In accordance with the terms of this Contract, you are hereby authorized and instructed to
perform the Work as altered by the following provisions:
Provide such services as necessary in order to maximize funding from FEMA, insurance, and
third-party funding sources for Hurricanes Katrina, Rita, Gustav, Ike, Isaac, as well as
Tropical Storm Lee pursuant and in accord with Addendum 1, Addition #2 and the terms and
conditions set forth in the Contract for Services as executed.
Addition 3 will be in full force and effect from July 1, 2015 to June 30, 2016, for a period of 12
months, OR until such time as the close out of the grant process is completed by FEMA and
Louisiana Governor's Office of Homeland Security and Emergency Preparedness policy and
procedures or the amount of reimbursements available have been exhausted, as
recommended by JPPSS Emergency Management Department, whichever comes first. In any
event, the JPPSS reserves the right to extend this Change Order or add subsequent Change
Orders for up to 24 additional months, in 12 month increments with the mutual agreement of
both parties which shall be made in writing at least 30 days prior to the completion date.
The total of all sums payable under Addition 3, including fees and reimbursement of expenses,
shall not exceed the ceiling amount of 3% of eligible FEMA damages before insurance
reimbursements (as detailed in FEMA Project Worksheets for Categories A BG) for all of the
aforementioned storms.
Further, Paragraph 10 of the agreement pertaining to Insurance is amended to read as follows:
A10.
DMS agrees to comply with the insurance provisions required by JPPSS as stated in the RFP for
applicable services as further amended by these presents, and DMS agrees to provide the
following insurance, insurance coverage and/or policies of insurance, which are described as
follows:

All vendors that perform repairs, services, installation, construction, and/or
make deliveries to any JPPSS Facility by other than common carrier must have a
current Certificate of Insurance on file with the Purchasing Department.

B.
All such policies of insurance as required herein shall be endorsed to include a
Waiver of Subrogation in favor of JPPSS and its affiliated and associated
companies and agents.
C.
All such policies of insurance as required herein shall name the Jefferson Parish
School Board, Board Members, individually and collectively, and employees as
additional insured(s), not merely as certificate holders.
D.
All such policies of insurance shall provide the JPPSS with a minimum of thirty
(30) days prior written notice of cancellation or any material adverse change.
E.
All such policies of insurance must be in a company acceptable to the JPPSS and
subject to the approval of the JPPSS, and rated as follows:
a.
A.M. Best rating of A-VI subject to JPPSS approval for Commercial
Automobile and Commercial General Liability Insurance.
b.
Workers Compensation Insurance coverage with an admitted insurance
carrier, in accordance with all applicable State, Federal and Maritime
laws, including Employer=s Liability Insurance in the minimum statutory
amount, but in no case less than $1,000,000.00 per accident,
$1,000,000.00 per disease and $1,000,000.00 aggregate, disease. Said
insurance may be provided by the Louisiana Workers= Compensation
Corporation (LWCC), or as provided by a state-approved group qualified
self-insurance program. In case of state approved, group self-insurance
programs, the State of Louisiana ASelf-Insurers Certification of
Authority@ must be attached.
F.
All such policies of insurance shall provide Comprehensive General Liability (CGL)
insurance, including Blanket Contractual and Products Liability, with Completed
Operations Liability where applicable for at least the limits of Combined Single
Limit $1,000,000.00 per occurrence subject to an Annual Aggregate of
$2,000,000.00 per policy for Bodily Injury and Property Damage Liability, a
Personal Injury Liability Limit of $1,000,000.00 per claim, and a Products and
Completed Operations Annual Aggregate of $2,000,000.00 per policy.
G.
All such policies of insurance shall provide Comprehensive General Automobile
Liability insurance with a combined single limit of at least $1,000,000.00.
H.
All deductibles under said policies shall be the sole responsibility of DMS. DMS
hereby waives all rights of recourse against the JPPSS, including any rights to
which another may be subrogated, with respect to any claim of personal injury
(including death), or any property damage, to the extent covered by any of
DMS=s insurance policies with respect to the sole or joint negligence of DMS.
I.
All such policies of insurance shall be primary to any insurance of JPPSS and/or
self-insurance program which JPPSS may participate. Further, the insurance
must not require waivers of subrogation of any kind by JPPSS.

J.
Upon request, DMS or their insurer shall immediately furnish copies of the
required insurance policies to the JPPSS through its Superintendent or his/her
designee, including but not limited to an e-copy thereof.
K.
The JPPSS may reject any insurance carrier for cause at any time.”
All other terms and conditions of the Contract for Services and Addendum 1 and Addition #2
remain in full force and effect.
