(Smart growth is an urban planning and transportation theory that concentrates growth in compact walkable urban centers to avoid sprawl.) As amended, the DCAMM Commissioner would still be responsible for the acquisition, control and disposition of real property but may also delegate that responsibility to an administrator who has 10 years of experience in the management of commercial, industrial, institutional or public real property. In acquiring properties and buildings for the use of state agencies, DCAMM is to give first consideration to any structures that have been certified as historic landmarks; real property acquired for the use of state agencies is still to be held in the name of the Commonwealth; the Commissioner may transfer and change the use of land, buildings and other real property of the Commonwealth (other than the State House) within or between state agencies including, with the consent of the CJAM of the Trial Courts, the judiciary; a transfer within or between state agencies or executive offices which involves either a change in the purposes or a change in use in excess of 50% of the usable floor space will require the prior approval of the Legislature. The Commissioner, with the consultation of the Surplus Land Coordination Committee, may sell, lease, transfer or otherwise dispose of surplus real property of the Commonwealth with a few restrictions. Before making a determination that any real property larger than 2 acres or valued at more than $1,000,000 is surplus to current and foreseeable state uses, the Commissioner must file a report with the legislature, hold a public hearing within 30 days of making that report, and notify the the host municipality and the regional planning agency affected. The Regional Planning Agency must then conduct a smart growth reuse review. Each host municipality is to have a right of first refusal to acquire the surplus real property for a direct public use at 80% of the official valuation. Finally, the bill also establishes a new Capital Projects Fund, to be financed by a portion of the net cash proceeds resulting from the disposition of surplus real property and to be expended, subject to appropriation, to meet the capital improvement needs of the Commonwealth. Real property that is the subject of a special act having an effective date before the new provisions come into effect would be exempted from the new provisions.
