SHORELINE COMMUNITY COLLEGE DISTRICT NUMBER SEVEN BOARD OF TRUSTEES REGULAR MEETING OF JUNE 27, 2012 TAB 4 ACTION Subject: Ratify Agreement By and Between The Board of Trustees Of Community College District Number VII and the Shoreline Community College Federation of Teachers, Local No. 1950, AFT Washington/AFT/AFL-CIO Effective: July 1, 2012 Through June 30, 2015 Background Shoreline Community College recognizes the Shoreline Community College Federation of Teachers as the exclusive negotiating representative for academic employees as defined in RCW 28B.52. Last Spring (2011), the College entered into an agreement to negotiate limited re-openers this year and to roll the rest of the contract dated July 1, 2008, through June 30, 2011. As a result, changes were negotiated and agreed in the following articles and sections: General contract updating: Revisions were made to conform references to the College’s current organizational structure and Vice President titles. References to “advising” or “advising duties” will be replaced with “academic advising duties” wherever they appear in the contract. Article VI: Terms and Conditions of Employment Section B: Simplifies the process and parties needed for faculty to mutually agree with their dean on a non-traditional academic calendar. This change provides increased flexibility and efficiency to meet year-round student needs in scheduling faculty. Section C: Conforms phrasing “academic advising duties” and specifies those duties may be performed online and in-person. This change emphasizes that academic advising is a faculty duty that may be performed both online and in-person. Section D: First change emphasizes that full-time instructional faculty will provide advising in multiple modalities and will be assigned advisees. Housekeeping change in Contact Hours eliminates reference to obsolete Cosmetology program. This change reiterates that academic advising is a faculty duty and specifies it will be assigned. Second change streamlines the process for the VPASA to determine course capacities. This change can increase the economic efficiency of high capacity classes. 1 of 2 | P a g e Article X: Reduction In Force Section B: Updates RIF units to reflect current programs. Section D: First change clarifies the recall rights of RIF’d faculty to receive assignments, necessary training to provide online or hybrid instruction, and designating minimum compensation level. Second change adds a new conditional “trigger” to suspend the provision that limits the replacement of RIF’d fulltime tenured faculty by part-time Associate faculty based on a “rolling cumulative average” of budget reductions in three consecutive fiscal years. Article XII: Corrective and Disciplinary Action New Article expands and replaces prior Corrective Action article to distinguish and adds more detailed progressive corrective action and discipline process for tenured faculty. Article XVIII: Evaluations Section B: Clarifies selection of faculty peer on evaluation team to avoid conflict of interest. Section D: Reduces the frequency of recurring evaluations for Associate faculty; increases administrative efficiency in evaluations, eliminating evaluation in 3rd and 4h and 7th and 8th quarters, retains evaluations in the 5th and 6th quarters, and clarifies ongoing evaluations every fifth year after the first year’s evaluation. The Federation and the College have mutually agreed to resume negotiations in fall quarter 2012 in a limited reopener environment to further clarify and reorganize the contract. Recommendation It is recommended that the Board approve the changes made to the Agreement By and Between The Board of Trustees of Community College District Number VII and the Shoreline Community College Federation of Teachers, Local No. 1950, AFT Washington/AFT/AFL-CIO, Effective July 1, 2012 Through June 30, 2015.
