rugs. At the time of installation, we will require that all appliances be present so that we can fully complete
the job. If there is an area that overhangs from a wall or cabinet, the customer must supply countertop supports. If the countertop is
level with the sink and it extends over the end of the cabinet 12 inches or more or if the countertop for a raised bartop extends over 5
inces, countertop supports will be needed. Our installers will install the supports if they are present at the time of install. Otherwise, it
will be the responsibility of the customer to install the supports. If appliances, supports and fixtures are not present and $39 Granite
needs to make a secondary trip, there will be an additional trip charge of $200.00. Installers will not be able to remove or install any
appliances. If the installers have to move appliances, any damage incurred will be the responsibility of the customer. For the safety of
our installers, they are required to wear shoes when they install. If there is inclement weather, we may postpone installation. Any
request otherwise will not be honored. INT____
Payment of Balance Upon Completion
Upon installation, the customer agrees to pay the balance in full to the installer as long as the customer stays at the jobsite during the
installation of paying the balance by check or cash. If the homeowner or contractor leaves the jobsite, the homeowner or contracto must
pay the balance in full prior to leaving. If the customer does not pay the balance upon completion of the installation, the customer will
be assessed a $250 collection fee. Any balance not collected at installation will be assessed a collection fee of 2% after 10 days past due.
If $39 Granite has to take any legal action or collection action to claim the past due balance, the customer shall pay all costs incurred
including attorney’s fees, court costs and damages plus interest. $39 Granite will also have the right to charge the provided credit card
account number on record for the balance on the business day before installation. INT____
Warranty
Evergreen Homes, Inc. and $39 Granite’s warranty covers seam splitting, general installation and granite breakage under normal usage
for a period of one year from the date of installation. The warranty does not cover any abuse of the countertop, including but not limited
to the removal or moving of the countertop by a person other than $39 Granite personnel or any deliberate destruction of the
countertop including but not limited to purposely staining, breaking, moving of cabinets or appliances. The warranty excludes damages
that were caused by the structural integrity of the customer’s wall, floor and or cabinets, house settling, abusive use of the countertops,
lack of or improper maintenance, or that were altered by a third party or by unusual impact or load. INT ____
