Call to order
President McMurran called the Representative Council to order at 1:44 p.m.
II.
Approval of minutes: November 17th
It was moved by Representative Boyd and seconded by Representative Jacobson to
approve the minutes of November 17. Motion carried.

President's Report
A. CCFA Motion on Shared Governance
The motion from the November 3, 2014 meeting states: “In the spirit of shared
governance, we condemn the lack of discussion with the campus community before
the District decided to equip campus police with assault rifles.” The Faculty Senate is
having discussion with the Campus Police prior to deciding whether it will join CCFA
on this motion.
B. CTA Scholarships: Members and Dependent Children (go to http://www.cta.org/AboutCTA/CTA-Foundation/Scholarships.aspx)
The scholarships are available to members who are continuing their education as
well as their dependent children.
C. CCA Winter Conference February 20-22 at the Hyatt Regency Mission Bay, San
Diego
Three delegates from CCFA may attend. Speak with President McMurran if you are
interested.
D. Incomplete Grade Communication
The inappropriate tone of the e-mail explaining the new incomplete grade procedure was
brought to Associate Superintendent Guerrero’s attention. The issue will be discussed
with Eric Bishop, Interim Vice President of Student Services.
E. BP 4104 and AP 4104 and Education Code 78022 (see Addendum below)
BP 4104 and AP 4101 are procedures on contract education. Section 78022 “D” from
the Education Code was omitted from these procedures. According to these procedures,
the District may enter into contracts with public or private agencies to provide classes,
but the faculty who teach them must be paid according to the active faculty contract.
There are important differences between contract education and academic credit courses
offered through the District. Further, community education is different from contract
education. For example, students may receive college credit for contract education
courses, but they do not receive college credit for community education courses. In
addition, grant money is tied into contract education, as opposed to tax dollars. With
contract education, faculty must meet minimum qualifications, but there is no oversight
(e.g., evaluation of faculty). Also, these courses are not counted toward the 75/25 rule.
A few relevant questions asked by the Representative Council are whether it is
permissible for tenured faculty to teach not-for-credit courses and, if so, how are they
selected?
Another important distinction exists between non-credit and not-for-credit courses. Noncredit courses are one of seven areas (Citizenship, Parenting, Remedial English,
Remedial Mathematics, English as a Second Language, etc.). These course proposals
must go through the Curriculum Committee, but do not have units. The Chancellor
scrutinizes these proposals. Not-for-credit courses are contract education and community
education courses (e.g., Make-up 101, How to sell on the Internet, etc.).

IV.
Officers' Reports
A. Treasurer: Diana Cosand
Recently, Treasurer Cosand attended the California Teachers Association (CTA)
Treasurers’ Workshop held in Santa Fe Springs, California. If Treasurer Cosand’s
mileage is not reimbursed through CTA, the Chaffey College Faculty Association will
do so.
B. Membership Chair: Denise Johnson
C. Negotiators: Sue Herman, Vera Dunwoody and Greg Creel – Facilitator
The negotiations’ facilitator unexpectedly resigned from her position with the state of
California. She has agreed to continue working for the Chaffey District as an
independent contract worker. However, it is unclear whether it is necessary that this
position be filled by a facilitator who is employed with the State. A resolution to this
question is in discussion.
The CCFA Readers’ group will meet Friday, December 12 between 8 a.m. and 11 a.m.
to review tentative agreements produced in the contract negotiations.
D. Grievance Committee: Jon Ausubel, Paula Snyder and Bret McMurran – Evaluation
committee make-up and change in Spring Schedule)
A problem has arisen regarding a non-tenured, full-time faculty member. On this
faculty member’s committee is an individual who has been in conflict with the
faculty member. Additional problems are involved which call into doubt whether
the faculty member would receive a fair evaluation.

It is moved that no more than $500 be spent on the Representative Council’s last
meeting of the Fall 2014 term to be held at Zendejas’ Mexican Restaurant. The
motion has carried. Several guests will be invited including President/Superintendent
Shannon.

AP 4104
The District may contract for instructional classes to be offered at the request
of in service to public or private agencies or groups.
NOTE: The District may insert local practice here, which should include:

Development, review, approval, and evaluation processes and criteria
Criteria for and limits on contracts, including differentiation of courses
for which state support is sought and those for which it is not.
Ratification of contract by Governing Board.
As part of its economic and workforce development efforts, the District provides
instructional classes and customized training and services to business,
industry, government agencies, and other public or private organizations. The
process may involve creation of new courses or training, revision of existing
course outlines for use in a particular training program, special assistance and
assessment, and consultative or developmental services to define specific
needs. The District may contract with business, industry, government agencies,
other public or private organizations, or individuals to develop and/or deliver
these services. In certain cases, these services may be funded by the
contractor (client) through public training funds. These contracted activities are
generally closed to the public. Contracted services shall be self-supporting and
shall not use unrestricted general funds of the District. When contract
education involves academic credit classes, faculty appointments will be
consistent with minimum qualifications, and curriculum approval processes and
registration procedures will be followed.

Education Code
78022.
(a) Faculty in all credit and noncredit contract education classes shall be
selected and hired according to procedures existing in a community college
district for the selection of instructors for credit classes.
(b) Faculty teaching credit and noncredit contract education classes shall be
compensated in the same manner as comparable faculty in the regular,
noncontract
education program. This subdivision does not apply to faculty teaching in contract
education programs conducted outside California for the United States armed
forces, unless the faculty member is covered by a collective bargaining
agreement. (c) Faculty teaching credit or noncredit contract education classes
shall be evaluated according to the procedures used for the evaluation of faculty
in the regular, noncontract education program.
(d) Faculty teaching not-for-credit contract education classes shall be
compensated in the same manner as faculty in the regular, noncontract
education program if the
course meets the same standards as a course in the credit curriculum. This
subdivision does not apply to faculty teaching in contract education programs
conducted outside California for the United States armed forces, unless the
faculty member is covered by a collective bargaining agreement.

(e) Faculty teaching not-for-credit contract educational programs shall be
evaluated according to procedures specified in the contract between the
community college district and the public or private entity to establish the
program.
(f) This section shall not be construed to restrict the appearance of guest lecturers
in any programs or classes operated by a community college district.
