This bill implements the creation of Community Benefit Districts in the form of management
entities that are intended to help with the development of communities through business,
recreation, preservation, security, and sanitation. Each CBD shall have to petition to be
recognized as such and then a board of directors shall oversee the management entity to
ensure the implementation of a management plan. Provides further guidance for the operation

Enacts a new GL 65D, an act relative to regional transportation ballot initiatives; authorizes a
municipality, or a district formed from two or more municipalities, to impose a tax surcharge on
one of four taxes from a list including payroll, sales, property, or vehicle excise tax, to be used
for transportation-related purposes only: establishes the process for acceptance of the
surcharge in a municipality or district; establishes the regulations governing the collection of the
surcharge; directs that a municipality or district which accepts this section must establish a
local or regional transportation committee, consisting of 5 members; establishes the
regulations for governing the committee; establishes the powers and duties of the committee;
directs the commonwealth to establish the Massachusetts Local and Regional Transportation
Trust Fund, for the exclusive benefit of municipalities or districts accepting this act; requires the
commonwealth to annually disburse from this fund an amount not to exceed the total surcharge
collected in each municipality or district that has accepted this act; authorizes the municipality
to reduce or make changes in the amount of the surcharge or the amount of exemptions in the
same manner as it were accepted; authorizes a municipality to revoke the surcharge after 5
years in the same manner as it were accepted; directs the commissioner of revenue to
promulgate rules and regulations relating to this chapter.

Eliminates the so-called Pacheco Privatization law, which has historically been used to limit the
government's ability to privatize current public functions without a cost-benefit analysis and
without changing prevailing labor standards as an end-run around the public employee unions.
Under the existing law an agency must prepare a detailed written statement of the service to be
contracted, estimate the most cost-efficient method of providing the service with agency
employees, select a contractor through a competitive bidding process, and compare the inhouse cost to the cost of the private contract. Bidders must maintain comparable labor
standards; the state auditor then reviews the the application to ensure that the cost of the
contracted service would be less than the in-house cost and maintain at least equal quality of
service. The auditor has 30 days to approve or reject the application.

respect to the acquisition, control, and disposition of real property. As rewritten the emphasis
turns to "smart growth" land use policies. (Smart growth is an urban planning and
transportation theory that concentrates growth in compact walkable urban centers to avoid
sprawl.) As amended, the DCAMM Commissioner would still be responsible for the
acquisition, control and disposition of real property but may also delegate that responsibility to
an administrator who has 10 years of experience in the management of commercial, industrial,
institutional or public real property. In acquiring properties and buildings for the use of state
agencies, DCAMM is to give first consideration to any structures that have been certified as
historic landmarks; real property acquired for the use of state agencies is still to be held in the
name of the Commonwealth; the Commissioner may transfer and change the use of land,
buildings and other real property of the Commonwealth (other than the State House) within or
between state agencies including, with the consent of the CJAM of the Trial Courts, the
judiciary; a transfer within or between state agencies or executive offices which involves either a
change in the purposes or a change in use in excess of 50% of the usable floor space will
require the prior approval of the Legislature. The Commissioner, with the consultation of the
Surplus Land Coordination Committee, may sell, lease, transfer or otherwise dispose of surplus
real property of the Commonwealth with a few restrictions. Before making a determination that
any real property larger than 2 acres or valued at more than $1,000,000 is surplus to current
and foreseeable state uses, the Commissioner must file a report with the legislature, hold a
public hearing within 30 days of making that report, and notify the the host municipality and the
regional planning agency affected. The Regional Planning Agency must then conduct a smart
growth reuse review. Each host municipality is to have a right of first refusal to acquire the
surplus real property for a direct public use at 80% of the official valuation. Finally, the bill also
establishes a new Capital Projects Fund, to be financed by a portion of the net cash proceeds
resulting from the disposition of surplus real property and to be expended, subject to
appropriation, to meet the capital improvement needs of the Commonwealth. Real property
that is the subject of a special act having an effective date before the new provisions come into
effect would be exempted from the new provisions. (HB 2874 and HB 2902 are identical; both
are very similar to SB 1535.)
