GENERAL CONDITIONS OF RFP Request of Proposal under this RFP will be received no later than 2:00 p.m. on Wednesday, October 7, 2015 at the Municipal Office to the attention of Mrs. Jocelyn Pronovost, Clerk, 171 – 4th Avenue, P.O. Box 490. Cochrane, Ontario P0L 1C0. It is the responsibility of each proponent to ensure that its’ proposal is received prior to the closing time of 2:00 p.m. on Wednesday, October 7, 2015. Late proposals shall be returned unopened. Proposals must be submitted bearing the name of the proponent, addressed as above and clearly marked: “RFP 2015-39- Sidewalk Replacement at various locations in the Town of Cochrane” Electronically transmitted proposal will be accepted (i.e. Fax or computer E-Mail transfer) nor adjustment to the proposal submitted will be considered. Question pertaining to this request must be submitted in writing no later than forty eight (48) hour prior to the closing time and date. A written answer along with the question will be provided to all proponents. The Corporation of the Town of Cochrane reserves the right to reject any and all proposals received as a result of this RFP. If a proposal is selected it will be the most advantageous regarding price, quality of service, the Contractor qualifications and capabilities to provide the specified service, and other factors which The Corporation of the Town of Cochrane may consider. The Town does not intend to award a contract fully on the basis of any response made to the proposal; the Town reserves the right to consider proposals for modifications at any time before a contract would be awarded, and negotiations would be undertaken with that contractor whose proposal is deemed to best meet the Town's specifications and needs. B. Failure of the successful bidder to accept the obligation of the contract may result in the cancellation of any award. C. In the event it becomes necessary to revise any part of the RFP, addendum will be provided. Deadlines for submission of RFP's may be adjusted to allow for revisions. The entire proposal document with any amendments should be returned. To be considered, original proposal must be at the Town Hall on or before the date and time specified and mail two copies. D. Proposals should be prepared simply and economically providing a straightforward, concise description of the contractor’s ability to meet the requirements of the RFP. Proposals shall be written in ink or typewritten. No erasures are permitted. Mistakes may be crossed out and corrected and must be initialed in ink by the person signing the proposal. E. The compensation requirements stated in the bidder's proposal will not be subject to any price increase from the date on which the proposal is opened at the Town Hall to the mutually agreed-to date of contract. F. If at any time, in the opinion of the representative(s) of the Corporation of the Town of Cochrane, the work being carried out is progressing unsatisfactorily, the contract may be cancelled upon written notice of the representative of the Town of Cochrane, without redress or compensation to the Contractor, save and except for the work having been carried out. 3 THE CORPORATION OF THE TOWN OF COCHRANE REQUEST FOR PROPOSALS Inquiry Number 2015-39 2. BACKGROUND This project is to replace Asphalt or Concrete sidewalk replacement at various locations in Cochrane. The Town will evaluate the cost of both asphalt and concrete in determining what material will be used at each location. Bidders are encouraged to submit on both materials but will not be eliminated from the process if the submission proposes only one material. 3. SCOPE OF WORK The Town of Cochrane requires the Sidewalks to be constructed in accordance with the OPSD 310.010, 310.020 AND 310.030. Prices quoted are for price per linear meter with standard depth and width. 4. OBLIGATIONS . 1. All submission(s) sent to the Corporation of the Town of Cochrane become the property of the Town of Cochrane and as such may be subject to the Freedom of Information and Protection of Privacy Act. 2. The Town of Cochrane reserves the right to reject any or all submissions and, in the event, is not obligated to accept any submissions. The Town of Cochrane reserves the right not to proceed with a part of parts of the RFP dependent upon budget constraints. 3. The Town of Cochrane shall not be liable for any costs for preparation or presentation (if required), and all submissions and accompanied documents submitted by respondents become the property of the Town of Cochrane and shall not be returned. 4. Submissions shall be firm for a period of 60 days from the submission deadline and shall be used as the basis of an agreement. THE BIDDER’S RESPONSIBILITY 1. It is the responsibility of those wishing to provide a submission to carefully examine the SITE OF the proposed work, evaluate the existing conditions and limitations and included in the quote price the amount required to cover of all items required to be done to complete the project in accordance with the highest standards or workmanship to the satisfaction of the owner. 2. All work to be carried out shall be in compliance with all the applicable laws and regulation governing the provision of the services, being requested. 4 THE CORPORATION OF THE TOWN OF COCHRANE REQUEST FOR PROPOSALS Inquiry Number 2015-39 5. SUBMITTALS 1. 6. DISBURSEMENT 1. 7. Disbursement of the consideration whether whole or in part will be made only after portions of the work has been completed and approved by the Municipal representative. DATE FOR THE COMPLETION OF THE WORK 1. 8. Firms submitting a proposal are responsible for any errors and/or omissions in their submissions, which may not be relieved by the Town of Cochrane. Time shall be of the essence of this contract completion prior to November 1st, 2015. INDEMNIFICATION AND INSURANCE The Bidder’s shall indemnify and hold harmless the Town of Cochrane, its representatives, along with its agents and employees from all claims, demands, losses, costs, damages, actions, suits or proceedings by any third party that arise out of, or are attributable to the Engineering Firm’s performance of the contract. The Bidder’s shall provide, maintain and pay for general Liability Insurance in the joint name of the Engineering Firm and the Town of Cochrane with limits of not less than FIVE MILLION ($5,000,000.00) DOLLARS inclusive per occurrence for bodily injury, death and damage to property including loss of use thereof. This form insurance shall be maintained continuously from the date of the issuance of an agreement until completion of the work as determined by the representative of the Town of Cochrane.
