Attachment 3 MINNESOTA DEPARTMENT OF TRANSPORTATION NOTICE OF VIOLATION Minnesota Junk Yard Act Date: To: Address: Minnesota Statutes 161.242, Subd. 3, provides that no junk yard may exist or be operated outside a zoned or unzoned industrial area adjacent to any trunk or interstate highway unless it is screened so as to effectively conceal it from the view of motorists using the highway. This notice is to advise you of our determination that a junk yard owned by you or under your control, adjacent to Highway No. , Control Section No. , at M.P. is presently in violation of the above provision. We request that you take the following action at once to correct this condition: Move the junk too keep it from view of the highway, reduce the amount of discarded material stored to less than the bulk of 5 motor vehicles, or build a screen to keep the junk from view of the highway. You must submit specifications relative to screening to the Department for approval within 90 days following the date of this notice and prior to commencing any related construction. If, within that 90 day period, you have not complied with the request contained in this notice, the Commissioner of Transportation may invoke Minnesota Statutes 161.242, Subd. 3(b), which provides in part: “Any junkyard…that does not conform to this section…is hereby declared to be a public nuisance and illegal, and the Commissioner may enter upon the land where the junk yard is located and may screen the same, or may relocate or dispose of the junk yard…” The Commissioner may collect the cost of screening, removal, relocation or disposal from the owner of the junk or the land upon which it is located. In addition, Minnesota Statutes 161.242, Subd. 5, makes any person violating that section guilty of a misdemeanor.
