Puppy Contract
The following contract is between Pantheon Acres, Inc. represented by Erika T. Wepner, President, and Brandon L. Buzzell, Secretary
hereafter referred to as "Breeders”, and _____________________________________________________________________________,
hereafter referred to as "Buyer(s)” for the sale and purchase of one purebred dog of the ___________ breed on this _____ day of
___________, 20__.

The Breeders and the Buyer(s) have entered into an agreement to transfer the ownership of the puppy, identified above and hereafter
referred to as “Puppy”, and agree to the following conditions set down for the betterment of the breed, the protection of this Puppy, and
the reputation of the Breeders 's kennel. The intent of this Contract is not to limit or restrict the Buyer(s), but to protect each individual
Puppy sold by the Breeders.
Purchase & Possession
1. The Purchase Price of $__________ will be paid by the Buyer(s) to the Breeders in the form of cash or certified check made out to
Pantheon Acres, Inc. A non-refundable deposit of $__________ was made on ____________________________ and the Puppy will
be held until _____________________, at which time the balance of the purchase price, ___________, must be paid in full, either in
a lump sum or through payments received, or the deposit is forfeited and alternate arrangements will be made for the placement of
the puppy.
a. In exchange for a reduced price, the Buyer(s) will adhere to the provisions in the attached Co-Ownership Agreement. Buyer(s)

2. The Buyer(s) will be able to take full physical possession of the Puppy upon receipt of the full purchase price and once the Puppy has
attained eight (8) weeks of age. The expected pick-up date is _______________. After that pick-up date, if the Buyer(s) have not
taken possession of the Puppy and no arrangements have been made in writing for the Breeders to hold the Puppy until a specific
date, then the deposit and puppy will be forfeited and alternate arrangements will be made for the placement of the puppy.
a. If within seven (7) calendar days of Possession, the Buyer(s) decide to not keep the Puppy, for other than health reasons, the
Buyer(s) may return the Puppy, registration papers, and all of the Puppy’s personal effects given to Buyer at the time of
Transfer, for an immediate refund, minus deposit and any transportation expenses incurred by the Breeder to retrieve the
Puppy.
3. The Breeder certifies that the Puppy is purebred and eligible for registration under the Regulations of ___________________ Kennel
Club, hereafter referred to as “Kennel Club”, as a purebred ____________ and will provide the proper forms for such a registration,
if available, at the time of sale, or forwarded later within a reasonable amount of time after receiving forms from the Kennel Club.
a. The Puppy will be registered in the name of the Buyer(s) listed on this Contract.
b. The Buyer(s) are responsible for registering the Puppy with the Kennel Club within two (2) months of taking possession of the
Puppy or receipt of registration papers, whichever is later.
c. The Buyer(s) will send a copy of the registration certificate to the Breeders within ten days of receipt from the Kennel Club.
d. The Buyer(s) agree that neither this Puppy nor any of the offspring produced by the Puppy will ever be registered with any
other canine registry other than the ones listed below without the Breeders’ written permission. In the event that the Buyer(s)
registers the Puppy with an unsanctioned canine registry, without the express written consent of the Breeders, he/she agrees
to pay a fine of one thousand dollars ($1000) to the Breeders and cancel the Puppy’s registration within ten (10) days of
notification from the Breeders.

The Buyer(s) agree that the Breeders’ kennel name prefix PANTHEON will be at the beginning of the puppy’s registered name
on the Registration certificate
i.
The Buyer(s) agree not to change the registered name of the Puppy to remove the kennel prefix at any time.
1. In the event that the Buyer(s) fails to use the kennel prefix in the Puppy’s registered name, without the express
written consent of the Breeders, he/she agrees to pay a fine of one thousand dollars ($1000) to the Breeders and
correct the Puppy’s registration within ten (10) days of notification from the Breeders.
ii.
The Buyer(s) retain the right to give the Puppy his or her "call" name, defined as the every-day name the Puppy will be
known by.
Buyer(s) Intent
1. The Buyer(s) agree that that the Puppy is going to become a family companion dog or for a working dog used for tasks appropriate
for the ___________ breed such as for Therapy, exhibition in AKC conformation, obedience, or agility competition. The Puppy will
not be used or trained for activities which are illegal or for which it is not suited by reason of temperament or conformation or any
sport detrimental to the breed and its reputation. Specifically it will not be used as an attack dog or to hunt domesticated animals or
fight other animals.
2. The Buyer(s) agrees that he/she will not sell, transfer ownership or possession of the puppy or any of his/her progeny to any
individual or organization whose intent it is to resell (pet store or broker), trade, or give away the puppy, or use it in any
experiments, laboratory or otherwise or to use it as breeding stock for a puppy mill.
Puppy Care
1. The Buyer(s) is required to take the Puppy to the licensed veterinarian of his/her choice within five (5) business days of receipt of the
Puppy for a health check-up at his/her own expense. If the veterinarian finds the Puppy to be unhealthy, unsound or having a
previously undiagnosed medical issue or genetic defect because of breeding or early kennel care, a written statement from the
diagnosing veterinarian detailing the health issue must be delivered to the Breeders within seventy-two (72) hours of diagnosis. The
Breeders will have their veterinarian review that statement to confirm the condition. In the event that there is a disagreement, then
the Breeders’ veterinarian will make the final determination.
a. If the Breeders do not confirm the condition, then the Buyer(s) will return the Puppy, its paperwork and personal effects. Upon
receipt, the Breeders will at their discretion, refund the Buyer(s) for the purchase price of the Puppy, minus the deposit.
b. If the Breeders do confirm the condition, the Breeders will at their discretion, either replace the Puppy or reimburse the
Buyer(s) as outlined in the Reimbursement and/or Replacement section of this Contract.
2. The Buyer(s) agree to notify the Breeders’ of any health, training, or temperament problems immediately.
3. The Buyer(s) agrees to maintain the Puppy in a humane environment and properly train and care for it throughout his/her life as
specified in this section.
4. The Buyer(s) acknowledges receipt of the Code of Ethics from the _____________________ (National Breed Club) and by the signing
of this Contract do hereby agrees to abide by them while owning, breeding, and/or showing the Puppy.
5. The Buyer(s) agrees to take responsibility to prevent illness and injury by providing necessary booster vaccinations, veterinary care,
nutrition, fresh water, shelter, and supervision.
a. The Buyer(s) will maintain routine veterinary visits and vaccination protocols as recommended by his/her Veterinarian,
including inoculations against rabies, distemper, parvovirus, and other communicable diseases. As the Breeders recognize
alternative and holistic methods to traditional vaccination protocols, the Buyer(s) may deviate from the veterinary
recommended protocol upon the express written consent of the Breeders.
b. The Buyer(s) agrees that care will be taken to prevent injury to joints and growth plates for a minimum of one year or more if
growth spurts are still evident by
i.
Avoiding slippery surfaces
ii.
Preventing the Puppy from bounding up and down stairs, rough-housing with larger dogs, jumping down from heights
iii.
Minimizing excessive exercise,
iv.
Assisting the pup on/off furniture and in/out of cars
6. The Buyer(s) agrees that the Puppy will be properly licensed, not allowed to roam unsupervised, and must be kept in a manner to
prevent it from being abused or teased in any way.
7. The Buyer(s) agrees that the Puppy will be socialized and obedience trained appropriately, specifically:
a. The Buyer(s) and Puppy will attend a basic obedience class (Ex: Puppy Kindergarten). The Breeders recommend that the class
be completed by the time the puppy is 5 months old.
b. The Buyer(s) realizes that socialization is extremely important in the proper rearing of a puppy to become a temperamentally
stable adult dog and canine good citizen and agrees to socialize the Puppy with people and other dogs on a regular basis.
8. The Buyer(s) agrees that the puppy’s weight will be under strict supervision until the Puppy reaches his/her second birthday. It is far
better to have the dog slightly underweight then overweight, because excess weight contributes to structural breakdown of the dog.
a. The Buyer(s) also agrees nothing will be given to the Puppy that would encourage rapid growth; including steroids, or any
supplements that promotes rapid weight gain
b. The Buyer(s) agree to provide high quality dog food. Proper, balanced nutrition is extremely important every single day.

9.
The Buyer(s) agrees to keep the Puppy as a house pet and to provide the Puppy with considerate companionship on a daily basis as a
family member.
a. The Buyer(s) agree that the Puppy will never live in an outside kennel - or any other structure outside the home - or in the
garage or basement, or chained, tied, or tethered for any length of time.
b. The Puppy will be raised in the home and crated only when no-one is at home or when the Buyer(s) is sleeping and is unable to
provide adequate supervision.
10. The Breeders retain the right to visit, or have their agent visit, the Puppy periodically for the purpose of determining what the litter
produced and to check on the Puppy’s welfare.
a. The Buyer(s) agree to notify the Breeder of any and all changes of address, email and/or phone number. It is the Breeders’ wish
to remain in close contact with the Buyer(s) and to receive updates on the Puppy’s progress as often as possible. The Buyer(s)
is encouraged to call the Breeder with any problems or questions that they may have in raising his/her Puppy. The Breeders
agree to notify the Buyer(s) if there is a change to their address, email or phone number.
Breeders’ Guarantees
1. As the Breeders are dedicated to the breed and as members in good standing of the _________________ (National Breed Club),
they recognize their responsibility to breed only the best specimens to compliment the betterment of the breed. The Breeders are
selling the Puppy feeling that they have fulfilled this responsibility. To the best of the Breeders’ knowledge, the Puppy is in good
health and free of any symptoms of contagious disease at the time of sale. A licensed veterinarian will have examined the Puppy
prior to the date of sale. All precautions have been made to insure that the Puppy is in excellent health at the time of purchase.
a. Additionally, male show dogs have been checked and verification has been made that both testicles have descended at the time
of pickup. Accidents can happen with new puppy dogs and this Contract does not cover testicle trauma after the Puppy goes to
his new home.
2. The Breeders will provide to the Buyer(s) their contact information to the Buyer(s) to answer any questions and provide
recommendations based on the Breeder’s experience. The Breeders will also provide:
a. At least a three generation pedigree (up to a seven generation pedigree is available upon request),
b. Signed ___________________ Kennel Club registration or transfer papers,
c. Information and instructions regarding the care, feeding, and training of the Puppy,
d. Record of inoculations and worming,
e. Copies of any existing medical records for the Puppy,
f. Microchip implanted in the Puppy,
i.
The Buyer(s) will be given information for registering the Puppy with a recovery program and said registration will
include the Breeders as an alternate contact to provide recourse should the terms of this Contract be willingly
breached. The Buyer(s) will send a copy of the registry conformation to the Breeders within ten days of receipt
g. Health Guarantees.
3. As the Breeders have done everything possible to eliminate hereditary diseases and problems by testing, care, pedigree planning,
and selection, the Breeders’ guarantee against serious congenital or genetic defects until the Puppy reaches twenty six (26) months
of age, up to and at which time the Puppy can be officially tested.
a. The Breeders cannot guarantee the ultimate size, weight, or suitability for showing or breeding other than to provide the
Buyer(s) with as accurate a genetic disposition towards these traits as possible.
b. The Buyer(s) agree that there is no guarantee past twenty-six (26) months of age.
c. Should a genetic condition be diagnosed at any time during this period, the Buyer(s) will notify the Breeder(s) of the condition
within seven (7) days
4. The Breeders do not guarantee against any non-genetic condition, disease, or injury that is caused by: inappropriate diet, over
nutrition, excessive exercise, injury (deliberate or accidental), abuse, untimely or inappropriate veterinary care, including but not
limited to:
a. Over Nutrition including but is not limited to:
i.
MASTIFFS ONLY: the feeding of “growth” formula dog foods and/or nutritional supplements, (i.e. calcium supplements)
to the Puppy
ii.
EURASIERS ONLY: the feeding of dog foods with protein at a higher percentage than recommended by the Breeders
b. OCD - osteochondritis dessicans
c. HOD - hypertrophic osteodystrophy
d. Pano - panosteitis
e. Unilateral dysplasia
f. Bloat
g. Torn/Damaged Crutiate
h. DJD grade 1
i.
Any non-genetic disease of the joints or bones
j.
Thyroid disease
k. Heartworm related cardiac disease
l.
Internal or external parasites

m. MASTIFFS ONLY: As these conditions are attributable to the Mastiff type:
i.
Entropian
ii.
Extropian
n. The Breeder reserves the right to not guarantee hips if evidence of atrophy due to torn cructiate or meniscus ligaments of the
knee joint is present.
o. Other health problems the Puppy may experience will be reviewed by the Breeders’ and their veterinarian. It will be at the
Breeders’ discretion as to whether there are grounds for compensation. The Buyer(s) agree to accept the decision of the
Breeders in such circumstances.
5. No other guarantees are made by the Breeders.
6. In the unfortunate event of the death of the Puppy prior to its first (1st) birthday, a full and complete autopsy report must be sent to
the Breeders by a licensed canine pathology lab and the attending licensed veterinarian. Should the report prove that death was
caused by a genetic fault or early kennel care then, the Breeders will at their discretion, either:
a. The Breeders will replace the Puppy from the next available litter. The Buyer(s) is responsible for costs related to retrieving the
replacement puppy.
b. The Breeders will refund the full purchase price of the Puppy. The Breeders are not responsible for any expenses incurred by
the Buyer(s) while the Puppy was in his/her possession.
7. Any perceived congenital or genetic defect that renders the Puppy unfit for the purpose intended, including Breeding and/or
Showing, must be agreed to by the Breeders prior to any surgical corrections being performed.
a. The Buyer(s) must provide proof of defect to the Breeders in the form of a certificate from a licensed veterinarian and/or
Orthopedic Foundation for Animals (OFA) evaluation stating the defect and the certificate/evaluation must be accompanied by
x-rays, full medical history and findings.
b. The Breeders’ reserve the rights to have a have a veterinarian of their choice give a second opinion at the Breeders' expense.
c. If there is question on environmental factors or possibly mishandling by the Buyer(s) that may contribute to problem then the
Breeders may visit the Buyer(s)’ home at their convenience to see the Puppy’s living environment.
8. If the Breeders conclude that there were contributing factors from the Buyer(s) care and environment and that the condition could
have been avoided, then the Breeders may at their discretion repossess the Puppy.
9. If the Breeders do not agree that the defect is genetic, then the provisions in Health Guarantees section of this Contract will not be
exercised.
10. If the Breeders agree to that the defect is genetic, the Breeders will at their discretion, either replace the Puppy or reimburse the
Buyer(s) as outlined in the Reimbursement and/or Replacement section of this Contract.
11. All guarantees will be null and void if:
a. The Puppy has been bred, or
b. The Puppy has not been spay/neuter as set out in the Non-Breeding Prospect section of this Contract,
c. The problems developed from past or recent injury(s), neglect, negligence and/or over-nutrition, or
d. Other conditions within this Contract have not been met by the Buyer(s).
e. The Breeders’ are not notified within seven (7) days of diagnosis of the condition.
Buyer(s) Incentives
1. The Breeders’ will create an incentive fund of $500 from within the purchase price for the Buyer(s). The requests for refunds must
be presented by the time the Puppy is twenty-six (26) months of age.
a. Once the Puppy is over 26 months, all refunds will no longer be valid.
b. The Buyer(s)’ must present proof of achievement or completion at the time the request for refund is made.
2. The following refunds are available to all Puppies who complete and receive certificates for the following activities for a total of
three hundred dollars ($300).
a. Canine Good Citizen (CGC) or equivalent certificate - $25
b. Therapy Dog certificate from an accredited therapy dog association - $25
c. Training - $25 per class for a total of $50
i.
Puppy Kindergarten
ii.
Basic Obedience
d. Health Testing - $25 per certificate received for a total of $150
i.

ii.

The following refunds are available to Puppies sold as a Non-Breeding Prospect:
a. Spay/neuter as set out in the Non-Breeding Prospect section of this Contract -$150 (must send letter from licensed veterinarian
who performed the surgery as proof)
The following refunds are available to Puppies sold as a Breeding/Show Prospect:
a. Mastiffs Only:
i.
American Kennel Club and/or Canadian Championship - $150
b. Eurasiers Only
i.
Canadian Championship and/or American Rare Breed Association Championship and/or International All Breed Canine
Championship - $150
Breeding Prospect
The Buyer(s) does hereby state that he/she is purchasing this Puppy as a companion and shall provide for it as a member of the family. In
addition, he/she is purchasing this Puppy as a Breeding Prospect and agrees to abide by the terms stipulated in this section.

The Breeders have used their best judgment and the advice of other fanciers and breeders in evaluating the Puppy as a
Breeding/Show prospect. There is NO guarantee that a puppy evaluated as a Breeding/Show Prospect will be successful in the show
ring as an adult and no warranties are made to that effect. The Breeders encourages owners to participate in the sport of purebred
dogs and may be available to assist the Buyer(s) in preparing and showing the Puppy. The Breeders also have no control over the
breeding potential of any puppy as an adult and makes no warrantee as to the success of the Puppy as breeding stock. The Buyer(s)
and the Breeders both acknowledge that no representations, verbal or implied, have been made in regard to the Puppy’s future
abilities.
The Buyer(s) agree that once the Puppy reaches breeding age, the Puppy will be re-evaluated as a Breeding/Show Prospect by the
Breeders and the Buyer(s).
a. If the Buyer(s) and the Breeders agree that the Puppy should not be shown and/or bred, then the Breeders will at their
discretion, either replace the Puppy or reimburse the Buyer(s) as outlined in the Reimbursement and/or Replacement section
of this Contract.
For the protection of the breed, health and well being of the Puppy, and the Buyer(s) hereby agrees :
a. That the Puppy will never be bred to any other breed or crossbreed of dog, domestic or wild, and will only be bred to a
registered bitch/dog that is a respectable specimen of the same breed that has passed the testing as outlined in this Contract,
always keeping in mind the betterment of the breed, always striving to improve the breed and to reduce genetic faults.
b. To test for any genetic defect, and agrees not to breed the Puppy unless both the Puppy and prospective mate meet the
following standards:
i.
OFA Hips – Excellent, Good, Fair
ii.
OFA Elbows - Normal
iii.
CERF – Clear (entropia/ectropia excluded)
iv.
OFA Thyroid – Normal
v.
VonWillebrand Disease – Normal
vi.
Brucellosis - Negative prior to all and any breeding
c. Not knowingly breed the Puppy to any known puppy mill, broker, or pet shop mate; nor be used to breed litters for the purpose
of producing puppies for the same. Neither shall it be allowed to breed litters for the purpose of producing stock for laboratory
experimentation.
i.
It shall be the Buyer(s) responsibility to check the reputability of the mate’s owner before the breeding takes place.
Should question arise as to the reputability of the mate’s owner, the Buyer(s) will not go through with the breeding.
The Buyer(s) will first contact the Breeders before the breeding takes place.
d. The Buyer(s) will take the necessary steps to insure that all puppies resulting from a breeding, whether from a bitch or from a
dog, are placed in homes where they will be raised inside, as part of a family, and that those puppies go home with a signed
copy of a contract that includes all of the Buyer(s)’ Intent and Puppy Care stipulations of THIS particular contract, although the
kennel/breeder name(s) must be adjusted.
The Buyer(s) agree not to spayed/neutered or corrective surgery rendering the Puppy unable to show, prior to the completion of all
health testing and the Puppy whelping/siring his/her first litter, without the express written consent of the Breeders.
a. The Buyer(s) agree to notify the Breeders at least five (5) days prior to the surgery and provide a written statement from the
attending veterinarian detailing the necessity for the surgery.
i.
If the Breeders do not agree that surgery is necessary, then Breeders will take immediate possession of the Puppy and
registration papers as outlined in the Lifetime Return Policy/Right of Recovery section of this Contract.

Exceptions to the clause include instances of severe injury, severe illness, or to save the Puppy’s life. The intent is to
prevent the unnecessary suffering of the Puppy. The Buyer(s) will notify the Breeders within five (5) days of the surgery
and provide a statement from the attending veterinarian detailing the reason for the surgery.
b. If the Breeders do not agree that the surgery was necessary, then Buyer(s) will be in violation of the Contract.
If the Puppy is a bitch, then the Buyer(s) further agrees:
a. Not to breed the Puppy more than three (3) times unless a breeding does not produce a litter, the litter results in only one live
puppy, or a litter is still born. This clause includes accidental breedings.
b. Not breed the Puppy bitch in successive heats but shall wait one year between litters unless one of the above conditions apply
or unless advised by a veterinarian for the treatment of pyometra or metritis.
i.
In the above situation`, the Buyer(s) will furnish a letter signed by the licensed veterinarian to the Breeders at least 30
days before the Puppy’s next heat cycle.
c. The Puppy will not be bred before reaching twenty-two (22) months of age, nor after her seventh (7th) birthday.
d. Not to breed the Puppy bitch to a male younger than fifteen (15) months.
e. To not allow any puppies produced by the Puppy to be sold to any known puppy mill, broker, or pet shop or for the purpose of
producing stock for laboratory experimentation.
If the Puppy is a dog, then the Buyer(s) further agrees:
a. To give the Breeders stud access for any bitch owned or co-owned by the Breeders at no charge.
i.
The Breeders agree to pay all expenses for the collection of semen, semen transportation, storage of semen for the
Breeders’ use or any other expenses incurred for such a breeding.
1. The Buyer(s) will sign over the semen at the time of collection for the purpose of maintaining the line in the
Breeders’ breeding program.
ii.
The Breeders agree to pay all travel and other expenses incurred for a natural breeding.
b. Not to neuter the Puppy as per Number 4 of this section and until his semen has been collected for storage, unless agreed upon
by the Breeders in writing.
c. Not to breed the Puppy
i.
To more than two (2) bitches per month.
ii.
Until the Puppy is at least eighteen (18) months of age.
iii.
To breed to a bitch that has produced a litter of more than one live puppy within a twelve (12) month period.
1. Should a litter result from a mating, it will not result in the bitch owner producing over a total number of eight (8)
litters produced within a twenty-four (24) month period.
Show Prospect
The Buyer(s) does hereby state that he/she is purchasing this Puppy as a companion and shall provide for it as a member of the family. In
addition, he/she is purchasing this Puppy as a Show Prospect and agrees to abide by the terms stipulated in this section.

The Buyer(s) understands and acknowledges the responsibility of showing the Puppy as expressed in the terms of this Contract, and
agrees to make a reasonable attempt to train and show the Puppy with the intent to earn the title of Champion from the:
a. MASTIFFS ONLY:
i.
American Kennel Club or,
ii.
Canadian Kennel Club
b. EURASIERS ONLY:
i.
Canadian Kennel Club, or
ii.
American Rare Breed Association, or
iii.
International All Breed Canine, or,
iv.
United Kennel Club
The Buyer(s) agree to prepare the Puppy, while still a puppy, for the show ring by:
a. Regular, scheduled socialization through taking the Puppy to a public training class consisting of either an Obedience class,
Canine Good Citizenship Class, Socialization class, or Conformation class. The Breeders recommend both a Conformation class
and an Obedience Class, either concurrently or consecutively, but will accept any regular class where the Puppy is regularly
socialized
The Buyer(s) agrees that if the Puppy is shown and becomes a Champion, a show picture along with a copy of the Championship
certificate will be sent to the Breeders.
a. The Breeders may publish this information stating that Pantheon Acres, the Breeders, are the breeders of the Puppy along with
the Buyer(s) being the owner(s).
The Buyer(s) will make sincere attempt to win a championship title on this Puppy before its third (3rd) birthday by showing the Puppy
in dog shows sanctioned by the bodies listed in Number 1, above, a minimum of twelve (12) times between the Puppy’s first (1st)
and third (3rd) birthday or until the Puppy receives a championship title
a. Dog shows attended before the Puppy’s first birthday shall not count toward the number of shows required unless the Puppy
wins Championship points

The Buyer(s) will show proof of attempts to win a championship by presenting to the Breeders any of the following within thirty (30)
days after the Puppy’s second (2nd) and third (3rd) birthdays:
a. Official results from shows sanctions by the bodies listed in Number 1, above.
b. Copy of show ribbons and/or photos
c. Signed letter from a professional handler
d. Show catalogues are NOT acceptable as they do not prove that the Puppy was actually shown)
If the Buyer(s) acknowledges to the Breeders, before the Puppy’s second (2nd) birthday, that they cannot comply with the Show
Provisions then the Breeders shall, at their discretion, make attempts to assist the Buyer(s) in showing the Puppy to its
Championship provided that the socialization and training requirements have been met.
a. In the case of extenuating circumstances where the Puppy cannot, or should not, be shown due to the fact the Puppy lacks
maturity, or due to illness of the Puppy; the Breeders may, at the their discretion, make the decision to pardon, or delay, the
showing of the Puppy without further obligations to show, on the part of the Buyer(s). This decision will be presented to the
Buyer(s) in writing and no other excuse shall be valid.
If the showing conditions are not met before the Puppy’s second (2nd) birthday, and the Breeders have not been notified, then The
Breeders have the right to take possession of the Puppy and show it to a championship at the Buyer(s) expense.
a. Should the Breeders not be able to show the Puppy, or deem the Puppy is not show-able due to lack of socialization or care, on
the part of the Buyer(s), then the Buyer(s) will be responsible for all costs related to the rehabilitation of the Puppy to show
condition. The Breeders shall have the final decision as to whether or not the Puppy can be shown.
b. Copies of all receipts for rehabilitation and/or showing will be provided to the Buyer(s). Upon payment of these receipts, the
Puppy will be returned to the Buyer(s).
i.
Should the receipts not be paid within thirty (30) days, the Buyer(s) shall sign ownership of Puppy back over to the
Breeders, including all registration papers.
ii.
If the Puppy cannot be rehabilitated, then the Buyer(s) agree to relinquish custody of the Puppy to the Breeders
without remuneration.
Non-Breeding Prospect

1. The Buyer(s) agrees not to use the Puppy for breeding purposes under any circumstances.
2. The Buyer(s) acknowledge that the Puppy is to be registered without breeding or showing rights.

b. Canadian Kennel Club (CKC) – Non-Breeding Agreement
3. The Buyer(s) agree to spay/neuter the Puppy prior to the Puppy reaching thirty (30) months of age and to send a copy of the
veterinarian’s bill or statement from the licensed veterinarian providing proof of spaying/neutering within ten (10) days of when the
surgery was performed.
a. If the Puppy is a bitch, then the Buyer(s) agree not to spay her prior to the completion of her first heat cycle.
b. If the Puppy is a dog, the Buyer(s) agree not to neuter him prior to the Puppy reaching eighteen (18) months of age. Male dogs
need proper hormones to develop body structure normally - without it they may grow tall and narrow and never develop the
breed type would develop if left intact.

c. If the Buyer(s) spay/neuter before the Puppy reaches the age indicated for its sex, then all guarantees and incentives outlined
the Breeders’ Guarantees and Buyer(s) Incentive sections of this Contract will be null and void.
d. If the Buyer(s) do not spay/neuter by time the Puppy reaches thirty (30) months of age, the Breeders have the right to take
possession of the Puppy and have it spayed/neutered by their own veterinarian. Copies of all receipts will be provided to the
Buyer(s). Upon payment of the receipts, including the Breeders’ travel expenses, the Puppy will be returned to the Breeder.
i.
If the receipts are not paid within thirty (30) days, then the Buyer(s) relinquish his/her rights to the Puppy and will sign
ownership of the Puppy back to the Breeders, include the registration. The Buyer(s) will not be entitled to any refund.
4. If the Buyer decides that he/she would like to show or breed the Puppy at a later date, the Breeders may at their discretion, allow
the Buyer(s) to sign a new contract with Breeding/Show Prospect provisions initialed, pay the differences between Non-Breeding
and Breeding/Show Prospect ($__________), and pay for the cost of transferring the registration to allow breeding and showing
rights.
a. No changes will be made until the Puppy has been evaluated by the Breeders’, or their agent, as a Breeding/Show Prospect.
b. The Breeders have the final decision as to whether or not the Puppy is a Breeding/Show Prospect.
5. In the event that the Buyer(s) breeds or attempts to breed this Puppy, the Breeders have the right to assume legal custody of the
Puppy, including all registration papers, without any reimbursement to the owner.
a. The Buyer(s) further agree to forfeit every puppy from any litter that which the Puppy may be carrying or may have sired. All
puppies will be spayed/neutered and placed into Rescue homes. Any and all profits from the sales of such puppies shall be
donated to the rescue sanctioned by the National Breed club. Any stud fees incurred by this breeding shall be the responsibility
of the Buyer(s).
6. In the case of extenuating circumstances where the Puppy cannot, or should not, be spayed/neutered at that time, the Buyer(s) shall
provide the Breeders with a veterinarian's statement of reason and this shall include a probable time for which the procedure may
be completed.

Lifetime Return Policy/Right of Recovery
The Breeders have no desire to repossess any Puppy that they have sold or placed. The sole intent of this section is to ensure that the
Puppy is always in a place where he/she will be properly cared for. The Breeders will ALWAYS take back the Puppy, at no expense to the
Breeders, no questions asked.

The Breeders maintain first right of recovery, free of charge, of the Puppy and all relevant registrations if the Puppy is not to remain
with the Buyer(s).
2. The Buyer(s) agree that the Puppy cannot be resold, traded, leased, or given to a third party, or in any other way placed into a new
home.
3. The Buyer(s) agree that if he/she cannot or do not wish to maintain custody of the Puppy or if he/she is unable to provide an
appropriate home, at any time during the Puppy’s lifetime, in accordance with this Contract, ownership shall revert directly back to
the Breeders including all registration papers.
a. The Buyer(s) agree to notify the Breeder if any such contingency arises and will not abandon the Puppy to a shelter, sell, or give
the Puppy away.
b. The Buyer(s) will not be entitled to any refunds.
c. The Buyer(s) will be responsible for any expenses incurred by the Breeder in the retrieval and care of the Puppy, along with any
expenses incurred for rehabilitation of the Puppy if it has not received adequate socialization or has health concerns. Both
parties agree that the very first concerns shall be for the welfare of the Puppy. Copies of receipts shall be provided to the
original owner upon request.
d. If the Buyer(s) find a suitable home for the Puppy, and the Breeders concur, the Buyer(s) will transfer ownership and
registration of the Puppy back to the Breeders who will then enter into a new contract with the new owners and transfer
registration to them as set in the new contract.
4. The Buyer(s) agree that in the event he/she is incapable of caring for the Puppy due to recoverable illness, to notify the Breeders
immediately. The Breeders agree to provide temporary care and housing for the Puppy until the Buyer(s) are able to resume
custody.
5. The Puppy must not be euthanized or put to death by any means without the express written consent of the Breeders.
a. The Buyer(s) agree to notify the Breeders at least five (5) days prior to the euthanizing the Puppy with a written statement from
the attending veterinarian detailing the necessity for the euthanasia.
i.
If the Breeders do not agree that euthanasia is necessary, then Breeders will take immediate possession of the Puppy
and registration papers as outlined in the Lifetime Return Policy/Right of Recovery section of this Contract.
ii.
Exceptions to the clause include instances of severe injury or severe illness, or significant complications arising from old
age when accompanied by the expressed recommendation of a licensed veterinarian. The intent is to prevent the
unnecessary suffering of the Puppy. The Buyer(s) will notify the Breeders within five (5) days of the euthanasia and
provide a statement from the attending veterinarian detailing the reason for the euthanasia.
1. If the Breeders do not agree that euthanasia was necessary, then Buyer(s) will be in violation of the Contract.
6. In the event the Buyer(s) must release custody of the Puppy, they shall first make a sincere attempt to contact the Breeders. If after
seven (7) days the Breeders cannot be contacted, or should the Buyer(s) need to immediately release custody of the Puppy, the
Buyer(s) agree to relinquish the Puppy to an authorized agent of the rescue group sanctioned by the National Breed Club.
7. If Puppy belongs to more than one person/party, and there is a division of properties due to separation and/or divorce, the Puppy
shall not be held in litigation. Should custody of the Puppy be in question the Breeders have the right to enforce "Right of Recovery"
and immediately assume legal ownership of the Puppy from any person, pound, shelter, or boarding facility where it may be placed;
including all records and registration papers.
8. In the event the Buyer(s) predeceases the puppy and
a. The Puppy belonged to the single person then the Breeders have the right to enforce "Right of Recovery" and immediately
assume legal ownership of the Puppy from any person, pound, shelter, or boarding facility where it may be placed; including all
records and registration papers.
b. The Puppy belongs to more than one person then the surviving Buyer(s) may retain ownership of the Puppy.
c. If the Puppy belongs to more than one person and all Buyer(s) are deceased, then Breeders have the right to enforce "Right of
Recovery" and immediately assume legal ownership of the Puppy from any person, pound, shelter, or boarding facility where it
may be placed; including all records and registration papers.
d. This clause will override any provisions made in the Buyer(s) will.
9. In the event that the Breeders are dead, incapacitated, or otherwise unavailable, the Buyer(s) agree to relinquish the Puppy to an
authorized agent of the rescue group sanctioned by the National Breed Club.
10. In the event the Breeders need to repossess the Puppy, due to explicit violations of the Contract, the Buyer(s):
a. Will forfeit all rights to this Puppy
b. Give the Breeders the right to enter any property where the Puppy (or its progeny) is located to repossess the Puppy and its
progeny.
c.
Agree not to sue the Breeders for any issues arising from the repossession of the Puppy.
d. Sign and turn over all relevant registrations to the Breeders within forty-eight (48) hours of the repossession.
e. Reimburse the Breeders for all transportation and legal costs incurred in repossessing the Puppy.

Contract Violations, Limitations and Litigation
1. Reimbursement and/or Replacement:
The Breeders will determine if the Buyer(s) may retain the Puppy or return the Puppy.
a. If the Buyer(s) retain Puppy and the Breeders will at the their discretion, either:
i.
Refund the difference in purchase price between a breeding/show prospect and a pet puppy ($__________), if the
Puppy was purchased as a Breeding/Show prospect and upon receipt of proof that the Puppy has been
spayed/neutered as set out in the Non-Breeding Prospect section of this Contract. The Buyer(s) will be responsible for
all veterinary costs for the Puppy in this Contract, AND
ii.
Pay up to six hundred dollars ($600) of veterinary costs. Receipts must be provided to the Breeders, OR
iii.
Allow the Buyer(s) to purchase another puppy from the next available litter at half price. The Buyer(s) is responsible for
costs related to retrieving the replacement puppy. The Breeders are not responsible for any expenses incurred by the
Buyer(s) while the Puppy was in his/her possession.
b. If the Buyer(s) return the Puppy and registration papers to the Breeders and the Breeders will at the their discretion, either:
i.
Replace the Puppy from the next available litter. The Buyer(s) is responsible for costs related to retrieving the
replacement puppy.
ii.
Refund the full purchase price of the Puppy. The Breeders are not responsible for any expenses incurred by the
Buyer(s) while the Puppy was in his/her possession.
2. Contract Violations:
a. If the conditions of this Contract are not adhered to, the Breeders have the right, and the Buyer(s) fully agree, to the
repossession of the Puppy at any time, without any monetary reimbursement to the Buyer(s).
i.
Violation of any part of this Contract by the Buyer(s) shall nullify all guarantees and incentives provided by the Breeders
under the terms of this Contract.
ii.
The Breeders will take legal action and the Buyer(s) will be responsible for all reasonable legal expenses incurred by the
Breeders as well as any damages set forth in this Contract.
iii.
The Buyer(s) will be responsible for reimbursing the Breeders in full for any and all expenses in the retrieval of the
Puppy, including transportation and any and all reasonable attorney fees.
iv.
Failure on the part of the Buyer(s) to comply with this Contract will render the Buyer(s) liable to the Breeders for the
costs of repossessing the Puppy, plus Five Thousand dollars ($5,000) for damages to cover the cost of any actions
necessary to restore the Breeders’ kennel name and reputation, and to cover any costs associated with the physical
and/or behavioral rehabilitation the Puppy requires.
b. The Buyer(s) agrees this Contract was violated, if:
i.
The Puppy is in any way abused, neglected, or suffers from malnutrition.
ii.
The Buyer(s) is ever charged or convicted of animal abuse or cruelty by any state, local or federal agency, or Kennel
Club, or is convicted of violating any Kennel Club rule or regulation.
iii.
The Puppy or any of its offspring are confiscated by authorities due to any illegal activity, abuse/neglect charge, or
puppy mill raid.
c. Failure to comply with the provisions of this Contract, even after corrective actions have been taken, including the payment of
fines, will render all guarantees and incentives outlined the Breeders’ Guarantees and Buyer(s) Incentive sections of this
Contract null and void.
3. Contract Limitations:
a. This Contract applies to the original puppy only and is non-transferable to a second party. No replacement puppy will be given
or discount given on a future puppy, if the Puppy has been bred, spayed/neutered in violation of the guidelines (unless the Non
Breeding Prospect section is marked as applicable). Anything else not stated or covered in this Contract may only be made with
the Buyer(s) and the Breeders with written consent.
b. All questions concerning the validity, operation, interpretation, and construction of this Contract shall be governed by and
determined in accordance with the laws of the State of Illinois. In the event that any one or more provisions contained in this
Contract should, for any reason, be held to be unenforceable in any respect under the laws of any state or of the United States,
unenforceability shall not affect any other provisions of this Contract, but this Contract shall be construed as if such
unenforceable provisions had not been contained herein.
4. Limitation of Liability:
a. In no event will the Breeders be liable for any incidental or consequential damages including, without limitations, loss of profit
and claims of third parties, however caused.
5. In the Event of Litigation:
a. In the event that litigation is commenced to enforce any of the terms of this Contract, the Breeders’ shall be entitled to the
costs thereof, including reasonable attorney's fees and expenses, all travel expenses incurred by them and their attorney; plus
five thousand dollars ($5,000.00) in damages to cover the cost of any actions necessary to restore the Breeders’ kennel name
and reputation, and to cover any costs associated with the physical and/or behavioral rehabilitation the Puppy requires.
i.
Furthermore, the Buyer(s) shall forfeit any monetary refund due the Buyer(s) upon court awarding return of the Puppy
to the Breeders.
b. Any litigation commenced shall take place in the state and County of Kane County, Illinois. Both parties shall contact the
second party in notification of such action and proof of such notification shall be provided to the court. In the event of their
absence from court on the date set forth, both parties do hereby agree to abide by the decision of the court of Kane County,

Illinois; and further understand that action to enforce the decision of this court will be taken within their state, or any state or
county, to execute the decision of the court of Kane County, Illinois.
This Contract represents the entire agreement between the Buyer(s) and the Breeders. No other agreements or promises, verbal or
implied are included unless specifically stated in this written agreement. This Contract is intended to protect the Puppy and its future
offspring, the Breeders and the Buyer(s) of said Puppy. By signing, all parties agree to all the clauses of this Contract. The Breeders and
the Buyer(s) do hereby acknowledge this to be a true and binding contract, and make absolute promise, to fully abide by its terms and
conditions as evidenced by the signatures below. Buyer agrees that he/she has read and understands the terms and conditions of this
Contract. The Buyer(s) have had the opportunity to consult with their own legal representation prior to signing this Contract.
The Breeders require that the Buyer(s) sign the contract either in their presence or in the presence of a Notary Public. If signing in the
presence of the Breeders, then the Buyer(s) will furnish a valid Driver’s License or State Identification as proof of identity and residence
where the Puppy will reside and will allow the Breeders to photocopy same. If signed in the presence of a Notary Public, then the
Buyer(s) will provide the Breeders a photocopy of the valid Driver’s License or State Identification with a copy of the signed contract and
full payment to the Breeders prior to taking possession of the Puppy.
