INDIVIDUAL CONSULTANT PROCUREMENT NOTICE (NATIONAL) Date: 09 April 20134 Country: Kenya Description of the assignment: Request for Recruitment of National Individual Consultant – Natural Resources & Conflicts: 6 weeks assignment; 30 Consultancy days. UNDP supports capacity development for the Government of Kenya in conflict prevention and peace building. Recently there have been many conflicts related to the exploration and exploitation of Kenya’s natural resources including oil and gas exploration in Northern Kenya. UNDP using funding from DFID would like to recruit a consultant to undertake a rapid 6 weeks assessment of natural resources and conflicts in Kenya Project name: PBCP 1. BACKGROUND 1) GENERAL BACKGROUND UNDP’ role in natural resources management and conflict prevention UNDP’s broader mandate involves addressing conflicts over natural resources within a development framework. This is because there is a connection between competition for natural resources and conflicts. The overall impact of conflicts on development may be negative and yet the disputes over natural resources could be managed. In that respect, UNDP’s role in supporting national and local actors in conflict prevention becomes critical. In the Kenya case, conflict prevention could help mitigate the effects of violent conflicts and to harness the potential of natural resources for sustainable development, to create a just, equitable and peaceful society. UNDP Kenya has been and will continue being at the forefront of supporting national and local institutions in conflict prevention and peace building. In the last 10 years, capacities for national and community-based institutions and civil society organizations in Kenya have been strengthened to deal with conflicts, promote reconciliation and promote peaceful co-existence. The experiences and the successes of those conflict prevention initiatives, strategies and frameworks would be useful in the context of addressing potential and real natural resource based conflicts and threats. For UNDP and its partners in Kenya to address conflicts over natural resources, it is imperative that any initiatives, interventions, strategies and plans are designed based on solid understanding of the particular situations and contexts. This would require information and evidence gathering. The information could be on the following aspects: nature and types of resources; the conflict situation in the country and in those regions with natural resources; factors or causes of natural resources based conflicts; the various actors, their relationships and influences on conflicts and natural resources; strategies and institutions at local and national level for conflict management and peace building; and any challenges and opportunities for conflict prevention and peace building within the context of natural resources exploitation and management. It is within this background and context that UNDP and its partners seek the services of a National consultant to undertake research and appraisal of the status of natural resources and conflicts in Kenya. The consultant will focus on exploration and exploitation of resources such as oil, gas, minerals, wind and solar energy potential found in Kenya and in the specific localities affected. 2) OBJECTIVES OF THE ASSIGNMENT Objectives of the Research and Field Assessments/ Surveys 1.To collect relevant data on the status of natural resources (Oil, gas and other minerals) and conflicts ( actual or potential, real or perceived) in the country 2.To assess the nature and extent of natural resources based disputes and conflicts in selected localities / counties in Kenya 3.To interact and profile critical actors (communities, multi-national and local corporations, government, activists, CSOs etc) in the natural resources-based conflicts, the powers and influences 4.To understand and document various local and national level initiatives, strategies, plans etc for prevention of natural resources driven conflicts (mediation, negotiations, peace committees etc) and peace building in those particular regions. 3) SCOPE OF WORK In order to achieve the above objective, under the overall guidance of the UNDP the consultant will be assigned specific duties and is expected to perform the following tasks : To conduct a desk review of existing information, literature and data on natural resources in Kenya focusing on extractive industry To collect relevant data on the status of natural resources (Oil, gas and other minerals) and conflicts ( actual or potential, real or perceived) in the country To undertake field studies and to assess the nature and extent of natural resources based disputes and conflicts in selected localities / counties in Kenya. To undertake stakeholder-analysis in the extractives industry and in the conflict prevention and peace building sector i.e. identify, interact with and profile the goals, powers and influences of critical actors (communities, multi-national and local corporations, government, activists, CSOs etc) To understand and document various local and national level initiatives, strategies, plans etc for prevention of natural resources driven conflicts (mediation, negotiations, peace committees etc) and peace building in those particular regions. To make presentations of the research findings to the management of UNDP and critical stakeholders as directed by UNDP To finalize and submit to UNDP the final concise report to on the status of natural resources and conflicts in Kenya 4) DURATION OF ASSIGNMENT, DUTY STATION AND EXPECTED PLACES OF TRAVEL Duration: 6 Weeks months overall and subject to extension on a need-to basis Consultancy days: The successful consultant will be paid based on the number of Consultancy days agreed upon for this assignment. The Unit proposes 30 Working Days based UN rates for National Consultants. Duty station: Field-based with regular reporting to UNDP Gigiri Offices in Nairobi Travel: The consultancies are expected to undertake reasonable travels within the country particularly in the selected regions (the list will be provided by UNDP). UNDP will cater for costs of travel and Accommodation authorized by PCBP. 5) FINAL PRODUCTS Expected results 1. Inception report 2.A comprehensive report on the status of natural resources and conflicts in Kenya ( detailing the types of resources, where they are found, actual and potential conflicts, the communities affected, companies involved in exploration, interventions for conflict management etc) 3. A complete data bank of the critical actors in the extractive sector (who is doing what where and how) and their influences in generating conflicts and/ or preventing conflicts 4. Presentation of the report to UNDP management and key stakeholders and validation of the same through at least 2 workshops 5. Final consultancy report with clear and practical conclusions and recommendations to guide the design and implementation of UNDP’s programmes and partnership strategies in the addressing conflicts and development challenges associated with Kenya’s extractive industry. Work Breakdown Schedule Task Desk Review as per TORs Field Research as per TORs Compilation and presentation of reports Validation and publication of report/ assessment 4 Total consultancy days Consultancy Days 5 Expected product Inception report 14 Field research report 7 Draft final Assessment Report 4 Validation workshop report and revised Final Assessment report 30 6) PROVISION OF MONITORING AND PROGRESS CONTROLS The work of the consultants will be interactive and they will be supervised by the Team Leader of the Peace Building and Conflict Prevention Unit. 7) DEGREE OF EXPERTISE, QUALIFICATIONS AND COMPETENCIES Qualification requirements for the consultants •Higher education (at least a master’s degree) in, conflict management, law, natural resources management, political science and economics, public administration, governance and any social sciences related to the subject of this research •Knowledge of conflicts, conflict analysis and resolution within natural resources management contexts •Extensive knowledge of natural resource based conflicts in Kenya and the local environment •Competencies in research and publications •Knowledge of gender, conflict sensitive and human rights dimensions of natural resources extraction and management •Minimum of 5 years professional experience in results based development •Demonstrated analytical, communication and report writing skills; •Fluency in written and spoken English and any other local languages in Kenya. •Competencies in team work, communication, strategic partnerships and networking. 8) LANGUAGE REQUIREMENTS •Excellent ability to communicate in English and Kiswahili 9) EVALUATION CRITERIA Only candidates obtaining a minimum of 70 points will be considered Criteria Weight Max.
