Administrative regulation on the state environmental examination of the State
Examination Office of the Ministry of Ecology and Natural Resources related to the
utilization and neutralization of toxic industrial wastes
1. General statements
1.1. The name of e-service : Admission of the application and documents for the grant
of special permission (lisence) to the utilization and neutralization of toxic industrial wastes
1.2. Content of e-service : This service is for the electronic admission of application
and required documents for the grant of special permission to the conduction of utilization and
neutralization of toxic industrial wastes resulting from manufacturing and service activities
1.3. Legal basis of e-services :
1.3.1. Articles № 5-8 of “On the environmental protection” Act of the Republic of
Azerbaijan (Baku city, 08 june, 1999, № 678-IQ) ;
1.3. 2. № 782 Order of the President of Azerbaijan Republic, dated 02.09.2012
1.3.3. № 174 Resolution of the Cabinet of Minister dated November 7, 2002;
1.3.4. № 2.1 and 2.2 items of № 429 Decree of the President of Azerbaijan Republic “On
certain activities in the field of e-services arrangement by state bodies” dated May 23, 2011
1.3.5. №191 Order of the Cabinet of Ministers of the Republic of Azerbaijan on the
confirmation of “Rules of e-services by central executive bodies on specific fields” and “List of
e-service types” dated November 24, 2011

2.2.1. President of the Republic of Azerbaijan dated September 2, 2002, approved by
Decree No. 782, Annex № 2 - "special permit (license) and the list of activities requiring these
types of special permit (license) the amount of fees to be paid for," the 4 - According to the 1100
(one thousand one hundred) the amount of fees paid to the state.

Required documents for e-service and forms of their submission:
2.6.1. application for grant of special permission (lisence) to the utilization and
neutralization of toxic industrial wastes (signs with e-signature and attaches to the administrative
regulation)

2.6.2. Copy of document on the registration of applicant by tax bodies

2.6.3. Formal confirmative documents of applicant on the collection, transportation,
storage and manfuacture of toxic industrial wastes;
2.6.4. Formal confirmation documents on the storage and landfills possibilities of wastes
meeting sanitary-environmental norms and regulations;
2.6.5. Applicant’s action plan prepared condisering the state standards and technical safety
requirements;
2.6.6 Formal confirmation documents on the alarm provision with the purpose of waste
neutralization and area protection;
2.6.7. Formal confirmation documents on the special clothing, tools and equipments supply
of service personnel;
3. Administrative procedures for e-service:
3.1. Informative e-services are always available for users and access can not be limited in any
manner
3.2. Survey for interactive e-service:
3.2.1. forming the survey:
Survey of the user is formed through the defined authorization process by visiting the
sites given in the item № 2.4 of administrative regulations. After this, proper activity type is
choosen and sent along with addition of documents compatible with the item № 2.6 of
regulation.
3.2.2. Admission of survey :
Survey is registered by State Examination Office as it is included in http://exidmet.eco.gov.az/ web-site and notification on it as well as on its further execution is sent to
user’s e-mail.
3.3. Execution or refusal of e-service:
3.3.1. Decisions on the grant of special permission to the utilization and neutralization
of toxic industrial wastes are refused only in cases envisaged by legislation. In case of refusal,
substantitated reply is sent to user’s e-mail along with an indication of reason.;
3.3.2. In the absence of arguments for refusal, decision on the grant of special permission
to the utilization and neutralization of toxic industrial wastes is adopted by State Examination
Office within 10 (ten) days.
3.4. Execution of survey:
3.4.1. Survey is registered conforming the Decree № 935 of the President of the Republic
of Azerbaijan “Instruction on the conduction of clerical works in state governmental bodies,
organizations and institutions” dated 27 September, 2003 and sent to the responsible departments
for execution.
3.4.2 The contents of each administrative operation, execution time and / or a maximum
execution time:
Query and the documents attached to it which can be removed when you look at faults have been
found and are not grounds for rejection, the applicant shall be notified in writing within 5 days.
Upon request, they are removed and re-examined and a decision is made to them within 5 days
3.4.3. Relevant decision on the grant of state examination opinion is made, registered in
the book and presented to the customer.
3.5. Supervision for the execution of e-service:
3.5.1. Supervision for the execution of e-service is carried out by State Examination Office
of the Ministry of Ecology and Natural Resources via electronic clerical works ;
3.5.2. Supervision for the execution of e-service is conducted conforming the Decree №
935 of the President of Azerbaijan Republic “Instruction on the conduction of clerical works in
state governmental bodies, organizations and institutions” dated 27 September, 2003
3.6. Discussions on the execution of e-service:
3.6.1. Users can administratively complaint and (or) appeal to the court against the
decisions adopted for the grant of special permission to the utilization and neutralization of toxic
industrial wastes and misbehaviours of officials;
3.6.2. Complaint letter should be in conformation to the article № 74 of
“On the administrative proceedings” Law of the Republic of Azerbaijan. Complaint petition
should be sent to the Ministry of Ecology and Natural Resources on paper, but electronically to
the web-site given in the item № 2.5 of administrative regulation.
3.6.3. Complaint is reviewed within the period specified by the article № 78 of “On the
administrative proceedings” Law of the Republic of Azerbaijan.
