CITY COUNCIL MEETING CITY HALL October 3, 2011 Mayor Ernst called the meeting to order at 6:00 p.m. with the following members present: Fineran, Clough, Carnine, Rupert and Cates. Others present were City Clerk Ball, Attorney Boerner, and Joel Ahrendsen, Farmers Coop. Motion by Council Member Rupert to approve the agenda, second by Council Member Clough. On a unanimous vote motion carried. Mayor Ernst opened the public hearing on the final plat of Ridgeview Estates Subdivision and Ordinance 536 on the Compost and Brush pile at 6:05 p.m. Joel Ahrendsen discussed with the Council the corner of 2nd and Rohwer Streets noting the original plan was to pave it for the farm trucks using their elevator, but now they were not sure of where the truck will go. Once it is decided the area will be paved, but that probably will not happen until after harvest. The sidewalks that were removed will have to be marked like a sidewalk and possibly signs put up to note it is a public walkway. Mayor Ernst noted no verbal or written comments had been received on the Ridgeview Estates final plat or on Ordinance 536 for the Compost and Brush piles and closed the Public Hearing at 6:15 p.m. Motion by Council Member Fineran to approve Resolution 2011-10 accepting and approving the plat of Ridgeview Estates to the City of Ida Grove, second by Council Member Carnine. On a unanimous vote motion carried. RESOLUTION NUMBER 2011-10 RESOLUTION ACCEPTING AND APPROVING THE PLAT OF: RIDGEVIEW ESTATES TO THE CITY OF IDA GROVE, IDA COUNTY, IOWA WHEREAS, Ida Grove Planning and Zoning Commission did file with the City Clerk of the City of Ida Grove, Ida County, Iowa, a certain plat designated as Ridgeview Estates to the City of Ida Grove, Ida County, Iowa as hereto attached and forming part of this Resolution, and the same hereby is accepted and approved. Passed by the City Council of the City of Ida Grove, Iowa on the 3 rd day of October, 2011, and approved this 3rd day of October, 2011. Motion by Council Member Fineran to waive the second and third readings of Ordinance 536 pertaining to the operation and maintenance of the City’s compost and brush piles, second by Council Member Clough. ORDINANCE NO. 536 AN ORDINANCE REGARDING MUNICIPAL COMPOST AND BRUSH PILE USE BE IT ENACTED BY THE CITY OF COUNCIL OF THE CITY OF IDA GROVE, IOWA Section 1 A new Chapter to Title III is enacted as follows: TITLE III – Mental AND PHYSICAL HEALTH Chapter 6 – Article 1 – City Maintained Compost and Brush Pile 3-6.0101 – Municipal Compost and Brush Piles. The City of Ida Grove, from time to time, as designated by the City Council at a regular meeting, may open, operate and maintain a compost and/or brush pile on City property for the use and convenience of citizens residing in the corporate limits for disposal of yard waste, trees, branches and bark during designated hours of operation. 3-6.0102 – Compost and Brush Piles. During the periods of time the City compost pile or brush piles are open, citizens of Ida Grove may deposit in the compost pile yard wastes defined for purposes of this section as grass clippings, leaves, flowers, etc., produced as part of yard and garden development and maintenance and deposit in the brush pile, bark, tree limbs and branches not exceeding six inches in diameter and eight feet in length. 3-6.0103 – Unlawful Deposits in Compost and Brush Piles. It shall be unlawful and a municipal infraction to: a) Deposit in the compost or brush pile compost or other brush originating from outside the City limits. b) To deposit in the brush or compost piles any matter or items not designated in this chapter (e.g. plastic bags or other containers, tree limbs exceeding maximum size, garbage and building materials). c) To remove compost or brush without specific authorization from the City Clerk. d) Deposit compost or brush other than during times or hours of operation. 3-6.01.04 – Fines. The municipal offense fine for violation of this chapter is $250 for first offense, $500 for second offense and $750 for third or subsequent offenses. Section 2 This Ordinance shall be in effect from and after its final passage, approval and publication as provided by law. On a unanimous vote motion carried. Motion by Council Member Carnine to approve the consent agenda consisting of the claims list, Clerk’s Report, financial reports and the Minutes from September 19 th, second by Council Member Fineran. On a unanimous vote motion carried. Mayor Ernst announced the Town Hall meeting on the Strategic plan was October 5th at the Rec Center and encouraged everyone to attend. This event is the opportunity to gather information from community residents that will be used to develop the strategic plan for the City in the next couple of months. The Council reviewed and agreed with Street Superintendent Sholty’s recommendation to wait until Spring to do any asphalt street repairs. The concern is needing to wait for the repair work to harden which would prevent any use of the street sweeper for picking up leaves. Discussion also included Densmore Concrete proposal to repair the alley from the Community Hall to Third Street noting concrete would not be any issue for cleaning leaves. Motion by Council Member Carnine to approve $5,330.75 for Densmore Concrete to repair the alley from the Community Hall to 3 rd Street, second by Council Member Cates. On a unanimous vote motion carried. Motion by Council member Cates to approve Resolution 2011-11 authorizing an internal advance to the tax increment revenue fund, second by Council Member Fineran. On unanimous vote motion carried. RESOLUTION NUMBER 2O11-11 AUTHORIZING INTERNAL ADVANCE TO TAX INCREMENT REVENUE FUND WHEREAS, the City of Ida Grove, Iowa (the “City”), has established the Ida Grove Urban Renewal Area (the “Urban Renewal Area”) and has created the Ida Grove Urban Renewal Area Tax Increment Revenue Fund (the “Tax Increment Fund”) in connection therewith; and WHEREAS, the City has undertaken an urban renewal project consisting of construction of street, water, sanitary and storm sewer improvements in the Urban Renewal Area (the “Project”); and WHEREAS, in order to cover the costs of the Project and to make such costs eligible to be reimbursed from future incremental property tax revenues, it is necessary to make an internal advance of funds; NOW, THEREFORE, IT IS RESOLVED by the City of Council of the City of Ida Grove, Iowa, as follows: Section 1. It is hereby directed that One Hundred Fifty Thousand Dollars ($150,000) be advanced to the Tax Increment Fund from the City’s Water Fund (the “Advance”) in order to pay the costs of the Project. The Advance shall be repaid to the Water Fund out of future incremental property tax revenues received with respect to the Urban Renewal Area. To the extent that there are funds available for this purpose in the Tax Increment Fund, payments on the Advance shall be made on June 1 of each year. Repayment of the Advance is subject to the determination of the City Council that there are incremental property tax revenues available for such purpose which have been allocated to or accrued in the Tax Increment Fund, and the City Council reserves the right to appropriate funds to the repayment of the Advance, or to withhold such appropriation, at its discretion. Section 2. A copy of this Resolution shall be filed in the office of the County Auditor of Ida County, Iowa to evidence the Advance. Pursuant to Section 403.19 of the Code of Iowa, the City Clerk is hereby directed to certify to the County Auditor, no later than December 1, 2011, the original amount of the Advance and to certify the remaining balance in subsequent years. Section 3. All resolutions or parts thereof in conflict herewith are hereby repealed, to the extent of such conflict. PASSED AND APPROVED this 3rd day of October 2011. Dennis R. RESOLUTION NUMBER 2011-12 RECEIVING BIDS FOR SALE OF CITY GENERAL OBLIGATION NOTE WHEREAS, the City of Ida Grove, in Ida County, State of Iowa (hereinafter referred to as the “City”) has invited interested persons to submit proposals for the sale of the City’s $246,500 General Obligation Note, the proceeds of which will be used for infrastructure improvements; and WHEREAS, bids were received from the following: United Bank of Iowa, 501 Second Street, Ida Grove, IA 51445 First State Bank, PO Box 276, Ida Grove, IA 51445; and WHEREAS, before the City Council may award the sale of the Note, the Council must hold a public hearing on entering into a loan agreement and issuing the Note; and WHEREAS, a public hearing will be held on October 10, 2011; NOW, THEREFORE, It Is Resolved by the City Council of the City of Ida Grove, Iowa as follows: Section 1. The City Council hereby acknowledges the receipt of the bids set out above and declares that a decision will be made with respect to the sale of the Note following the public hearing on October 10, 2011. Section 2. All resolutions and orders or parts thereof in conflict with the provisions of this resolution, to the extent of such conflict, are hereby repealed. Passed and approved October 3, 2011. Dennis R. Ernst, Mayor Attest: Edith Ann Ball, City Clerk The Council discussed the need to have the airport lights repaired so that the lights would not be on 24-hours. Currently pilots have difficulty in turning on the lights at night for landing so the lights have been left on. City Clerk Ball will check on the progress and then based on that will decide if a city employee will need to begin turning the lights on and off during work hours. Mayor Ernst announced a county wide burn ban would be implemented tomorrow due to lack of rain. On Sunday a three alarm fire was close to Ida Grove city’s limits because of a baler catching fire.
