The Financial Bid shall be on % basis, inclusive of all taxes, such as Vat charges, Excise duty (ies), overheads expenses etc excluding cartage and entry tax. 4. The bidder should quote the % rate preferably both in figures as well as in words. In case of any dispute/ambiguity in the rates quoted in words/figures, the higher value quoted either of the two shall be considered for evaluation of the bid. 5. The Materials supplied by the bidders should be of BIS (earlier ISI) specifications. 6. The stores are required to be delivered in full and within 30 days after acceptance of the offer. 7. The offer should be firm and open for acceptance till 90 days from the stipulated date of opening. Price escalation will not be allowed. 8. Earnest Money is to be deposited in the form of FDR (Nationalized Bank) pledged in favour of ‘Suptdg. Archl. If the date of issue/receipt of the tender happens to be a holiday, the tender will be issued/opened on the next working day. The date of issuing of and accepting of tenders will be postponed even in the absence (due to any reasons) of officers authorized to initiate and complete the above process of procurement of laboratory furniture at any one or more stages of its processing. The renderers will be informed accordingly by a suitable mode of communication depending upon the extended period proposed by the ASI. 11. The contractor/supplier will be permitted to attend tender opening. 12. No commitment to accept lowest or any tender: Archaeological Survey of India shall be under no obligation to accept the lowest or any other quotation received in response to this tender enquiry, and shall be entitled to reject any or all offers including those received late or having incomplete offers without assigning any reason whatsoever. 13. The Earnest Money will be refunded, if the offer is not accepted. In case the offer is accepted, but is not honored by the tendered, the Earnest Money will be forfeited. The Earnest Money will also be forfeited, if wrong information is given in the tender to influence the tender cost. 14. Any or all tenders can be rejected by the competent authority, without assigning any reason. It cannot be challenged in any court of Law. 15. Resolution of Disputes: All disagreements, disputes, difference that may arise between the ASI and the Supplier which cannot be resolved through mutual negotiations shall be referred to an Arbitrator appointed in accordance with the provisions of relevant Indian or International Law as the case may be. The venue of the proceedings and arbitration shall be Bhubaneswar, India. 16. Jurisdiction: The obligations and liabilities arising out of this contract shall be construed in accordance with the laws of Union of India. The Courts in Bhubaneswar, India shall have the exclusive jurisdiction to try all or any of the disputes. 17. Notices: Any notice given by one party to the other pursuant to this contract/ order shall be sent to the other party in writing or by cable, telex, FAX or e-mail and confirmed in writing to the other party’s address specified in the contract. A notice shall be effective when delivered or on the notice’s effective date, whichever is later. 18. Tenders which do not fulfill any or all of the above conditions or incomplete, are liable to be rejected.
