Violence & Harassment Free Policy Franchise Management Inc. must ensure that all employees have a work environment that is free of violence or harassment of any kind, whether it arises from other employees or customers visiting the store. What is Harassment? Harassment is a form of discrimination and is defined as any unwelcome comment or conduct that is prohibited grounds of discrimination under The Canadian Human Rights Act and Provincial Human Rights legislation. Harassment is prohibited on the basis of: Race Sex Sexual Orientation Marital Status Place of Origin Gender Age Disability Colour Ethnic Origin Record of Offences Political Opinion Ancestry Citizenship Family Status Creed Harassment includes deliberate or unintentional gestures, comments, racial slurs, questions, representations or other behaviours that the harasser should reasonably know are unwelcome by the recipient. Personal/Psychological Harassment Personal/Psychological harassment refers to interaction or conduct creating an unacceptable or offensive work environment. It includes behaviours such as, but not limited to yelling, loss of temper over minor issues, expression of opinion in an obscene manner, humiliating, offensive, foul and/or obscene language, repeated threats of dismissal, or other severe punishment for no reason, or leaving offensive messages by letter, fax, email, or phone. Workplace Violence Workplace violence is defined as exercising physical force or an attempt to exercise physical force against an employee that causes or could cause physical injury to the employee. It includes behaviours such as, but not limited to threatening behaviour, verbal or written threats, verbal abuse, or physical attack. Employees If any employee engages in workplace violence or harassment, which includes threats, an investigation will take place immediately. The employee involved will face disciplinary action which may include immediate termination. Any employee who observes workplace violence or harassment or is a victim thereof shall immediately report it to the Restaurant General Manager or Supervisor. At the discretion of management, the police may need to be contacted, and a thorough investigation will take place.
