On joint motion of all Councilmembers present, the following resolution was
offered:
RESOLUTION NO.
A resolution authorizing the purchase of 24.8 acres of
bottomland hardwood mitigation credits at a cost of two
hundred forty-eight thousand dollars ($248,000.00) for
mitigation associated with phased development of Jefferson
Parish Parc des Familles in accordance with the mitigation
agreement executed on February 1, 2008, between
Jefferson Parish and Chevron U.S.A., Inc. for the purpose of
complying with the U.S. Army Corps of Engineers mitigation
requirements relative to Permit No. MVN 2006-3732-MJ
(Council District No.1)
WHEREAS, Jefferson Parish was issued USACE Permit No. MVN-2006-3732MJ, dated April 18, 2008, which authorized work to clear, grade, excavate and deposit
fill material to construct a public park/playground area, Parc des Families, to provide
recreational space and public service and entertainment facilities for the West Bank of
Jefferson Parish in accordance with a plan developed by the Parc des Families Citizens
Advisory Committee and approved by the Jefferson Parish Council.;
WHEREAS, issuance of the USACE permit required that Jefferson Parish
provide, in accordance with permit Special Condition No. 10, compensatory mitigation
for unavoidable impacts to bottomland hardwood wetlands that will result from activities
associated with Permit No. MVN 2006-3732 MJ for Jefferson Parish Parc des Families
Recreational Area; and
WHEREAS, as authorized by Council Resolution No. 109992 adopted on April 9,
2008, Jefferson Parish entered into an agreement with Chevron U.S.A., Inc. to provided
compensatory mitigation for unavoidable impacts to bottomland hardwood wetlands that
will result from activities associated with Permit No. MVN 2006-3732 MJ; and
WHEREAS, Jefferson Parish has agreed to compensate Chevron U.S.A. two
hundred forty-eight thousand dollars, no later than February 28, 2011, to perform
mitigation work associated with phase 3 development of Parc des Familles in fulfillment
of U.S. Army Corps of Engineers Permit No. MVN 2006-3732 MJ by enhancing 28.4
acres of lands located in Paradis Mitigation Bank in accordance with the attached
contract; and
NOW, THEREFORE, BE IT RESOLVED by the Jefferson Parish Council of
Jefferson Parish, Louisiana acting as governing authority of said Parish:
SECTION 1. The purchase of 24.8 acres of bottomland hardwood mitigation
credits at a cost of two hundred forty-eight thousand dollars ($248,000.00) for mitigation
associated with phased development of Jefferson Parish Parc des Familles in
accordance with the mitigation agreement executed on February 1, 2008, between
Jefferson Parish and Chevron U.S.A., Inc. for the purpose of complying with the U.S.
Army Corps of Engineers mitigation requirements relative to Permit No. MVN 20063732-MJ is hereby authorized.
SECTION 2. That the Council Chairman or in his absence, the Vice-Chairman be
and is hereby authorized to execute any and all documents necessary to give full force
and effect to this resolution.
SECTION 3. That payment, in the amount of two hundred forty-eight thousand
dollars ($248,000.00) for purchase of mitigation associated with phase 3 development,
from the Jefferson Parish Department of Parks and Recreation, Parc des Families
Account No. 44690-4087-7331 (46911.010), is hereby authorized.
The foregoing resolution having been submitted to a vote, the vote thereon was
