PLANNING COMMITTEE MEETING
HELD AT THE PARISH COUNCIL OFFICES

MINUTES
PRESENT: Chairman: Cllr Casson. Cllrs: Abel, Harness, Hardwick, Jump, Kind, McLaren,
and Wright

Cllr Casson gave some background to the Neighbourhood Plan and the work that had taken
place to date. He also explained the procedure of the Committee Meeting.
Members of the public were in attendance and spoke for and against application no 3402 in
the Day Book (14/03532/STOUT) – Outline – Residential development (Access to be
considered) at Land North of White Cottage, Harland Way, Cottingham for The Trustees.
Comments in support of the application included:
 Application was for outline permission only
 The drawing showed a suggestion of how the site could be laid out with an indicative
level of 102 dwellings; however the design could be altered.
 The site is promoted by ERYC in the emerging Local Plan with an indicative
capacity of 153 dwellings.
 Access is from a single point which would protect the tree belt and incorporates the
current access onto the site.
 Remit of the drainage engineer was for the site to cope with extreme weather events
(eg 2007 floods) and not to worsen flooding problems for any other properties.
 Strategy of using SUDS drainage which mimics the existing drainage rates by
storing water underground and/or by attenuation areas on site which allow for the
release of water in a controlled manner.
 Approximately 25% of the site would be affordable dwellings.
Comments objecting to the application included:
 No confidence that drainage systems would prevent flooding as the site does not
drain well at present – evidenced by photos etc following flash flooding in July
2014.
 Traffic analysis on site allows for only one car per dwelling which is not realistic.
 Harland way – busy route designated for 7.5+ tonne vehicles.

Major bus route.
Cottingham High School – pedestrian and car traffic at busy times.
The proposed access, although at the point where the current access to the site is,
will not be able to accommodate the amount of traffic movements. It would be
impossible to safely get out, especially during busy periods.
Has the 300+ dwellings proposed for the land allocation on the other side of Harland
Way been taken into consideration.
Who would be responsible for the SUDS drainage system once the houses were sold
on? If it is Yorkshire Water as set out in the developer’s reports – the public have no
confidence in Yorkshire Water’s ability to maintain the current system let alone new
developments.
Infrastructure not in place (drainage/flooding/sewerage/traffic) to cope with
any further large developments.
Members of the public were in attendance and spoke against application no 3399 in the Day
Book (14/03413/STOUT)- Outline – Residential Development (up to 100 dwellings) with
associated landscaping, public open space, vehicular access and infrastructure (All Matters
Reserved) at Endike Filling Station Development Land, Endyke Lane, Cottingham for
Begbies Traynor. Comments objecting to the application included:
 Unhappy with where the notices were put up and which houses were notified.
 Flooding issues – the site regularly has standing water and doesn’t drain well.
 Safety issues with a further access onto Endyke Lane which is already congested at
peak times.
 Development would be detrimental to the wildlife found on the site
 This land is the only remaining open space between Cottingham and Hull on this
side of the village and shouldn’t be built on. It would set a dangerous precedent for
other open gaps.
 Infrastructure – cannot cope at present (drainage/traffic/flooding).
 Retention of village identity by not closing the gap.
 This site is in Flood Zone 3 – the highest risk area.
A member of the public was also in attendance and spoke for application no 3408 in the Day
Book (15/00019/PLF) – Erection of a single storey extension and first floor extension with
balcony to rear (re-submission of 14/02450/PLF) at 11 Harland Way, Cottingham for Mr &
Mrs Poyser.
Councillors took the comments into consideration when making their recommendations.

1196.1 Cllrs Casson and Hardwick declared a pecuniary interest in Item no 3405 in the Day
Book (14/03615/PLF) – Change of use of agricultural land for use for the storage of
plant hire machinery and creation of vehicular access at Land East of Humberside
Plant Hire Limited, North Moor Lane, South Cottingham for Mr R Hoe; as they both
had financial dealings with this company.
1196.2 Cllr Kind declared a prejudicial interest in Item no 3406 in the Day Book
(14/03770/REG3) – Erection of a mono-pitched canopy over the foundation stage
play area at Cottingham Croxby Primary School, Bricknell Avenue, Cottingham for
Cottingham Croxby Primary School, as he was a Governor of the School.

Item no 3397 in the Day Book – TPO – COTTINGHAM NO 44 – 2001 (REF
608) AND COTTINGHAM CONSERVATION AREA – Fell large Silver Birch
tree located on the front drive due to excessive height, branches overhanging the
property roof and gutters causing a buildup of debris and materials and the
potential for damage to the property at Birch Lea, 2 Walnut Close, Cottingham
for Mrs Diane Wilson had been refused.
The following Notices of Decision had been received by the Parish Council since
the agenda and associated papers had been posted.
9. Item no 3350 in the Day Book – Change of use of land to builders yard and
alterations to building at Low Farm, Willerby Low Road, Willerby for Marsden
Builders Ltd had been approved.
10. Item no 3393 in the Day Book – Retention of carport at 55 Burton Road,
Cottingham for Mr & Mrs Choudhury had been approved.
11. Item no 3394 in the Day Book – Variation of Condition 4 (opening times),
Condition 5 (delivery hours) and Condition 8 ( hot food consumption off
premises) of planning permission 08/03553/PLF at Olive Garden, 218 Hallgate,
Cottingham for TIJ Food Ltd had been approved.
12. Item no 3395 in the Day Book – Replace existing 2.4m high fence with new 3m

APPLICATIONS 1. Item no 3399 in the Day Book (14/03413/STOUT)- Outline – Residential
Development (up to 100 dwellings) with associated landscaping, public open
space, vehicular access and infrastructure (All Matters Reserved) at Endike
Filling Station Development Land, Endyke Lane, Cottingham for Begbies
Traynor. On a unanimous decision the Committee strongly objected to this
application on the following grounds:
 The development was not part of the land allocated in the emerging East
Riding Local Plan.
 The development was not recommended in the emerging Cottingham
Neighbourhood Plan.
 The proposed development was in Flood Zone 3.
 Safety issues with a further access onto Endyke Lane which is already
congested at peak times.
 Development would be detrimental to the wildlife found on the site
 This land is the only remaining open space between Cottingham and Hull
on this side of the village and shouldn’t be built on. It would set a
dangerous precedent for other open gaps.
 Retention of village identity by not closing the gap.
 The results of the recent Boundary Referendum showed that 96% of the
75% that voted wanted the open spaces between Cottingham and the
surrounding areas maintained.

The Committee feel very strongly that before any further development takes
place in Cottingham strategic improvements need to be carried out to the
infrastructure ie drainage, flooding, sewerage and traffic.
Should the ERYC Planning Officer not agree with the Committee’s decision
then it was agreed that this application should go before the ERYC Planning
Committee.
2. Item no 3400 in the Day Book – 20 Castle Road, Cottingham – This application
had been previously discussed at the Parish Council Planning Committee
Meeting held on Thursday 11 December 2014 to meet with the ERYC deadline.
3. Item no 3401 in the Day Book – (14/03878/TPO) Description of Works: TPO –
WOODLAND SOUTH OF BEECHDALE, EAST OF RAILWAY LINES,
COTTINGHAM – 1986 (REF 188) – Crown lift four trees one Beech (T1) and
three Oak trees (T2-T4) with overhanging branches to neighbouring gardens and
to allow additional light into the garden at Woodside House, 6 The Covert,
Cottingham for Mrs Beverley Sidwell. On a unanimous decision the Committee
had no objections to this application
4. Item no 3402 in the Day Book – (14/03532/STOUT) – Outline – Residential
development (Access to be considered) at Land North of White Cottage, Harland
Way, Cottingham for The Trustees. On a unanimous decision the Committee
strongly objected to this application although they felt the developer should be
commended for taking into consideration the draft Concept Statement produced
as part of the Cottingham Neighbourhood Plan. The Committee objected on the
following grounds:
 Safety issues surrounding the access point onto Harland Way which is
already congested, particularly at peak times.
 Harland Way is the main route into the village for 7.5 tonne+ vehicles.
 Cottingham High School on Harland Way already causes obstructions
with parents parking for most of the length of the road at school drop off
and pick up times.
 The access point is on a bend.
 Consideration should be given to the proposed allocation of 300+ houses
on the other side of Harland Way which is set out in the emerging ERYC
Local Plan.
 Problems with flooding in this area – flash flood in July 2014 caused
serious flooding to this area including damage to the High School.
 Who will maintain any SUDS/drainage systems once the houses are sold
on; if it is to be adopted by Yorkshire Water then the Committee do not
have any confidence that problems with flooding/sewerage spillage in the
village will not be exacerbated.
 Public health concerns with respect to sewerage spillages which are
increasing in frequency and can only be made worse by increased
pressure on the current systems.
 In the Cottingham S19 Flood Investigation Report to ERYC Cabinet
(following the floods in July 2014) in October 2014, Recommendation 3
states ‘that in accordance with requirements set out in section 94 of the
Water Industry Act 1991, that Yorkshire Water publish an action plan to
demonstrate how it intends to address capacity and serviceability issues

with public sewer networks in Cottingham. So far as we are aware this
action plan has not yet been done.
The Committee feel very strongly that before any further development takes

ATM at HSBC, 112 King Street, Cottingham for HSBC Corporate Real Estate.
On a unanimous decision the Committee had no objections to this application.
6. Item no 3404 in the Day Book – (14/03166/PLF) – Erection of single storey
extension to rear and creation of new beer garden at Blue Bell Inn, West Green,
Cottingham for Blue Bell Inn. On a unanimous decision the Committee had no
objections to this application.
7. Item no 3405 in the Day Book (14/03615/PLF) – Change of use of agricultural
land for use for the storage of plant hire machinery and creation of vehicular
access at Land East of Humberside Plant Hire Limited, North Moor Lane, South
Cottingham for Mr R Hoe. Cllrs Casson and Hardwick declared pecuniary
interests in this item as they both had financial dealings with this company; they
left the room and took no part in the discussion or vote. On a unanimous
decision the Committee objected to this application on the grounds that the
change of use constituted a loss of agricultural land in this area and the change of
hours would be anti-social and badly affect the quality of life of the residents in
the area. Should ERYC Planning Officer not agree with the Committee’s
decision then it was agreed that this application should go before the ERYC
Planning Committee.
8. Item no 3406 in the Day Book (14/03770/REG3) – Erection of a mono-pitched

extension and first floor extension with balcony to rear (re-submission of
14/02450/PLF) at 11 Harland Way, Cottingham for Mr & Mrs Poyser. On a
unanimous decision the Committee had no objection to this application.
11. Item no 3409 in the Day Book (15/00035/TCA) – Description of works:
COTTINGHAM CONSERVATION AREA – Reduce False Acacia tree to 6m
standing monolith and remove epicormic growth, due to concerns by
neighbouring property, 40 South Street, at 42 South Street, Cottingham for Dr
Brian Cook. On a unanimous decision the Committee had no objection to this
application.

The Clerk referred Councillors to the following applications which had been received after
the agenda had been circulated. Due to the deadlines imposed by ERYC, Cllrs unanimously
resolved that the applications would be discussed and recommendations made as follows:
Item no 3410 in the Day Book – To retain installation of roller shutter to front
door at Alterframe Limited, 146 Hallgate, Cottingham for Miss Deborah
Botham. On a unanimous decision the Committee had no objection to the
application. .
2. Item no 3411 in the Day Book – COTTINGHAM CONSERVATION AREA –
Pollard three large trees located in the front garden of Dunnington, 71 Thwaite
Street, Cottingham for Mr Steve Rangeley. On a unanimous decision the
Committee had no objection to this application.

NEIGHBOURHOOD PLAN UPDATE
Cllr Casson reported on the Neighbourhood Plan Steering Group and informed the
Committee that the next would be on 28 January when it was hoped a mock up of the draft
Neighbourhood Plan would be available.
